The site contains two (2) major ephemeral drainage ways and southerly 50 acres has been leveled in the past for flood irrigation purposes.. Chico Meleka, Apparently your office has a project or at least an application for a project for 299 lots with expectations to develope using community sewage and water. I've talked to the applicant and engineer (Mann and Gilbertson). They acknowledge that they did not talk to me about this project specifically but referenced a conversation regarding a similar type project south of Chico in which I told them that their proposal most certainly would require Regional Board involvement and Discharge Permit. From that conversation they deduced and properly so that the Regional Board would be the primary agency for waste water disposal. Therefore on this project they wish to jump immediately to them for approval. However the Regional Board will insist that they first complete CEQUA planning requirements before they will consider accepting their application as complete. That is our business and we probably should not defer that assuming the Regional Board will eventually approve their waste water system whatever that turns out to be. Previous projects in the county in which we knew that the applicant would probably have problems meeting our improvement standards for subdivision were handled by very close relationships between the Regional Board and county staff so that we knew or were told by the Board that they were willing to give "conceptual" approval of a project by the time the map was scheduled to be heard by the county (conditions). Lately however the Board has been less likely to do that sort of concept approval until there application for waste discharge is complete (in essence an acceptable plan). In addition, they have also indicated that they will no longer consider options such as chlorination of effluent to mitigate distance to ground water (perched water). So they may no longer approve any subsurface discharge if the applicant can not stay five feet above the highest ground water elevation with sewage disposal trench bottoms. The area where this project is proposed is subject to perched ground water tables in the winter and even periodic sheet flow type flooding during particularly heavy rain fall events. It would not be an area I would feel comfortable assuming that a usable leach area could be found for certain somewhere. In fact I would be more certain that an acceptable area might be entirely lacking. That would leave one option for them (assuming they don't want to put in a new sewer trunk line extension), winter storage of septage effluent and summer irrigation. This most certainly would be in the realm of the Regional Board. That type of system will probably fall into Title 22 requirements which governs the use of waste water for secondary purposes (eg., irrigation, industrial etc.). Those reg's are formitable. This is a project that will have the potential to significantly effect the area in many ways eg., water quality, infrastructure demands, storm water drainage, traffic etc. It is not a project that can be validated or dismissed from our requirements with a simple waiver of soil data letter. In fact we will strongly push for an EIR to be completed for our concerns. With that said we also do not wish to hold the application up but instead recommend continuing with the process in order to let the applicant find out all of the hurdles ahead of them. I did talk to them and they are aware of the problems involved with onsite sewage disposal on that property. We will comment on the project when it is circulated to this office. I would like to take this opportunity to inform you as to how the ongoing Butte County .General Plan 2030 process may affect this project. As you know, the current General Plan designations on the project site are Agricultural Residential (AR) for the northern portion, and Grazing and Open Lands (GOL) for the southern portion. The subject property is currently zoned A40 (Agriculture — 40 -acre minimum). The Preferred Land Use 'Alternative for this property as identified to date by the General Plan 2030 process is a designation of "Agriculture" and would likely retain a zoning classification to what is currently on the property. At this time, it -does not appear that the General 'Plan 2030 land use and zoning designations for the subject property will be consistent with the proposed project. In addition, your letter references the County's ongoing process of developing a Community Wastewater Treatment System Ordinance. It is expected that this ordinance would be considered by the Board of Supervisors in December 2010, shortly after adoption of the General Plan 2030, zoning code and Environmental Impact Report. At this time, the scope of the proposed ordinance is limited to areas of the County identified by the General Plan 2030 Preferred Land Use Alternative for urban level development outside the Spheres of Influence for Butte County's five municipalities. Thus, in its current form the proposed ordinance would not specifically allow use of a community wastewater treatment system for the Clover Creek Project. It is important to keep in mind that the both the proposed General Plan 2030 designations and Community Wastewater Treatment System Ordinance are drafts reflecting direction given to date. Both General Plan 2030 and the proposed wastewater ordinance will have opportunities for public participation and comment over the next 13 and 17 months, respectively. Wes Gilbert, our engineer has installed water monitoring wells over the past 4 years and coordinated this work with Butte County Environmental Health Department. Unfortunately as you know we have not experienced normal rainfall activity for adequate monitoring. We have been discussing the -retention of a Registered Hydro Geologist to work with the information we have been able to develop. Progress albeit slow on this project due to awaiting the completion of the Butte County (updated) General Plan and (hopefully) the opportunity for ponding of treated affluent, I am sure you are aware of some. of,the most.exclusive,real:estate:in. California; (and.the entire world) use of this type of alternative. wastewater,treatment. Subsequent:;use of treated, chlorinated/dechlorinated water will be'"used on public areas, the golf course, etc. This is important for the Clover Creek Project's Proposed Golf Course. We are hopeful that Butte County knowledge of our dilemma with water will embrace this opportunity to preserve ground water using wastewater package plant modern technology. We have retained the firm of ECO:LOGIC. Consulting Engineers in Rocklin to work on this part of the project. ECO:LOGIC specializes in wastewater issues and has years of success in this area of expertise. Additionally we have engaged Foothill Environmental (Dr. Ken Whitney) to delineate the site and we have received verification from the US Army Corps of Engineers. Soil Analysis, golf course architecture, and a lot of planning have gone into Mr. Bill Ralph's project and we look forward to moving ahead sometime in early 2010. Mr...Mann:... I have reviewed the above -referenced letter conce'ming the Clover Creek project (County File #GPA 02-03 and TSM 02-04, Ralph Ranch), which brings up issues related to completeness and environmental review regarding this project. The County's original letter concerning the incompleteness of this project is still applicable. It appears you are looking for further clarification concerning aspects of this letter. I have reviewed the statements you make regarding comments from the Environmental Health Division, Department of Public Works, Butte County Mosquito and Vector Control, Cal Water, CDF/Butte County Fire, and the City of Chico and concur with the conclusions you present. I have provided some further elaboration on several subject areas below. Environmental Health Division Requirements If you have not already done so, an application for Waste Discharge should be applied for with the Regional Water Quality Control Board concerning the Community Sewage Disposal Area. You should discuss this process with the Environmental Health Division. You should also be aware that the County prohibits the storage of effluent water in ponds pursuant to County Resolution 87-108. General Plan Policy The information concerning County General Plan policy was included because the requested General Plan Amendment and Rezone is a legislative act. General Plan policy must be used in providing recommendations to the Planning Commission and Board of Supervisors concerning these projects. The information concerning the County's General Plan policy was included for your information and it is not considered an issue of project completeness. You should know, however, that these policy issues will be analyzed by staff in future reports to the Planning Commission and Board of Supervisors. As I indicated in my previous letter this project does not appear to comply with General Plan policy that requires projects be provided with appropriate levels of services, and locating urban type development in areas of the county that provide for the logical extension of services. Environmental Review and Biological Studies Biological surveys are required because of the possibility of significant environmental impact due to the known presence of vernal pools in the subject area, according to the Department of Fish and Game's Natural Diversity Data Base. The area is also known to be habitat for birds of prey (raptors). These studies are not required as part of the completeness of the project application. You should know, however, that these studies will be required as part of the subsequent environmental review process. Proposed Golf Course and PUD I agree that a golf course could be incorporated into the project through the use of a Planned Unit Development (PUD) pursuant to Butte County Code Section 24-210. With regard to your request concerning the Agricultural Residential and Low Density Residential General Plan designations, both designations allow outdoor recreation facilities such as golf courses. The minimum parcel size for the Agricultural Residential General Plan designation is 1 (one) to 40 (forty) acres. The Low Density Residential General Plan designation allows net parcel sizes of 1 (one) acre to 6,500 square feet. In accordance with Section 24-210, the residential land use density of any Planned Unit Development zone cannot exceed that allowed by the Butte County General Plan designation for the proposed site. Because the processing of a PUD is much different than what is currently being proposed, staff would require a new application if you wish to pursue a PUD. The GPA/RZ application could be amended to reflect the requested General Plan Amendment. Pedestrian and Bike Paths I concur that Section 20-140 and 20-141 indicates that dedications of pedestrian and bicycle paths may be required. I do not consider this an issue of completeness unless these types of facilities will be used to connect dead-end roads or provide access to public facilities (schools, parks etc.). If you are planning such facilities it would be beneficial for them to be shown on the tentative map or future PUD so that County decision makers and staff will have an opportunity to see what is proposed. Changes to their ultimate lay- out can always be modified in consultation with County staff. I hope that this information helps to clarify the points from the original letter and answer the questions you set forth. The Planning Division also held a Public Meeting .on February 6, 2002, which included members of the Development Review Committee and representatives from other Responsible Agencies. This meeting was attended by project representative Wes Gilbert. Based upon the County's review, these applications are considered incomplete. Attached to this letter are the comments received during the. review period. Any additional comments received after this date will be provided under separate cover. The following list of Responsible Agencies submitted comments that indicate that additional requirements will be necessary prior to deeming this application complete, and continuing application processing (a brief summary of the comments is included): Environmental Health Division —See attached response Requests information regarding a proposed solution to sewage disposal, provision of drinking water, and oversight and maintenance of shared facilities. The Environmental Health Division recommends the completion of an Environmental Impact Report (EIR) to help address these issues. Department of Public Works —See attached response Requests additional information regarding traffic and drainage impacts. Notes that proposal includes urban densities outside of City Sphere of Influence and that the Cite of Chico should be contacted for comments. Butte County Mosquito and Vector Control District —See attached response Requests additional information regarding stone drainage facilities, detention, the relocation of existing swales, and the community sewage disposal system. Recommends the preparation of an EIR. California Water Service Company —See attached response Indicates that special facilities including a well and/or main extension will be required to serve the project. Requests more detailed plans and fire flow requirements to comment on the projects. California Department of Forestry/Butte County Fire —See attached response States that the maximum length of a dead-end road cannot exceed 800 feet for parcel zoned for less than I -acre. The tentative map must be designed to conform to this requirement (in accordance with Butte County Code Section 20-133) Citv of Chico Community Development Department —See attached response States concerns regarding traffic, air quality and growth inducing impacts. States that the project contemplates the development of urban uses, both residential and commercial, well outside of the City's urban planning area. The City recommends that these types of impacts be addressed in a project EIR. The City also notes that the application's Environmental Information form is lacking adequate information and should be amended. The Planning Division also received comments from the Air Quality Management District. These comments do not speak towards the completeness of the application. They do, however, indicate that the project will have a potentially significant impact on air quality and recommends that a quantified air quality analysis be performed for full build -out of the project. Such an analysis will be a requirement for the future environmental analysis of the project pursuant to CEQA. In addition to the above, the Planning Division wishes to inform you that the proposed General Plan Amendment. Rezone, and Tentative Subdivision Map does not appear to be provided with basic community services such as sewer, water, and drainage that are necessary for a development of the proposed size. Staff also notes that the large amount of commercial land requested for rezone does not correlate to the smaller size of the proposed development. The Planning Division concurs with the Environmental Health Division. Department of Public Works and the City of Chico with regards to the unmet service demands of the proposed project and the potential for this project to develop urban densities and land uses with associated environmental impacts within a non -urban, agricultural area. The Butte County General Plan Land Use Element contains specific policies that uphold requirements for the provision of appropriate levels of service, and locating urban development in suitable areas of the County. These policies require that urban developments be directed towards urban areas and away from agricultural land. Many of these polices do not appear to be upheld by this proposal. Such policies have been attached for your consideration. Planning Division staff is available to discuss these policies in more detail should you so desire. The Planning Division also requires appropriate biological surveys, to include a wetland delineation and surveys for sensitive plant and animal .species including raptors and bird species. These types of surveys must be taken into account in the design and lay -out of any proposal. You are encouraged to have these studies completed by qualified consultants for your own planning purposes. I must inform you, however. that the county reserves the right to have any such study independently reviewed and/or performed again by a consultant of the County's own choosing in conjunction with the Environmental Review of this project required under the California Environmental Quality Act (CEQA). Other Considerations: The proposal also contemplates the development of a golf course. A golf course can only be permitted in either the current A-40 zone or proposed SR -'/Z zone upon securing a Conditional Use Permit. The current permit applications do not include a Use Permit application and, therefore, the approval of a golf course at this location cannot be considered at this time. The proposal must meet the design requirements of the proposed SR- 1/2 zone. Some of the proposed parcels do not equal one-half acre (21,780 square feet). This should be corrected on the proposed tentative map. In accordance with Butte County Code Section 20-120.1, the lot area for all parcels of less than 1 acre shall be computed exclusive of that area lying within access easements or public roads. Several of the lots within the subdivision appear to have double frontage. Butte County Code Section 20-133 indicates that proposed lots shall not have double frontage. This situation should be corrected on the proposed tentative map. Butte County Code Section 20-78 indicates that parkland dedication or in -lieu fees will be required for subdivisions having fifty or more lots. This requirement should be taken into consideration in your proposal. Butte County Code Sections 20-140 and 20-141 requires subdivisions of the size proposed to include bicycle paths and pedestrian ways. Allowances for these improvements should be provided on the tentative map where applicable. The Planning Division would also like to disclose to you that submittal of the General Plan Amendment/Rezone and Tentative Subdivision Map applications in no way authorizes any work to be performed in conjunction with site development. You should be aware that the Regional Water Quality Control Board, the California Department of Fish and Game. and the Army Corps of Engineers have regulatory authority over impacts associated with wetlands and sensitive plant and animal species that are potentially located on the project site. Disturbance or grading on this land could result in violations of the Endangered Species Act, the Clean Water Act, and other State and Federal laws. These agencies should be consulted prior to any type of land clearing or grading at the project site. I encourage you to individually contact representatives from the above-mentioned Responsible Agencies. A copy of the roster from the public meeting is attached to this letter to assist you in contacting the appropriate individuals. I would also like to suggest that another meeting with County Planning Division staff may be beneficial to discuss policy issues relative to the General Plan. Within 30 days after accepting an application as complete the County will determine if the project warrants the preparation of an EIR pursuant to CEQA. As noted these parcels are all currently zoned A-10 (Agriculture —10 -acre minimum). The previous General Plan designation for these parcels was Agricultural Residential (AR), which required the following Conditional Zoning and Development Criteria to be satisfied: 1. Compatible with neighboring agricultural activities. 2. Evidence of adequate water and sewage disposal capacity. 3. Availability of adequate fire protection facilities. 4. adequately maintained approved road facilitieswith sufficient capacity to service area. 5. Reasonable access to commercial service and schools. A key provision of Butte County General Plan 2030 and the Draft Zoning Ordinance is that every legally created lot is considered a valid lot, regardless of the minimum parcel size. Parcels will no longer be considered non -conforming due to substandard size and, except as specifically restricted under limited circumstances, allowed the same range of uses as parcels that meet or exceed the minimum parcel size. Under the Agricultural land use 8/1/2011 4, • Page 3 of 6 designation established under Butte County General Plan 2030, consistent zoning designations range from AG -20 to AG -320 (Agricultural — 20 -acre minimum to Agricultural — 320 -acre minimum). Another key provision is to remove restrictions on .placement of second units in the AG zone. The Draft Zoning Ordinance allows either an Agricultural Worker Housing Unit (as permitted under the current Zoning Ordinance) or a second unit, thereby doubling the potential number of residential units on Mr. Ralph's properties. B. Parcels located on the West Side of Meridian Road In addition to the 13 smaller parcels, Mr. Ralph owns Parcels 14 and 15 (as shown in the table) totaling 448.49 acres. These parcels are currently zoned A-40 (Agriculture — 40 -acre minumum) and designated Agriculture -AG under the recently adopted General Plan. The previous General Plan split the designation on Parcel #14 between Agricultural Residential (AR) and Grazing and Open Lands (GOL), with Parcel #15 being designated GOL. Incomplete applications have been pending with Butte County since 2002 for a General Plan Amendment and Rezone (GPA/RZ 02-03) and Tentative Subdivision Map (TSM 02-04) for a 298 -lot residential subdivision (collectively known as the "Ralph Ranch" project) requiring community sewer and water systems. Early in the General Plan 2030 process, these properties were considered as potential study areas for future growth, but dropped from further consideration by the Board of Supervisors. Existing parcel sizes anre generally consistent with adjacent properties that are enrolled in the Williamson Act. The subject property itself has a past history of grazing. Approximately the northern 40 percent of the subject property has been identified at a reconnaissance level by wildlife agencies participating in development of the Butte Regional Conservation Plan (BCRP), including the California Department of Fish and Game, U.S. Fish and Wildlife Service, and National Oceanic and Atmospheric Administration, National Marine Fisheries Service, as posessing Very High Constraints to development due to the presence of species of concern and associated natural communities identified by the BRCP process. As a result of these existing constraints and the Board of Supervisors' action, the Preferred Land Use Alternative, and the Environmental Impact Report (EIR) prepared for Butte County General Plan 2030, did not assess the potential programmatic impacts of the 2002 development applications. Following the process laid out in the "Corrections Process Memo," a project such as the Ralph Ranch project would be pursued via the pending General Plan Amendment, Rezone and Tentative Subdivision Map applications together with any other required entitlements. We are hopeful that Butte County knowledge of our dilemma .with water will embrace this opportunity to preserve ground water using wastewater package plant modern technology. We have retained the firm of ECO:LOGIC Consulting Engineers in Rocklin to work on this part of the project. The County's original letter concerning the incompleteness of this project is still applicable. It appears you are looking for further clarification concerning aspects of this letter. I have reviewed the statements you make regarding comments from the Environmental Health Division, Department of Public Works, Butte County Mosquito and Vector Control, Cal Water, CDF/Butte County Fire, and the City of Chico and concur with the conclusions you present. I have provided some further elaboration on several subject areas below. Environmental Health Division Requirements If you have not already done so, an application for Waste Discharge should be applied for with the Regional Water Quality Control Board concerning the Community Sewage Disposal Area. You should discuss this process with the Environmental Health Division. You should also be aware that the County prohibits the storage of effluent water in ponds pursuant to County Resolution 87-108. General Plan Policv The information concerning County General Plan policy was included because the requested General Plan Amendment and Rezone is a legislative act. General Plan policy must be used in providing recommendations to the Planning Commission and Board of Supervisors concerning these projects. The information concerning the County's General Plan policy was included for your information and it is not considered an issue of project completeness. You should know, however, that these policy issues will be analyzed by staff in future reports to the Planning Commission and Board of Supervisors. As I indicated in my previous letter this project does not appear to comply with General Plan policy that requires projects be provided with appropriate levels of services, and locating urban type development in areas of the county that provide for the logical extension of services. Environmental Review and Biological Studies Biological surveys are required because of the possibility of significant environmental impact due to the known presence of vernal pools in the subject area, according to the Department of Fish and Game's Natural Diversity Data Base. The area is also known to be habitat for birds of prey (raptors). These studies are not required as part of the completeness of the project application. You should know, however, that these studies will be required as part of the subsequent environmental review process. Proposed Golf Course and PUD I agree that a golf course could be incorporated into the project through the use of a Planned Unit Development (PUD) pursuant to Butte County Code Section 24-210. With regard to your request concerning the Agricultural Residential and Low Density Residential General Plan designations, both designations allow outdoor recreation facilities such as golf courses. The minimum parcel size for the Agricultural Residential General Plan designation is 1 (one) to 40 (forty) acres. The Low Density Residential General Plan designation allows net parcel sizes of 1 (one) acre to 6,500 square feet. In accordance with Section 24-210, the residential land use density of any Planned Unit Development zone cannot exceed that allowed by the Butte County General Plan designation for the proposed site. Because the processing of a PUD is much different than what is currently being proposed, staff would require a new application if you wish to pursue a PUD. The GPA/RZ application could be amended to reflect the requested General Plan Amendment. Pedestrian and Bike Paths I concur that Section 20-140 and 20-141 indicates that dedications of pedestrian and bicycle paths may be required. I do not consider this an issue of completeness unless these types of facilities will be used to connect dead-end roads or provide access to public facilities (schools, parks etc.). If you are planning such facilities it would be beneficial for them to be shown on the tentative map or future PUD so that County decision makers and staff will have an opportunity to see what is proposed. Changes to their ultimate lay- out can always be modified in consultation with County staff. In addition to the above, the Planning Division wishes to inform you that the proposed General Plan Amendment, Rezone, and Tentative Subdivision Map does not appear to be provided with basic community services such as sewer, water, and drainage that are necessary for a development of the proposed size. Staff also notes that the large amount of commercial land requested for rezone does- not correlate to the smaller size of the 0 • proposed development. The Planning Division concurs with the Environmental Health Division. Department of Public Works and the City of Chico with regards to the unmet service demands of the proposed project and the potential for this project to develop urban densities and land uses with associated environmental impacts within a non -urban, agricultural area. The Butte County General Plan Land Use Element contains specific policies that uphold requirements for the provision of appropriate levels of service, and locating urban development in suitable areas of the County. These policies require that urban developments be directed towards urban areas and away from agricultural land. Many of these polices do not appear to be upheld by this proposal. Such policies have been attached for your consideration. Planning Division staff is available to discuss these policies in more detail should you so desire. The Planning Division also requires appropriate biological surveys, to include a wetland delineation and surveys for sensitive plant and animal species including raptors and bird species. These types of surveys must be taken into account in the design and lay -out of any proposal. You are encouraged to have these studies completed by qualified consultants for your own planning purposes. I must inform you, however. that the county reserves the right to have any such study independently reviewed and/or performed again by a consultant of the County's own choosing in conjunction with the Environmental Review of this project required under the California Environmental Quality Act (CEQA). Other Considerations: The proposal also contemplates the development of a golf course. A golf course can only be permitted in either the current A-40 zone or proposed SR -%z zone upon securing a Conditional Use Permit. The current permit applications do not include a Use Permit application and, therefore, the approval of a golf course at this location cannot be considered at this time. The proposal must meet the design requirements of the proposed SR- '/ zone. Some of the proposed parcels do not equal one-half acre (21,780 square feet). This should be corrected on the proposed tentative map. In accordance with Butte County Code Section 20-120.1, the lot area for all parcels of less than I acre shall be computed exclusive of that area lying within access easements or public roads. Several of the lots within the subdivision appear to have double frontage. Butte County Code Section 20-133 indicates that proposed lots shall not have double frontage. This situation should be corrected on the proposed tentative map. Butte County Code Section 20-78 indicates that parkland dedication or in -lieu fees will be required for subdivisions having fifty or more lots. This requirement should be taken into consideration in your proposal. 11 0 Butte County Code Sections 20-140 and 20-141 requires subdivisions of the size proposed to include bicycle paths and pedestrian ways. Allowances for these improvements should be provided on the tentative map where applicable. The Planning Division would also like to disclose to you that submittal of the General Plan Amendment/Rezone and Tentative Subdivision Map applications in no way authorizes any work to be performed in conjunction with site development. You should be aware that the Regional Water Quality Control Board, the California Department of Fish and Game. and the Army Corps of Engineers have regulatory authority over impacts associated with wetlands and sensitive plant and animal species that are potentially located on the project site. Disturbance or grading on this land could result in violations of the Endangered Species Act, the Clean Water Act, and other State and Federal laws. These agencies should be consulted prior to any type of land clearing or grading at the project site. Other Considerations With regard to the golf course, it appears that a rezone to a Planned Unit Development (PUD) would address the Use Permit issue, as it would be covered under the PUD Master Plan thereby not requiring a Use Permit. Could this application be amended to propose a General Plan designation of Agricultural Residential rather than Low Density Residential and a zoning of PUD without being considered a new application? It appears that these two designations would suit the project better. The double frontage lots designs will be addressed in a revised map. Parkland dedications or in -lieu fees will be paid. Your letter. states that Butte County Code Sections 20-140 and 141 requires the dedication of bicycle and pedestrian ways. As I read the sections the _code states that bicycle and pedestrian paths may be required to be dedicated. If paths are desired, we are willing to work with the County to come up with appropriate locations. This, however, is not a requirement to make the application complete. That is our business and we probably should not defer that assuming the Regional Board will eventually approve their waste water system whatever that turns out to be. Previous projects in the county in which we knew that the applicant would probably have problems meeting our improvement standards for subdivision were handled by very close relationships between the Regional Board and county staff so that we knew or were told by the Board that they were willing to give "conceptual" approval of a project by the time the map was scheduled to be heard by the county (conditions). Lately however the Board has been' less likely to do that sort of concept approval until there application forwaste discharge is complete (in essence an acceptable plan). In addition, they have also indicated that they will no longer consider options such as chlorination of effluent to mitigate distance to ground water (perched water). So they may no longer approve any subsurface discharge if the applicant can not stay five feet above the highest ground water elevation with sewage disposal trench bottoms. The area where this project is proposed is subject to perched ground water tables in the winter and even periodic sheet flow type flooding during particularly heavy rain fall events. It would not be an area I would feel comfortable assuming that a usable leach area could be found for certain somewhere. In fact I would be more certain that an acceptable area might be entirely lacking. That would leave one option for them (assuming they don't want to put in a new sewer trunk line extension), winter storage of septage effluent and summer irrigation. This most certainly would be in the realm of the Regional Board. That type of system will probably fall into Title 22 requirements which governs the use of waste water for secondary purposes (eg., irrigation, industrial etc.). Those reg's are formitable. This is a project that will have the potential to significantly effect the area in many ways eg., water quality, infrastructure demands, storm water drainage, traffic etc. It is not a project that can be validated or dismissed from our requirements with a simple waiver of soil data letter. In fact we will strongly push for an EIR to be completed for our concerns. With -that said we also do not wish to hold the application up but instead recommend continuing with the process in order to let the applicant find out all of the hurdles ahead of them. I did talk to them and they are aware of the problems involved with onsite sewage disposal on that property. We will comment on the project when it is circulated to this office. Ralph application for rezone and housing/commercial development on parcel # 047-100-022 & 047-130-154. The proposed project is located between Hwy 99 and Meridian road here in north Chico. Also, we have mailed copies of this information to the Members of the Butte County Planning Commission, and the Butte County Board of Supervisors. I am asking you to please distribute a copy of this note to any involved staff member,who works with this project request. My wife and I are hoping beyond hope that this project will be denied, and have listed the reasoning for our feelings below. Here is the situation. For the past year we have been meeting with the Rock Creek Reclamation District, the Army Corps, Rock Creek home owners (East of Hwy 99), USFWS, and Supervisor Mary Anne Houx. These meetings were designed to address flooding problems associated with Keefer Slough and Carriage Estates. In short, the county - sponsored fix to this situation called for our land to be "taken" for the purpose of building a flood control project. The ill -placed homeowners residing in Carriage Estates would gain protection, and we (Almond Farmers) would be forced out of business, losing our land in the process. As these meetings moved along, other local landowners in this area discovered that they too would suffer losses, and consequently, a ground swell of opposition developed against the project. Currently the project is on hold, and for this, we are truly thankful. Apparently the FEMA maps (allowing for this development) were in error, and that's what caused the problem. Now fast forward to why we have written this note. We were amazed, when we found out that an entirely new housing development is being planned -between 99 and Meridian Road, and you guessed it, the drains from this new project go directly through our ranch, now we have the same problem all ovi...n19 a F s e Here are our specific concerns: Water and drainage issues us 27 2002 COUNTY The name of the "Ephemeral stream" as it is marked on the eve oper s map is actually Harbean Slough (later called Jordan Slough). And it is historically without question, the mostflood food prone drain in the whole of Butte County. Literally hundreds of acres are inundated from this drain annually, and if you will reference county Public Works for data on the most frequent road closures, you will find that Hamilton Nord Cana Hwy is number one on the list. It too is closed every year due to massive run-off/flooding from Harbean slough. Same culprit I am extremely concerned about the amount of water that will pass from and through this proposed development. Any changes in sheet flow and flood timing, slough. curvature or slope change, drain time, quality of the runoff, and amount of runoff, would be devastating to our livelihood. Please note that drains marked on the Gilbert site plan map are shown as being 5 to 10 feet, and 15 to 20 feet in width. Actually, when seasonal rains do occur, these drains become torrents of water. They commonly reach 500 feet in width, and flood all of the local low-lying areas. I have included several pictures of this sheet -flow taken from our property just downstream. They were taken in January this year ... just two months ago. Further, simple widening of these drains (in the project) will actually cause a bigger problem, since then the floodwaters will reach our property sooner and in greater supply making local flooding worse than it is already. In short, the Vina Plains are made of tough stuff with bedrock being very close to the surface. The amount of runoff can be tremendous. Additionally, if this proposed project's sewers drain into Harbean Slough, or drain into a catch that eventually drains into the slough, then our downstream lands, will eventually realize the damage of effluent laced with antifreeze, asphalt oil, soap, nitrogenous compounds due to the golf course, etc. This will surely lower the value of our land. Project incompatibility with our local land use (hunting club and wetlands) The whole issue of water drainage and quality becomes even more important when it is noted that the total value of our land is based on its use as a hunting club. Our club area is designated as a federally recognized wetland (by ASCS currently the Butte County Farm Service Agency). Its value to wintering Canada geese and ducks cannot be overemphasized. Harbean slough bisects our property and supplies water to this wetland. This investment has been in place, for more than thirty-five years,. and is recognized by USFWS as virtually the last remaining wetland on the south Vina Plains (please contact Denise Dachner, Outdoor Recreation Planner, Sacramento National Wildlife Refuge) for more information on our property, and it value to this national resource. The fact is that the proposed project inclusive of street lighting, construction of houses and roads, traffic, simple disturbance, and the loss of the existing pasture lands habitat will adversely effect our hunting club and harvest opportunities. It is common knowledge that when development occurs, wild game will simply leave the area entirely. For us, the current use of the land is compatible with our land use. It is currently used by many migratory Canada geese, and serves as crucial green browse for their diet. Further, I would expect that if this project doesfind approval, then each prospective homeowner be noticed of the fact that they will hear the endless gunning from our club. `This occurs for approximately.6 months of the year, and starts at legal shoot time each day (one half hour before sunrise to sunset in - , accordance with the law). I see this as an issue of mandatory full disclosure, and should be made to each prospective resident who considers parcel purchase. Our hunting club is less than '/i mile from the proposed site, and we can plainly hear the cows there each morning. * Therefore I'm sure the opposite will be true. Whenever the zoning interface is adjusted, as is the request here, from A-40 to small parcel, damages will result. Agriculture landowners usually forge uses for their land so compatibilities not conflicts occur. Developments such as these, on this kind of scale, will cause major changes to an area (view shed for example), and give rise to litigations and damage suits. They leave longstanding landowners with no time to adapt, and truly set the stage for use conflict. Some of the in-place investments (such as ours) may take many years and literally hundreds of thousands of dollars to complete. We can't move, and shouldn't be made to fold our investment.
