It was moved by Commissioner Lambert, seconded by Commissioner Cage, and carried to approve the Minor Use Permit for up to ten (10) children subject to the findings and conditions below: , Find that the project is Categorically Exempt from environmental review pursuant to CEQA Section 15305 (Class 5), which states that minor alterations in land use limitations can be approved in areas with an average slope of less than 10 percent and that do not result in any change in land use, and pursuant to CEQA Section 15300.2(a), which allows for Class 5 exemptions upon consideration cf where the project is located and ensuring that the project is not located in any particularly sensitive environment, as supported by the following: A. The project involves a modification to the uses permitted within a Suburban -Residential zone, does not involve a change in land use, and, therefore, qualifies as a minor alteration of a land use limitation. B. The proposed expansion of the current land use, from a small day care facility to a large day care facility, constitutes a minor alteration in land use but does not result in any change in land use. C. The property's slope is level and does not exceed 20 percent. D. The project is not located in an area of any particularly sensitive environment. II. The availability of public facilities, services and utilities: The large day care facility will not create a need for new public facilities, services and utilities because water, telephone, gas, and electrical services already extend to. the project parcel. The project site is provided with municipal water and sewer facilities. The Butte County Fire Department requires compliance with State Fire! Marshall requirements for large day care facilities. Y ■ BUTTE COUNTY PLANNING COMMISSION ■ MINUTES JULY 13, 2000 ■ • The harmful effect, if any, upon desirable neighborhood character: The proposed large day care facility will not change the traditional architectural style that is of a character consistent with an urban residential neighborhood. The larEe day care facility may lead to a minor increase in noise levels due to children playing outside, and due to the increase in vehicletraffic, but this will not be significant. 4. The generation of traffic and the capacity and physical character of surrounding streets: The proposed large day care facility will not significantly increase vehicle traffic in the area, nor will it create any vehicle circulation impacts., The suitability of the site for the type and intensity of use or development which is proposed: The site has adequate area for off-site parking spaces for the residents of the dwelling and for employees of the large family day care facility. There is also adequate parking for an off-street loading area. 6. Any other relevant impact of the proposed use: The Planning Division has circulated the proposed large family day care facili3.y application to County Agencies and has received no evidence that the use will cause any other relevant impact. C. The proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or injurious to properties or improvements in the vicinit- : D. The proposed use will comply with each of the applicable provisions of the Chapter 24, Section 265, of the Butte County Code. Conditions of Approval: The facility is a single family residence that shall be the principal residence of the provider and the large day care facility shall be clearly incidental and secondary to the use of the property for residential purposes. 2. A minimum of four (4) off-street parking spaces shall be provided, consisting of: (a) Two (2) off-street parking spaces for the residents of the dwelling. (b) One (1) off-street parking space for each employee. The two (2) required residential spat -.s may not be used for employees. (c) One (1) off-street parking space/loading area. The large family day care home shall be licensed by the California Department of Social Service 3; Community Care Licensing. 5. Meet all California Building Code regulations pertaining to large family day care facilities, including, but not limited to, the installation of smoke detectors, a device for sounding alarm, fire extinguishers, and exit doors operable from the inside without the use of a key or any special knowledge or effort. 6. Prior to issuance of the Minor Use Permit the large day care facility shall be inspected by the Butte County Fire Department/CDF and the State Fire Marshal. 7. Building permits shall be required for any change of occupancy. Prior to issuance of the Minor Use Permit, applicant shall obtain any necessary building permits. 8. (SH) (MUP 00- 13) (Continued Open from 6/7/00) Mr. Parilo reviewed the process and procedures regarding a Minor Use Permit with the applicant and Mrs. Jones. He explained that this item would go to the Planning Commission on their Consent Agenda. If the Commission approves the Consent Agenda as presented, there is a 10 day appeal period to the Board of Supervisors. He said the Commission can choose to pull this item from the Consent Agenda and set it for public hearing. He said if the item is set for hearing at the Commission, that decision also has a 10 day appeal period to the Board. He noted that the brief summary of this project was presented at the last meeting. He noted the petitions submitted opposing this project. Mr. Wilson explained the proposed parking arrangement. He said there are two parking spaces shown on the map, one for an employee and one for dropping off and picking up of children'on-site. He asked Ms. Bashaw how many parking spaces she has. Ms. Bashaw said she has two in her driveway and she parks her vehicle in the garage. She said she has two parking spaces off-site in the front. She said the parking in the front would be vertical instead of parallel to the curb. I - The hearing was opened to the public. Ms. Bashaw said that one of the families she works for would like to increase her care from two of their children to five of their children. She said this would not increase the traffic. She said she cares for 2-5 year olds and her two children are counted on the State license. She said she opens at 7:30 and the first child arrives at 8:00 a.m. and is there from 8:00 a.m. to 5:00 p.m. She said she has one boy who comes at 9:00 a.m. or 9:30 a.m. and is there until 4:00 p.m. She said she has a girl on Wednesday only and she arrives with her brother. She said she wants to increase the children from 6 to 9 at this time. Mr. Parilo said there will be 12 trips a day with the increase. He said part.of the concern is any Use Permit or Minor Use Permit will go with the property and not the applicant. Ms. Jones questioned whether the size of the house is large enough to handle the increase in children. She said her house is the same size and it is 1,300 square feet. She said she was concerned with how much damage children can do to the house and property. She said she owns her house and Ms. Bashaw is renting. She said the main concern of the neighbors is the traffic. Mr. Parilo said he did not think the applicant wants more than 8 or 9 children. He asked how many children she will have at one time. He asked what is the maximum number of children at any given time? Ms. Bashaw-said she uses her sons' room as a playroom and the dinning room as a classroom. She said she would not have more than 9 at any given time. She said her landlord has no problems with her running the pre-school the way it is. She said she has made improvements to the house and it is in better condition than when she moved in. She said she has 2 1/2 years of schooling for child development teaching. 0 BUTTE COUNTY PLANNING SERVICES MEETING 0 MINUTES - JUNE 28, 2000 ■ Mr. Parilo asked if she would object to a restriction on the permit for the maximum number of children? , Ms. Bashaw said she wants her State license for up to 12 children for any future increase. She said she wants to run a class with another teacher's aide to help. She said you have to have an assistant when there is more than 8 children. Mr. Wilson said the petitions are from Walnut Glen Court and Streamside Court in opposition to this permit. Mr. Parilo said the Zoning Code requires one off-street parking. space for each employee and one off- street parking space for loading and unloading the children. The hearing was closed to the public. Mr. Parilo said he would like to limit the number of children. He said the County recognizes 6 children without a permit. He said he is concerned with this going to 12 or 14 children in the future. He said this is clearly a residential area. He said there is a privacy issue living on a cul-de-sac. He said the problem is that a Minor Use Permit goes with the land. Ms. Bashaw said in answer to a question, that it is not her intention to disrupt the neighbors or the community. She said she just wants to be able to support her children as she is a single mom. She said she wants the option for more children in the future. The hearing was re -opened. Mr. Parilo asked Ms. Jones if she would object to a limit being put on the permit for a cap. of 10 children? Ms. Jones said she would have a problem with 10 children. She said a day care is an ever changing business. She discussed the small children that play on the sidewalk and ride bikes. She said it could be dangerous for them with the traffic. The hearing was closed. Mr. Parilo said he is recommending approval of the Minor Use Permit with a maximum of 10 children, making the findings listed below, adding to the findings the further restriction of a maximum of 10 children at any one time. He added a condition that "Accurate records of child care activities shall be kept. These records shall include for each day the facility operates, the arrival and departure times of each child. Every six months from the approval date of the permit these records shall be presented to the Planning Division for review." This. item will be placed on the Consent Agenda for the Planning Commission on July 13, 2000, at 9:30 a.m. Mr. Wilson explained the appeal process. Mr. Parilo said he would send an agenda to Ms. Jones to notify her of the hearing. It was noted that the applicant could not be present due to a personal emergency. ' Mr. Parilo asked if the parking would be and is required to be contained within their driveway? Mr. Wilson said the parking would be within the driveway„but part of the loading area would be outside. The hearing was opened to the public. Era Jones, 1134 Walnut Glen Court, submitted a two page petition in opposition and two letters from owners in the area opposed to this application. She said the house is on a small cul-de-sac and there will be a traffic problem. She said this.was too big a project for such a small area. Mr. Parilo asked how it works with six children in the day care? Ms. Jones said it has been ok. She said 12 children would be too much. She said she hears the children in the back yard from time to time. Mr. Wilson read the parking requirements from the County Code.. He said the applicant needs to clarify the parking situation at the next meeting. Mr. Pardo said in light of the letters and the petitions, and the absence of the applicant, he would move to continue this item. Ap #042--600-049 To Whom It May Concern: 0., I own two Residences, two parcels, away, from the proposed day care center, and I'm very concerned over the size of the proposed facility. This is a quiet cul-de-sac and there will be a very dangerous situation with a big increase in the traffic and parking for parents dropping off and picking up children. The unit in question is in the curved part of the street and parking is currently at a minimum, without any additional visitors. If there would ever be a situation when more than two people would show up at the same time the only parking would be in the middle of the street. There also is a very dangerous situation for any visitors to exit on to East Ave at Streamside Ct. Because of the speed and high traffic volume going both directions at the Subdivision entrance. It's only a matter of time when a traffic light will be the only safe way to exit. I feel that a small 3-5 (in house) baby sitting situation will not create a major problem for the neighborhood, but 12 will make safety, a big concern for all involved. I would request that you vote no to the permit in question, because of the problems that it would create for the neighborhood, and the safety of all involved. This is a quiet cul-de-sac and there will be a very dangerous situation with a big increase in the traffic and parking for parents dropping off and picking up children. The unit;in,-question'is in the curved part of the street and parking is currently at a minimum, without any additional visitors. If there would ever be a situation when more than two people would show up at the same time the only parking would be in the middle of the street. There also is a very dangerous situation for any visitors to exit on to East Ave at Streamside Ct. Because of the speed and high traffic volume going both directions at the Subdivision entrance. It's only a matter of time when a traffic light will be the only safe way to exit. I feel that a small 3-5 (in house) baby sitting situation will not create a ajor problem for the neighborhood, but 12 will make safety, a big concern for all involved. The applicant currently cares for six or fewer children, and approval of this Minor Use Permit will allow her to care for 12 or fewer children. Domestic water is supplied by California Water Company. The dwelling is hooked up to City of Chico community sewer. The applicant lives in the residence and is currently the sole care provider, taking care of five (5) children. With approval for a large day care facility, the applicant proposes 'to have as many as twelve (12) children, with one additional full-time ■ Butte County Department of Development Services ■ Agenda Report ■ Page 1 0 • employee. • The surrounding parcels are similarly developed, with single family homes sharing a common wall on zero lot -line parcels. The area is developed with residential subdivisions to the east and south, with commercial development to the west. The subdivision in which the project is located is bordered by West East Avenue on the north and railroad tracks on the west. Although Lindo Channel is located approximately 300+ feet to the south, the project site is not located in a 100 year floodplain. The following information is the result of additional research of the project & property: • The applicant is currently conducting a Small Day Care operation; and • The subdivision lots for Walnut Glen Court were approved as Split -Duplex Lots; and • The applicant's lot at 1138 Walnut Glen Court, APN 042-600-049, Lot 11B, meets SECTION 24-80 Site Requirements for Split -Duplex Lots; and • The building plans identify the construction as Zero Lot Line Laydown; and • The Building Division's Permit sheet identifies the structure as Single Family Dwelling. ANALYSIS: The property is zoned S -R (Suburban Residential) and has a General Plan land use designation of LDR (Low Density Residential). The S -R zoning classification allows large family day care facilities with approval of a Minor Use Permit and subject to the requirements of Section 24-265 of the Zoning Code. The General Plan states that the Primary Use of the Low Density Residential land use designation is single family homes at urban densities. Secondary Uses include group quarters and care homes. Butte County Code Section 24-265(e)(2) requires that new large family day care centers be located at least 500 feet driving distance from any other large family day care center. Staff conducted an analysis of the location of other large family day care centers in the area of the project and determined that there are no other such facilities in the area. This facility will not cause any residence to be bounded on more than one side with a large family day care center. There is sufficient area for off-street parking for the residents of the dwelling, for an employee, and for drop-off and pick-up of children. Located on a cul-de-sac, the project site provides a measure of traffic safety during drop-off and pick-up times that a grid -type street does not provide. ' The site access road, Walnut Glen Court, is a County -maintained road, which serves the project site and the neighboring residences. The Butte County Environmental Health Department recommends approval without any Environmental Health conditions because the residence is on municipal water and sewer. The Butte County Fire Department requires State Fire Marshal inspection and approval prior to opening the large day facility. The large day care facility may lead to a minor increase in noise levels due to children playing outside and due to a minor increase in vehicle traffic. Noise from children playing outside will constitute an incremental increase in noise as compared with the present day care facility. The vehicle traffic generated by the proposed large day care facility will also result in an incremental ■ Butte County Department of Development Services ■ Agenda Report 0 Page 2 0 increase in noise levels because of the additional number of vehicle trips that will be generated by the large family day care facility. CEQA ISSUES: This application for a Minor Use Permit to allow a large family day care is Categorically Exempt from environmental review under Section 15305(Class 5). Staff recommends that the Planning Manager take the following actions: Find that the project is Categorically Exempt from environmental review pursuant to CEQA Section 15305 (Class 5), which states that minor alterations in land use limitations can be approved in areas with an average slope of less than 10 percent and that do not result in any change in land use, and pursuant to CEQA Section 15300.2(a), which allows for Class 5 exemptions upon consideration of where the project is located and ensuring that the project is not located in any particularly sensitive environment, as supported by the following: A. The project involves a modification to the uses permitted within a Suburban - Residential zone, does not involve a change in land use, and, therefore, qualifies as a minor alteration of a land use limitation. B. The proposed expansion of the current land use, from a small day care facility to a large day care facility, constitutes a minor alteration in land use but does not result in any change in land use. C. The property's slope is level and does not exceed 20 percent. D. The project is not located in an area of any particularly sensitive environment. II. Recommend approval to the Planning Commission for a Minor Use Permit for Kristina Bashaw for a large family day care facility for 12 or fewer children, MUP 00-13, on APN 042-600-049, subject to the conditions found in Exhibit "A" and based on the following findings: A. That the location, size, design, and operating characteristics of the proposed use will be compatible with, and will not adversely affect, or be detrimental to adjacent uses, residents, buildings, structures, or natural resources, with consideration given to: 1. Harmony in scale, bulk, coverage, and density: The project is in harmony with scale, bulk, coverage, and density because the large family day care facility will not create a need for any new structures or an alteration to any existing structures. 2. The availability of public facilities, services and utilities: The large day care facility will not create a need for new public facilities, services and utilities because water, telephone, gas, and electrical services already extend to the project parcel. The Butte County Fire Department requires compliance with State Fire Marshall requirements for large day care facilities. The harmful effect, if any, upon desirable neighborhood character: The proposed large day care facility will not change the traditional architectural style that is of a character consistent with an urban residential neighborhood. The large day care facility may lead to a minor increase in noise levels due to children playing outside, and due to the increase in vehicle traffic, but. this will not be significant. 4. The generation of traffic, and the capacity and physical character of surrounding streets: The proposed large day care facility will not significantly increase vehicle traffic in the area, nor will it create any vehicle circulation impacts. The suitability of the site for the type and intensity of use or development which is proposed: The site has adequate area for off-site parking spaces for the residents of the dwelling and for employees of the large family day care facility. There is also adequate parking for an off-street loading area. 6. Any other relevant impact of the proposed use: The Planning Division has circulated the proposed large family day care facility application to County Agencies and has received no evidence that the use will cause any other relevant impact. C. The proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or injurious to properties or improvements in the vicinity: D. If any use for which a Minor Use Permit has been granted is not established within two years of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. 5. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. Conditions of Approval: 1. The facility is a single family residence that shall be the principal residence of the provider and the large day care facility shall be clearly incidental and secondary to the use of the property for residential purposes. 2. A minimum of four (4) off-street parking spaces shall be provided, consisting of: (a) Two (2) off-street parking spaces for the residents of the dwelling. (b) One (1) off-street parking space for each employee. One sign, not to exceed 3 square feet, is allowed. This sign shall not be placed in the front yard building setback. 4. Meet all California Building Code regulations pertaining to large family day care facilities, including, but not limited to, the installation of smoke detectors, a device for sounding alarm, fire extinguishers, and exit doors operable from the inside without the use of a key or any special knowledge or effort. 6. Prior to issuance of the Use Permit the large day care facility shall be inspected by the Butte County Fire Department/CDF and the State Fire Marshal. 7. Building permits shall be required for any change of occupancy. Prior to issuance of the Use Permit, applicant shall obtain any necessary building permits. The Second Unit may be attached to the primary residence or may be a separate, on-site detached dwelling. 2. The attached second unit shall be architecturally compatible with the primary residence and the appearance of the building shall be that of a single family dwelling. The size of the attached second unit shall not exceed 640 square feet or 30% of the size of the primary dwelling, whichever is greater, in no case shall the second unit exceed 1200 square feet. A detached second unit shall not exceed 1200 square feet. —4. The parcel or lot upon which the Second Unit is to be located must meet the minimum acreage requirements for which the parcel or lot is zoned. 5. In addition to the off-street parking required for the primary dwelling, one off-street parking space shall be provided for second units of 640 square feet or less; two additional off-street parking spaces shall be provided for larger units. 6. An attached or detached garage or carport with a maximum exterior dimension of 12' by 20' is pemutted for second units of 640 square feet or less. Adequate sewer and potable water facilities shall be provided as determined by the Butte County Environmental Health Division. 8. A second unit may not be placed on a parcel or lot where a temporary mobile home, in accordance with Section 24-295 and 24-295.20, has been approved or on a lot that has more than one dwelling located upon it. 9. Either the existing single family dwelling or the second unit shall be owner occupied. Verification of ownership shall be required prior to permit issuance and annually thereafter by submittal of a declaration in a form specified by the Director of Development Services or designee. :..
