APN 003-363-004 (MUP 00-02) (DD) Mr. Wilson gave a brief summary of the project. Commissioner Cage said she visited the site. Commissioner Nelson commented that this lot is really small and he wanted to make sure the State would approve 12 children at this site. Mr. Wilson said that Condition 4 requires them to be licensed by the State. Mr. Doody said he contacted the State agency in Chico. He said there have been no complaints or_ the operation of a day care. It was moved by Commissioner Cage, seconded by Commissioner Lambert, and unanimously carried to approve a Minor Use Permit, MUP 00-02 for Victoria Elizabeth Haselton, APN 003-363-004, subject to the findings and conditions listed below: Determine the project Categorically Exempt from environmental review under Section 15303(a) of the California Environmental Quality Act based on the following finding: A. The proposed conversion of the existing small family day care center into a large &*day care center in an urbanized area is only a minor change in the use of the existing structure. II. Approve the Minor Use Permit 00-02, Victoria Elizabeth Haselton on APN 003-363-004 to allow a large family day care for up to 12 children subject to conditions listed in Exhibit "A" and based on the following findings: A. The proposed location, size; design, and operating characteristics of the proposed use =.s in accordance with the purpose of Chapter 24 of the Butte County Code, the purpose of the zone in which the site is located, the Butte County General Plan, and the development policies and standards of the County; and B. The proposed location, size, design, and operating characteristics of the proposed use will be compatible with and will not adversely affect, or be materially detrimental to adja.;ent uses, residents, buildings, structures or natural resources, with consideration given to: 1. Harmony in scale, bulk, coverage and density; 2. The availability of public facilities, services and utilities; 3. The harmful effect, if any, upon desirable neighborhood character; 4. The generation of traffic and the capacity and physical character of surrounding streets; 5. The suitability of the site for the type and intensity of use or development which is proposed; 6. The proposed use will comply with each of the applicable provisions of Chapter 24, Section 265, of the Butte County Code. Conditions of Approval: 1. The facility is a single-family residence that is the principal residence of the provider and the use is clearly incidental and secondary to the use of the property for residential purposes. 2. Large family day care homes shall meet the following traffic control measures: (a) Provide a minimum of 4 (four) parking spaces. (b) Each employee shall have'an off-street parking space. The 2 (two) required residential spaces may not be used for employees. (c) Provide (1) one off-street parking space/loading area in addition to employee and residential parking spaces. 3. One sign, not to exceed 3 square feet, shall be allowed. This sign shall not be placed in the font yard setback. 4. The Large Family day care home shall be licensed by the California Department of Social Servi.: es, Community Care Licensing. le 5. Meet all State Fire Marshall regulations pertaining to Large Family day care facilities. 6. Facilities not meeting the above standards shall require a Conditional Use Permit to operate. 7. Construct the driveway access to County standards. 8. Maintain the existing septic system so as to meet Butte County Sewage Ordinance. 9. PROJECT DESCRIPTION/SITE CHARACTERISTICS: This is a proposal to convert an existing small family day care center to a large family day care center. Per Section 24.265(b) small family day care centers are limited to 6 (six) or fewer children and large family day care centers may have up to 12 children. The state law changed recently setting new limits of 8 children for small family day care centers and 14 for large family day care centers. The County Code has not been changed to reflect these new limits. This proposal is being processed under the existing County Code and at such time as the code is revised to the new state standards the limits on the number of children allowed may be administratively adjusted for existing small and large child care centers. The project site is located at 477 East 10th Avenue in the Chico Area. The project is within an existing facility. CEQA ISSUES: This application for a Minor Use Permit to allow a large family day care is Categorically Exempt from environmental review under Section 15303(a). ANALYSIS: The property is zoned R-1 (Residential) and has a Medium Density Residential General Plan designation. Large family day care centers are allowed in all zones that allow single family residential use, subject to a Minor Use Permit per Section 24-265(d) of the Zoning Code. The project site zoning of R-1 allows for approval of this project. Section 24-265(e)(2) requires that new large family day care centers locate at least 500 feet driving distance from any other large family day care center. Staff conducted an analysis of the location of other large family day care centers in the area of the project. There are three other such facilities in the area. All of the facilities are 500 feet or more driving distance from the project site. Also this facility will not cause any residence to be bounded on more than one side with a large family day care center. The layout of the residence and buildings on the project parcel allows for parking of 4 to 5 vehicles. Parking standards applicable to this project include 2 off street parking space for the residence, an off street loading space and one space for each employee. A maximum of 2 employees is allowed under the available parking. ACTIONS FOR CONSIDERATION: Staff recommends the Planning Manager take the following actions: I. Determine the project Categorically Exempt from environmental review under Section 15303(a) of the California Environmental Quality Act based on the following finding: A. The proposed conversion of the existing small family day care center into a large family day care center in an urbanized area is only a minor change in the use of the existing structure. II. Recommend approval to the Planning Commission of MUP 00-02, Victoria Elizabeth Haselton on APN 003-363-004 to allow Minor Use Permit to allow a large family day care for up to 12 children subject to conditions listed in Exhibit "A" and based on the following findings: A. Harmony in scale, bulk, coverage and density; 2. The availability of public facilities, services and utilities; 3. The harmful effect, if any, upon desirable neighborhood character; 4. The generation of traffic and the capacity and physical character of surrounding streets; 0 5. The suitability of the site for the type, and intensity of use or development which is proposed; 6. Any other relevant impact of the proposed use. C. The proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it will be operated or maintained will not be detrimental to the public health, safety and general welfare, or injurious to properties or improvements in the vicinity; and D.
