It was moved by Commissioner Leland, seconded by Commissioner Lambert, and carried to approve the Minor
Use Permit for Alan Tompkins (KCVU-TV) subject to the findings and conditions listed below.

Find that the project is exempt from the provisions of the California Environmental Quality Act
under Section 15061(b)(3). Section 15061(3) states that where it can be seen with certainty that there
is no possibility that the activity in question may have a significant effect on the environment, the
activity is not subject to CEQA. The project will not cause any significant impacts because the site
was cleared and rough graded for installation of the existing tower, and because the proposed 2,800
square foot building cannot be seen off of the site.
II. Recommend approval to the Planning Commission of Minor Use Permit 01-15 for Alan Tompkins,
subject to the conditions found in Exhibit A and subject to the following findings:
A. That the proposed location, size, design, and operating characteristics of the proposed use is
in accordance with the purpose of this Ordinance, the purpose of the zone in which the site
is located, the Butte County General Plan, and the development policies and standards of the
County because:
The project is in accordance with the purpose of the zone in which the land lies and
the Butte County General Plan because the project site is designated Agricultural -
Residential and is zoned TM -5. The Agricultural -Residential land use designation
allows public and utilities as Secondary Uses. The TM -5 zone allows communication
facilities upon approval of a Minor Use Permit.
B. That the location, size, design, and operating characteristics of the ,proposed use will be
compatible with, and will not adversely affect, or be detrimental to adjacent uses, residents,
buildings, structures, or natural resources, with consideration given to:
1.. Harmony in scale, bulk, coverage, and density:
The proposed building will be a one-story, 2,800 square foot structure that
will be consistent with the existing buildings and structures on the site.
2. The availability of public facilities, services and utilities:

Electrical power service is already established to the property and no
additional services or utilities are required.
3. The harmful effect, if any, upon desirable neighborhood character:
The project site is already developed with two tall towers and four buildings.
The proposed building will not be visible to the public and will not have a
harmful effect upon the neighborhood character.
4. The generation of traffic and the capacity and physical character of surrounding
streets:
Very little vehicle traffic will be generated during installation of the antennas
and equipment cabinets. The communications facility is unmanned and only
one to two site visits per month will be required after construction.
5. The suitability of the site for the type and intensity of use or development which is
proposed:
The site is ideally suited for the project because the proposed building will
contain television transmitters for future antennas to be placed on the existing
400 -foot tall tower. The project will not have an impact to any agricultural
or timber operations.
6. Any other relevant impact of the proposed use:
The Planning Division has circulated the project to County Agencies and has received
no evidence that the use will cause any other relevant impact.
C. Based on the above findings, the proposed location, size, design, and operating
characteristics of the proposed use and the conditions under which it would be operated or
maintained will not be detrimental to the public health, safety, or welfare, or injurious to
properties or improvements in the vicinity.
D. The proposed use will comply with each of the applicable provisions of the Chapter 24,
Section 262, of the Butte County Code.
E. A Minor Use Permit must be approved prior to any communications equipment being placed
in the structure and prior to any antennas placed on the adjacent tower.
Conditions of Approval:
Planning Division:
1. A Minor Use Permit must be approved prior to the installation of any transmitters or other
communications equipment in the building and prior to installation of any antennas on the adjacent
tower.

2. The installation of the Facility shall comply with all applicable building and electrical codes.
3. The placement of any structure shall not adversely affect any on-site sewage disposal system or its
repair area without written approval from the Division of Environmental Health.
4. The installation of the Facility shall not violate any existing deed restrictions.
5. The Facility shall have at least a twelve (12) foot wide all-weather access to a publicly maintained
road capable of supporting a forty thousand (40,000) pound fire apparatus with fifteen (15) feet of
vertical clearance.
6. There shall be no outdoor vehicle or equipment storage except for emergency purposes.
7. The Facility may not encroach into, under, over, above, or upon any public street in the
unincorporated area of the County in the absence of a valid encroachment permit from the County.
8. The Facility shall be secured at all times to prevent access by the public.
9. Applicant shall implement measures to prevent fugitive dust emissions during all construction
activities.
10. The project site shall be developed in accordance with the approved project site plan and the
conditions contained herein. Said site plan is on file in the Planning Division, is identified as
"Exhibit E" and date-stamped January 17, 2001, and is incorporated herein by this reference.
11. Prior to use of this project, the applicant shall contact the Planning Division for a field inspection to
verify all conditions of approval and ordinance requirements have been met.
12.. Applicant must also comply with all other applicable State and local statutes, ordinances and
regulations.
Public Works:
13. Prior to issuance of building permits, obtain encroachment permit for all new or existing driveway
approaches and construct them to County standards, as specified in County Improvement Standards.
Fire Department:
14. Meet the requirements of Public Resource Code 4290.
15. Meet the requirements of the Uniform Building Code and the Uniform Fire Code.
Environmental Health Division:
16. Install septic system for proposed building under review and permit issued by the Butte County
Environmental Health Department.

17. Prior to issuance of building permits submit a Hazardous Materials Release Response Plan and
Inventory Forms to the Butte County Environmental Health Department as required by Chapter 6.95
of the California Health and Safety Code.
Building Division:
18. Building Permits Required. Prepare four (4) sets of construction plans and make an application for
permit. Construction shall comply with federal, state, and local regulations. Plans shall be prepared,
sealed and signed by a California Licensed Architect or Registered Engineer for non-residential
buildings and certain residential buildings.
19. All structures shall be made accessible to the disabled. Disabled accessible parking and an accessible
path of travel shall be provided.
20. Proposed improvements shall comply with Title 24 energy conservation regulations. Appropriate
compliance forms (two sets) shall be submitted indicating compliance with those standards.
21. Proposed improvements shall comply with recorded map conditions applicable to construction.
22. Proposed improvements shall comply with Public Resources Code 4290 Fire Safe Construction
standards.
23. Development fees for the proposed residential or non-residential improvements shall be paid prior
to the issuance of building permits. The fees shall be those in effect at time of application, and shall
include, but not be limited to, School Fees, Park and Recreation District fees, Water and Sewer
Service Fees, Permit and Plan Check fees, and Fire Protection Fees.

Mr. Betts gave a brief summary of the project. He said the building is to house equipment in the
future. He noted that there were no letter received from the neighbors. .
The hearing was opened to the public.
Mr. Tompkins stated that the pad area for the building had been graded and they need this permit to
proceed with the building.
The hearing was closed.
Mr. Wilson said he concurred with staff's recommendation for approval of this Minor Use Permit for
Alan Tompkins (KCVU-TV) to allow a 2,800 square foot communication building that will contain
communication equipment for high definition TV broadcasts, a 350 KW generator with a 1,000 gallon
diesel tank, and a bathroom subject to the findings and condition listed below:
I. Recommend that the Planning Commission find that the project is exempt from the provisions
of the California Environmental Quality Act under Section 15061(b)(3). Section 15061(3)

site and adjacent properties, conforms to safety standards adopted by the FCC, if applicable.
The reports prepared for Facilities shall conform to the reporting requirements set by the
County and FCC OET 65 human exposure standards. The report shall also analyze the
evidence provided in support of the proposed Facility location, height and radiated power,
frequency, the number of channels, and all other related data and present alternatives for the
location, height and radiated power, pursuant to the requirements of this section. If the
proposed Facility exceeds FCC OET 65 human exposure standards, applicant shall also
provide additional comprehensive technical and planning information regarding how the
applicant shall protect all persons from such excessive exposure consistent with all Federal
and State requirements, and any additional County requirements.
19. El❑ Lanfl�caping and painting plans for the completed project.
20. ❑ ❑ Pro/'cls in Agricultural Zones (A-5 through A-160) shall, prior to submitting an application
for a proposed Facility, submit a site plan of the proposed Facility to the Butte County
Agricultural Commissioner for comment and send a notification letter to all aerial
agricultural applicators registered in the County informing them of the proposed site
location and tower height. No hearing on an application for a proposed facility in any
agricultural zone will be scheduled, nor shall any Administrative Permit for any such facility
be issued without proof that the Butte County Agricultural Commissioner and all aerial
agricultural applicators registered in the County have been notified, as specified herein.

On March 22, 2001, the Planning Commission approved Minor Use Permit 01-15 for a 2,800 square
foot communications building that will contain communications equipment for high definition TV
broadcasts, a 350 KW generator with a 1,000 gallon diesel tank, and a bathroom. The Permit was
approved by the Planning Manager on March 7, 2001.
The applicant has submitted building plans to the Building Department. Because of weather
conditions at the project sites 3,500 foot altitude, completed construction is not anticipated to be
completed prior to the one year deadline of the permit.

PROJECT DESCRIPTION/SITE CHARACTERISTICS:
This project will allow for the installation of a 2,800 square foot building that will contain
transmitters for high definition TV broadcasts, a 350 kilowatt emergency backup generator with a
1,000 gallon diesel tank, and a bathroom. The building will remain vacant until such time as
antennas for high definition TV are placed on the existing 400 -foot tall tower adjacent to the
proposed building. At that time, another Minor Use Permit application will be submitted by the
applicant for the antennas and communication equipment to be installed in the proposed building.
A septic system will be installed to handle waste from the bathroom in the proposed building.
The project site is developed with two 400 -foot tall towers, communication sheltersibuildings, a
caretakers residence, and a septic system. Access to the proposed building is via an existing 15 -foot
wide gravel driveway off of Cohasset Road. A locked gate provides access into the site. The two

existing towers were installed at a time when a Minor Use Permit was not required for
communication facilities. The 400 -foot tall tower located next to the proposed structure does not
support any antennas at this time. The existing towers are painted alternating red and white stripes
and are lighted.
ANALYSIS:
The project site is designated as Agricultural -Residential by the Land Use Element Map of the
General Plan, which allows public uses and utilities as secondary uses. Section 24-216 of Butte
County Code states that wireless communication facilities are not permitted in the TM -5 zone unless
a Minor Use Permit is obtained, subject to the requirements of Butte County Code Section 24-262.
As already note above, the proposed building will not be used for its intended purpose until such
time as the television transmitters are placed in the building and high definition antennas are added
to the adjacent 400 foot tall tower. The reason for installing the structure now is so that the site will
be ready when KCVU-TV decides to install the equipment and antennas, which will occur in the
near future. The applicant is required to obtain a Minor Use Permit for the installation of
communications equipment in the proposed structures and for the antennas on the adjacent tower.
This project will not have an impact to the environment because the area where the building will be
placed has already been cleared and rough graded. The access road leading to the site has already
been constructed. The proposed building will not be visible from Cohasset Road. The generator
located inside the proposed building will only be used during commercial power outages. Noise
from the generator will not be heard off of the site. The 1,000 gallon diesel tank also located inside
the proposed building must meet all county, state, and federal standards for the storage of hazardous
material.
ACTIONS FOR CONSIDERATION:
Staff recommends that the Planning Manager take the following actions:
Recommend that the Planning Commission find that the project is exempt from the
provisions of the California Environmental Quality Act under Section 15061(b)(3). Section
15061(3) states that where it can be seen with certainty that there is no possibility that the
activity in question may have a significant effect on the environment, the activity is not
subject to CEQA. The project will not cause any significant impacts because the site was
cleared and rough graded for installation of the existing tower, and because the proposed
2,800 square foot building cannot be seen off of the site.

II. Recommend approval to the Planning Commission of Minor Use Permit 01-15 for Alan
Tompkins, subject to the conditions found in Exhibit A and subject to the following findings:
A. That the proposed location, size, design, and operating characteristics of the proposed
use is in accordance with the purpose of this Ordinance, the purpose of the zone in
which the site is located, the Butte County General Plan, and the development
policies and standards of the County because:
The project is in accordance with the purpose of the zone in which the land
lies and the Butte County General Plan because the project site is designated
Agricultural -Residential and is zoned TM -5. The Agricultural -Residential
land use designation allows public and utilities as Secondary Uses. The TM -5
zone allows communication facilities upon approval of a Minor Use Permit.
B. That the location, size, design, and operating characteristics of the proposed use will
be compatible with, and will not adversely affect, or be detrimental to adjacent uses,
residents, buildings, structures, or natural resources, with consideration given to:
Harmony in scale, bulk, coverage, and density:
The proposed building will be a one-story, 2,800 square foot structure
that will be consistent with the existing buildings and structures on
the site.
2. The availability of public facilities, services and utilities:
Electrical power service is already established to the property and no
additional services or utilities are required.
The harmful effect, if any, upon desirable neighborhood character:
The project site is already developed with two tall towers and four
buildings. The proposed building will not be visible to the public and
will not have a harmful effect upon the neighborhood character.
4. The generation of traffic and the capacity and physical character of
surrounding streets:
Very little vehicle traffic will be generated during installation of the
antennas and equipment cabinets. The communications facility is
unmanned and only one to two site visits per month will be required
after construction.

The suitability of the site for the type and intensity of use or development
which is proposed:
The site is ideally suited for the project because the proposed building
will contain television transmitters for future antennas to be placed on
the existing 400 -foot tall tower. The project will not have an impact
to any agricultural or timber operations.
6. Any other relevant impact of the proposed use:
The Planning Division has circulated the project to County Agencies and has
received no evidence that the use will cause any other relevant impact.
C. Based on the above findings, the proposed location, size, design, and operating
characteristics of the proposed use and the conditions under which it would be
operated or maintained will not be detrimental to the public health, safety, or welfare,
or injurious to properties or improvements in the vicinity.
D. The proposed use will comply with each of the applicable provisions of the Chapter
24, Section 262, of the Butte County Code.
E. A Minor Use Permit must be approved prior to any communications equipment being
placed in the structure and prior to any antennas placed on the adjacent tower.

contain communications equipment for high definition TV broadcasts (to be placed in the structure
at a later date), a 350 KW generator with a 1,000 gallon diesel tank, and a bathroom.
Failure to comply with the conditions specified herein as the basis for approval of application
and issuance of Permit, constitutes cause for the revocation of said permit in accordance with
the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code
Sec. 24-45.65.
2. Unless otherwise provided for in a special condition to this use permit, all conditions must
be completed prior to or concurrently with the establishment of the granted use. The use
granted by this permit must be established within 12 months of the date of approval.
3. Minor changes may be approved administratively by the Directors of Development Services,
Environmental Health, or Public Works, or their respective designee, upon receipt of a
substantiated written request by the applicant. Prior to such approval, verification shall be
made by each Department or Division that the modification is consistent with the application,
fees paid and environmental determination as conditionally approved. Changes deemed to
be major or significant in nature shall require a formal application for amendment.
4. If any use for which a Minor Use Permit has been granted is not established within one year
of the date of approval, the permit shall become null and void and reapplication and a new
permit shall be required to establish the use. A Minor Use Permit subject to lapse may be
renewed for an additional period of up to one year, provided that sixty (60) calendar days
prior to the expiration date, an application for renewal of the Minor Use Permit is filed with
the Planning Division on the prescribed form and accompanied by the necessary data and
fees.

5. The terms and conditions of this permit shall run with the land and shall be binding upon and
be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee.
6. Neither the applicant, nor any agent nor representative of the applicant shall intentionally
omit or misrepresent any material fact in connection with the application. Any alleged
material misrepresentation shall constitute grounds for the Director of Development Services
to commence a revocation hearing, and, if proven to exist, shall constitute sufficient grounds
to revoke a permit.
Conditions of Approval:
Planning Division:
A Minor Use Permit must be approved prior to the installation of any transmitters or other
communications equipment in the building and prior to installation of any antennas on the
adjacent tower.
2. The installation of the Facility shall comply with all applicable building and electrical codes.
3. The placement of any structure shall not adversely affect any on-site sewage disposal system
or its repair area without written approval from the Division of Environmental Health.
4. The installation of the Facility shall not violate any existing deed restrictions.
5. The Facility shall have at least a twelve (12) foot wide all-weather access to a publicly
maintained road capable of supporting a forty thousand (40,000) pound fire apparatus with
fifteen (15) feet of vertical clearance.
6. There shall be no outdoor vehicle or equipment storage except for emergency purposes.
7. The Facility may not encroach into, under, over, above, or upon any public street in the
unincorporated area of the County in the absence of a valid encroachment permit from the
County.
8. The Facility shall be secured at all times to prevent access by the public.
9. Applicant shall implement measures to prevent fugitive dust emissions during all
construction activities.
10. The project site shall be developed in accordance with the approved project site plan and the
conditions contained herein. Said site plan is on file in the Planning Division, is identified
as "Exhibit E" and date-stamped January 17, 2001, and is incorporated herein by this
reference.

11. Prior to use of this project, the applicant shall contact the Planning Division for a field
inspection to verify all conditions of approval and ordinance requirements have been met.
12. Applicant must also comply with all other applicable State and local statutes, ordinances and
regulations.

16. Install septic system for proposed building under review and permit issued by the Butte
County Environmental Health Department.
17. Prior to issuance of building permits submit a Hazardous Materials Release Response Plan
and Inventory Forms to the Butte County Environmental Health Department as required by
Chapter 6.95 of the California Health and Safety Code.
Building Division:
18. Building Permits Required. Prepare four (4) sets of construction plans and make an
application for permit. Construction shall comply with federal, state, and local regulations.
Plans shall be prepared, sealed and signed by a California Licensed Architect or Registered
Engineer for non-residential buildings and certain residential buildings.
19. All structures shall be made accessible to the disabled. Disabled accessible parking and an
accessible path of travel shall be provided.
20. Proposed improvements shall comply with Title 24 energy conservation regulations.
Appropriate compliance forms (two sets) shall be submitted indicating compliance with
those standards.
21. Proposed improvements shall comply with recorded map conditions applicable to
construction.
22. Proposed improvements shall comply with Public Resources Code 4290 Fire Safe
Construction standards.

23. Development fees for the proposed residential or non-residential improvements shall be paid
prior to the issuance of building permits. The fees shall be those in effect at time of
application, and shall include, but not be limited to, School Fees, Park and Recreation
District fees, Water and Sewer Service Fees, Permit and Plan Check fees, and Fire Protection
Fees.

At the regular meeting of the Butte County Planning Commission held March 22, 2001, your request
for a Minor Use Permit, was approved subject to the conditions listed on the permit.
Should you desire to appeal any of the conditions imposed by the Planning Commission, you must
do so in writing, to the Clerk of the Board of Supervisors, 25 County Center Drive, Oroville,
California, prior to 5:00 p.m., Monday, April 2, 2001. The appeal fee of $50.00 must be paid at that
time. If you do not appeal and if there are no other appeal within the 10 calendar -day appeal period,
the action of the Planning Commission is final.
For purposes of the California Environmental Quality Act, a Notice of Exemption must be filed. The
fee for the filing of a Notice of Exemption is the $25.00 documentary handling fee. A check made
payable to the Butte County Treasurer in the amount of $25.00 should be submitted to the Planning
Division in order to complete the process.
You will receive your valid permit, if there are no appeals, after it has been signed by the Planning
Commission Chairman.
Pursuant to Section 66020 (d) (2) of the Government Code you are hereby notified that you have 90
days to register a. protest challenging any fees, dedications, reservations, or exactions imposed as
conditions of approval for this project.

DISTRICT POLICY FOR EXEMPTING SPECIFIED CLASSES OF
STATIONARY INTERNAL. COMBUSTION ENGINES FROM DISTRICT
PERMIT REQUIREMENTS
This policy establishes criteria for exempting specified classes of existing, and new or
modified stationary internal combustion engines (ICS's) from the requirements of District
Rules 402 and 403, as allowed by District Rule 404.
Except as noted below, the District shall require that each applicant requesting exemption
under this policy file an application for Authority to Construct or Permit to Operate
(permit application) and remit the filing fee specified in District Rule 500 to offset the cost
of processing the request. The applicant shall provide sufficient information to verify that
proposed equipment for which the exemption is requested is in compliance with Best
Available Control Technology (BACT) emission limits, as specified in District Rule 430,
or that BACT is not required.
An Authority to Construct and/or Permit to Operate shall not be required for stationary
internal combustion engines that meet one or more of the criteria established below:
1. Engines exempt from District permit requirements in accordance with California
Health & Safety Code Section 42310(e). A permit application requesting
exemption shall not be required unless this exemption is removed from State law;
and,
2. Any continuous -duty engine rated at 250 brake horsepower or less, except diesel -
fueled engines, limited by written authorization from the Air Pollution Control
Officer (APCO) to operate less than 200 hours per calendar year for non-
emergency purposes. Engines with a rated capacity greater than 250 brake
horsepower which have a physical limitation such that the rated capacity is less
than or equal to 250 brake horsepower may also qualify for exemption as
determined by the APCO; and,
3. Any engine rated by the manufacturer at 50 brake horsepower or less. A permit
application requesting an exemption is not required; and,
4. Engines used exclusively for fire fighting or flood control. A permit application
requesting exemption is only required if the equipment is fired with diesel fuel and.
greater than 50 brake horsepower; and,
5. Laboratory engines used in research testing. A permit application requesting
exemption is only required if the equipment is fired with diesel fuel and greater
than. 50 brake horsepower.
All persons/facilities requesting a permit exemption under this policy shall receive written
approval from the APCO prior to operating the exempt engine, and must abide by any and
all written restrictions imposed by the APCO. Exemptionsgranted under this policy from
the requirements of District Rules 402, and 403 shall not preempt any engine covered
under this policy from complying with any and all federal, State or District requirements.

May 12, 1993.
3. The emergency standby category is valid until March 2002, or until the analysis supporting the Emergency Standby Retrofit ATCM is complete, whichever is
sooner. At that time, emergency standby engines will be required to meet all requirements specified in the Retrofit ATCM. New emergency standby engines
must be "plumbed" to facilitate the installation of a catalyst -based DPF at a later date.
4. The annual hours of operation for emergency standby engines include the hours of operation for maintenance and testing only, and do not include emergency
operation hours.
5. Very low sulfur (< 15 ppmw) CARB diesel or equivalent is only required if the fuel is available at the Chico Terminal. CARB diesel is required to be used in
all other areas.
6. The hours of operation and actual emission rate will be limited through enforceable permit conditions based upon accepted health risk thresholds specified in
the District's Toxic Health Risk Assessment Guidelines.
7. Any Authority to Construct Permit issued shall contain a condition that requires the source to install controls if required by the Emergency Standby Retrofit
ATCM.
8. School is defined in Section 42301.6 of the California Health & Safety Code.

PROJECT DESCRIPTION/SITE CHARACTERISTICS:
This project will allow for the installation of a 2,800 square foot building that will contain
transmitters for high definition TV broadcasts, a 350 kilowatt emergency backup generator with a
1,000 gallon diesel tank, and a bathroom. The building will remain vacant until such time as
antennas for high definition TV are placed on the existing 400 -foot tall tower adjacent to the
proposed building. At that time, another Minor Use Permit application will be submitted by the
applicant for the antennas and communication equipment to be installed in the proposed building.
A septic system will be installed to handle waste from the bathroom in the proposed building.
The project site is developed with two 400 -foot tall towers, communication shelters/buildings, a
caretakers residence, and a septic system. Access to the proposed building is via an existing 15 -foot
wide gravel driveway off of Cohasset Road. A locked gate provides access into the site. The two

existing towers were installed at a time when a Minor Use Permit was not required for
communication facilities. The 400 -foot tall tower located next to the proposed structure does not
support any antennas at this time. The existing towers are painted alternating red and white stripes
and are lighted.
ANALYSIS:
The project site is designated as Agricultural -Residential by the Land Use Element Map of the
General Plan, which allows public uses and utilities as secondary uses. Section 24-216 of Butte
County Code states that wireless communication facilities are not permitted in the TM -5 zone unless
a Minor Use Permit is obtained, subject to the requirements of Butte County Code Section 24-262.
As already note above, the proposed building will not be used for its intended purpose until such
time as the television transmitters are placed in the building and high definition antennas are added
to the adjacent 400 foot tall tower. The reason for installing the structure now is so that the site will
be ready when KCVU-TV decides to install the equipment and antennas, which will occur in the
near future. The applicant is required to obtain a Minor Use Permit for the installation of
communications equipment in the proposed structures and for the antennas on the adjacent tower.
This project will not have an impact to the environment because the area where the building will be
placed has already been cleared and rough graded. The access road leading to the site has already
been constructed. The proposed building will not be visible from Cohasset Road. The generator
located inside the proposed building will only be used during commercial power outages. Noise
from the generator will not be heard off of the site. The 1,000 gallon diesel tank also located inside
the proposed building must meet all county, state, and federal standards for the storage of hazardous
material.
ACTIONS FOR CONSIDERATION:
Staff recommends that the Planning Manager take the following actions:
I. Recommend that the Planning Commission find that the project is exempt from the
provisions of the California Environmental Quality Act under Section 15061(b)(3). Section
15061(3) states that where it can be seen with certainty that there is no possibility that the
activity in question may have a significant effect on the environment, the activity is not
subject to CEQA. The project will not cause any significant impacts because the site was
cleared and rough graded for installation of the existing tower, and because the proposed
2,800 square foot building cannot be seen off of the site.

II. Recommend approval to the Planning Commission of Minor Use Permit 01-15 for Alan
Tompkins, subject to the conditions found in Exhibit A and subject to the following findings:
A. That the proposed location, size, design, and operating characteristics of the proposed
use is in accordance with the purpose of this Ordinance, the purpose of the zone in
which the site is located, the Butte County General Plan, and the development
policies and standards of the County because:
The project is in accordance with the purpose of the zone in which the land
lies and the Butte County General Plan because the project site is designated
Agricultural -Residential and is zoned TM -5. The Agricultural -Residential
land use designation allows public and utilities as Secondary Uses. The TM -5
zone allows communication facilities upon approval of a Minor Use Permit.
B. That the location, size, design, and operating characteristics of the proposed use will
be compatible with, and will not adversely affect, or be detrimental to adjacent uses,
residents, buildings, structures, or natural resources, with consideration given to:
Harmony in scale, bulk, coverage, and density:
The proposed building will be a one-story, 2,800 square foot structure
that will be consistent with the existing buildings and structures on
the site.
2. The availability of public facilities, services and utilities:
Electrical power service is already established to the property and no
additional services or utilities are required.
3.- The harmful effect, if any, upon desirable neighborhood character:
The project site is already developed with two tall towers and four
buildings. The proposed building will not be visible to the public and
will not have a harmful effect upon the neighborhood character.
4. The generation of traffic and the capacity and physical character of
surrounding streets:
Very little vehicle traffic will be generated during installation of the
antennas and equipment cabinets. The communications facility is
unmanned and only one to two site visits per month will be required
after construction.

5. The suitability of the site for the type and intensity of use or development
which is proposed:
The site is ideally suited for the project because the proposed building
will contain television transmitters for future antennas to be placed on
the existing 400 -foot tall tower. The project will not have an impact
to any agricultural or timber operations.
6. Any other relevant impact of the proposed use:
The Planning Division has circulated the project to County Agencies and has
received no evidence that the use will cause any other relevant impact.
C. Based- on the above findings, the proposed location, size, design, and operating
characteristics of the proposed use and the conditions under which it would be
operated or maintained will not be detrimental to the public health, safety, or welfare,
or injurious to properties or improvements in the vicinity.
D. The proposed use will comply with each of the applicable provisions of the Chapter
24, Section 262, of the Butte County Code.
E. A Minor Use Permit must be approved prior to any communications equipment being
placed in the structure and prior to any antennas placed on the adjacent tower.

Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions
set forth below: Alan Tompkins is hereby granted a Minor Use Permit in accordance with
application filed: Minor Use Permit for a 2,800 square foot communication building that will
contain communications equipment for high definition TV broadcasts (to be placed in the structure
at a later date), a 350 KW generator with a 1,000 gallon diesel tank, and a bathroom.
1. Failure to comply with the conditions specified herein as the basis for approval of application
and issuance of Permit, constitutes cause for the revocation of said permit in accordance with
the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code
Sec. 24-45.65.
2. Unless otherwise provided for in a special condition to this use permit, all conditions must
be completed prior to or concurrently with the establishment of the granted use. The use
granted by this permit must be established within 12 months of the date of approval.
3. Minor changes may be approved administratively by the Directors of Development Services,
Environmental Health, or Public Works, or their respective designee, upon receipt of a
substantiated written request by the applicant. Prior to such approval, verification shall be
made by each Department or Division that the modification is consistent with the application,
fees paid and environmental determination as conditionally approved. Changes deemed to
be major or significant in nature shall require a formal application for amendment.
4. If any use for which a Minor Use Permit has been granted is not established within one year
of the date of approval, the permit shall become null and void and reapplication and a new
permit shall be required to establish the use. A Minor Use Permit subject to lapse may be
renewed for an additional period of up to one year, provided that sixty (60) calendar days
prior to the expiration date, an application for renewal of the Minor Use Permit is filed with
the Planning Division on the prescribed form and accompanied by the necessary data and
fees.

5. The terms and conditions of this permit shall run with the land and shall be binding upon and
be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee.
6. Neither the applicant, nor any agent nor representative of the applicant shall intentionally
omit or misrepresent any material fact in connection with the application. Any alleged
material misrepresentation shall constitute grounds for the Director of Development Services
to commence a revocation hearing, and, if proven to exist, shall constitute sufficient grounds
to revoke a permit.
Conditions of Approval:
Planning Division:
1. A Minor Use Permit must be approved prior to the installation of any transmitters or other
communications equipment in the building and prior to installation of any antennas on the
adjacent tower.
2. The installation of the Facility shall comply with all applicable building and electrical codes.
3. The placement of any structure shall not adversely affect any on-site sewage disposal system
or its repair area without written approval from the Division of Environmental Health.
4. The installation of the Facility shall not violate any existing deed restrictions.
5. The Facility shall have at least a twelve (12) foot wide all-weather access to a publicly
maintained road capable of supporting a forty thousand (40,000) pound fire apparatus with
fifteen (15) feet of vertical clearance.
6. There shall be no outdoor vehicle or equipment storage except for emergency purposes.
7. The Facility may not encroach into, under, over, above, or upon any public street in the
unincorporated area of the County in the absence of a valid encroachment permit from the
County.
8. The Facility shall be secured at all times to prevent access by the public.
9. Applicant shall implement measures to prevent fugitive dust emissions during all
construction activities.
10. The project site shall be developed in accordance with the approved project site plan and the
conditions contained herein. Said site plan is on file in the Planning Division, is identified
as "Exhibit E" and date-stamped January 17, 2001, and is incorporated herein by this
reference.

11. Prior to use of this project, the applicant shall contact the Planning Division for a field
inspection to verify all conditions of approval and ordinance requirements have been met.
12. Applicant must also comply with all other applicable State and local statutes, ordinances and
regulations.
Public Works
13. Prior to issuance of building permits, obtain

14. Meet the requirements of Public Resource Code 4290.
15. Meet the requirements of the Uniform Building Code and the Uniform Fire Code.
Environmental Health Division:
16. Install septic system for proposed building under review and permit issued by the Butte
County Environmental Health Department.
17. Prior to issuance of building permits submit a Hazardous Materials Release Response Plan
and Inventory Forms to the Butte County Environmental Health Department as required by
Chapter 6.95 of the California Health and Safety Code.
Building Division:
18. Building Permits Required. Prepare four (4) sets of construction plans and make an
application for permit. Construction shall comply with federal, state, and local regulations.
Plans shall be prepared, sealed and signed by a California Licensed Architect or Registered
Engineer for non-residential buildings and certain residential buildings.
19. All structures shall be made accessible to the disabled. Disabled accessible parking and an
accessible path of travel shall be provided.
20. Proposed improvements shall comply with Title 24 energy conservation regulations.
Appropriate compliance forms (two sets) shall be submitted indicating compliance with
those standards.
21. Proposed improvements shall comply with recorded map conditions applicable to
construction.
22. Proposed improvements shall comply with Public Resources Code 4290 Fire Safe
Construction standards.

23. Development fees for the proposed residential or non-residential improvements shall be paid
prior to the issuance of building permits. The fees shall be those in effect at time of
application, and shall include, but not be limited to, School Fees, Park and Recreation
District fees, Water and Sewer Service Fees, Permit and Plan Check fees, and Fire Protection
Fees.
I hereby declare under penalty of perjury that I have read the foregoing conditions, that they
are in fact the conditions which were imposed upon the granting of this use permit, and that I agree
to abide fully by said conditions.

The District has reviewed the request for comments for a Minor Use Permit to allow a
communications building and 350 KW generator with a 1,000 gallon diesel tank to be located at
11045 Cohasset Road, in Cohasset. Based on the information submitted, a District Authority to
Construct permit will be required for the diesel generator. Enclosed is an application for an
Authority to Construct and supplemental application forms for Internal Combustion Engines
(ICE). Also enclosed is a copy of District policy for exempting specified classes of ICE's, policy
on particulate control requirements, and a list of EPA certified engines. The completed
applications must be submitted and approved by the District prior to construction.

Director of Development Services will hold a hearing on Wednesday, March 7, 2001, at 9:00 a.m.,
at 7 County Center Drive, Oroville, CA, in the Planning Division Conference Room. Any interested
person may attend this hearing. The decision of the Director of Development Services will be
submitted to the Planning Commission for final approval: If recommended for approval, this item

PROPOSED USE PERMIT STANDARD CONDITIONS
1.
Building Permits Required. Prepare 4ets of construction plans and make an
application for permit. Construction shall comply with federal, state, and local
regulations. Plans shall be prepared, sealed and signed by a California Licensed
Architect or Registered Engineer for non-residential buildings and certain residential
buildings.
Proposed improvements constitute a "change in use" or "change in the character of use"
as stated in the building code. Improvement plans shall incorporate all code -required
elements for the new use.

All structures shall be made accessible to the disabled. Disabled accessible parking and
an accessible path of travel shall be provided.
Proposed improvements shall comply with Title 24 energy conservation regulations.
Appropriate compliance forms (two sets) shall be submitted indicating compliance with
those standards.
Proposed improvements shall comply with Butte County Code and FEMA Flood Hazard
Prevention regulations. A FEMA Elevation Certificate, prepared by a qualified
professional, shall be completed and submitted with improvement plans to the Building
Division.
Proposed improvements shall comply with recorded map conditions applicable to
construction.
7.
Proposed improvements shall comply with Public Resource Code 4290 Fire Safe
Construction standards.

Development fees for the proposed residential or non-residential improvements shall be
paid prior to the issuance of building permits. The fees shall be those in effect at time of
application, and shall include, but not be limited to, School Fees, Park and Recreation
District Fees, Drainage Fees, Water and Sewer Service Fees, Permit and Plan Check
Fees, and Fire Protection Fees.

Subject: Minor use permit for a communication building at A.P. #056-070-079
The attached application for a minor use permit is for a communications building at 11045
Cohasset Rd. The building will house equipment associated with antennas to be mounted
on an existing 400' tower. The tower is currently empty. It is designed to accommodate
several broadcast and communication antennas.
The proposed building is 2800 sq. ft. with septic for a single bathroom. It will house a diesel
standby generator rated at approximately 350 Kw. It will be an unmanned site with gravel
parking area for two service vehicles. The site was cleared and rough graded when the
tower was installed. The site is adjacent to an existing tower and building (1800 sq. ft.).
The building will not be visible from any road. The building and tower will be enclosed by a
6' chain link fence with 3 barbed wire top.
We are currently planning to install a broadcast antenna and transmitter toward the end of
the year 2001. This equipment will broadcast a digital TV signal for our Fox affiliate station.
This signal is mandated by the FCC to be on the air by May, 2002 if we are to retain our
commercial broadcast license.
Once the building is constructed we will be able to lease tower space to other broadcast and
communications providers. This type of tower space is in constant demand and will provide
collocation opportunities for many of these providers.
