The property is located at 739 Lawn Drive, off of Godman Avenue, Chico. APN 007-360-038 (SH) (MUP 01-07) It was moved by Commissioner Lambert, seconded by Commissioner. Cage, and unanimously carried to approve the Minor Use permit for Jennifer Ann Shults subject to the findings and conditions listed below. I. Find that the project is Categorically Exempt from environmental review pursuant to CEQA Section '153 05 (Class 5), which states that minor alterations in land use limitations can be approved in Ereas with an average slope of less than 10 percent and that do not result in any change in land use. and pursuant to CEQA Section 15300.2(a), which allows for Class 5 exemptions upon consideration of where the project is located and ensuring that the project is not located in any particularly sensitive environment, as supported by the following: A. The project involves a modification to the uses permitted within a Suburban -Residential zone, does not involve a change in land use, and, therefore, qualifies as a minor alteration of a land use limitation. B. The proposed expansion of the current land use, from a small day care facility to a large day care facility, constitutes a minor alteration in land use but does not result in any change in land use. C. The property's slope is level and does not exceed 20 percent. D. The project is not located in an area of any particularly sensitive environment. II. Recommend approval to the Planning Commission for a Minor Use Permit for Jennifer Shuhs for a large family day care facility for 12 or fewer children, MUP 01-07, on AN 007-360-038, subject to the conditions found in Exhibit "A" and based on the following findings: A. That the location,. size, design, and operating characteristics of the proposed use will be compatible with, and will not adversely affect, or be detrimental to adjacent uses, residents, buildings, structures, or natural resources, with consideration given to: 1. Harmony in scale, bulk, coverage, and density: The project is in harmony with scale, bulk, coverage, and density because the large family day care facility will not create a need for any new structures or an alteration to any existing structures. 2. The availability of public facilities, services and utilities: The large day care facility will not create a need for new public facilities, services and utilities because water, telephone, gas, and electrical services already extend to the project parcel. The project site is provided with municipal water and Eewer facilities. The Butte County Fire Department requires compliance with State Fire Marshall requirements for large day care facilities. 3. The harmful effect, if any, upon desirable neighborhood character: ■ BUTTE COUNTY PLANNING COMMISSION ■ MINUTES 0 OCTOBER 26, 2000 ■ The proposed large day care facility will not change the traditional architectural style that is of a character consistent with an urban residential neighborhood. The large day care facility may lead to a minor increase in noise levels due to children playing outside, and due to the increase in vehicle traffic, but this will not be significaat. 4. The generation of traffic and the capacity and physical character of surrounding streets: The proposed large day care facility will not significantly increase vehicle traffic in the area, nor will it create any vehicle circulation impacts. The suitability of the site for the type and intensity of use or development which is proposed: The site has adequate area for off-site parking spaces for the residents of the dweling and for employees of the large family day care facility. There is also adequate parking for an off-street loading area. 6. Any other relevant impact of the proposed use: The Planning Division has circulated the proposed large family day care facility application to County Agencies and has received no evidence that the use will cause any other relevant impact. C. The proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it would be operated or maintained will not be detrimental tc the public health, safety, or welfare, or injurious to properties or improvements in the vicir_ity: D. The proposed use will comply with each of the applicable provisions of the Chapter 24, Section 265, of the Butte County Code. Conditions of Approval: 1. The facility is a single family residence that shall be the principal residence of the provider and the large day care facility shall be clearly incidental and secondary to the use of the property for residential purposes. 2. A minimum of four (4) off-street parking spaces shall be provided, consisting of: (a) Two (2) off-street parking spaces for the residents of the dwelling. (b) One (1) off-street parking space for each employee. The two (2) required residential spaces may not be used for employees. (c) One (1) off-street parking space/loading area. 3. One sign, not to exceed 3 square feet, is allowed. This sign shall not be placed in the front yard building setback. 4. Meet all California Building Code regulations pertaining to large family day care facili=les, including, but not limited to, the installation of smoke detectors, a device for sounding alarm, fire extinguishers, and exit doors operable from the inside without the use of a key or any special knowledge or effort. 6. Prior to issuance of the Minor Use Permit the large day care facility shall be inspected by the Butte County Fire Department/CDF and the State Fire Marshal. 7. Building permits shall be required for any change of occupancy. Prior to issuance of the Minor Use Permit, applicant shall obtain any necessary building permits. 8. The property is located at 739 Lawn Drive, off of Godman Avenue, Chico. APN 007-360-038 (SH) (MUP 01-07) Mr. Hackney gave a brief summary of the project. Mr. Parilo noted that five letters were received. One in favor of the project and four in opposition. Mr. Hackney explained that one of the letters was opposed because of the increase in traffic. He said the traffic figures stated in the one letter were not accurate. He said another objected because there is believed to be an illegal operation in another residence. He said that should not affect this residence. He said one of the letters states there is a registered sex offender in the neighborhood. He said it is the offender's parents that live in the neighborhood and it is his understanding that the offender. is not permitted on the parents' property. There was a brief discussion. Mr. Parilo asked if the road meets County road standard R54C? Mr. Hackney said he had talked with Public Works and this road meets the County standards. He said the roads are well paved with curb, gutter, and sidewalk. He said she has one or two helpers. The hearing was opened to the public. Jennifer Shults explained about the sex offender, stating that he was not allowed on her street, by law, because of the day care facility. She said the next day care is 1 1/2 miles away. She said that part of the traffic problems are because the street is used as a short cut to Sandi Drive. She said the day care is for ages 0-12 years. She said she will have three employees that will overlap. She said they will not be all working at the same time. She said she can accommodate four cars in her driveway. Mr. Parilo said that one of the letters had concerns about children being in the front yard and street. Ms. Shults said some time ago she used to sit out front and let the older children ride their bikes. She said she was there supervising them at all times. She said she no longer does this due to accepting younger children into the day care. She said the maximum number of children there at one time will be 12, two of which are her children. She submitted a petition from neighbors in favor of this permit. Kim Groom said her son, Chad, stays with Ms. Shults. She said Ms. Shults is a very good child care provider and her son is very happy there. She said Ms. Shults is very organized. She said the children will be well supervised and she is in favor of the permit. Mr. Parilo said he was concerned with people parking on the street. He said the ZoningCode requires that employees and drop-off cars with children need to occur on-site. Ms. Shults said that they do not all arrive at the same time. She said she parks in the garage and her employees will be able to park in the driveway and still have room for children being dropped off. She said the pick up time are also different. Mr. Parilo said he would like to add a condition for the pick up and delivery times to be staggered to avoid problems. -- - - - _ ._—............ .......... ... .. ■ BUTTE COUNTY PLANNING SERVICES MEETING ■ MINUTES - OCTOBER 11, 2000 ■ The hearing was closed. Ms. Shults said she was very frustrated with the processing of this permit. She said she called several people and was giving different information each time. She said she wanted to be on record that she was not happy with the processing of her application. Mr. Parilo concurred with staff's recommendation to recommend approval of this Minor Use Permit for a large day care center for Jennifer Shults for no more than 12 children, subject to the findings and conditions listed below, adding a new Condition 9 to read "Pick up and delivery times shall be staggered to meet on-site off-street parking requirements." He said this request will be forwarded to the Planning Commission's Consent Agenda on October 26, 2000. He explained the procedure. Staff recommends that the Planning Manager take the following actions: I. Changes deemed to be major or significant in nature shall require a formal application for amendment. 4. If any use for which a Minor Use Permit has been granted is not established within one year of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. Conditions of Approval: The facility is a single family residence that shall be the principal residence of the provider and the large day care facility shall be clearly incidental and secondary to the use of the property for residential purposes. 2. A minimum of four (4) off-street parking spaces shall be provided, consisting of: (a) Two (2) off-street parking spaces for the residents of the dwelling. (b) One (1) off-street parking space for each employee. The two (2) required residential spaces may not be used for employees. (c) One (1) off-street parking space/loading area. 3. One sign, not to exceed 3 square feet, is allowed. This sign shall not be placed in the front yard building setback. 4. The large family day care home shall be licensed by the California Department of Social Services, Community Care Licensing. 5. Meet all California Building Code regulations pertaining to large family day care facilities, including, but not limited to, the installation of smoke detectors, a device for sounding alarm, fire extinguishers, and exit doors operable from the inside without the use of a key or any special knowledge or effort. 6. Prior to issuance of the Minor Use Permit the large day care facility shall be inspected by the Butte County Fire Department/CDF and the State Fire Marshal. 7. PROJECT DESCRIPTION/SITE CHARACTERISTICS: This is a proposal to convert an existing small family day care facility to a large family day care facility. The applicant currently cares for six or fewer children, and approval of this Minor Use Permit will allow her to care for 12 or fewer children. Per Butte County Zoning Code Section 24.265(b) small family day care centers are limited to six (6) or fewer children and large family day care centers may have up to twelve (12) children. The state law changed recently setting new limits of eight (8) children for small day care centers and fourteen (14) for large family day care centers. The County Code has not been changed to reflect these new limits. This proposal is being processed under the existing County Code and at such time as the code is revised to the new state standards the limits on the number of children allowed may be administratively adjusted for existing small and large child care centers. The project site is located at 739 Lawn Drive, in the Chico area. The parcel is developed with a single family home, approximately 1400 square feet in size, on a standard residential parcel. The back yard is fenced with a six foot high solid wood fence. The project is located .on a local residential connector street, in a neighborhood characterized by urban development. There are approximately three to five dwelling units per acre. Access to the dwelling is from Lawn.Drive, off of Godman Avenue, Chico. Domestic water is supplied by California Water Company. The dwelling has a septic system. The applicant lives in the residence and is currently the sole care provider, taking care of six children. With approval for a large day care facility, the applicant may have up to twelve (12) children, with additional full-time employees. 0 Butte County Department of Development Services 0 Agenda Report 0 Page 1 0 The surrounding parcels are similarly developed, with single family homes on approximately one- third acre parcels. The area is developed with residential subdivisions to the north, south, east and west of the project. The subdivision in which the project is located is bordered by Eaton Avenue on the north, East Avenue on the south, SR99 to the west, and Morseman Avenue on the east. The project site is not located in a 100 year floodplain. The following information is the result of additional research of the project & property: • The applicant is currently conducting a Small Day Care operation; and • The subdivision lots for Lawn Drive were approved as standard residential lots of approximately one-third acre in size; and • The building plans received final approval on 10/23/79; and • The Building Division's Permit sheet identifies the structure as Single Family Dwelling. ANALYSIS: The property is zoned R-1 (Residential) and has a General Plan land use designation of LDR (Low Density Residential). The R-1 zoning classification allows large family day care facilities with approval of a Minor Use Permit and subject to the requirements of Section 24-265 of the Zoning Code. The General Plan states that the Primary Use of the Low Density Residential land use designation is single family homes at urban densities. Secondary Uses include group quarters and care homes. Butte County Code Section 24-265(e)(2) requires that new large family day care centers be located at least 500 feet driving distance from any other large family day care center. Staff conducted an analysis of the location of other large family day- care centers in the area of the project and determined that there are no other such facilities within that distance. This facility will not cause any residence to be bounded on more than one side with a large family day care center. There is sufficient area for off-street parking for the residents of the dwelling, for an employee, and for drop-off and pick-up of children. Located on a through street, the project site provides a measure of traffic safety during drop-off and pick-up times in that the site is located on a minor residential collector. street. The Butte County Environmental Health Department recommends the existing septic system be maintained within operating standards as prescribed in Butte County Code 19-4. The Butte County Fire Department requires State Fire Marshal inspection and approval prior to opening the large day facility. The large day care facility may lead to a minor increase in noise levels due to children playing outside and due to a minor increase in vehicle traffic. Noise from children playing outside will constitute an incremental increase in noise as compared with the present day care facility. The vehicle traffic generated by the proposed large day care facility will also result in an incremental increase in noise levels because of the additional number of vehicle trips that will be generated by the large family day care facility. 0 Butte County Department of Development Services ■ Agenda Report 0 Page 2 ■ PUBLIC COMMENT: Staff has received written comments by neighbors who are opposed to the approval of a Minor Use Permit for a large day care facility on their street. The objections to the proposed large day care offered by the neighbors include increased traffic volumes and related safety concerns, and observed unsupervised children playing in the unfenced front yard and in the neighbor's front yard. The letters also inform staff of the presence of a registered child molester who lives approximately 500 feet away on the corner of Lawn Drive and Morseman Avenue. CEQA ISSUES: This application for a Minor Use Permit to allow a large family day care is Categorically Exempt from environmental review under Section 15305(Class 5). ACTIONS FOR CONSIDERATION Staff recommends that the Planning Manager take the following actions: I. Find that the project is Categorically Exempt from environmental review pursuant to CEQA Section 15305 (Class 5), which states that minor alterations in land use limitations can be approved in areas with an average slope of less than 10 percent and that do not result in any change in land use, and pursuant to CEQA Section 15300.2(a), which allows for Class 5 exemptions upon consideration of where the project is located and ensuring that the project is not located Jn any particularly sensitive environment, as supported by the following: A. The project involves a modification to the uses permitted within a Suburban - Residential zone, does not involve a change in land use, and, therefore, qualifies as a minor alteration of a land use limitation. B. The proposed expansion of the current land use, from a small day care facility to a large day care facility, constitutes a minor alteration in land use but does not result in any change in land use. C. The property's slope is level and does not exceed 20 percent. D. The project is not located in an area of any particularly sensitive environment. II. Recommend approval to the Planning Commission for a Minor Use Permit for Jennifer Shults for a large family day care facility for 12 or fewer children, MUP 01-07, on AN 007- 360-038, subject to the conditions found in Exhibit "A" and based on the following findings: A. That the location, size, design, and operating characteristics of the proposed use will be compatible with, and will not adversely affect, or be detrimental to adjacent uses, residents, buildings, structures, or natural resources, with consideration given to: Harmony in scale, bulk, coverage, and density: The project is in harmony with scale, bulk, coverage, and density because the large family day care facility will not create a need for any new structures or an alteration to any existing structures. ■ Butte County Department of Development Services 0 Agenda Report 0 Page 3 ■ 2. The availability of public facilities, services and utilities: The large day care facility will not create a need for new public facilities, services and utilities because water, telephone, gas, and electrical services already extend to the project parcel. The project site is provided with municipal water and sewer facilities. The Butte County Fire Department requires compliance with State Fire Marshall requirements for large day care facilities. .3. The harmful effect, if any, upon desirable neighborhood character: The proposed large day care facility will not change the traditional architectural style that is of a character consistent with an urban residential neighborhood. The large day care facility may lead to a minor increase in noise levels due to children playing outside, and due to the increase in vehicle traffic, but this will not be significant. 4. The generation of traffic and the capacity and physical character of surrounding streets: The proposed large day care facility will not significantly increase vehicle traffic in the area, nor will it create any vehicle circulation impacts. 5. The suitability of the site for the type and intensity of use or development which is proposed: The site has adequate area for off-site parking spaces for the residents of the dwelling and for employees of the large family day care facility. There is also adequate parking for an off-street loading area. 6. Any other relevant impact of the proposed use: The Planning Division has circulated the proposed large family day care facility application to County Agencies and has received no evidence that the use will cause any other relevant impact. C. The proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or injurious to properties or improvements in the vicinity: D. Drive, Chico Dear Director: My wife and I are opposed to approval of this permit for the following reasons: • We have observed unsupervised children from this daycare playing in the front yard of this residence.. • Lawn Drive is becoming a thoroughfare between Godman and Morseman, the 25 mph speed. limit is frequently ignored, especially by younger drivers. • The increased traffic volume .(24 trips per day additional) would disturb the. peace of the neighborhood. + There is an illegal manufacturing use taking place next door which would be a dangerous combination of uses. (Someone is manufacturing soap for sale in their garage next door. Some of the reasons that concern us are safety, noise, and traffic. We live in a neighborhood of cul-de-sacs except for Lawn Dr. It is the only street that connects Godman Ave. and Moorsman Ave. The residents and their visitors , 4o live in this area use this street as a short cut. Keep in mind, when using this shortcut; most do not observe the speed limit. Lawn drive also has an "S" curve in it. The concern here is, the proposed daycare is right on this "S" curve and the house next door, parks all of their cars and camp trailer on the street which blocks your vision when driving down this street even at normal speed. I know Jennifer Shults is already running a daycare at this residence with several children. What annoys us about this is we have come home from work early a few times this summer only to find the kids driving their motorized toy cars up and down the sidewalk unsupervised: These toy cars travel down the street turning around in the neighborhood driveways. My only worry is that on this busy street someone may get run over. I would also like to add that if this facility expands to accommodate 12 children, we also add twelve more cars on this street twice a day. This neighborhood is zoned R-1, residential. We would like to keep this neighborhood as quiet and safe as possible.,,,,With kids playing in the front yard, it only adds more noise. Another issue that Jennifer Shults may not be aware of is*that Mike Thayer, Jr. who is a convicted child molester was released from prison this last summer. His parents live at the end of this street. Mike Jr. lived with his parents at the time of his arrest and conviction. Since his release, we -have seen him at his parents' residents several times. Parents that bring their children to this daycare should, be aware of this. We as parents are very concerned about this issue. I would like to point out that we are not the only resident on this street that feels this way.
