The property is located at 130 Summit Avenue, off of Lower Wyandotte and District Center Drive, Oroville. (SH) (MUP 01-18) It was moved by Commissioner Lambert, seconded by commissioner Mooney, and carried to approve the consent agenda subject to the findings and conditions listed below. , The project is exempt from the provisions of the California Environmental Quality Act under Section 15303 Class 3(a). Section 15303 consists of construction and location of limited numbers of new structures. II. Approve a Minor Use Permit for Bart & Yvette Castanon, subject to the conditions Exhibit A and the following findings and conditions: A. The proposed location, size, design, and operating characteristics of the proposed use is in accordance with the purpose of this Ordinance, the purpose of the zone in which the site is located, the Butte County General Plan, and the development policies and standards of the County because: Project conditions of approval have been applied to this project pursuant to the applicable requirements of Section 24-280(c) "Standards and Conditions outside of Urban Areas" for second dwelling units of the Butte County Zoning Code, the Butte County Environmental Health Department and Butte County Fire Department. The project is in accordance with the purpose of the zone in which the land lies and the Butte County General Plan because the project site is designated Agricultural Residential and zoned AR -5. The Agricultural Residential land use designation allows dwelling units as Secondary Uses. The AR -5 zone allows second dwelling units upon approval of a Minor Use, Permit. B. The location, size, design, and operating characteristics of the proposed use will be compatible with, and will not adversely affect, or be detrimental to adjacent uses, residents, buildings, structures, or natural resources, with consideration given to: Harmony in scale, bulk, coverage, and density: ' The project is in harmony with scale, bulk, coverage, and density because the second dwelling unit will not create a need for any additional structures beyond the request or alter any existing structures. 2. The availability of public facilities, services and utilities: The second dwelling unit will not create a need for new public facilities, services and utilities because water, telephone, gas, and electrical services already extend to the project parcel. The Environmental Health Department requires that the applicant be required to obtain the required sewage disposal permit prior to being issued the 0 BUTTE COUNTY PLANNING COMMISSION ■ MINUTES ■ JULY 26, 2001 ■ PAGE 1 ■ Minor Use Permit. The Butte County Fire Department requires compliance with standard California Fire Safe Regulations, Public Resources Code 4290. 3. The harmful effect, if any, upon desirable neighborhood character: The proposed second dwelling unit will not change the traditional.architectural style that is of a character consistent with an agricultural residential neighborhood. The second dwelling unit may lead to a minor increase in noise levels due to one additional family living on-site, and due to the increase in vehicle traffic, but this will not be significant. 4. The generation of traffic and the capacity and physical character of surrounding streets: The proposed second dwelling unit will not significantly increase vehicle traffic in the area nor will it create any vehicle circulation impacts. 5. The suitability of the site for the type and intensity of use or development which is proposed: The site has adequate area for off-site parking spaces for the residents of the second dwelling unit. 6. Any other relevant impact of the proposed use: The Planning Division has circulated the proposed second dwelling unit application to County Agencies and has received no evidence that the use will cause any other relevant impact. C. Based on the above findings, the proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or injurious to properties or improvements in the vicinity, because the dwelling unit will be located in a non- urban area, on a 23+/- acre parcel, more than the acreage required by the zoning classification in a sparsely populated area. , D. The proposed use will comply with each of the applicable provisions of the Chapter 24, Section 280 of the Butte County Code. Conditions of Approval: 1. Prior to issuance of a building permit for the second dwelling unit, the property owner shall execute and record a covenant running with the land. A copy of the recorded covenant shall be submitted to the Planning Division and the Building Division. The covenant shall be on a form approved by the Department of Development Services and shall: , (a) Stipulate the occupancy requirement of Condition 2, below; 0 BUTTE COUNTY PLANNING COMMISSION ■ MINUTES ■ JULY 26, 2001 ■ PAGE 2■ (b) Prohibit any land division, merger, or lot line adjustment that results in a parcel containing the two dwellings, which is less than twice the minimum parcel size requirement of the zone; (c) Stipulate that any land division proposing to place the dwellings on separate parcels must meet all the zoning and development requirements for devising land in Butte County, including, but not limited to : lot size, lot configuration, septic requirements, and setback standards of the zone in which the parcel is located; (d) . Stipulate that if all such zoning and development requirements cannot be met, the parcel shall not be divided. 2. The owner of the parcel or lot must occupy either the main dwelling or the Second Dwelling Unit 3. Prior to receiving Building Division permits, the applicant shall obtain the necessary septic permit from the Environmental Health Division. 4. Prior to building permit issuance for a new residential dwelling unit(s), the applicant shall pay all applicable development fees at the rate in effect at the time of acceptance of the application. Such fees, shall include, but not be limited to: Park Fee, School Fee, Drainage Fee, Permit and Plan Checking Fees, Water and Sewer Service Fees, and Fire Protection Fees. 5. Sincerely, Lynn Richardson Planning / Administrator Support Service Assistant lr BUTTE COUNTY PLANNING MANAGER AGENDA REPORT - July 11, 2001 Applicant: Bart & Yvette Castanon File #: MUP 01-18 Request: Minor Use Permit for a permanent Second Dwelling Unit G.P.: AR (Agricultural -Residential) Zoning: AR -5 APN: 027-020-027 Location: 130 Summit Avenue, off of Lower Wyandotte and District SUMMARY: Center Drive, Oroville. Parcel Size: 23+/- acres Zone date: April 14, 1998 Supervisor District: District 1 Attachments: A: Conditions of Approval B: Vicinity Map C: General Plan/Zoning Map D: Public Notice Map E: Site Plan Y Staff recommends approval of the Minor Use Permit with conditions. PROJECT DESCRIPTION/SITE CHARACTERISTICS: The applicant proposes to add a new 2,000 square foot dwelling to a 23+/ -'acre parcel. There is an existing double -wide mobile home on the property. The applicants propose to live in the dwelling while the wife's parents will continue to live in the existing dwelling. The new dwelling is proposed to become the second dwelling unit on the project site. The property is located on Summit Road, off of District Center Drive, on the south side of Lower Wyandotte Road, in the Oroville area. The property is located at approximately the 500 foot elevation. The project site is in a very high fire hazard area. It is in a State Response Area (SRA). The site is in a non -urban area. ANALYSIS: The property is zoned AR -5 (Agricultural Residential - 5 acre minimum). The AR -5 zone allows a second dwelling unit with approval of a Minor Use Permit. The Second Dwelling Ordinance permits a second dwelling unit in a non -urban area when the parcel size meets at least twice the minimum parcel size stipulated by the zone. The applicant's property is zoned AR -5 with a minimum parcel size of 5 acres. The applicant's property is approximately 23+/- acres in size. The ■ BUTTE COUNTY PLANNING MANAGER ■ AGENDA REPORT ■ 1 ■ Vi • 0 project site has a General Plan land use designation of Agricultural Residential (AR). The General Plan land use designation of AR provides for dwelling units as a Secondary Use. There are no known significant issues or areas of concern. The Building Division has responded to the application by requiring building permits for alterations, additions, or improvements to structure or utilities. Prior to receiving building permits, the Environmental Health Division requires the applicant to obtain the necessary septic permits. The California Department of Forestry requires the applicant to comply with Public Resources Code 4290. CEQA ISSUES: This application for a Minor Use Permit to allow a Second Dwelling Unit is Categorically Exempt from environmental review under Section 15303 Class 3(a). Class 3 consists of construction and location of limited numbers of new, small facilities or structures. Subsection (a) includes: One single-family residence, or a second dwelling unit in a residential zone. ACTIONS FOR CONSIDERATION Staff recommends that the Planning Manager take the following actions: I. Recommend that the Planning Commission find that the project is exempt from the provisions of the California Environmental Quality Act under Section 15303 Class 3(a). Section 15303 consists of construction and location of limited numbers of new structures. II. Recommend approval to the Planning Commission.of Minor Use Permit for Bart & Yvette Castanon, subject to the conditions found in Exhibit A and subject to the following findings: A. That the proposed location, size, design, and operating characteristics of the proposed use is in accordance with the purpose of this Ordinance, the purpose of the zone in which the site is located, the Butte County General Plan, and the development policies and standards of the County because: Project conditions of approval have been applied to this project pursuant to the applicable requirements of Section 24-280(c) "Standards and Conditions outside of Urban Areas" for second dwelling units of the Butte County Zoning Code, the Butte County Environmental Health Department and Butte County Fire Department. The project is in accordance with the purpose of the zone in which the land lies and the Butte County General Plan because the project site is designated Agricultural Residential and zoned AR -5. The Agricultural Residential land use designation allows dwelling units as Secondary Uses. The AR -5 zone allows second dwelling units upon approval of a Minor Use Permit. B. That the location, size, design, and operating characteristics of the proposed use will be compatible with, and will not adversely affect, or be detrimental to adjacent uses, residents, buildings, structures, or natural resources, with consideration given to: 0 BUTTE COUNTY PLANNING MANAGER ■ AGENDA REPORT ■ 2 ■ 1. Harmony in scale, bulk, coverage, and density: The project is in harmony with scale, bulk, coverage, and density because the second dwelling unit will not create a need for any additional structures beyond the request or alter any existing structures. 2. The availability of public facilities, services and utilities: The second dwelling unit will not create a need for new public facilities, services and utilities because water, telephone, gas, and electrical services already extend to the project parcel. The Environmental Health Department requires that the applicant be required to obtain the required sewage disposal permit prior to being issued the Minor Use Permit. The Butte County Fire Department requires compliance with standard California Fire Safe Regulations, Public Resources Code 4290. 3. The harmful effect, if any, upon desirable neighborhood character: The proposed second dwelling unit will not change the, traditional architectural style that is of a character consistent with an agricultural residential neighborhood. C. Based on the above findings, the proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or injurious to properties or improvements in the vicinity, because the dwelling unit ■ BUTTE COUNTY PLANNING MANAGER 0 AGENDA REPORT ■ 3 ■ will be located in a nonurban area, on a 23+/- acre parcel, more than the acreage required by the zoning classification in a sparsely populated area. D. The proposed use will comply with each of the applicable provisions of the Chapter 24, Section 280 of the Butte County Code. ■ BUTTE COUNTY PLANNING MANAGER ■ AGENDA REPORT ■ 4 ■ • EXHIBIT A MINOR USE PERMIT BUTTE COUNTY PLANNING COMMISSION • DATE: (Certified Mail Rec.)
