The property is located at 3876 Foothill Blvd., in the southeast Oroville area. APN 036-220-104 (SH) (MUP 01-13) It was moved by Commissioner Cage, seconded by Commissioner Mooney, and unanimously carried to approve a Minor Use Permit for Barry DeForest subject to the findings and conditions listed below: I. Find that the project is exempt from the provisions of the California Environmental Quality Act under Section 15303 Class 3. Section 15303 consists of construction and location of limited numbers of new structures. II. Approve a Minor Use Permit for Barry DeForest, subject to the following findings: A. That the proposed location, size, design, and operating characteristics of the proposed use is in accordance with the purpose of this Ordinance, the purpose of the zone in which the site is located, the Butte County General Plan, and the development policies and standards of the County because: Project conditions of approval have been applied to this project pursuant to the applicable requirements of Section 24-2800 "Standards and Conditions outside of Urban Areas" for second dwelling units of the Butte County Zoning Code, the Butte County Environmental Health Department and Butte County Fire Department. The project is in accordance with the purpose of the zone in which the land lies and the Butte County General Plan because the project site is designated Grazing and Open Land and zoned U. The Grazing and Open Land land use designation allows dwelling units as Secondary Uses. The U zone allows second dwelling units upon approval of a Minor Use Permit. B. That the location, size, design, and operating characteristics of the proposed use will be compatible with, and will not adversely affect, or be detrimental to adjacent uses, residents, buildings, structures, or natural resources, with consideration given to: Harmony in scale, bulk, coverage, and density: The project is in harmony with scale, bulk, coverage, and density because the second dwelling unit will not create a need for any additional structures beyond the request or alter any existing structures. 2. The availability of public facilities, services and utilities: The second dwelling unit will not create a need for new public facilities, services and utilities because water, telephone, gas, and electrical services already extend to the project parcel. The Environmental Health Department requires that the existing septic system be maintained in a manner that complies with the Butte County Sewage Ordinance. Depending upon the size of the second dwelling proposed an expansion of the septic system may be necessary. The Butte County Fire Department requires compliance with standard California Fire Safe Regulations, Public Resources Code 4290. 3. The harmful effect, if any, upon desirable neighborhood character: ■ BUTTE COUNTY PLANNING COMMISSION ■ MINUTES 0 NOVEMBER 16, 2000 ■ Of The proposed second dwelling unit will not change the traditional architectural style that is of a character consistent with an agricultural residential neighborhood. The second dwelling unit may lead to a minor increase in noise levels due to one additional family living on-site, and due to the increase in vehicle traffic, but this will not be significant. 4. The generation of traffic and the capacity and physical character of surrounding streets: The proposed second dwelling unit will not significantly increase vehicle traffic in' the area nor will it create any vehicle circulation impacts. 5. The suitability of the site for the type and intensity of use or development which is proposed: The site has adequate area for off-site parking spaces for the residents of the second dwelling unit. 6. Any other relevant impact of the proposed use: The Planning Division has circulated the proposed second dwelling unit application to County Agencies and has received no evidence that the use will cause any other relevant impact.. C. Based on the above findings, the proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or injurious to properties or improvements in the vicinity, because the dwelling unit will be located in a rural area, on a 45+acre parcel, more than double the acreage required by the zoning classification in a sparsely populated area. D. The proposed use will comply with each of the applicable provisions of the Chapter 24, Section 280 of the Butte County Code. Conditions of Approval: Prior to issuance of a building permit for the second dwelling unit, the property owner shall execute and record a covenant running with the land. A copy of the recorded covenant shall be submitted to the Planning Division and the Building Division. The covenant shall be on a form approved by the Department of Development Services and shall' (a) Stipulate the occupancy requirement of Condition 2, below; (b) Prohibit any land division, merger, or lot line adjustment that results in a parcel containing the two dwellings, which is less than twice the minimum parcel size requirement of the zone; © Stipulate that any land division proposing to place the dwellings on separate parcels must meet all the zoning and development requirements for devising land in Butte County, including, but not limited to : lot size, lot configuration, septic requirements, and setback standards of the zone in which the parcel is located; ■ BUTTE COUNTY PLANNING COMMISSION ■ MINUTES ■ NOVEMBER 16, 2000 ■ Y (d) Stipulate that if all such zoning and development requirements cannot be, met, the parcel shall not be divided. 2. The owner of the parcel or lot must occupy either the main dwelling or the Second Dwelling Unit: 3. Prior to receiving a building division permit the applicant shall obtain a sanitation clearance. 4. Construction, installation or development of structures or facilities on the parcels/lots shall comply with the latest California Fire Safe Regulations, (Public Resources Code 4290), and all other applicable State and County codes, ordinances and regulations in effect at the time of application for improvement permits. 5. Building identification and/or addresses shall be installed in conformance with Public Resources Code 4290 and shall be posted at the beginning of building construction and maintained continuously thereafter. 6. Mr. Wilson asked if there was one well to serve both dwellings and if a septic system needs to be added. Mr. Hackney said that is correct. The hearing was opened to the public. There was no one present to speak on this item. The hearing was closed. Mr. Wilson said he would concur with staff's recommendation for approval of this Minor Use Permit to allow a second dwelling for Barry DeForest subject to the findings and condition listed below: Recommend that the Planning Commission find that the project is exempt from the provisions of the California Environmental Quality Act under Section 15303 Class 3. PROJECT DESCRIPTION/SITE CHARACTERISTICS: The applicant proposes to add a 1,400 square foot mobile home on a 20+ acre parcel as a second dwelling unit. There is an existing 1,600 square foot constructed home on the property. There also exists an agricultural building. The property is located approximately 500 feet west and approximately 800 feet south of Foothill Boulevard, in the southeast Oroville area. Access to the property is from Sigfrid Way off of Foothill Boulevard. The property is located at approximately 420 foot elevation. The project site is in a very high fire hazard area. ANALYSIS: The Second Dwelling Ordinance permits a second dwelling unit in a nonurban area when the parcel size meets at least twice the minimum parcel size stipulated by the zone. The applicant's property is zoned A -R (Agricultural -Residential) which has a minimum site requirement of 8,125 square feet. The applicant's property of approximately 20 acres meets the parcel size criteria of the second dwelling unit ordinance. The location of the proposed second dwelling unit and proposed access to the unit would allow for a subdivision of the property. The project site is designated Low Density Residential by the ■ BUTTE COUNTY PLANNING MANAGER ■ AGENDA REPORT ■ PAGE 1 ■ C� C Butte County General Plan. The General Plan specifies single family dwelling units at urban densities as a Primary Use. CEQA ISSUES: This application for a Minor Use Permit to allow a Second Dwelling Unit is Categorically Exempt from environmental review under Section 15303 Class 3. Staff recommends that the Planning Manager take the following actions: I. Recommend that the Planning Commission find that the project is exempt from the provisions of the California Environmental Quality Act under Section 15303 Class 3. Section 15303 consists of construction and location of limited numbers of new structures. II. Recommend approval to the Planning Commission of Minor Use Permit for Barry DeForest, subject to the conditions found in Exhibit A and subject to the following findings: A. That the location, size, design, and operating characteristics of the proposed use will be compatible with, and will not adversely affect, or be detrimental to adjacent uses, residents, buildings, structures, or natural resources, with consideration given to: Harmony in scale, bulk, coverage, and density: The project is in harmony with scale, bulk, coverage, and density because the second dwelling unit will not create a need for any additional structures beyond the request or alter any existing structures. 2. The availability of public facilities, services and utilities: The second dwelling unit will not create a need for new public facilities, services and utilities because water, telephone, gas, and electrical services already extend to the project parcel. The second dwelling unit may lead to a minor increase in noise levels due to one additional family living on-site, and due to the increase in vehicle traffic, but this will not be significant. 4. The generation of traffic and the capacity and physical character of surrounding streets: The proposed second dwelling unit will not significantly increase vehicle traffic in the area nor will it create any vehicle circulation impacts. 5. The suitability of the site for the type and intensity of use or development which is proposed: The site has adequate area for off-site parking spaces for the residents of the second dwelling unit. 6. Any other relevant impact of the proposed use: The Planning Division has circulated the proposed second dwelling unit application to County Agencies and has received no evidence that the use will cause any other relevant impact. C. Based on the above findings, the proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or injurious to properties or improvements in the vicinity, because the dwelling unit will be located in a nonurban area, on a 20+acre parcel which is many times greater in acreage than required by the zoning classification. D.
