APN 036-160-046 (SB) (MUP 02-04) It was moved by Commissioner Mooney, seconded by Commissioner Marin, and unanimously carried to approve the Minor Use Permit for SiteCom for Metro PCS, MUP 02-04, subject to the following findings and conditions: I. Recommend that the Planning Commission find that the project is exempt from the provisions of the California Environmental Quality Act under Section 15311. Section 15311 consists of construction of minor structures accessory (appurtenant) to existing commercial facilities. Antennas colocated on an existing tower are considered to be accessory structures. Il. Recommend approval to the Planning Commission of Minor Use Permit 02-04 for SiteCom for Metro PCS, subject to the following findings and the conditions in Exhibit "A:" A. The proposed location, size, design, and operating characteristics of the proposed use is in accordance with the purpose of this Ordinance, the purpose of the zone in which the site is located, the Butte County General Plan, and the development policies and standards of the County because: Conditions of approval have been applied to this project pursuant to the applicable requirements of Section 24-262 (Wireless Communication Facilities). The project is in accordance with the purpose of the zone in which the land lies and the Butte County General Plan because the project site is designated Public and is. zoned P -Q. The Public land use designation allows public utilities as Secondary Uses. The P -Q zone allows colocation of communication facilities with approval of a Minor Use Permit. B. The location, size, design, and operating characteristics of the proposed use would be compatible with, and would not adversely affect, or be detrimental to adjacent uses, residents, buildings, structures, or natural resources, with consideration given to: 1. Harmony in scale, bulk, coverage, and density: The proposed antennas will not increase the height of the existing monopole or extend beyond -the existing antennas. 2. The availability of public facilities, services and utilities: Electrical power service is already established to the property and no additional services or utilities are required. ■ BUTTE COUNTY PLANNING COMMISSION 0 MINUTES 0 OCTOBER 11, 2001 ■ PAGE 21 ■ ; 3. The harmful effect, if any, upon desirable neighborhood character The project site is already developed with a 152 foot tall monopole. The proposed antennas to be mounted on the existing monopole would not have a harmful effect upon the neighborhood character. The radio- que,ncy, emissions from the proposed antennas must meet FCC standards. Only a minor amount of vehicle traffic would be generated during installation of the antennas and equipment cabinets. The communications facility is unmanned and only one to two site visits per month will be required after construction. 5. The suitability of the site for the type and intensity of use or development which is proposed: The site is ideally suited for the project because the proposed antennas will be mounted on the existing 152 foot tall monopole. The project would not have an impact to any agricultural operations or to the cemetery use. 6. Any other relevant impact of the proposed use: The Planning Division has circulated the proposed communication facility application to County Agencies and has received no evidence that the use would cause any other relevant impact. C. Based on the above findings, the proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it would be operated or maintained would not be detrimental to the public health, safety, or welfare, or injurious to properties or improvements in the vicinity. D. The proposed use shall comply with each of the applicable provisions of the Chapter 24, Section 262, of the Butte County Code. E. This project will colocate antennas on an existing communications tower, which eliminates the need for a new communications tower to be erected elsewhere in the project area. Conditions of Approval: Planning Division: 1. The new antennas and mounting hardware shall be painted to match the color of the existing monopole. 2. Radio-frequency emissions from the proposed antennas shall not interfere with the City of Oroville's public service communications. The Facility must meet or fall within current standards and regulations of the FAA, the FCC, the County, and any other agency of the Federal or State government with the authority to regulate such Facilities. 4. The installation of the Facility shall comply with all applicable building and electrical codes. The Facility operator shall submit certification from a registered structural engineer to the Building Division, that all associated monopoles and towers in excess of thirty (30) feet in height will withstand sustained winds as required by the Uniform Building Code. 5. No advertising or display shall be permitted on the Facility. 6. The placement of any antenna or structure shall not adversely affect any on-site sewage disposal . system or its repair area without written approval from the Division of Environmental Health. 7. The installation of the Facility shall not violate any existing deed restrictions. 8. The Facility shall have a twelve (12) foot wide all-weather access to a publicly maintained road capable of supporting a forty thousand (40,000) -pound fire apparatus with fifteen (15) feet of vertical clearance. 9. There shall be no outdoor vehicle or equipment storage except for emergency purposes. 10. The Facility shall fall within current standards and regulations of the FAA, the FCC, and any other State and/or Federal agency with the authority to regulate such Facility. If such standards and regulations are changed, the property owner or responsible party shall bring the Facility into compliance with such revised standards and regulations within ninety (90) days of the effective date of such standards and regulations, unless a more stringent compliance schedule is mandated by the controlling agency. 11. The Facility or combination of the Facilities on the site shall not generate, at any time, electromagnetic frequency radiation (EMF) or radio frequency radiation (RF) in excess of the FCC adopted standards for human exposure, as amended over time. 12. If it is found that the Facility is or will be detrimentaloto the health, safety, or welfare of persons working or residing near such facility, then the service provider(s) and property owner shall be jointly and solely responsible for the removal, adjustment, or replacement of the Facility. In no case shall the Facility remain in operation if it is found to create a hazard to health, safety, and welfare. The Facility shall not be found to create a hazard to health, safety, or welfare as a result of EMF or RF emissions from the Facility so long as it meets all current standards established by the FCC, pursuant to FCC OET 65. Prior to issuance of the building permit for the installation of the Facility, the applicant shall ■ BUTTE COUNTY PLANNING COMMISSION ■ MINUTES 0 OCTOBER 11, 2001 ■ PAGE 23 0 post a performance security in an amount and form determined by the Director, of Development Services that is sufficient to cover the cost of a one-time test by a radio frequency consultant selected by the County, sufficient to determine whether the Facility's RF/EW emissions comply with FCC standards. If the Facility's emissions are determined to exceed FCC standards, the applicant is required to pay for such other tests and other corrective measures as are necessary to establish compliance with FCC OET 65 and its successors and such noncompliance shall constitute sufficient grounds to commence a permit revocation hearing which may lead to permit revocation. The applicant shall cooperate in all respects with the County's consultant to assist the consultant to reach his/her conclusion. 13. All Facilities that are not in continual use for a period of six (6) months shall be considered abandoned. Abandoned Facilities are hereby designated as unlawful and as public nuisances, requiring no amortization period. If the Director of Development Services determines that the Facility is abandoned, the applicant may be required to remove all equipment belonging to the applicant from the premises and return the site to its original condition within thirty (30) calendar days of receipt of notice to abate. If such Facility is not removed and the site returned to its original condition within thirty (30) days, the County may remove the Facility at the applicant's and/or land owner's joint and several expense. 14. All ground level support Facilities shall be painted and/or screened from view with adequate landscaping appropriate to the surrounding environment. All aesthetic treatments, including landscaping shall be maintained as approved for the life of the Facility. 15. The Facility may not encroach into, under, over, above, or upon any public street in the unincorporated area of the County in the absence of a valid encroachment permit from the County. 16. The owner/operator of the Facility shall annually submit a written verification, attested to under penalty of perjury, signed by both the owner/operator and an FCC licensee in the employ of or retained by the owner/operator, that the radio frequency radiation/electromagnetic frequency (RF/EMF) emitted by the facility conforms to safety standards set forth in FCC OET 65. The reports prepared for the Facility shall conform to reporting requirements set by the FCC and the County. The reports shall be submitted to the Planning Division no later than January 31 of each year. 17. . The Facility shall be secured at all times to prevent access by the public. 18. The project site shall be developed in accordance with the approved project site plan and the conditions contained herein. Said site plan is on file in the Planning Division, is identified as "Exhibit E" and date-stamped July 20, 2001, and is incorporated herein by this reference. 19. Prior to use of this project, the applicant shall contact the Planning Division for a field inspection to verify all conditions of approval and ordinance requirements have been met. 20. Building permits are required. Provide plans and calculations prepared, sealed, and signed by a California licensed architect or registered engineer verifying adequacy of existing tower with addition of antennas. The property is zoned P -Q (Public - Quasi Pubic) and is located in the Oroville Memorial Cemetery, at 5646 Lincoln Boulevard, Oroville. APN 036-160-046 (SB) (MUP 02-04) Mr. Betts gave a brief summary of the project noting that the Radio Frequency Analysis was performed and were below the FCC requirements. The City of Oroville has requested a condition that this antenna not interfere with their radio tower which is 300 feet form this location. Condition 2 addresses the concern submitted by the City of Oroville. The hearing was opened to the public. Lisa Burke agreed to the recommended conditions. The hearing was closed. Mr. Meleka concurred with staff's recommendation to approve this Minor Use Permit for SiteCom, MUP 02-04, subject to the findings and conditions listed below: I. IF INSUFFICIENT INFORMATION IS SUBMITTED, THE APPLICATION WILL BE DEEMED INCOMPLETE. 4 The use of best available technology and/or construction to maximally achieve visual unobtrusiveness is mandatory. 16. ❑6- ❑ Applicants which operate common carrier facilities (specifically, but not Iimited to cellular, PCS, SMR and paging service licensees of the FCC) shall provide written evidence that the applicant has provided notice to all FCC licensed wireless communication service carriers operating within the County of Butte of the plans to develop the site. 17. Ltd" Evidence of a valid, current operating license or construction permit from the FCC or, if the applicant is not a wireless communications service provider, a user operating agreement for each and every such provider to which the applicant intends to rent space on the proposed Facility. 18. Ltd A report, signed by a qualified radio frequency engineer licensed by the FCC, prepared pursuant to FCC OET 65, stating whether the maximum radio frequency radiation/electromagnetic radiation (RF/EMF) to be emitted by the proposed Facility, taking into account all other Facilities, both existing and known future Facilities, at the proposed site and adjacent properties, conforms to safety standards adopted by the FCC, if applicable. The reports prepared for Facilities shall conform to the reporting requirements set by the County and FCC OET 65 human exposure standards. The report shall also analyze the evidence provided in support of the proposed Facility location, height and radiated power, frequency, the number of channels, and all other related data and present alternatives for the location, height and radiated power, pursuant to the requirements of this section. If the proposed Facility exceeds FCC OET 65 human exposure standards, applicant shall also provide additional comprehensive technical and planning information regarding how the applicant shall protect all persons from such excessive exposure consistent with all Federal and State requirements, and any additional County requirements. 19. ❑ Landscaping and painting plans for the completed project. 20. ❑U�,a ❑ Prot s in Agricultural Zones (A-5 through A-160) shall, prior to submitting an application for a proposed Facility, submit a site plan of the proposed Facility to the Butte County Agricultural Commissioner for comment and send a notification letter to all aerial agricultural applicators registered in the County informing them of the proposed site location and tower height. No hearing on an application for a proposed facility in any agricultural zone will be scheduled, nor shall any Administrative Permit for any such facility be issued without proof that the Butte County Agricultural Commissioner and all aerial agricultural applicators registered in the County have been notified, as specified herein. Unless otherwise provided for in a special condition to this use permit, all conditions must be completed prior to or concurrently with the establishment of the granted use. The use granted by this permit must be established within 12 months of the date of approval. 3. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 4. If any use for which a Minor Use Permit has been granted is not established within one year of the date of approval, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. A Minor Use Permit subject to lapse may be renewed for an additional period of up to one year, provided that sixty (60) calendar days prior to the expiration date, an application for renewal of the Minor Use Permit is filed with the Planning Division on the prescribed form and accompanied by the necessary data and fees. ' 5. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. 1 6. Neither the applicant, nor any agent nor representative of the applicant shall intentionally omit or misrepresent any material fact in connection with the application. Any alleged material misrepresentation shall constitute grounds for the Director of Development Services to commence a revocation hearing, and, if proven to exist, shall constitute sufficient grounds to revoke a permit. Conditions of Approval: Planning Division: 1.. The new antennas and mounting hardware shall be painted to match the color of the existing monopole. 2. Radio-frequency emissions from the proposed antennas shall not interfere with the City of Oroville's public service communications. The applicant shall mitigate any degradation to the City of Oroville's public service communications either through modification or cessation as necessary to maintain pre -project levels of service. 3. The Facility must meet or fall within current standards and regulations of the FAA, the FCC, the County, and any other agency of the Federal or State government with the authority to regulate such Facilities. 4. The installation of the Facility shall comply with all applicable building and electrical codes. The Facility operator shall submit certification from a ,registered structural engineer to the Building Division, that all associated monopoles and towers in excess of thirty (30) feet in height will withstand sustained winds as required by the Uniform Building Code. 5. No advertising. or display shall be permitted on the Facility. 6. The placement of any antenna or structure shall not adversely affect any on-site sewage disposal system or its repair area without written approval from the Division of Environmental Health. 7. The installation of the Facility shall not violate any existing deed restrictions. 8. The Facility shall have a twelve (12) foot wide all-weather access to a publicly maintained road capable of supporting a forty thousand (40,000) -pound fire apparatus with fifteen (15) feet of vertical clearance. 9. There shall be no outdoor vehicle or equipment storage except for emergency purposes. 10. The Facility shall fall within current standards and regulations of the FAA, the FCC, and any other State and/or Federal agency with the authority to regulate such Facility. If such standards and regulations are changed, the property owner or responsible party shall bring the Facility into compliance with such revised standards and regulations within 0 r- ninety (90) days of the effective date of such standards and regulations, unless a more stringent compliance schedule is mandated by the controlling agency. 11. The Facility or combination of the Facilities on the site shall not generate, at any time, electromagnetic frequency radiation (EMF) or radio frequency radiation (RF) in excess of the FCC adopted standards for human exposure, as amended over time. 12. If it is found that the Facility is or will be detrimental to the health, safety, or welfare of persons working or residing near such facility, then the service provider(s) and property owner shall be jointly and solely responsible for the removal, adjustment, or replacement of the Facility. In no case shall the Facility remain in operation if it is found to create a hazard to health, safety, and welfare. The Facility shall not be found to create a hazard to health, safety, or welfare as a result of EMF or RF emissions from the Facility so long as it meets all current standards established by the FCC, pursuant to FCC OET 65. Prior to issuance of the building permit for the installation of the Facility, the applicant shall post a performance security in an amount and form determined by the Director of Development Services that is sufficient to cover the cost of a one-time test by a radio frequency consultant selected by the County, sufficient to determine whether the Facility's RF/EMF emissions comply with FCC standards. If the Facility's emissions are determined to'exceed FCC standards, the applicant is required to pay for such other tests and other corrective measures as are necessary to establish compliance with FCC OET 65 and its successors and such noncompliance shall constitute sufficient grounds to commence a permit revocation hearing which may lead to permit revocation. The applicant shall cooperate in all respects with the County's consultant to .assist the consultant to reach his/her conclusion. 13. All Facilities that are not in continual use for a period of six '(6) months shall be considered abandoned. Abandoned Facilities are hereby designated as unlawful and as public nuisances, requiring no amortization period. If the Director of Development Services determines that the Facility is abandoned, the applicant may be required to remove all equipment belonging to the applicant from the premises and return the site to its original condition within thirty (30) calendar days of receipt of notice to abate. If such Facility is not removed and the site returned to its original condition within thirty (30) days, the County may remove the Facility at the applicant's and/or land owner's joint and several expense. 14. All ground level support Facilities shall be painted and/or screened from view with adequate landscaping appropriate to the surrounding environment. All aesthetic treatments, including landscaping shall be maintained as approved for the life of the Facility. 3 15. The Facility may not encroach into, under, over, above, or upon any public street in the unincorporated area of the County in the absence of a valid encroachment permit from the County. . 16. The owner/operator of the Facility shall annually submit a written verification, attested to under penalty of perjury, signed by both the owner/operator and an FCC licensee in the employ of or retained by the owner/operator, that the radio frequency radiation/electromagnetic frequency (RF/EMF) emitted by the facility conforms to safety standards set forth in FCC OET 65. The reports prepared for the Facility. shall conform to reporting requirements set by the FCC and the County. The reports shall be submitted to the Planning Division no later than January 31 of each year. 17. The Facility shall be secured at all times to prevent access by the public. 18. The project site shall be developed in accordance with the approved project site plan and the conditions contained herein. Said site plan is on file in the Planning Division, is identified as "Exhibit E" and date-stamped July 20, 2001, and is incorporated herein by this reference. 19. A Minor Use Permit was approved in 2000 to collocate the six -panel antennas on the monopole. ANALYSIS: General Plan and Zoning: The project site is designated as Public by the Land Use Element Map of the General Plan, which allows public uses as secondary uses (note: cellular phone service providers are considered a public utility). Section 24-216 of Butte County Code states that wireless communication facilities are not permitted in the P -Q zone unless a Minor Use Permit is obtained, subject to the requirements of Butte County Code Section 24-262. The Wireless Communication Facilities Ordinance (Butte County Code Section 24-262) allows colocation on existing facilities in the P -Q zone with approval of a Minor Use Permit, subject to numerous requirements. The project has been conditioned to meet the requirements of Section 24-262, including: • Submittal of bonds to cover the costs of a one-time radio-frequency analysis. • Radio-frequency emissions in excess of FCC standards are not allowed. • Facilities that are not in continual use for a period of six (6) months shall be considered to be abandoned. • Verification submitted annually attesting that the radio frequency radiation/ electromagnetic frequency (RF/EMF) emitted by the facility conforms to safety standards set forth in FCC OET 65. • Access to the site must be at least 12 feet wide and capable of supporting a 40,000 pound fire apparatus. The additional antennas mounted on the existing monopole will not create a significant aesthetic impact. The antennas will not increase the height of the monopole, nor will the additional antennas extend horizontally beyond the existing antennas. A photo simulation of the proposed antennas on the existing monopole shows that the antennas will not be highly conspicuous. A radio-frequency analysis was prepared for the proposed antennas to ensure compliance with the appropriate Federal guidelines for human exposure to radio frequency or electromagnetic fields. The analysis determined that the maximum ambient RF level anywhere at ground level would be less than 2% of the applicable public exposure limit. The existing monopole and support equipment are located on private property and are surrounded by a six-foot tall fence with three strands of barbed wire on top. Access to the communications facility is limited to company personnel. The City of Oroville commented on this project and stated that the City maintains a radio tower, located approximately 300 feet from the site, which transmits radio communications for the City's police and fire departments. The City is concerned that radio-frequency emissions from the proposed antennas may interfere with their public safety communications and recommends that the project be conditioned to require the applicant to mitigate any degradation of communications service on the City's tower. The project is conditioned per the City of Oroville's recommendation. ACTIONS FOR CONSIDERATION: Staff recommends that the Planning Manager take the following actions: I. Recommend that the Planning Commission find that the project is exempt from the provisions of the California Environmental Quality Act under Section 15311. Section 15311 consists of construction of minor structures accessory (appurtenant) to existing commercial facilities. Antennas colocated on an existing tower are considered to be accessory structures. II. Recommend approval to the Planning Commission of Minor Use Permit 02-04 for SiteCom for Metro PCS, subject to the following findings and the conditions in Exhibit «A.„ A. The proposed antennas to be mounted on the existing monopole would not have a harmful effect upon the neighborhood character. Only a minor amount of vehicle traffic would be generated during installation of the antennas and equipment cabinets. Any other relevant impact of the proposed use: The Planning Division has circulated the proposed communication facility application to County Agencies and has received no evidence that the use would cause any other relevant impact. Any alleged material misrepresentation shall constitute grounds for the Director of Development Services to commence a revocation hearing, and, if proven to exist, shall constitute sufficient grounds to revoke a permit. The Facility must meet or fall within current standards and regulations of the FAA, the FCC, the County, and any other agency of the Federal or State government with the authority to regulate such Facilities. 4. The installation of the Facility shall comply with all applicable building and electrical codes. The Facility operator shall submit certification from a registered structural engineer to the Building Division, that all associated monopoles and towers in excess of thirty (30) feet in height will withstand sustained winds as required by the Uniform Building Code. 5. No advertising or display shall be permitted on the Facility. 6. The placement of any antenna or structure shall not adversely affect any on-site sewage disposal system or its repair area without written approval from the Division of Environmental Health. 7. The installation of the Facility shall not violate any existing deed restrictions. 8. The Facility shall have a twelve (12) foot wide all-weather access to a publicly maintained road capable of supporting a forty thousand (40,000) -pound fire apparatus with fifteen (15) feet of vertical clearance. 9. The Facility shall fall within current standards and regulations of the FAA, the FCC, and any other State and/or Federal agency with the authority to regulate such Facility. The Facility or combination of the Facilities on the site shall not generate, at any time, electromagnetic frequency radiation (EMF) or radio frequency radiation (RF) in excess of the FCC adopted standards for human exposure, as amended over time. 12. If it is found that the Facility is or will be detrimental to the health, safety, or welfare of persons working or residing near such facility, then the service provider(s) and property owner shall be jointly and solely responsible for the removal, adjustment, or replacement of the Facility. In no case shall the Facility remain in operation if it is found to create a hazard to health, safety, and welfare. The Facility shall not be found to create a hazard to health, safety, or welfare as a result of EMF or RF emissions from the Facility so long as it meets all current standards established by the FCC, pursuant to FCC OET 65. Prior to issuance of the building permit for the installation of the Facility, the applicant shall post a performance security in an amount and form determined by the Director of Development Services that is sufficient to cover the cost of a one-time test by a radio frequency consultant selected by the County, sufficient to determine whether the Facility's RF/EMF emissions comply with FCC standards. If the Facility's emissions are determined to exceed FCC standards, the applicant is required to pay for such other tests and other corrective measures as are necessary to establish compliance with FCC OET 65 and its successors and such noncompliance shall constitute sufficient grounds to commence a permit revocation hearing which may lead to permit revocation. The applicant shall cooperate in all respects with the County's consultant to assist the consultant to reach his/her conclusion. 13. All Facilities that are not in continual use for a period of six (6) months shall be considered abandoned. Abandoned Facilities are hereby designated as unlawful and as public nuisances, requiring no amortization period. If the Director of Development Services determines that the Facility is abandoned, the applicant may be required to remove all equipment belonging to the applicant from the premises and return the site to its original condition within thirty (30) calendar days of receipt of notice to abate. If any use for which a Minor Use Permit has been granted is not established within one year of the date of approval, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. 6. Any alleged material misrepresentation shall constitute grounds for the Director of Development Services to commence a revocation hearing, and, if proven to exist, shall constitute sufficient grounds to revoke a permit. Conditions of Approval: Planning Division: 1. The new antennas and mounting hardware shall be painted to match the color of the existing monopole. 2. Radio-frequency emissions from the proposed antennas shall not interfere with the City of Oroville's public service communications. The applicant shall mitigate any degradation to the City of Oroville's public service communications either through modification or cessation as necessary to maintain pre -project levels of service. 3. The Facility must meet or fall within current standards and regulations of the FAA, the FCC, the County, and any other agency of the Federal or State government with the authority to regulate such Facilities. . 4. The installation of the Facility shall comply with all applicable building and electrical codes. The Facility operator shall submit certification from a registered structural engineer to the Building Division, that all associated monopoles and towers in excess of thirty (30) feet in height will withstand sustained winds as required by the Uniform Building Code. 5. No advertising or display shall be permitted on the Facility. 6. The placement of any antenna or structure shall not adversely affect any on-site sewage disposal system or its repair area without written approval from the Division of Environmental Health. 7. The installation of the Facility shall not violate any existing deed restrictions. 8. The Facility shall have a twelve (12) foot wide all-weather access to a publicly maintained road capable of supporting a forty thousand (40,000) -pound fire apparatus with fifteen (15) feet of vertical clearance. 9. The Facility shall. fall within current standards and regulations of the FAA, the FCC, and any other State and/or Federal agency with the authority to regulate such Facility. If such standards and regulations are changed, the property owner or responsible party shall bring the Facility into compliance with such revised standards and regulations within ninety (90) days of the effective date of such standards and regulations, unless a more stringent compliance schedule is mandated by the controlling agency. 11. The Facility or combination of the Facilities on the site shall not generate, at any time, electromagnetic frequency radiation (EMF) or radio frequency radiation (RF) in excess of the FCC adopted standards for human exposure, as amended over time. 12. If it is found that the Facility is or will be detrimental to the. health, safety, or welfare of persons working or residing near such facility, then the service provider(s) and property owner shall be jointly and solely responsible for the removal, adjustment, or replacement of the Facility. In no case shall the Facility remain in operation if it is found to create a hazard to health, safety, and welfare. The Facility shall not be found to create a hazard to health, safety, or welfare as a result of EMF or RF emissions from the Facility so long as it meets all current standards established by the FCC, pursuant to FCC OET 65. Prior to issuance of the building permit for the- installation of the Facility, the applicant shall post a performance security in an amount and form determined by the Director of Development Services that is sufficient to cover the cost of a one-time test by a radio frequency consultant selected by the . County, sufficient to determine whether the Facility's RF/EMF emissions comply with FCC standards. If the Facility's emissions are determined to exceed FCC standards, the applicant is required to pay for such other tests and other corrective measures as are necessary to establish compliance with FCC OET 65 and its successors and such noncompliance shall constitute sufficient grounds to commence a permit revocation hearing which may lead to permit revocation. The applicant shall cooperate in all respects with the County's consultant to assist the consultant to reach his/her conclusion. 13. All Facilities that are not in continual use for a period of six (6) months shall be considered abandoned. Abandoned Facilities are hereby designated as unlawful and as public nuisances, requiring no amortization period. If the Director of Development Services determines that the Facility is abandoned, the applicant may be required to remove all equipment belonging to the applicant from the premises and return the site to its original condition within thirty (30) calendar days of receipt of notice to abate. If such Facility is not removed and the site returned to its original condition within thirty (30) days, the County may remove the Facility at the applicant's and/or land owner's joint and several expense. ■ BUTTE COUNTY PLANNING COMMISSION AGENDA REPORT ■ PAGE 8 ■ 14. All ground level support Facilities shall be painted and/or screened from view with adequate landscaping appropriate to the surrounding environment. The Facility may not encroach into, under, over, above, or upon any public street in the unincorporated area of the County in the absence of a valid encroachment permit from the County. 16. The owner/operator of the Facility shall annually submit a written verification, attested to under penalty of perjury, signed by both the owner/operator and an FCC licensee in the employ of or retained by the owner/operator, that the radio frequency radiation/electromagnetic frequency (RF/EMF) emitted by the facility conforms to safety standards set forth in FCC OET 65. The reports prepared for the Facility shall conform to reporting requirements set by the FCC and the County. The reports shall be submitted to the Planning Division no later than January 31 of each year. 17. The Facility shall be secured at all times to prevent access by the public. 18. The project site shall be developed in accordance with the approved project site plan and the conditions contained herein. Watershed Conservancy School Districts • • PROJECT DESCRIPTION/JUSTIFICATION STATEMENT METRO PCS SITE - SAC -C21-084 APN# 036-160-046 Project Descriution In order to provide personal communications services to the County of Butte and surrounding area, Metro PCS, respectfully requests approval of its application for a Minor Use Permit to construct and operate a personal communication service (PCS) system facility at the property known as 5646 Lincoln Blvd, Oroville, California. The facility will be comprised of nine (9) antennas mounted at 125 feet on an existing 152' monopole. A concrete pad with up to 7 equipment cabinets plus power and telco will be located to adjacent to the pole to house the necessary electronic equipment. The equipment cabinets are each approximately 30" x 40" x 72" high. Background Metro PCS, Inc. is a privately held telecommunications service provider that has been authorized by the Federal Communications Commission to provide Personal Communication Services (PCS) in the Butte County area. The Company plans to implement an innovative and affordable pricing structure to capitalize on wireless customers' sensitivity to price. The Company believes that a substantial market opportunity exists to essentially eliminate the pricing gap between existing heavy usage cellular airtime and wire line telephone rates. Relative to current wireless service packages, Metro PCS expects to offer service packages that include large blocks of minutes consisting of anytime airtime at significantly lower effective prices per minute. Justification Statement Metro PCS is requesting a Minor Use Permit to add antennas to an unmanned telecommunications facility located at 5646 Lincoln Blvd. The entitlement is requested in accordance with the guidelines set forth in the zoning code regarding wireless communication facilities. The proposed antenna panels will be co -located on an existing monopole; will be attached below the topmost existing antenna array; and will blend in visually to the monopole. System Benefits Metro PCS's telecommunications facility will provide Personal Communication Services to the residents of the Butte County area. This service will be offered to local police, fire, and public safety entities as well as to the local businesses and the general public. The proposed site located at 5646 Lincoln Blvd in the County of Butte is part of a network that will cover Northern California. Metro PCS's goal is to provide service to the Butte County area in the fall of 2001. Environmental Imvacts The Metro PCS communication facility will result in no significant impacts to the environment or the area in which it is located. The unmanned facility (visited on an average of twice per month for routine maintenance purposes) will not be lit, nor emit noise or glare and will not interfere with television or radio reception. The subject site will be such that the location, size, design, and operating characteristics of the proposed facility will be compatible with and will not adversely affect the livability or appropriate development of adjacent parcels and the surrounding area. Therefore, the proposed site will have no adverse impact upon the existing land use. JUL 202001 00 BUTTE COUNTY PLANNING DIVISION Power Density A power density study has been prepared for this site and it includes all the existing antennas and the proposed antennas. The study shows that the proposed facility will operate at 2% of the Federal Safety Standard. Metro PCS will use one channel for the Butte County area initially.
