APN 058-560-006 (SH) (MUP 01-02) It was moved by Commissioner Lambert, seconded by Commissioner Cage, and unanimously carried to approve the Minor Use Permit for Nathan Miller subject to the findings and conditions listed below. I. Find that the project is exempt from the provisions of the California Environmental Quality Act under Section 15311. 'Section 15311 consists of construction ,of minor structures accessory (appurtenant) to existing commercial facilities. Antennas colocated on an existing tower are considered to be accessory structures, subject to the following findings: A. This application.for a Minor Use Permit to allow a second dwelling no larger than 1,200 sq.ft. is Categorically Exempt from environmental review; and B. The proposed location, size, design, and operating characteristics of the proposed use is in accordance with the purpose of Chapter 24 of the Butte County Code, the purpose of the zone in which the site is located, the Butte County General Plan, and the development policies and standards of the County; and C. The proposed location, size, design, and operating characteristics of the proposed use will be compatible with and will not adversely affect, or be detrimental to adjacent uses, residents, buildings, structures or natural resources, with consideration given to: 1. Harmony in scale, bulk, coverage and density; 2. The availability of public facilities, services and utilities; 3. The harmful effect, if any, upon desirable neighborhood character; 4. The generation of traffic and the capacity and physical character of surrounding streets; 5. The suitability of the site for the type and intensity of use or development which is proposed; 6. Any other relevant impact of the proposed use. D. The proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it will be operated or maintained will not be detrimental to the public health, safety and general welfare, or injurious to properties or improvements in the vicinity; and E. The proposed use will comply with each of the applicable provisions of Chapter 24, Section 280, of the Butte County Code. II. Recommend approval to the Planning Commission of Minor Use Permit for Nathan Miller, subject to the conditions found in Exhibit A and subject to the following findings: A. Based on the above findings, the proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or injurious to properties or improvements in the vicinity. D. The proposed use will comply with each of the applicable provisions of the Chapter 24, Section 262, of the Butte County Code. Conditions of Approval: 1. The second dwelling unit shall not exceed 1,200 square feet. 2. Provide two additional off-street parking spaces. 3. An attached or detached garage or carport with a maximum exterior dimension of 20' by 24' is permitted. 4. Adequate sewer and potable water facilities shall be provided under permit as determined by the Butte County Environmental Health Division. 5. Either the existing single family dwelling or the Second Unit shall be owner occupied. Certification of ownership shall be required prior to permit issuance and annually thereafter by submittal of a declaration in a form specified by the Director of Development Services or designee. - 6. No permits for any additional dwelling may be approved unless a Use Permit is granted by the Planning Commission. 7. Construction, installation or development of structures or facilities on the parcels/lots shall comply with the latest California Fire Safe Regulations, (Public Resources Code 4290), and ■ BUTTE COUNTY PLANNING COMMISSION ■ MINUTES ■ OCTOBER 26, 2000 ■ all other applicable State and County codes, ordinances and regulations in effect at the time of application for improvement permits. 8. Mr. Wilson noted that no one was present. The hearing was closed. Mr. Wilson concurred with staff's recommendation to recommend to the Planning Commission that the Minor Use Permit to construct a second single-family dwelling for Nathan Miller be approved subject to the findings and conditions listed below: Staff recommends that the Planning Commission take the following actions: Recommend that the Planning Commission find that the project is exempt from the provisions of the California Environmental Quality Act under Section 15311.
