Mr. Wilson explained that there is a 10 day appeal period. I. Find that the project is exempt from the provisions of the California Environmental Quality Act under Section 15303(a). Section 15303(a) consists of construction of new, small facilities or structures, including one single-family residence, or a second dwelling unit in a residential zone, subject to the following findings: ' A. This application for a Minor Use Permit to allow a second dwelling is Categorically Exempt from environmental review; and B. The proposed location, size, design, and operating characteristics of the proposed use is in accordance with the purpose of Chapter 24 of the Butte County Code, the purpose of the zone in which the site is located, the Butte County General Plan, and the development policies and standards of the County; and - C. The proposed location, size, design, and operating characteristics of the proposed use will be compatible with and will not adversely affect, or be detrimental to adjacent uses, residents, buildings, structures or natural resources, with consideration given to: 1. Harmony in scale, bulk, coverage and density; 2. The availability of public facilities, services and utilities; 3. The harmful effect, if any, upon desirable neighborhood character; 4. The generation of traffic and the capacity and physical character of surrounding streets; 5. The suitability of the site for the type and intensity of use or development which is proposed; 6. Any other relevant impact of the proposed use. D. The LDR designation provides for up to six (6) residential units per gross acre. 3. The project site meets the requirements of Section 24-280 for a permanent second dwelling unit due to the fact the project site is more`than twice the minimum size required by this section. B. That the location, size, design, and operating characteristics of the proposed use will be compatible with, and will not adversely affect, or be detrimental to adjacent uses, residents, buildings, structures, or natural resources, with consideration given to: . 1. Provide two additional off-street parking spaces. 2. No permits for any additional dwelling may be approved unless a Use Permit is granted by the Planning Commission. 5. Construction, installation or development of structures or facilities on the parcels/lots shall comply with the latest California Fire Safe Regulations, (Public Resources Code 4290), and all other applicable State and County codes, ordinances and regulations in effect at the time of application for improvement permits. 6. Building identification and/or addresses shall be installed in conformance with Public Resources Code 4290 and shall be posted at the beginning of building construction and maintained continuously thereafter. 7. The property is located at 10 Bo -y -le Lane, Oroville. APN 033-010-078 (SH) (MUP 01-16) Stephen Hackney gave a brief summary of the project. The hearing was opened to the public. Randy Wilson reviewed all of the conditions with the applicant. Mr. Thresher's son was present representing his father. He asked if the conditions included building a shop for his own personal use. Mr. Wilson said the conditions related to the second dwelling. He said Mr. Thresher would need to go through the Building Division for permits on a shop. The hearing was closed. Mr. Wilson said he concurred with staff's recommendation for approval of this Minor Use Permit for Charles W. Thresher to allow a permanent second dwelling unit subject to the findings and condition listed below: I. We had, at that time, an existing manuf Meed home on this property, which is still here. In the meeting we attended at 7 County Center Drive, concerning the special use permit, a discussion occurred regarding splitting the land in the future. We were required to place our new home in a manner that would allow future splitting of the land. At that time we said that the land would be split in front of several people there and that was the obvious understanding in the room. Now we have 2 homes on this property with their own wells and septic systems. Further, there is available room to replace the leach fields if either were to fail. Under the auspices of Butte County Code 20.4, we respectfully request an exception to allow us to split this developed property. We do indeed meet all of the requirements under this code and it's subsections. My son, as well as I, have a life savings tied up in this matter. Please allow this to go foreword.
