A. Tamara A. Stover, (Item determined to be Categorically Exempt from environmental
review), Minor Use Permit for a large family day care facility for 12 of fewer children on
property zoned R-1 (Residential). The property is located on the west side of Grand Teton
Way, approximately 100 feet north of Godman Avenue, at 713 Grand Teton Way, Chico.

Commissioner Lambert said she would like to pull this item for discussion. She said there is a question on
this item being reviewed by ALUC. She said -there was another day care further away from the airport that
was reviewed and conditioned by ALUC
Mr. Parilo said that ALUC staff reviewed this project and determined that it was not located within the safety
zone and, therefore, does not require review by ALUC. He said that Use Permits are not required to be
reviewed by ALUC within the Chico Municipal Airport area because there is a determination of consistency
between the General Plan and the Comprehensive Land Use Plan.
Commissioner Lambert said the fact that there was a Use Permit granted further away with concerns and
conditions added to the Permit, and asked if this one should have the same consideration.
Chairman Nelson said this is in the middle of an established R-1 area, and he has no problem.
It was moved by Commissioner Mooney, seconded by Commissioner Cage, and carried to approve a Minor
Use Permit for Tamara Stover subject to the findings and conditions listed below:
I. Determine the project to be Categorically Exempt from environmental review under Section
15303(a) of the California Environmental Quality Act based on the following finding:
A. The proposed conversion of the existing small family day care center into a large family day
care center in an urbanized area is only a minor change in the use of the existing structure.
II. Approve a Minor Use Permit, MUP 00-03, Tamara Stover for a large family day care facility for 12
or fewer children, on APN 007-360-031, subject to the conditions found in Exhibit "A" and based
on the following findings:
A. That the proposed location, size, design, and operating characteristics of the proposed use
is in accordance with the purpose of this Ordinance, the purpose of the zone in which the site
is located, the Butte County General Plan, and the development policies and standards of the
County because:

Project conditions of approval have been applied to this project pursuant to the applicable
requirements of Section 24-265 (E) "Standards and Conditions" for large family day care
facilities of the Butte County Zoning Code, the Butte County Environmental Health
Department and Butte County Fire Department. The project is in accordance with the
purpose of the zone in which the land lies and the Butte County General Plan because the
project site is designated Low Density Residential and zoned R-1. The Low Density
Residential land use designation allows group quarters and care homes as Secondary Uses.
The R-1 zone allows large family day care facilities upon approval of a Minor Use Permit.
B. That the location, size, design, and operating characteristics of the proposed use will be
compatible with, and will not adversely affect, or be detrimental to adjacent uses, residents,
buildings, structures, or natural resources, with consideration given to:

Harmony in scale, bulk, coverage, and density: r
The project is in harmony with scale, bulk, coverage, and density because the large
family day care facility will not create a need for any new structures or an alteration
to any existing structures.
2. The availability of public facilities, services and utilities:
The large day care facility will not create a need for new public facilities, services
and utilities because water, telephone, gas, and electrical services already extend to
the project parcel. The Environmental Health Department requires that the existing
septic system be maintained in a manner that complies with the Butte County Sewage
Ordinance. The Butte County Fire Department requires compliance with State Fire
Marshall requirements for large day care facilities.
3. The harmful effect, if any, upon desirable neighborhood character:
The proposed large day care facility will not change the traditional architectural style
that is of a character consistent with an urban residential neighborhood. The large
day care facility may lead to a minor increase in noise levels due to children playing
outside, and due to the increase in vehicle traffic, but this is not expected to be
significant.
4. The generation of traffic and the capacity and physical character of surrounding
streets:
The proposed large day care facility will not significantly increase vehicle traffic in
the area nor will it create any vehicle circulation impacts.
5. The suitability of the site for the type and intensity of use or development which is
proposed:
The site has adequate parking spaces for the residents of the dwelling and for the one
employee that may work in the day care facility. There is also adequate parking for
one off-street loading area. Grand Teton Way and Godman Avenue have sufficient
capacity to handle the minor increase in vehicle traffic generated by the project.
6. Any other relevant impact of the proposed use:
The Planning Division has circulated the proposed large family day care facility
application to County Agencies and has received no evidence that the use will cause
any other relevant impact.
C. The proposed location, size, design, and operating characteristics of the proposed use and the
conditions under which it would be operated or maintained will not be detrimental to the
public health, safety, or welfare, or injurious to properties or improvements in the vicinity:
D. The proposed use will comply with each of the applicable provisions of the Chapter 24,
Section 265, of the Butte County Code.

Conditions of Approval:
1. The facility is a single family residence that shall be the principal residence of the provider
and the large day care facility shall be clearly incidental and secondary to the use o --"the
property for residential purposes.
2. A minimum of four (4) off-street parking spaces shall be provided, consisting of:
(a) Two (2) off-street parking spaces for the residents of the dwelling.
(b) One (1) off-street parking space for each employee. The two (2) required residential
spaces may not be used for employees.
(c) One (1) off-street parking space/loading area.
3. One sign, not to exceed 3 square feet, is allowed. This sign shall not be placed in the f7ont
yard building setback.
4. The large family day care home shall be licensed by the California Department of Social
Services, Community Care Licensing.
5. Meet all State Fire Marshall regulations pertaining to large family day care facilities.
6. The septic system shall be maintained in a manner that complies with ,the Butte County
Sewage Ordinance.
7. Building permits'shall be required for any change of occupancy.
8. Applicant -must also comply with all other applicable federal, state and local statures,
ordinances, and regulations.

MINUTES - NOVEMBER 10, 1999
The meeting was called to order at 9:00 a. m. in the 7 County Center Drive, Planning Division
Conference Room, Oroville, CA.

I. ITEM FOR CONSIDERATION
Ms. Leasure gave a brief summary of the project.
The hearing was opened.
Ms. Stover said she would like to be able to do everything that is recommended in the staff report.
Ms. Leasure said that one of the concerns is the septic system, if it was adequate, and if she had talked
to Environmental Health.

Ms. Stover said that most of the children are in diapers, and the increase will be mostly in diapers and
will not increase the use of the septic system. She said the septic system was being maintained.
Mr. Barrett said the area has CC&Rs and asked if they had been reviewed.
Ms. Leasure said the State law prohibits the County from looking at the CC&Rs. She said the State
law states that family day care for residential areas is of state wide importance.
Mr. Barrett said the previous use of this parcel was a day care facility and when operated as a small
family day care, it was acceptable. He said when it was expanded there was a problem with the
increase in traffic.
Ms. Stover said she has, talked with Mrs. Barrett who said in her letter her concern for parents being
rushed and the unsafe traffic conditions. She said the parents she has now, Mrs. Barrett does not have
a problem with. She said the parents coming to her house do drive safety because they are picking up
small children. She submitted letters from neighbors who were in favor of the permit.
Ms. Leasure said that traffic is addressed in the Staff Report.
Mr. Barrett said he disagrees with the Staff Report due to past experience.
Ms. Stover explained about the people who park in the wrong direction. She said they live at the end
of the cul-de-sac and the mother pulls in facing the wrong way because she is facing.towards her home.

The hearing was closed.
Ms. Leasure recommended to the Planning Commission that the Minor Use Permit for Tamara Stover
to allow a large family day care facility, for 12 children, at 713 Grand Teton Way, Chico, be approved
subject to the findings and conditions listed in the Agenda Report, and that the item be scheduled for
the November 18, 1999, Planning Commission Consent Agenda. If the Planning Commission concurs
with the recommendation, the Minor Use Permit can be issued.

Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions
set forth below: Tamara Stover is hereby granted a Minor Use Permit in accordance with the
application filed August 31, 1999, to allow a large family day care facility for 12 or fewer children.
1. Failure to comply with the conditions specified herein as the basis for approval of application
and issuance of Permit, constitutes cause for the revocation of said permit in accordance with
the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code
Sec. 24-45.65.
2. Unless otherwise provided for in a special condition to this use permit, all conditions must
be completed by the Permittee within 12 months of the delivery of the countersigned permit
to the Permittee.
If any use for which a use permit has been granted is not established within one year of the
date of receipt of the countersigned permit by the Permittee, the permit shall become null and
void and reapplication and a new permit shall be required to establish the use.
4. The terms and conditions of this permit shall run with the land and shall be binding upon and
be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee.
Minor changes may be approved administratively by the Directors of Development Services,
Environmental Health, or Public Works upon receipt of a substantiated written request by
the applicant and only as to those conditions or requirements recommended by their
respective departments. Prior to such approval, verification shall be made by each
Department or Division that the modification is consistent with the application, fees paid and
environmental determination as conditionally approved. Changes deemed to be major or
significant in nature shall require a formal application for amendment.
Conditions of Approval:
1. The facility is a single family residence that shall be the principal residence of the
provider and the large day care facility shall be clearly incidental and secondary to
the use of the property for residential purposes.
2. A minimum of four (4) off-street parking spaces shall be provided, consisting of:
(a). Two (2) off-street parking spaces for the residents of the dwelling.
(b) One (1) off-street parking space for each employee. The two (2) required
residential spaces may not be used for employees.
(c) One (1) off-street parking space/loading area.
3. One sign, not to exceed 3 square feet, is allowed. This sign shall not be placed in the
front yard building setback.
4. The large family day care home shall be licensed by the California Department of
Social Services, Community Care Licensing.
5. Meet all State Fire Marshall regulations pertaining to large family day care facilities.
6. The septic system shall be maintained in a manner that complies with the Butte
County Sewage Ordinance.
7. Building permits shall be required for any change of occupancy.
8.. Applicant must also comply with all other applicable federal, state and local statutes,
ordinances, and regulations.

PROJECT DESCRIPTION/SITE CHARACTERISTICS:
This is a proposal to convert an existing small family day care facility to a large family day care
facility. The applicant currently cares for six or fewer children, and approval of this Minor Use
Permit will allow her to care for 12 or fewer children.
Per Butte County Code Section 24.265(b) small family day care centers are limited to 6 or fewer
children and large family day care centers may have up to 12 children. The state law changed
recently setting new limits of 8 children for small family day care centers and 14 for large family day
care centers. The County Code has not been changed to reflect these new limits. This proposal is
being processed under the existing County Code and at such time as the code is revised to the new
state standards the limits on the number of children allowed may be administratively adjusted for
existing small and large child care centers.
The property is located in an urban residential area. The property fronts on Grand Teton Way, which
serves 16 parcels and ends in a cul-de-sac. Domestic water for the site is supplied by public water.
Sewage disposal is handled by an on-site septic system. A fire hydrant is located on the adjacent

parcel to the west. The applicant lives in the dwelling unit on the property and is currently the sole
care provider. One full-time employee will work in the proposed large day care facility.
The project site is located within the Chico Municipal Airport's Area of Influence, and as such may
be subject to review by the Butte County Airport Land Use Commission (ALUC). ALUC staff
reviewed this project and determined that the project is not located within an airport safety zone that
requires a hearing before ALUC.
ANALYSIS:
The subject property is zoned R-1 (Residential,1 dwelling unit per parcel). The R-1 Zoning Code
permits large family day care facilities with approval of a Minor Use Permit and subject to the
requirements of Section 24-265 of the Zoning Code. The General Plan states that the Primary Use
of this land use designation is single-family dwellings at rural densities. Secondary Uses include
group quarters and care homes.
Butte County Code Section 24-265(e)(2) requires that new large family day care centers be located
at least 500 feet driving distance from any other large family day care center. Staff conducted an
analysis of the location of other large family day care centers in the area of the project and
determined that there are no other such facilities in the area. This facility will not cause any
residence to be bounded on more than one side with a large family day care center.
The layout of the residence and buildings on the project parcel allows for off-street parking of four
vehicles. Parking standards applicable to this project include two off street parking space for the
residence, an off-street loading space and one space for each employee. A maximum of one
employee is allowed under the available parking.
The Environmental Health Department requires that the existing septic system be maintained in a
manner that complies with the Butte County Sewage Ordinance. The Butte County Fire Department
requires compliance with State Fire Marshall requirements for large day care facilities.
The large day care facility may lead to a minor increase in noise levels due to children playing
outside and due to a minor increase in vehicle traffic. The vehicle traffic generated by the proposed
large day care facility is not expected to have a significant impact on vehicle circulation in the
project area. Grand Teton Way and Godman Avenue have sufficient capacity to handle the minor
increase in vehicle traffic generated by the proposed large family day care facility.
ACTIONS FOR CONSIDERATION
Staff recommends that the Planning Manager take the following actions:
I. Determine the project to be Categorically Exempt from environmental review under Section
15303(a) of the California Environmental Quality Act based on the following finding:
A. The proposed conversion of the existing small family day care center into a large
family day care center in an urbanized area is only a minor change in the use of the
existing structure.

II. Recommend approval to the Planning Commission for a Minor Use Permit, MUP 00-03,
Tamara Stover for a large family day care facility for 12 or fewer children, on APN 007-360-
031, subject to the conditions found in Exhibit "A" and based on the following findings:
A. That the proposed location, size, design, and operating characteristics of the proposed
use is in accordance with the purpose of this Ordinance, the purpose of the zone in
which the site is located, the Butte County General Plan, and the development
policies and standards of the County because:
Project conditions of approval have been applied to this project pursuant to the
applicable requirements of Section 24-265 (E) "Standards and Conditions" for large
family day care facilities of the Butte County Zoning Code, the Butte County
Environmental Health Department and Butte County Fire Department. The project
is in accordance with the purpose of the zone in which the land -lies and the Butte
County General Plan because the project site is designated Low Density Residential
and zoned R-1. The Low Density Residential land use designation allows group
quarters and care homes as Secondary Uses. The R-1 zone allows large family day
care facilities upon approval of a Minor Use Permit.
B. That the location, size, design, and operating characteristics of the proposed use will
be compatible with, and will not adversely affect, or be detrimental to adjacent uses,
residents, buildings, structures, or natural resources, with consideration given to:
Harmony in scale, bulk, coverage, and density:
The project is in harmony with scale, bulk, coverage, and density because the
large family day care facility will not create a need for any new structures or
an alteration to any existing structures.
2. The availability of public facilities, services and utilities:
The large day care facility will not create a need for new public facilities,
services and utilities because water, telephone, gas, and electrical services
already extend to the project parcel. The Environmental Health Department
requires that the existing septic system be maintained in a manner that
complies with the Butte County Sewage Ordinance. The Butte County Fire
Department requires compliance with State Fire Marshall requirements for
large day care facilities.
3. The harmful effect, if any, upon desirable neighborhood character:
The proposed large day care facility will not change the traditional
architectural style that is of a character consistent with an urban residential
neighborhood. The large day care facility may lead to a minor increase in
noise levels due to children playing outside, and due to the increase in vehicle
traffic, but this is not expected to be significant.

4. The generation of traffic and the capacity and physical character of
surrounding streets:
The proposed large day care facility will not significantly increase vehicle
traffic in the area nor will it create any vehicle circulation impacts.
5. The suitability of the site for the type and intensity of use or development
which is proposed:
The site has adequate parking spaces for the residents of the dwelling and for
the one employee that may work in the day care facility. There is also
adequate parking for one off-street loading area. Grand Teton Way and
Godman Avenue have sufficient capacity to handle the minor increase in
vehicle traffic generated by -the project.
6. Any other relevant impact of the proposed use:
The Planning Division has circulated the proposed large family day care
facility application to County Agencies and has received no evidence that the
use will cause any other relevant impact.
C. The proposed location, size, design, and operating characteristics of the proposed use
and the conditions under which it would be operated or maintained will not be
detrimental to the public health, safety, or welfare, or injurious to properties or
improvements in the vicinity:
D. The proposed use will comply with each of the applicable provisions of the Chapter
24, Section 265, of the Butte County Code.

the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code
Sec. 24-45.65.
2. Unless otherwise provided for in a special condition to this use permit, all conditions must
be completed by the Permittee within 12 months of the delivery of the countersigned permit
to the Permittee.
If any use for which a use permit has been granted is not established within one year of the
date of receipt of the countersigned permit by the Permittee, the permit shall become null and
void and reapplication and a new permit shall be required to establish the use.
4. The terms and conditions -of this permit shall run with the land and shall be binding upon and
be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee.
Minor changes may be approved administratively by the Directors of Development Services,
Environmental Health, or Public Works upon receipt of a substantiated written request by
the applicant and only as to those conditions or requirements recommended by their
respective departments. Prior to such approval, verification shall be made by each
Department or Division that the modification is consistent with the application, fees paid and
environmental determination as conditionally approved. Changes deemed to be major or
significant in nature shall require a formal application for amendment.

Conditions of Approval:
•
The facility is a single family residence that shall be the principal residence of the
provider and the large day care facility shall be clearly incidental and secondary to
the use of the property for residential purposes.
2. A minimum of four (4) off-street parking spaces shall be provided, consisting of:
(a) Two (2) off-street parking spaces for the residents of the dwelling.
(b) One (1) off-street parking space for each employee. The two (2) required
residential spaces may not be used for employees.
(c) One (1) off-street parking space/loading area.
3. One sign, not to exceed 3 square feet, is allowed. This sign shall not be placed in the
front yard building setback.
4. The large family day care home shall be licensed by the California Department of
Social Services, Community Care Licensing.
5. Meet all State Fire Marshall regulations pertaining to large family day care facilities.
6. The septic system shall be maintained in a manner that complies with the Butte
County Sewage Ordinance.
7. Building permits shall be required for any change of occupancy.
8. Applicant must also comply with all other applicable federal, state and local statutes,
ordinances, and regulations.

I live in a family neighborhood, at the corner of Grand Teton and Godman Avenues. My
family has resided at this address for 9 years. My backyard fence is shared with the
daycare at 713 Grand Teton that is run by Tami 5tover.
My experiences with Ms. 5tover's daycare have been more than favorable. I find the
children to be content and well managed. The noise levels are minimal considering the
shared fencing. Traffic to and from the facility must pass my house. I have not found
the additional traffic troublesome, or an intrusion. Our neighborhood is family based and
children play outside together throughout the day and evening. Having additional children
around adds to an already "homey" atmosphere.
Today's families often require two parents working outside the home. It is a difficult and
stressful task to find daycare providers in whom we can entrust our most valuable
treasures... our children. I personally commend Ms. 5tover for the fine, conscientious work
that she does. It is a pleasure to see her care for children of working parents as if they
were her own.

Our family strongly supports Tamil efforts to expand this most needed
child care center in our neighborlNe have two small children of our own and
know the importance of not only day care facilities in neighborhoods, but of
well-managed, responsible day care operations and operators.
For the past few years, Tami has shown extreme respect for neighbors and
others in operating a 6 -child care center. She makes excellent choices in
choosing clients who respect the neighbors and the neighborhood. Tami
occasionally takes the children for walks along our sidewalks. Her charges
are the only kids (there are 16 neighbor children on our cul-de-sac) who
model good supervised behavior on the street: they stick with Tami in a line
like u marching band. Most of the children are picked up by 5:30 p.m. each
evening, which is about the time the rest of us get home from work. There
is no operation on the weekends. Traffic has never been an issue, even more
so because she lives one house from the corner, avoiding extra traffic deep
into the cul-de-sac where most of the children congregate.
I can't imagine a more positive influence, a stronger need, or a better
person to run a neighborhood 12 -child day care. Please accept our full
support of this ope*tion.

This letter in regards to the proposal of Tami Stover expanding her daycare on 713.Grand Teton Way. My
family currently resides on 745 Grand Teton Way, at the end of the cul-de-sac, about 7 houses down from
the Stovers. To drive anywhere in town, we have to pass the Stover resident. We are in favor and support
this expansion.
Tami lives on the second house at the end of the street, therefore the expansion of her center would not
affective our street in any great detail. There is a high volume of young children living on our street,
almost all reside within 4 houses around ours. It is these children that frequently are seen running around
the neighborhood and it is usually Tami that calls their parents to let them know their children are running
freely in the road. Tami has always looked out for the well being of all the neighbors on the street. She has
at times taken her daycare children on walks. You can see them all in a nice controlled group holding
hands. They are never running wildly upon any neighborhood property. Her center is always quite and
well kept.
Regarding traffic concerns for this expansion, the bulk of the traffic seems to come from the teenage
children living on our cul-de-sac. Two of these live directly next door to our property and one farther up
the street. It is usually these teen drivers and their friends that create illegal parking and unnecessary
driving hazards, usually later at night or on the weekends. It seems that Tami's daycare parents drop their
children off and pick them up at varied times, therefore there appears never to be a problem with traffic
congestion at her house at specific times of the day such as opening and closing.
We are proud to have such fine upstanding neighbors in our neighborhood such as the Stovers. Please
grant Tami Stover her permit to expand her daycare facility.

Tami Stover. Over two years we have considered ourselves lucky to have our children at
Tami's. She is one of the most caring and conscientious people we have ever met. `
Expanding her daycare should not pose any problems with her neighborhood.
Tami would never do anything to jeopardize the livelihood of her neighborhood. Actually,
she has shown extreme concern when she sees neighbor children playing out front without
parental supervision. She has always spoken highly of her neighbors and the street upon
which she lives. Personally, we always pull into her driveway when dropping off and picking
up our children, and we use extreme caution when we see other children or animals in the
street.
The two years we have known Tami we have marveled at the control she has over
the children. She makes it a fun environment, yet she is a disciplinarian, too. The kids are,
never allowed to be out of control and overly loud when they are outdoors. They are kids,
and the kids love her!

I have known Tami Stover for approximately two and half years both on a personal and business level.
My son is currently enrolled in her daycare center. Tami has been my first choice to love, teach and protect
my child while I work part-time since he was 4 months old. Yet, due to her great daycare setting, I was
unable to get an open spot in her center until he was two years old. At that time, I had no problems
removing him from his former adequate daycare setting. I didn't want just adequate daycare for my child,
that is why I moved him into Tami's daycare. She provides a well-planned structured day with flexible
activities. She loves, sincerely cares, and provides good care for my son. He strives in this environment, a
clear improvement from his former adequate setting.
I feel completely confident that Tami would manage very easy expanding her daycare to 12 total children.
In knowing Tami on a personal level as well as business, it has given me the opportunity to know that Tami
would never take on anything that she could not handle effectively and productively. It is clear and
apparant that Tami's main concern is for the children at her center and I have no worries in the slightest of
her expansion in her daycare center. .

outbuilding uses to those "strictly incident to and appurtenant to private residences. "
Furthermore, "No commercial activities of any nature, description or kind shall be
permitted on any lot of said subdivision, or on any part thereof'.
Increased traffic in both early morning and late afternoon hours
Drop off and pick up of children at the daycare create greatly increased traffic. Grand
Teton is a cul-de-sac street with very little traffic, a primary attribute residents value.
Inadequate parking for the increased peak periods, and parents who are often rushed or
late for work will create an unsafe traffic condition on a street where many (18) young
children live. Current small day care use of the parcel already results some in "wrong
way" pmrking and increased traffic load.
Increased sewage loading in a Nitrate Impacted area.
The "Lassen Avenue Corridor", including this parcel, is currently designated a high
nitrate area, subject to mandatory sewer hook-up. Sewer service will not be available for
some time, since trunk lines do not run through the area. Greatly increased sewage load
may not be adequately handled by the existing septic system, thereby creating an
unsanitary condition.
Although we do not object to the parcel's current small day care use, we oppose approval
of this permit and urge you to decline it's issuance.

I oppose the request for variance.
This neighborhood already has significant non -conforming use that is not being enforced by the County.
There is a person on Grand Teton doing an auto detailing business, and one who is doing electrical repair.
There is a day care, which generates sufficient neighborhood noise on Godman in the same block.
This is a residential area. It should be maintained in that manner. Increased traffic and noise is not in the
best interests of the "family residence" nature of the area. In addition, it would be helpful if the County
would address non -conforming use issues, and removal of non moving cars.

H. FIRE PROTECTION
1. Construction, installation or development of structures or facilities on the parcels/lots shall comply
with the latest California Fire Safe Regulations, (Public Resources Code 4290), and all other
applicable State and County codes, ordinances and regulations in effect at the time of application for
improvement permits.
Building identification and/or addresses shall be installed in conformance with Public Resources Code
4290 and shall be posted at the beginning of building construction and maintained continuously
thereafter.
Fire hydrant identification, reflector or post reflectors shall be installed acceptable to the County Fire
Warden.
—4. In lieu of a pressurized water system or water storage tank, payment of $200.00 per created parcel
into the Battalion _ water tend fund, is required prior to the issuance of a building permit.
5. A pressurized community water system for fire protection is required. The specific locations and fire
flow requirements shall be in accordance with the Fire Department specifications and to the
satisfaction of the County Fire Warden. Average required hydrant spacing _ feet, hydrant size _
inches, and residual fire flow gpm. Submit plans to the Fire Department for review and
approval prior to construction of facilities:
6. In lieu of hydrant installation, payment may be made into the hydrant fund at a cost of
$1.72 per lineal foot of street frontage. The estimated fee amount is $
Prior to recordation of the Map or application for a building permit, the applicant shall pay the then
current fee for the West Chico Fire Station Fund.
8. Provide an all weather access of at least 10 foot wide and with a vertical clearance of 15 feet that will
accommodate a 40,000 pound fire apparatus to all structures.

G. SECOND UNITS
1. The Second Unit may be attached to the primary residence or may be a separate, on-site detached
dwelling.
2. The attached second unit shall be architecturally compatible with the primary residence and the
appearance of the building shall be that of a single family dwelling.
The size of the attached second unit shall not exceed 640 square feet or 30% of the size of the primary
dwelling, whichever is greater, in no case shall the second unit exceed 1200 square feet. A detached
second unit shall not exceed 1200 square feet.
4. The parcel or lot upon which the Second Unit is to be located must meet the minimum acreage
requirements for which the parcel or lot is zoned.
5. In addition to the off-street parking required for the primary dwelling, one off-street parking space
shall be provided for second units of 640 square feet or less; two additional off-street parking spaces
shall be provided for larger units.
6. An attached or detached garage or carport with a maximum exterior dimension of 12' by 20' is
permitted for second units of 640 square feet or less. A garage or carport with a maximum dimension
of 20' x 24' is permitted for larger second units.
7. Adequate sewer and potable water facilities shall be provided as determined by the Butte County
Environmental Health Division.
8. A second unit may not be placed on a parcel or lot where a temporary mobile home, in accordance
with Section 24-295 and 24-295.20, has been approved or on a lot that has more than one dwelling
located upon it.
Either the existing single family dwelling or the second unit shall be owner occupied. Verification
of ownership shall be required prior to permit issuance and annually thereafter by submittal of a
declaration in a form specified by the Director of Development Services or designee.
