APN 041-260-048 (SH) (MUP 01-11) It was moved by Commissioner Cage, seconded by Commissioner Mooney, and unanimously carried to approve the Minor Use Permit for Lawrence A. Smith subject to the findings and conditions listed below: I. Find that the project is exempt from the provisions of the California Environmental Quality Act under Section 15303 Class 3. Section 15303 consists of construction and location of limited numbers of new structures. II. Approve a Minor Use Permit for Lawrence A. Smith, subject to the following findings: A. That the proposed location, size, design, and operating characteristics of the proposed use is in accordance with the purpose of this Ordinance, the purpose of the zone in which the site is located, the Butte County General Plan, and the development policies and standards of the County because: Project conditions of approval have been applied to this project pursuant to the applicable requirements of Section 24-280© "Standards and Conditions outside of Urban Areas" for second dwelling units of the Butte County Zoning Code, the Butte County Environmental Health Department and Butte County Fire Department. The project is in accordance with the purpose of the zone in which the land lies and the Butte County General Plan because the project site is designated Grazing and Open Land and zoned U. The Grazing and Open Land use designation allows dwelling units as Secondary Uses. The U zone allows second dwelling units upon approval of a Minor Use Permit. B. That the location, size, design, and operating characteristics of the proposed use will be compatible with, and will not adversely affect, or be detrimental to adjacent uses, residents, buildings, structures, or natural resources, with consideration given to: Harmony in scale, bulk, coverage, and density: The project is in harmony with scale, bulk, coverage, and density because the second dwelling unit will not create a need for any additional structures beyond the request or alter any existing structures. 2. The availability of public facilities, services and utilities: The second dwelling unit will not create a need for new public facilities, services and utilities because water, telephone, gas, and electrical services already extend to the project parcel. The Environmental Health Department requires that the existing septic system be maintained in a manner that complies with the Butte County Sewage Ordinance. Depending upon the size of the second dwelling proposed an expansion of the septic system may be necessary. The Butte County Fire Department requires compliance with standard California Fire Safe Regulations, Public Resources Code 4290. The harmful effect, if any, upon desirable neighborhood character: ■ BUTTE COUNTY PLANNING COMMISSION ■ MINUTES 0 NOVEMBER 16, 2000 ■ The proposed second dwelling unit will not change the traditional architectural style that is of a character consistent with an agricultural residential neighborhood. The second dwelling unit may lead to a minor increase in noise levels due to one additional family living on-site, and due to the increase in vehicle traffic, but this will not be significant. 4. The generation of traffic and the capacity and physical character of surrounding streets: The proposed second dwelling unit will not significantly increase vehicle traffic in the area nor will it create any vehicle circulation impacts. The suitability of the site for the type and intensity of use or development which is proposed: The site has adequate area for off-site parking spaces for the residents of the second dwelling unit. 6. Any other relevant impact of the proposed use: The Planning Division has circulated the proposed second dwelling unit application to County Agencies and has received no evidence that the use will cause any other relevant impact. C. Based on the above findings, the proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or injurious to properties or improvements in the vicinity, because the dwelling unit will be located in a rural area, on a 45+acre parcel, more than double the acreage required by the zoning classification in a sparsely populated area. D. The proposed use will comply with each of the applicable provisions of the Chapter 24, Section 280 of the Butte County Code. Conditions of Approval: 1: Prior to issuance of a building permit for the second dwelling unit, the property owner shall execute and record a covenant running with the land. A copy of the recorded covenant shall be submitted to the Planning Division and the Building Division. The covenant shall be on a form approved by the Department of Development Services and shall: (a) Stipulate the occupancy requirement of Condition 2, below; (b) Prohibit any land division, merger, or lot line adjustment that results in a parcel containing the two dwellings, which is less than twice the minimum parcel size requirement of the zone; © Stipulate that any land division proposing to place the dwellings on separate parcels must meet all the zoning and development requirements for devising land in Butte County, including, but not limited to : lot size, lot configuration, septic requirements, and setback standards of the zone in which the parcel is located; 0 BUTTE COUNTY PLANNING COMMISSION 0 MINUTES 0 NOVEMBER 16, 2000 ■ (d) Stipulate that if all such zoning and development requirements cannot be met, the parcel shall not be divided. 2. Construction, installation or development of structures or facilities on the parcels/lots shall comply with the latest California Fire Safe Regulations, (Public Resources Code 4290), and all other applicable State and County codes, ordinances and regulations in effect at the time of application for improvement permits. 5. Building identification and/or addresses shall be installed in conformance with Public Resources Code 4290 and shall be posted at the beginning of building construction and maintained continuously thereafter. 6. Mr. Wilson asked if the parcels meets the minimum acreage requirements. He asked if this parcel could be split in the future without any major issues. Mr. Hackney said the parcel exceeds twice the acreage. He noted Condition 1 which requires a covenant to prevent any land division that results in a parcel containing the two dwellings. Mr. Wilson asked about,the septic system and wells for these dwellings? The hearing was opened to the public. Mr. Smith said he will be required to expand the leachlines on the existing system which will serve both dwellings. He said the well located in the southwest corner of the property is used for both dwellings. Mr. Wilson said he would supply Mr. Smith with a copy of the covenant. Mr. Smith agreed to the conditions. The hearing was closed. Mr. Wilson said he would concur with staff's recommendation for approval of this Minor Use Permit to allow a second dwelling for Lawrence A. Smith subject to the fmdings and condition listed below: Recommend that the Planning Commission find that the project is exempt from the provisions of the California Environmental Quality Act under Section 15303 Class 3. Conditions of Approval: 1. Prior to issuance of a building permit for the second dwelling unit, the property owner shall execute and record a covenant running with the land. A copy of the recorded covenant shall be submitted to the Planning Division and the Building Division. The covenant shall be on a form approved by the Department of Development Services and shall: (a) Stipulate the occupancy requirement of Condition 2, below; r (b) Prohibit any land division, merger, or lot line adjustment that results in a parcel containing the two dwellings, which is less than twice the minimum parcel size requirement of the zone; (c) Stipulate that any land division proposing to place the dwellings on separate parcels must meet all the zoning and development requirements for devising land in Butte County, including, but not limited to : lot size, lot configuration, septic requirements, and setback standards of the zone in which the parcel is located; (d) Stipulate that if all such zoning and development requirements cannot be met, the parcel shall not be divided. 2. PROJECT DESCRIPTION/SITE CHARACTERISTICS: The applicant proposes to add a new 1,464 square foot mobile home on a 45+ acre parcel. There is an existing 1,344 square foot mobile home on the property. The new mobile home is proposed to become the second dwelling unit on the project site. There also exists a 1,200 square foot agricultural building. The property is located approximately one-half mile south of the Cherokee Road/Oregon Gulch Road intersection, on Table Top Drive, at the end of Table Top Road, north of Oroville. The property is located at approximately 1,200 foot elevation. The project site is in a very high fire hazard area. The project site is approximately two miles west of Lake Oroville. • ANALYSIS: The subject property is zoned U (Unclassified). The U zone allows a second dwelling unit with approval of a Minor Use Permit. The Second Dwelling Ordinance permits a second dwelling unit in a nonurban area when the parcel size meets at least twice the minimum parcel size stipulated by the zone. The applicant's property is zoned U (Unclassified) which has a minimum site requirement of 20 acres. The applicant's property is approximately 45 acres in size. The project site is designated Grazing & Open Land by the Butte County General Plan. The General Plan includes dwelling units as a Secondary Use. A portion of the parcel is designated Deer Winter Herd Area -20 acre minimum. The covenant shall be on a form approved by the Department of Development Services and shall: (a) Stipulate the occupancy requirement of Condition 2, below; (b) Prohibit any land division, merger, or lot line adjustment that results in a parcel containing the two dwellings, which is less than twice the minimum parcel size requirement of the zone; (c) Stipulate that any land division proposing to place the dwellings on separate parcels must meet all the zoning and development requirements for devising land in Butte County, including, but not limited to : lot size, lot configuration, septic requirements, and setback standards of the zone in which the parcel is located; (d) Stipulate that if all such zoning and development requirements cannot be met, the parcel shall not be divided. 2.
