1. If applicant is not the owner, written authorization by the owner or other proof of
%-agency.,must be submitted in order for the.a1pplicant to legally�signythe application.
Application shall be considered void if not signed by the.owner or.legal agent.
2. All items on application shall be filled:imas completely as possible. If an item is not
applicable, please indicate by the term "N/A".
3. It is important that the applicant supply an accurate description of the location of
the proposed project, including the following:

folded to 81/2" x 11", and shall include the following information:
a. A scaled drawing of the parcel(s) boundaries._
b. Location and dimensions of all existing and proposed improvements on
the property, including buildings, driveways,' parking- areas; wells, septic
tanks and leach fields.
C. Location and name of bordering streets, access roads, nearby crossroads,
streams, bodies of water and railroads.
d. North arrow and scaleof drawing.
5. The "Application for Administrative Permit" is subject -td review by County Staff
and approval by the Planning Director. Any special conditions of approval shall
be made a part of the approved "Administrative Permit"'and shall be binding on
the applicant. The procedures for County action on Administrative permit
applications are stated in Chapter 24 of. the.,Butte County Code.,
6. In approving an Administrative Permit, the Planning Director may include such
conditions as are deemed reasonable and necessary under the circumstances to
preserve the integrity and character of the zone and to secure the general
purposes of the Butte County General Plan and Chapter 24, of the Butte County
Code. In general, said conditions will be listed as standards in Chapter 24 for
each use. In unique situations additional conditions may be added so long as
they are reasonably related to the use for which the permit is requested.

discuss with staff all questions about application requirements, County procedures,
zoning provisions and possible conditions of approval.

REGULATIONS FOR .'EffleRefflZEN DWELLING UNITS
BUTTE COUNTY PLANNING DEPARTMENT-,
The following conditions shall be applicable to all Senior Citizen Dwelling Units as defined in section 24-202 of the
Bute County Code and located. within the unincorporated area of Butte County. It is the applicants responsibility
to insure that these conditions have. been or can be met prior to the application for an Administrative Permit. The
applicant shall be responsible for providing, as requested by the County, information or proof of compliance with
the conditions.
(1) The lot or parcel on which the senior citizen dwelling unit is proposed contains an existing single-family dwelling
unit..
(2) The "living area", meaning the interior habitable floor space area of a dwelling unit including basements and
"attics, but not including a garage or any accessory structure, shall not exceed 1,200 square feel: for a detached
senior citizen dwelling unit. The "living area" of an attached dwelling unit shall not exceed 640 square feet or
30% of the existing single-family dwelling unit living area, whichever is greater.
(3) The senior citizen dwelling unit is intended for the sole occupancy of one (1) adult 62 years of age or over or
two (2)adult persons, one of whom is 62 years of age or over. An affidavit of compliance with the age
requirements of this section shall be recorded in the office of the Recorder prior to issuance of building permits.
Said affidavit shall include the legal description of the lot or parcel and shall constitute a covenant running with
the land, binding upon the original owners and their heirs, successors and assigns, limiting the occupancy of
the senior citizen dwelling unit to the conditions described in this section.
(4) The senior citizen dwelling unit shall not be sold as a separate unit unless a parcel containing the unit is created
in with the existing zoning and subdivision ordinances and the resulting density is in conformance
with the General Plan.
(5) Two off-street parking spaces shall be provided for the senior citizen dwelling unit in addition to the parking
spaces required. for the primary dwelling unit.
0) Adequate sewer and water facilities shall be provided subject to the approval of the Environmental Health
Department.
(7) All site development standards as required by the zoning district in which the unit is located shall be met.
(8) The Senior Citizen Dwelling unit shall be a conventionally constructed building or a mobile home that complies
With the National Manufactured Housing Construction and Safety Standards Act of 1974, except that in the "A",
"FR", and 'TM" series of zones a mobile home, as defined in Section 24-21.28, may be used. Travel trailers and
recreational vehicles shall not be allowed as a Senior Citizen Dwelling unit.
(9) The approval of this permit constitutes approval only to the. extent that the project complies with the Butte
County Code and all other applicable regulations.
(10) Any proposed grading which will create cuts or fills in excess of 18" for roads, driveways, building sites,
drainage ways or ditches on parcels shall be shown on the map included with the application and shall be
reviewed and approved by the Department of Public Works.
(11) The requirements of all concerned governmental agencies having.jurisdiction by law, including but not limited
to the issuance of appropriate permits,- shall be met.
As the applicant for a Senior Citizen Dwelling Unit to be located within the unincorporated area of. Butte County,

REGULATIONS FOR LARGE FAMILY DAY CARE FACILITIES
BUTTE COUNTY PLANNING DEPARTMENT
The following conditions shall be applicable to all Large Family Day Care facilities as defined by section 24-
201 of the Butte County Code and located within the unincorporated area of Butte County. It is the
applicants responsibility to insure that these conditions have been or can be met prior to the application for
an Administrative Permit. The applicant shall be responsible for providing, as requested by the County,
information or proof of compliance with the conditions.
The facility is a single family residence that is the principal residence of the provider and the use is
clearly incidental and secondary to the use of the property for residential purposes.
2. Properties proposed for Large Family day care shall be located at least 500 feet driving distance
from any other Large Family day care property and the granting of the permit shall not result in any
residence being bounded on more than one side by a Large Family day care.
3. Large Family day care homes shall meet the following traffic control measures:
a. In addition to providing the required number of parking spaces for the residential use, one
off street parking space for each employee of the facility and one off street parking
space/loading area shall be provided. The driveway area may be used to meet this
requirement.
b. Large Family day care homes located on principal or minor arterial roads as designated by
the General Plan Circulation Element shall provide drop-off and pick-up areas which prevent
vehicles from backing onto such roads.
c. Properties proposed for Large Family day care homes shall have frontage on and access
off of a paved road. Roads that are constructed for the purpose of meeting this
requirement shall meet the RS -4C standard as contained in the Butte County Improvement
Standards contained in Chapter 20 of the Butte County Code.
4. One sign, not to exceed 3 square feet, shall be allowed.
5. The applicant shall be licensed by the California Department of Social Services, Community Care
Licensing for a Large Family Day Care facility.
6. The applicant shall meet all State Fire Marshall regulations pertaining to Large Family day care
facilities.
7. The applicant must meet all other applicable County and State ordinances, statutes, and regulations.
If the proposed Large family Day Care facility does not meet these conditions, a Conditional Use Permit shall
be required.
As the.applicant for a Large Family Day Care facility to be located within the unincorporated area of Butte
County, I have read and understand the above conditions as they pertain to my project.

Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special
conditions set forth below: William C. Jackson is hereby granted a Minor Use Permit in
accordance with application filed: Minor Use Permit to allow a second dwelling. located at
6078 Oro Bangor Highway, Oroville.
Failure to comply with the conditions specified herein as the basis for approval
of application and issuance of Permit, constitutes cause for the revocation of
said permit in accordance with the procedures set forth in the Butte County
Zoning Ordinance, including Butte County Code Section 24-62.
2. Unless otherwise provided for in a condition .to a Minor Use Permit, all
conditions must be completed by the permittee within 12 months of the delivery
of the countersigned permit to the permittee.
3. If any use for which a Minor Use Permit has been granted is not established
within one year of the date of receipt of the countersigned permit by the
permittee, the permit shall be come null and void and reapplication shall be
required to establish the use.
4. The terms and conditions of this permit shall run with the land and shall be binding
upon and be to the benefit of the heirs, legal representatives, successors, and assigns
of the Permittee.
SPECIAL CONDITIONS:
1. In no case shall the detached Second Unit exceed 1200 square feet.
2. The property owner must maintain the minimum acreage requirement of the zone in
in which the parcel or lot upon which the Second Unit is to be located.
3. In addition to the off-street parking required for the primary dwelling, two additional
off-street parking spaces shall be provided for the second unit. A garage or carport

with a maximum dimension of 20' by 24' is permitted for larger Second Units (over
640 sq. ft.).
4. Adequate sewer and potable water facilities shall be provided as determined by the ,
Butte County Environmental Health Division.
5. Either the existing single family dwelling or the Second Unit shall be owner occupied.
Verification of ownership residency shall be required prior to permit issuance and
annually thereafter by submittal of a recorded declaration in a form specified by the
Director of Development -Services or designee..
6. Pay $200.00 into the Battalion 5 Water Tender Fund. All new structures must meet
the fire safe regulations of Public Resources Code 4290 and Butte County.
7. Applicant must also comply with all other applicable State and local statutes,
ordinances and regulations.
Minor changes may be approved administratively by the Director of Development
Services upon receipt of a substantiated written request by the applicant. Prior to
such approval, verification shall be made by each Department or Division that the
modification is consistent with the application, fees paid and environmental
determination as conditionally approved. Changes deemed to be major or significant
in nature shall require a formal application for amendment.
NOTE: Issuance of this Minor Use Permit does not waive requirement of obtaining Building
and Health Department permits before starting construction and their approvals prior to use
or occupancy, nor does it waive any other requirements.

ABSTRACT: This application for a Minor Use Permit for William Jackson meets all the requirements of Section
24-280 of the Butte County Code. Staff recommends approval of the request, with conditions.
PROJECT CHARACTERISTICS: This request is for a Minor Use Permit to allow a Second Dwelling Unit on a 8.89
acre parcel located at 6078 Oro Bangor Highway. The parcel is zoned A-5, with a General Plan designation of
Agricultural -Residential.
ANALYSIS: In this application, Mr. Jackson is asking to place a 1200 square foot mobile home, as a second unit.
The second unit is detached from the main dwelling. This request is consistent with the intent and requirements
of Section 24-280 of the Butte County Code. Upon review of this second unit application, staff has determined that
the proposed second unit will not significantly impair the integrity of the zone in which it lies, nor will it be
detrimental to the health, safety and welfare of the intended occupants or the immediate neighborhood.
ENVIRONMENTAL DOCUMENTATION: This project has been determined by the Secretary of the Resources to
be Categorically exempt under CEQA Section 15303 (Class 3)(a).
PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be held. Notices of the hearing
will be mailed to the nearest 10 property owners.
RECOMMENDATION: Staff recommends approval the application for a Minor Use Permit for William Jackson on
AP#028-380-013, subject to the following findings and conditions.
Section 1: Environmental Findings.
The application for a Minor Use Permit to allow a Second Dwelling Unit is Categorically Exempt under
CEQA, and;
Section 2: Zoning Ordinance Findings.
A. The proposed location, size, design, and operating characteristics of the proposed use is in
accordance with the purpose of this ordinance, the purpose of the zone in which the site is
located, the Butte County General Plan, and the development policies and standards of the
County; and
■ Butte County Department of Develooment Services - Planning Division .

compatible with and will not adversely affect or be materially detrimental to adjacent uses,
residents, buildings, structures, or natural resources, with consideration given to:
1. Harmony in scale, bulk, coverage, and density;
2. The availability of public facilities, services and utilities;
3. The harmful effect, if any, upon desirable neighborhood character;
4. The generation of traffic and the capacity and physical character of surrounding streets;
5. The suitability of the .site for the type and intensity of use or development which is
proposed;
6. Any other relevant impact of the proposed use.
C. The proposed location, size, design, and operating characteristics of the proposed use and the
conditions under which it would-be operated or maintained will not be detrimental to the public
health, safety and or welfare, or materially injurious to properties or improvements in the vicinity;
and
D. The proposed use will comply with each of the applicable provisions of Chapter 24, Section 280,
of the Butte County Code.
Section 3: Action.
Subject to the findings indicated in Sections 1 and 2 of this report, approve the Minor Use Permit for William
Jackson on AP#028-380-013. Approval shall be subject to the following conditions.
1. In no case shall the detached Second Unit exceed 1200 square feet.
2. The property owner must maintain the minimum acreage requirement of the zone for the lot or parcel
upon which the Second Unit is to be located.
3. In addition to the off-street parking required for the primary dwelling, two additional off-street parking
spaces shall be required for the second unit. A garage or carport with a maximum dimension of 20' by 24'
is permitted for larger second units (over 640 sq. ft.).
4. Adequate sewer and potable water facilities shall be provided as determined by the County Environmental
- Health Division.
5. Either the existing single family dwelling or the second unit shall be owner occupied. Verification of
ownership residency shall be required prior to permit issuance and annually thereafter by submittal of a
recorded declaration in a form specked by the Director of Development Services or designee.
6. Pay $200.00 into the Battalion 5 Water Tender fund. All new structures must meet the fire safe regulations
of Public Resources Code 4290 and Butte County.
7. Applicant must also comply with all other applicable State and local statutes, ordinances and regulations.
Minor changes may be approved administratively by the Director of Development Services, or designee, upon
receipt of a substantiated written request by the applicant. Prior to such approval, verification shall be made by
each Department or Division that the modification is consistent with the application, fees paid, and environmental
determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal
application for amendment.

Your request was approved by the Planning Manager on April 24, 1995 subject to the
following conditions:
1. In no case shall the detached Second Unit exceed 1200 square feet.
2. The property owner must maintain the minimum acreage requirement of the zone
in which the parcel or lot upon which the Second Unit is to be located.
3. In addition to the off-street parking required for the primary dwelling, two additional
off-street parking spaces shall be provided for the second unit. A garage or
carport with a maximum dimension of 20' by 24' is permitted for larger Second
Units (over 640 sq. ft.).
4. Adequate sewer and potable water facilities shall be provided as determined by the
Butte County Environmental Health Division.
5. Either the existing single family dwelling or the Second Unit shall be owner
occupied. Verification of ownership residency shall be required prior to permit
issuance and annually thereafter by submittal of a recorded declaration in a form
specified by the Director of Development Services or designee.
6. Pay $200.00 into the Battalion 5 Water Tender Fund. All new structures must meet
the fire safe regulations of. Public Resources Code 4290 and Butte County.
7. Applicant must also comply with all other applicable State and local statutes,
ordinances, and regulations.
An approval recommendation by , the Planning Manager, has been forwarded to the
Planning Commission as a consent item for final action on May 11, 1995 at 9:00 a.m., in
the Board of Supervisors' Room, 25 County Center Drive, Oroville, California.
Consent items are set for approval in one motion. These items are considered non-

NOTICE OF PROPOSED MINOR USE PERMIT APPROVAL
Notice is hereby given that the Butte County Planning Manager is proposing to grant a Minor Use Permit
to allow a detached Second Unit for William Jackson on property zoned A-5, identified as AP 028-380-013,
located at 6078 Oro Bangor Highway, east of Oroville. The permit will be granted subject to the following
conditions:

nature shall require a, formal application for an amendment."
Persons wishing to comment on the project may submit written comments to the Butte County Planning
Division any time prior to April 14, 1995. The Planning Manager shall consider all comments in determining
if the application meets all of the above conditions and criteria. Upon finding that the proposed use does
or will meet all of the conditions and criteria, the Planning Manager will hold a hearing on April 24, 1995.
Any interested person may attend this hearing. The decision of the Planning Manager will be submitted, to
the Planning Commission, for final approval.
