Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions
set forth below: Angela Davis is hereby granted a Minor Use Permit in accordance with application
filed: Plan to enlarge day care to have 12 children. Will add full-time employees.
1. Failure to comply with the conditions specified herein as the basis for approval of application
and issuance of Permit, constitutes cause for the revocation of said permit in accordance with
the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code
Sec. 24-41.
2. Unless otherwise provided for in a special condition to this Minor Use Permit, all conditions
must be completed prior to or concurrently with the establishment of the granted use. The use
granted by this permit must be established within 12 months of the delivery of the countersigned
permit to the Permittee.
3. Minor changes may be approved administratively by the Directors of Development Services,
Environmental Health, or Public Works upon receipt of a substantiated written request by the
applicant, or their respective designee, Prior to such approval, verification shall be made by
each Department or Division that the modification is consistent with the application, fees paid
and environmental determination as conditionally approved. Changes deemed to be major or
significant in nature shall require a formal application for amendment.
4. If any use for which a Minor Use Permit has been granted is not established within one year of
the date of receipt of the countersigned permit by the Permittee, the permit shall become null
and void and reapplication and a new permit shall be required to establish the use.
Conditions of Approval:
The facility is a single family residence that shall be the principal residence of the provider and
the large day care facility shall be clearly incidental and secondary to the use of the property for
residential purposes.
2. A minimum of four (4) off-street parking spaces shall be provided, .consisting of:
(a) Two (2) off-street parking spaces for the residents of the dwelling.
(b) One (1) off-street parking space for each employee. The two (2) required residential
spaces may not be used for employees.

(c) One (1) off-street parking space/loading area.
3. One sign, not to exceed 3 square feet, is allowed. This sign shall not be placed in the front yard
building setback.
4. The large family day care home shall be licensed by the California Department of Social
Services, Community Care Licensing.
5. Meet all California Building Code regulations pertaining to large family day care facilities,
including, but not limited to, the installation of smoke detectors, a device for sounding alarm,
fire extinguishers, and exit doors operable from the inside without the use of a key or any
special knowledge or effort.
6. Prior to issuance of the Minor Use Permit the large day care facility shall be inspected by the
Butte County Fire Department/CDF and the State Fire Marshal.
7. Building permits shall be required for any change of occupancy. Prior to issuance of the Minor
Use Permit, applicant shall obtain any necessary building permits.
8. Applicant must also comply with all other applicable State and local statutes, ordinances and
regulations.
NOTE: Issuance of this Minor Use Permit does not waive• requirement of obtaining Building and
Health Department permits before starting construction, nor does it waive any other requirements.

At the regular meeting of the Butte County Planning Commission held November 9, 2000, your
request for a Minor Use Permit, was approved subject to the conditions listed on the permit.
Should you desire to appeal any of the conditions imposed by the Planning Commission, you must
do so in writing, to the Clerk of the Board of Supervisors, 25 County Center Drive, Oroville,
California, prior to 5:00 p.m., Monday, November 20, 2000. The appeal fee of $50.00 must be paid
at that time. If you do not appeal and if there are no other appeal within the 10 calendar -day appeal
period, the action of the Planning Commission is final.
For purposes of the California Environmental Quality Act, allotice of Exemption must be filed. The
fee for the filing of a Notice of Exemption is the $25.00 documentary handling fee. A check made
payable to the Butte County Treasurer in the amount of $25.00 should be submitted to the Planning
Division in order to complete the process.
You will receive your valid permit, if there are no appeals, after it has been signed by the Planning
Commission Chairman and we have received your recorded Certification of Ownership.
Pursuant to Section 66020 (d) (2) of the Government Code you are hereby notified that you have 90

On October 25, 2000, a Planning Manager's hearing was held on the above referenced project. One
nearby property owner submitted a letter objecting to the application. The objections included a
concern about the potential impact to water quality and septic system on the property. Theapplicant
presented documents indicating the septic system and well had been upgraded in recent years. The
Environmental' Health Division did not have any objections or concerns with the application.
Testimony objecting to the application was provided by the same neighbor at the hearing. -
The Planning Manager recommends that the Planning Commission approve the Minor Use Permit
for a large day care facility subject to the findings and conditions as listed in the October 25, 2000,
Planning Manager's Minutes. The Planning Manager limited the number to 12 children. This is a
Consent Agenda item, and if the Commission takes any action other than that recommended by the
Planning Manager this item must be pulled from the Consent Agenda and set for a full public hearing
at a later date.

PROJECT DESCRIPTION/SITE CHARACTERISTICS:
This is a proposal to convert an existing small family day care facility to a large family day care
facility. The applicant currently cares for six or fewer children, and approval of this Minor Use Permit
will allow her to care for 12 or fewer children.
Per Butte County Zoning Code Section 24.265(b) small family day care centers are limited to six (6.)
or fewer children and large family day care centers may have up to twelve (12) children. The state law
changed recently setting new limits of eight (8) children for small day care centers and fourteen (14)
for large family day care centers. The County Code has not been changed to reflect these new limits.
This proposal is being.processed under the existing County Code and at such time as the code is revised
to the new state standards the limits on the number of children allowed may be administratively
adjusted for existing small and large child care centers.
The project site is located at 7528 Melvina Avenue, in the Palermo area. The parcel is developed with
a single family home, approximately 1239 square feet in size, on a standard residential lot of
approximately 0.34 acre. The back yard is fenced with a six foot high cyclone fence. The project is
located on a local residential connector street, in a neighborhood characterized by urban development.
There are approximately three to five dwelling units per acre. Access to the dwelling is from Melvina
Avenue, off of Kenilworth Avenue, Palermo. Domestic water is supplied by an onsite well. The
dwelling has a septic system. The applicant lives in the residence and is currently the primary care
provider, taking care of eight (8) children. The applicant does have two volunteer helpers assisting her.

With approval for a large day care facility, the applicant proposes to have as many as fourteen (14)
children, with two additional full-time employees.
The surrounding parcels are similarly developed, with single family homes on approximately one-
quarter to two -third acre parcels. The area is characterized by similar residential development
surrounding the project site. The residential neighborhood in which the project is located is bordered
by Railroad Avenue on the west, Irwin Avenue on the east, Palermo Road on the north, and South Villa
Road on the south. The project site is not located in a 100 year floodplain.
The following information is the result of additional research of the project & property:
• The applicant is currently conducting a Small Day Care operation; and
• The residential lots for Melvina Avenue have developed out over a number of years into one-
quarter to two -third acre lots; and
• The Building Division's Permit sheet identifies the structure as Single Family Dwelling.
ANALYSIS:
Staff recommends that the Planning Manager take the following actions:
The property is zoned AR -1 (Agricultural Residential -1 acre minimum) and has a General Plan land
use designation of Agricultural Residential. The AR -1 zoning classification allows large family day
care facilities with approval of a Minor Use Permit and subject to the requirements of Section 24-265
of the Zoning Code. The General Plan states that the Primary Use of the Agricultural Residential land
use designation is single family homes. Secondary Uses include group quarters and care homes.
Butte County Code Section 24-265(e)(2) requires that new large family day care centers be located at
least 500 feet driving distance from any other large family day care center. Staff conducted an analysis
of the location of other large family day care centers in the area of the project and determined that there
are no other such facilities within that distance. This facility will not cause any residence to be bounded
on more than one side with a large family day care center.
There is sufficient area for off-street parking for the residents of the dwelling, for an employee, and for
drop-off and pick-up of children. The applicant has approximately 75 foot long driveway with area for
turn -around for drop-off/pick-up of children. Located on a through street, the project site provides a
measure of.traffic safety during drop-off and pick-up times in that the site is located on a minor
residential collector street.
The Butte County Environmental Health Department recommends the existing septic system be
maintained within operating standards as prescribed in Butte County Code 19-4. The Butte County
Fire Department requires State Fire Marshal inspection and approval prior to opening the large day
facility.
The large day care facility may lead to a minor increase in noise levels due to children playing outside
and due to a minor increase in vehicle traffic. Noise from children playing outside will constitute an
incremental increase in noise as compared with the present day care facility. The vehicle traffic

generated by the proposed large day care facility will also result in an incremental increase in noise
levels because of the additional number of vehicle trips generated by the large family day care facility.
CEQA ISSUES:
This application for a Minor Use Permit to allow a large family day care is Categorically Exempt from
environmental review under Section 15305(Class 5).
Staff recommends that the Planning Manager take the following actions:
I. Find that the project is Categorically Exempt from environmental review pursuant to CEQA
Section 15305 (Class 5), which states that minor alterations in land use limitations can be
approved in areas with an average slope of less than -10 percent and that do not result in any
change in land use, and pursuant to CEQA Section 15300.2(a), which ' allows for Class. 5
exemptions upon consideration of where the project is located and ensuring that the project is
not located in any particularly sensitive environment, as supported by the following:
A. The project involves a modification to the uses permitted within a Residential zone,
does not involve a change in land use, and, therefore, qualifies as a minor alteration of
a land use limitation.
B. The proposed expansion of the current land use, from a small day care facility to a large
day care facility, constitutes a minor alteration in land use but does not result in any
change in land use.
C. The property's slope is level and does not exceed 20 percent.
D. The project is not located in an area of any particularly sensitive environment.
Il. Recommend approval to the Planning Commission for a Minor Use Permit for Angela Davis
for a large family day care facility for 12 or fewer children, MUP 01-08, on AN 026-181-028,
subject to the conditions found in Exhibit "A" and based on the following findings:
A. That the location, size, design, and operating characteristics of the proposed use will be
compatible with, and will not adversely affect, or be detrimental to adjacent uses,
residents, buildings, structures, or natural resources, with consideration given to:
1. Harmony in scale, bulk, coverage, and density:
The project is in harmony with scale, bulk, coverage, and density because the
large family day care facility will not create a need for any new structures or an
alteration to any existing structures..
2. - The availability of public facilities, services and utilities:

The large day care facility will not create a need for new public facilities,
services and utilities because water, telephone, gas, and electrical services
already extend to the project parcel. The project site is provided with onsite
well water and is on a septic system. The Butte County Fire Department
requires compliance with State Fire Marshall requirements for large day care
facilities.
3. The harmful effect, if any, upon desirable neighborhood character:
The proposed large day care facility will not change the traditional architectural
style that is of a character consistent with an urban residential neighborhood.
The large day care facility may lead to a minor increase in noise levels due to
children playing outside, and due to the increase in vehicle traffic, but this will
not be significant.
4. The generation of traffic and the capacity and physical character of surrounding
streets:
The proposed large day care facility will not significantly increase vehicle
traffic in the area, nor will it create any vehicle circulation impacts.
5. The suitability of the site for the type and intensity of use or development which
is proposed:
The site has adequate area for off-site parking spaces for the residents of the
t dwelling and for employees of the large family day care facility. There is also
adequate parking for an off-street loading area.
6. Any other relevant impact of the proposed use:
The Planning Division has circulated the proposed large family day care facility
application to County Agencies and has received no evidence that the use will
cause any other relevant impact.
C. The proposed location, size, design, and operating characteristics of the proposed use
and the conditions under which it would be operated or maintained will not be
detrimental to the public health, safety, or welfare, or injurious to properties or
improvements in the vicinity.
D. The proposed use will comply with each of the applicable provisions of the Chapter 24,
Section 265, of the Butte County Code.
PUBLIC COMMENT:
Staff has not received any written or telephone responses from the neighbors.

granted by this permit must be established within 12 months of the delivery of the
countersigned permit to the Permittee.
3. Minor changes may be approved administratively by the Directors of Development Services,
Environmental Health, or Public Works upon receipt of a substantiated written request by the
applicant, or their respective designee, Prior to such approval, verification shall be made by
each Department or Division that the modification is consistent with the application, fees paid
and environmental determination as conditionally approved. Changes deemed to be major or
significant in nature shall require a formal application for amendment.
4. If any use for which a Minor Use Permit has been granted is not established within one year of
the date of receipt of the countersigned permit by the Permittee, the permit shall become null
and void and reapplication and a new permit shall be required to establish the use.
Conditions of Approval:
1. The facility is a single family residence that shall be the principal residence of the provider and
the large day care facility shall be clearly incidental and secondary to the use of the property
for residential purposes.
2. A minimum of four (4) off-street parking spaces shall be provided, consisting of:
(a) Two (2) off-street parking spaces for the residents of the dwelling.

(b) One (1) off-street parking space for each employee. The two (2) required residential
spaces may not be used for employees.
(c) One (1) off-street parking space/loading area. '
3. One sign, not to exceed 3 square feet, is allowed. This sign shall not be placed in the front yard
building setback.
4. The large family day care home shall be licensed by the California Department of Social
Services, Community Care Licensing.
5. Meet all California Building Code regulations pertaining to large family day care facilities,
including, but not limited to, the installation of smoke detectors, a device for sounding alarm,
fire extinguishers, and exit doors operable from the inside without the use of a key or any
special knowledge or effort.
6. Prior to issuance of the Minor Use Permit the large day care facility shall be inspected by the
Butte County Fire Department/CDF and the State Fire Marshal.
7. Building permits shall be required for any change of occupancy. Prior to issuance of the Minor
Use Permit, applicant shall obtain any necessary building permits.
8. Applicant must also comply with all other applicable State and local statutes, ordinances and
regulations.
NOTE: Issuance of this Minor Use Permit does not waive requirement of obtaining Building and
Health Department permits before starting construction, nor does it waive any other requirements.

Persons wishing to comment on the project may submit written comments to the Butte County
Planning Division any time prior to Friday, October 20, 2000. The Director of Development
Services shall consider all comments in determining if the application meets all of the above
conditions and criteria. Upon finding that the proposed use does or will meet all of the conditions
and criteria, the Director of Development Services will hold a hearing on Wednesday, October 25,
2000, at 9:00 a.m., at 7'County Center Drive, Oroville, CA, in the Planning Division Conference
Room. Any interested person may attend this hearing. The decision of the Director of Development
Services will be submitted, to the Planning Commission for final approval. If recommended for
approval, this item will be on the Planning Commission Consent Agenda at the next available
meeting. Upon action taken by the Planning Commission on the project an appeal maybe filed with

It was moved by Commissioner Mooney, seconded by Commissioner Lambert, and unanimously carried to
approve the Minor Use Permit for Angela Davis subject to the fmdings.and conditions listed below.
Find that the project is Categorically Exempt from environmental review pursuant to CEQA Section
15305 (Class 5), which states that minor alterations in land use limitations can be approved in areas
with an average slope of less than 10 percent and that do not result in any change in land use,. and
pursuant to CEQA Section 15300.2(a), which allows for Class 5 exemptions upon consideration of
where the project is located and ensuring that the project is not located in any particularly, sens=tive
environment, as supported by the following:
A. The project involves a modification to the uses permitted within a Residential zone, does not
involve a change in land.use, and, therefore, qualifies as a minor alteration of a land use
limitation.
B. The proposed expansion of the current land use, from a small day care facility to a large day
care facility, constitutes a minor alteration in land use but does not result in any change in
land use.
C. The property's slope is level and does not exceed 20 percent.
D. The project,is not located in an area of any particularly sensitive environment.
II. Recommend approval to the Planning .Commission for a Minor Use Permit for Angela Davis =or a
large family day care facility for 12 or fewer children, MUP 01-08, on AN 026-181-028, subj etit to
the conditions found in Exhibit "A" and based on the following findings:
A. That the location, size, design, and operating characteristics of the proposed use wi-_l be
compatible with, and will not adversely affect, or be detrimental to adjacent uses, residents,
buildings, structures, or natural resources, with consideration given to:
Harmony in scale, bulk, coverage, and density:
The project is in harmony with scale, bulk, coverage, and density because the large
family day care facility will not create a need for any new structures or an alteration
to any existing structures.
2. The'availability of public facilities, services and utilities:
The large day care facility will not create a need for new public facilities, services
and utilities, because water, telephone, gas, and electrical services already extend to
the project parcel. The project site is provided with onsite well water and is on a
septic system. The Butte County Fire Department requires compliance with State
Fire Marshall requirements for large day care facilities.

3. The harmful effect, if any, upon desirable neighborhood character:
The proposed large day care facility will not change the traditional architectural style
that is of a character consistent with an urban residential neighborhood. The large
day care facility may lead to a minor increase in noise levels due to children playing
outside, and due to the increase in vehicle traffic, but this will not be significam.
4.. The generation of traffic and the capacity .and physical character of surrounding
streets:
The proposed large day care facility will not significantly increase vehicle traffi: in
the area, nor will it create any vehicle circulation impacts.
The suitability of the site for the type and intensity of use or development which is
proposed:
The site has adequate area for off-site parking spaces for the residents of the dwelling
and for employees of the large family day care facility. There is also adequate
parking for an off-street loading area.
6. 1Any other relevant impact of the proposed use:
The Planning Division has circulated the proposed' large family day care facility
application to County Agencies and has received no evidence that the use will cause
any other relevant impact.
C. The proposed location, size, design, and operating characteristics of the proposed use and the
conditions under which it would be operated or maintained will not be detrimental to the
public health, safety, or welfare, or injurious to properties or improvements in the vicinity.
D. The proposed use will comply with each of the applicable provisions of the Chapter 24,
Section 265, of the Butte County Code.
Conditions of Approval:
The facility is a single family residence that shall be the principal residence of the provider and the
large day care facility shall be clearly incidental and secondary to the use of the property for
residential purposes.
2. A minimum of four (4) off-street parking spaces shall be provided, consisting of:
(a) Two (2) off-street parking spaces for the residents of the dwelling.
(b) One (1) off-street parking space for each employee. The two (2) required residential spaces
may not be used for employees.
(c) One (1) off-street parking space/loading area.
3. One sign, not to exceed 3 square feet, is allowed. This sign shall not be placed in the fror_4 yard
building setback.

4. The large family day care home shall be licensed by the California Department of Social Services,
Community Care Licensing.
5. Meet all California Building Code regulations pertaining to. large family day care facil=.ties,

extinguishers, and exit doors operable from the inside without the use of a key or any sp,:cial
knowledge or effort.
6. Prior to issuance of the Minor Use Permit the large day care facility shall be inspected by the Butte
County Fire Department/CDF and the State Fire Marshal.
7. Building permits shall be required for any change of occupancy. Prior to issuance of the Minor Use
Permit, applicant shall obtain any necessary building permits.
8. Applicant must also comply with all other applicable State and local statutes, ordinances and
regulations.

Mr. Hackney gave a brief summary to the project.
Mr. Wilson noted a letter from Mr. Hightower in opposition to this permit. He asked if there was
another day. care facility within 500 feet of this one?
Mr. Hackney said the next day care is 1,650 feet driving distance away from this site.
The hearing was opened to the public.
Angela Davis said the parking is adequate because people come and go at different times. She said
there is a 120 foot deep well with a new pump. She said the leachfields are all new. She said they get
20 gallons a minute from the well.
Mr. Wilson asked how many cars can park in the yard at a time?
Ms. Davis said five.
Mr. Hightower said the business is needed in the neighborhood and Ms. Davis is a good care provider.
He said his objection is based on the size of the facility. He said the lot is too small and not an
adequate site for young children. He said there are other sites more suitable. He said this is an
enterprising young couple, but the County should look at this more closely.
Ms. Davis said she has had the small day care for a little over a year.
Mr. Wilson discussed the State Law regulating day care facilities. He said the Law allows for these
facilities to be run out of single-family homes. He said the County currently only allows up to 12
where the State allows up to 14. When the County Code is amended, this permit will go to a maximum
of 14 children allowed. He said the State regulates day care facilities and the State inspects those
facilities. He read the suggested conditions into the record.
Mr. Hightower asked how well does the State inspect and control the facility?
Mr. Davis explained what role the State plays in regulating day care facilities and that the State
inspects the day care every three years.
Ms. Davis said they are also periodically checked by the Valley Oaks Children Service. She described
the fencing and plans for future fencing.
Mr. Hightower showed a picture of the property. He said he owns the property next door, but lives
out of the area. He said they need day care facilities, but he asked if this house and lot was large
enough for this use.
Ms. Davis said two people are there at all times to supervise the children. She said her youngest is 15
months old.

The hearing was closed.
Mr. Wilson said with the recent improvements to the sewage disposal area and well, the
recommendation from Environmental Health that the existing system be maintained and that they had
no issues with the well and septic, there is adequate parking, the facility operation is regulated under
the State standards'for child care, he concurred with staff's recommendation for approval of this Minor
Use Permit to allow a Large Family Day Care Facility for Angela Davis subject to the findings and
condition listed below:
The Planning Manager recommends that the Planning Commission take the following actions:

MINOR USE PERMIT
APPLICATION SUBMITTAL REQUIREMENTS
Prior to submitting a Minor Use Permit application, it is requested that the. applicant
discuss the application requirements, County procedures, zoning provisions and
possible conditions of approval with the Development Services Staff. Please note that
acceptance of your application is not an indication of approval.
A. SPECIFIC INFORMATION
The following speck information and material shall accompany a Uniform Application
at the time of submittal. Applications will not be considered complete nor will they be
acted upon until all submittal requirements have been met., All items, maps and exhibits
submitted in support of this application shall become the property of Butte County.
The following items are required to be submitted at the time of application:
1, A completed, signed, tin' orm Ao.Pk cr ation. If the application is signed by an
agent.for the property owner, an agent authorization form must be submitted
along with- the Uniform Application. The application shall not be accepted
unless signed by the owner or legal agent.

Submittal Requirements - Minor Use Permit
■ Distances from any significant natural and man-made features of the .
property, such as streets, access roads, streams, rock outcroppings,
major tree stands, storm drains, bodies of water, railroads, to the
property lines.
■ North arrow and scale of drawing. All plans shall be drawn to an
engineering scale with the preferred scale of V = 20', with a north arrow
preferably oriented to the top of sheet.
■ All plans must be clear and legible.

This checklist is designed to assist applicants in making sure all necessary information is included in tl:eir

A completed, signed, Uniform Application. If the application is signed by an agent for the
property owner, an agent authorization form must be submitted along with the Unifo-m
Application. The application shall not be accepted unless signed by the owner or legal agent.
Payment of the currently required Application Fee and/or Deposit (Any unused portion of the
/deositwill be returned upon final action, if any remains). (Planner advises applicant)

Distances from any significant natural and man-made features of the property, such as
streets, access roads, streams, rock outcroppings, major tree stands, storm drains, bodie3

the preferred scale of 1" = 20', with a north arrow preferably oriented to the top of sheet.
