The property is located at 2007 Merrill Road, Paradise, at the end of Merrill and Matell Roads, on the east side of the Town of Paradise. (SH) (MUP 01-17) It was moved by Commissioner Leland, seconded by Commissioner Lambert, and carried to approve the consent agenda subject to the following findings and conditions: Find that the project is exempt from the provisions of the California Environmental Quality Act under Section 15303 Class 3(a). Section 15303 Class 3(a) consists of construction of new, small facilities or structures, including one single-family residence, or a second dwelling unit in a residential zone, subject to the following findings: A. This application for a Minor Use Permit to allow a second dwelling is Categorically Exempt from environmental review; and B. The proposed location, size, design, and operating characteristics of the proposed use is in accordance with the purpose of Chapter 24 of the Butte County Code, the purpose of the zone in which the site is located, the Butte County General Plan, and the development policies and standards of the County; and C. The proposed location, size, design, and operating characteristics of the proposed use will be compatible with and will not adversely affect, or be detrimental to adjacent uses, residents, buildings, structures or natural resources, with consideration given to: 1. Harmony in scale, bulk, coverage and density; 2. The availability of public facilities, services and'utilities; 3. The harmful effect, if any, upon desirable neighborhood character; 4. The generation of traffic and the capacity and physical character of surrounding streets; 5. The suitability of the site for the type and intensity of use or development which is proposed; 6. Any other relevant impact of the proposed use. D. The proposed location, size, design, and operating' characteristics of the proposed use and the conditions under which it will be operated or maintained will not be detrimental to the public health, safety and general welfare, or injurious to properties or improvements in the vicinity; and E. The proposed use will comply with each of the applicable provisions of Chapter 24, Section 280, of the Butte County Code. II. Approve the Minor Use Permit for -David D. Williams, subject to the conditions found in Exhibit A and subject to the following findings: A. The SR -1 zoning classification provides for a permanent second.dwelling unit with approval of a Minor Use Permit. 2. The development policies and standards of the General Plan Land Use designation, AR (Agricultural Residential), are met by this application. The AR designation provides for single family dwellings at rural densities. 3. The project site meets the requirements of Section 24-280'for a permanent second dwelling unit due to the fact the project site is more than twice the minimum size required by this section. B. That the location, size, design, and operating characteristics of the proposed use will be compatible with, and will not adversely affect, or be detrimental to adjacent uses, residents, buildings, structures, or natural resources, with consideration given to: Harmony in scale, bulk, coverage, and density. 2. The availability of public facilities, services and utilities. 3. The harmful effect, if any, upon desirable neighborhood character. 4. The generation of traffic and the capacity and physical character of surrounding streets. 5. The suitability of the site for the type and intensity of use or development which is proposed. 6. Any other relevant impact of the proposed use. C. The proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or injurious to properties or improvements in the vicinity. D. The proposed use will comply with each of the applicable provisions of the Chapter 24, Section 280, of the Butte County Code. Conditions of Approval: Prior to issuance of a building permit for the second dwelling unit, the property owner shall execute and record a covenant running with the land. A copy of the recorded covenant shall be submitted to the Planning Division and the Building Division. The covenant shall be on a form approved by the Department of Development Services and shall: (a) Stipulate the occupancy requirement of Condition 2, below; ■ BUTTE COUNTY PLANNING COMMISSION ■ MINUTES ■ JULY 12, 2001 ■ PAGE 2■ (b) Prohibit any land division, merger, or lot line adjustment that results in a parcel containing the two dwellings, which is less than twice the minimum parcel size requirement of the zone; (.c) Stipulate that any land division proposing to place the dwellings on separate parcels must meet all the zoning and development requirements for devising land in Butte County, including, but not limited to : lot size, lot configuration, septic requirements, and setback_ standards of the zone in which the parcel is located; (d) Stipulate that if all such zoning and development requirements cannot be met, the parcel shall not be divided. 2. The owner of the parcel or lot must occupy either the main dwelling or the Second Dwelling Unit. 3. Prior to receiving a building division permit the applicant shall obtain the required sewage disposal permit. 4. Construction, installation or development of structures or facilities on the parcels/lots shall comply with the latest California Fire Safe Regulations, (Public Resources Code 4290), and all other applicable State and County codes, ordinances and regulations in effect at the time of application for improvement permits. 5. Building identification and/or addresses shall be installed in conformance with Public Resources Code 4290 and shall be posted at the beginning of building construction and maintained continuously thereafter. 6. Applicant must also comply with all other applicable State and local statutes, ordinances and regulations. A copy of the recorded covenant shall be submitted to the Planning Division and the Building Division. The covenant shall be on a form approved by the Department of Development Services and shall: (a) Stipulate the occupancy requirement of Condition 2, below; (b) Prohibit any land division, merger, or lot line adjustment that results in a parcel containing the two dwellings, which is less than twice the minimum parcel size • • requirement of the zone; (c) Stipulate that any land division proposing to place the dwellings on separate parcels must meet all the zoning and development requirements for devising land in Butte County, including, but not limited to : lot size, lot configuration, septic requirements, and setback standards of the zone in which the parcel is located; (d) Stipulate that if all such zoning and development requirements cannot be met, the parcel shall not be divided. 2. The owner of the parcel or lot must occupy either the main dwelling or the Second Dwelling Unit. 3. The western half of the parcel is zoned SR -1 (Suburban Residential -1 acre minimum) with a General Plan Land Use designation of AR (Agricultural Residential). The eastern portion of the parcel is zoned FR -40 (Foothill Recreational -40 acre minimum) with a General Plan Land Use designation of GOL (Grazing & Open Land). ANALYSIS: The proposed project, a second dwelling unit, is to be located on the northern portion of the western half of the parcel. The site is in the SR -1 portion of the 38+/- acre parcel. The Second Dwelling Ordinance permits a second dwelling unit in a non -urban area when the parcel size meets at least twice the minimum parcel size stipulated by the zone. The applicant's property, in the proposed location of the second dwelling unit, is zoned SR -1 which has a minimum site requirement of 1 acre. Approximately half of the 38+/- acre parcel is in the SR -1 zone. The General Plan land use designation of Agricultural Residential provides for dwelling units at rural densities as a Primary Use. The application request is consistent with the Department of Fish & Game's deer designation which indicates the western portion of the parcel is not in any Deer Herd Area. No significant issues were raised by any departments or agencies. The Town of Paradise responded with questions regarding access to the parcel, adequate fire protection, and road improvements. Access to the second dwelling will be from the existing road which the applicant currently uses to get to his primary residence, i.e., Merrill Road. From inside the parcel, access to the second unit will be from an internal unimproved road. The County Department of Public Works did not have any comment on the project, nor did this Department require any internal road improvements. The California Department of Forestry requires the applicant to comply with the latest California Fire Safe Regulation, Public Resources Code 4290. CEQA ISSUES: This application for a Minor Use Permit to allow a Second Dwelling Unit is Categorically Exempt from environmental review under Section 15303 Class 3(a). Class 3 consists of construction and location of limited numbers of new, small facilities or structures. Subsection (a) includes: One single-family residence, or a second dwelling unit in a residential zone. ACTIONS FOR CONSIDERATION Staff recommends that the Planning Manager take the following actions: I.
