APN 027-300-023 (SH) (MUP 01-10) It was moved by Commissioner Cage, seconded by Commissioner Mooney, and unanimously carried to approve the Minor Use permit for Ada Guyot subject the findings and conditions listed below. I. Find that the project is exempt from the provisions of the California'Envitonmental Quality Act under Section 15303. Section 15303 consists of the conversion of existing small structures from one use to another where only minor modifications are made in the interior of the structure. II. Approve a Minor Use Permit for Ada Guyot, subject to the following findings: A. That the proposed location, size, design, and operating characteristics of the proposed use is in accordance with the purpose of this Ordinance, the purpose of the zone in which the site is located, the Butte County General Plan, and the development policies and standards of the County. B. That the location, size, design, and operating characteristics of the proposed use will be compatible with, and will not adversely affect, or be detrimental to adjacent uses, residents, buildings, structures, or natural resources, with consideration given to: Harmony in scale, bulk, coverage, and density; 2. The availability of public facilities, services and utilities; 3. The harmful effect, if any, upon desirable neighborhood character; 4. The generation of traffic and the capacity and physical character of surrounding streets; The suitability of the site for the type and intensity of use or development which is proposed; 6. Any other relevant impact of the proposed use. C. The proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or injurious to properties or improvements in the vicinity because the house already exists, has operated as a residence for many years in' the community, and the proposed rental of two bedrooms will meet the conditions and requirements of the zone and its appropriate uses. D. The proposed use will comply with each of the applicable provisions of the Chapter 24, Section 95, of the Butte County Code which allows approval of a Bed and Breakfast Home with a Minor Use Permit. No more than two (2) bedrooms shall be rented out at any one time. Parking shall be provided for guests on-site. Building identification and/or addresses shall be installed in conformance with Public Resources Code 4290 and shall be posted at the beginning of building construction and maintained continuously thereafter. Provide an all weather access of at least 10 foot wide and with a vertical clearance of 14 feet that will accommodate a 40,000 pound fire apparatus to all structures. The property is located between South Villa Avenue and Ludlum Avenue, on Palermo Honcut Highway, Palermo area. APN 027-300-023 (SH) (MUP 01-10) Mr. Hackney gave a brief summary of the project. The hearing was opened to the public. Ms. Guyot was present and said she agreed with the conditions. The hearing was closed. Mr. Wilson said he would concur with staff's recommendation for approval of this Minor Use Permit to allow a Bed and Breakfast for Ada Guyot subject to the findings and condition listed below: Recommend that the Planning Commission find that the project is exempt from the provisions of the California Environmental Quality Act under Section 15303. Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions set forth below: Ada Guyot is hereby granted a Minor Use Permit in accordance with application filed: Minor Use Permit for a Bed & Breakfast Home to rent out 2 bedrooms for Bed and Breakfast use. 1. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit, constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-41. 2. Unless otherwise provided for in a special condition to this Minor Use Permit, all conditions must be completed prior to or concurrently with the establishment of the granted use. The use granted by this permit must be established within 12 months of the delivery of the countersigned permit to the Permittee. 3. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee, Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to.be major or •significant in nature shall require a formal application for amendment. 4. If any use for which a Minor Use Permit has been granted is not established within one year of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. The applicant currently lives in the house, and approval of this Minor Use Permit will allow the applicant to use two of the house's seven bedrooms for this purpose. The parcel is developed with a single family home, approximately 4000 square feet in size, located on 1.79 acres. The parcel is fenced with an open -slatted wood fence of varying heights. The house is located on a residential collector street, in a neighborhood characterized by semi-rural/semi-urban residential development. The block upon which the applicant's house is located averages two houses per acre. Access to the dwelling is from South Villa Avenue, off of the Palermo-Honcut Highway. Domestic water is supplied by onsite wells. The dwelling has two septic systems. The applicant lives in the residence. There will not be any additional employees associated with running the.Bed and Breakfast Home. With approval for the use of a Bed and Breakfast Home, the applicant will rent out two of the bedrooms on a day-to-day basis. The surrounding parcels are similarly developed on parcels that vary from one-third acre to 30+acres in size. The area is developed with an old established residential subdivision to the north and west. Large parcels used for orchards and grazing are found to the south and east of the project site. The project site is not located in a 100 year floodplain. ■ BUTTE COUNTY PLANNING MANAGER ■ AGENDA REPORT ■ PAGE 1 ■ ANALYSIS: The property is zoned AR -1 (Agricultural Residential -one acre minimum) and has a General Plan land use designation of AR (Agricultural Residential). The AR -1 zoning classification allows a Bed and Breakfast Home with approval of a Minor Use Permit. The General Plan land use designation of AR states that the Primary Use of AR is single family homes at rural densities, and the Secondary Uses include home occupations and transient lodging. Staff conducted an analysis of the property and its surroundings. Following are staff's conclusions: • The residential structure is unique in its design and aesthetically suited as a Bed and Breakfast Home; • The residence is located on 1.79 acres of land that is completely surrounded with landscaping; • The parcel is completely fenced, and there is sufficient parking for guests, as well as for the residents. The Butte County Environmental Health Department does not recommend any conditions. The Butte County Fire Department requires building identification as required by Public Resources Code 4290, and that an all weather access be provided. Neither Public Works nor the Building Division recommend any conditions. PUBLIC COMMENT: Staff has not received any written or oral comments from the public regarding the application. CEQA ISSUES: This application for a Minor Use Permit to allow two rooms of an existing seven bedroom house to be rented out is Categorically Exempt from environmental review under Section 15303(Class 3). Staff recommends that the Planning Manager take the following actions: Recommend that the Planning Commission find that the project is exempt from the provisions of the California Environmental Quality Act under Section 15303. Section 15303 consists of the conversion of existing small structures from one use to another where only minor modifications are made in the interior of the structure. II. Recommend approval to the Planning Commission of Minor Use Permit for Ada Guyot, subject to the conditions found in Exhibit A and subject to the following findings: A. The proposed location, size, design; and operating characteristics of the proposed use and the. conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or injurious to properties or improvements in the vicinity because the house already exists, has operated as a residence for many years in the community, and the proposed rental of two bedrooms will meet the conditions and requirements of the zone and its appropriate uses. D.
