Public Notice Map APN: 007-340-021 E: Site Plan Location: 460 Mojave Court, off of Silverbell, in the north Chico area SUMMARY: Staff recommends approval of the Minor Use Permit with conditions. PROJECT DESCRIPTION/SITE CHARACTERISTICS: This is a proposal to change the ownership of an existing large family day care. Approval. of a Minor Use Permit will allow the applicant to care for 12 or fewer children. Per Butte County Zoning Code Section 24-265(b)(2) large family day care centers may have up to twelve (12) children. The recently changed state law sets new limits of eight (8) children for small day care centers and fourteen (14) for large family day care centers. The County Code has not been changed to reflect these new limits. This proposal is being processed under the existing County Code and at such time as the code is revised to the new state standards, the limits on the allowed number of children may be administratively adjusted for existing small and large child care centers. The project site is located at 460 Mojave Court, off of Silverbell, in the north Chico area. The parcel is developed with a single family home, approximately 1124 square feet in size, on an urban sized 0 BUTTE COUNTY PLANNING MANAGER 0 AGENDA REPORT 0 1 ■ residential lot of approximately 0.29 acre. The property has 5 -foot and 6 -foot high fencing completely around the child care areas. The project is located on a cul-de-sac, off of a minor residential street, in a neighborhood characterized by urban residential development. There are similar sized parcels bordering the property. Parcel size ranges from varying from 0.25 -acre to 0.45 -acre. Access to the dwelling is from Mojave Court. Domestic water is supplied by Cal Water. The dwelling has a septic system. The applicant lives in the residence and is currently the primary care provider. With approval for a large day care facility, the applicant proposes to have as many as twelve (12) children, with two additional full-time employees. The residential neighborhood in which the project is located is bordered by State Route 99 on the west and Eaton Avenue on the north. The project site is not located in a 100 -year floodplain. There is adequate parking in the front of the residence, with approximately 40+ feet depth from the right-of-way on Mojave Court, and approximately 85 foot distance along the frontage. ANALYSIS: The property is zoned R-1 (Residential) and has a General Plan land use designation of LDR (Low Density Residential). The R-1 zoning classification allows large family day care facilities with approval of a Minor Use Permit and subject to the requirements of Section 24-265 of the Zoning Code. The General Plan states that the Primary Use of the Low Density Residential land use designation is single family homes at urban densities. Secondary Uses include group quarters and care homes. Butte County Code Section 24-265(e)(2) requires that new large family day care centers be located at least 500 feet driving distance from any other large family day care center. Staff conducted an analysis of the location of other large family day care centers in the area of the project and determined that there are no other similar facilities in the area. This facility will not cause any residence to be bounded on more than one side with a large family day care center. There is sufficient area for off-street parking for the residents of the dwelling, one or more employees, and for drop-off and pick-up of children. Located on a standard cul-de-sac, the project location provides a measure of traffic safety during drop-off and pick-up times that a grid -type street does not provide. The site access road, Silverbell Road, is a County -maintained road that serves the project site and the neighboring residences. The Butte County Environmental Health Department recommends. approval with a condition that the applicant shall maintain the septic system in compliance with Butte County ordinance. The Butte County Fire Department requires standard conditions to comply with Public Resources Code 4290. Currently, there is an existing large family day care at this location. The ownership of the residence is changing. While meeting state requirements for licensing for a large day care facility, the applicants are requesting a Minor Use Permit to continue the same use as has been present at this location since November 1994. The current day care has been in operation for seven years with the same size as proposed in this application. Therefore, no increase in noise levels is anticipated due to children playing outside or any increase in vehicle traffic. Noise from children playing outside will continue to be at approximately the same level as compared to the present day care facility. The vehicle traffic generated by the proposed large day care facility will also continue to be at approximately the current level since no change in the size of the operation is proposed. ■ BUTTE COUNTY PLANNING MANAGER ■ AGENDA REPORT ■ 2 ■ CEQA ISSUES: This application for a Minor Use Permit to allow a large family day care is Categorically Exempt from environmental review under Section 15305(Class 5). ACTIONS FOR CONSIDERATION Staff recommends that the Planning Manager take the following actions: I. Find that the project is Categorically Exempt from environmental review pursuant to CEQA Section 15305 (Class 5), which states that minor alterations in land use limitations can be approved in areas with an average slope of less than 10 percent and that do not result in any change in land use, and pursuant to CEQA Section 15300.2(a), which allows for Class 5 exemptions upon consideration of where the project is located and ensuring that the project is not located in any particularly sensitive environment, as supported by the following: A. The project involves a modification to the uses permitted within a Residential zone, does not involve a change in land use, and, therefore, qualifies as a minor alteration of a land use limitation. B. The proposed change in ownership of the current large day care facility does not result in any change in land use. C. The property's slope is level and does not exceed 20 percent. D. The project is not located in an area of any particularly sensitive environment. II. Recommend approval to the Planning Commission for a Minor Use Permit for Josh Woolf and/or Amy McNeill for a large family day care facility for 12 or fewer children, MUP 02-05, on APN 007-340-021, based on the following findings and the conditions found in Exhibit "A": A. The location, size, design, and operating characteristics of the proposed use will be compatible with, and will not adversely affect, or be detrimental to adjacent uses, residents, buildings, structures, or natural resources, with consideration given to: . Harmony in scale, bulk, coverage, and density: The project is in harmony with scale, bulk, coverage, and density because the large family day care facility will not create a need for any new structures or an alteration to any existing structures. 2. The availability of public facilities, services, and utilities: The large day care facility will not create a need for new public facilities, services, and utilities because water, telephone, gas, and electrical services already extend to the project parcel. The project site is provided with ■ BUTTE COUNTY PLANNING MANAGER ■ AGENDA REPORT ■ 3 0 municipal water and existent septic facilities. The Butte County Fire Department requires compliance with State Fire Marshall requirements for large day care facilities. 3. The harmful effect, if any, upon desirable neighborhood character: The proposed large day care facility will not change the traditional architectural style that is of a character consistent with an urban residential neighborhood. The large day care facility will not lead to any increases in. noise levels due to children playing outside, increase in vehicle traffic, as the large family day care use is currently exists and has existed at this location for the past seven years. 4. The generation of traffic and the capacity and physical character of surrounding streets: The proposed large day care facility will not significantly increase vehicle traffic in the area, nor will it create any vehicle circulation impacts. 5. The suitability of the site for the type and intensity of use or development which is proposed: The site has adequate area for off-site parking spaces for the residents of the dwelling and for employees of the large family day care facility. There is also adequate parking for an off-street loading area. 6. Any other relevant impact of the proposed use: The Planning Division has circulated the proposed large family day care facility application to County agencies and has received no evidence that the use will cause any other relevant impact. C. The proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or injurious to properties or improvements in the vicinity. D. The proposed use will comply with each of the applicable provisions of the Chapter 24, Section 265, of the Butte County Code. ■ BUTTE COUNTY PLANNING MANAGER 0 AGENDA REPORT ■ 4 7 • W EXHIBIT A MINOR USE PERMIT BUTTE COUNTY PLANNING COMMISSION DATE: (Certified Mail Rec.) Public Notice Map APN: 007-340-021 E: Site Plan Location: 460 Mojave Court, off of Silverbell, in the north Chico area SUMMARY: Staff recommends approval of the Minor Use Permit with conditions. PROJECT DESCRIPTION/SITE CHARACTERISTICS: This is a proposal to change the ownership of an existing large family day care. Approval of a Minor Use Permit will allow the applicant to care for 12 or fewer children. This proposal is being processed under the existing County Code and at such time as the code is revised to the new state standards, the limits on the allowed number of children may be administratively adjusted for existing small and large childcare centers. The project site is located at 460 Mojave Court, off of Silverbell, in the north Chico area. The parcel is developed with a single family home, approximately 1124 square feet in size, on an urban sized ■ BUTTE COUNTY PLANNING MANAGER ■ AGENDA REPORT 0 1 0 residential lot of approximately 0.29 acre. Butte County Code Section 24-265(e)(2) requires that new large family day care centers be located at least 500 feet driving distance from any other large family day care, center. The Butte County Environmental Health Department recommends approval with a condition that the applicant shall maintain the septic system in compliance with Butte County ordinance. 0 BUTTE COUNTY PLANNING MANAGER ■ AGENDA REPORT ■ 2 0 • CEQA ISSUES: CJ This application for a Minor Use Permit to allow a large family day care is Categorically Exempt, from environmental review under Section 15305(Class 5). The location, size, design, and operating characteristics of the proposed use will be compatible with, and will not adversely affect, or be detrimental to adjacent uses, residents, buildings, structures, or natural resources, with consideration given to: 1. Harmony in scale, bulk, coverage, and density: The project is in harmony with scale, bulk, coverage, and density because the large family day care facility will not create a need for any new structures or an alteration to any existing structures. 2. The availability of public facilities, services, and utilities: The large day care facility will not create a need for new public facilities, services, and utilities because water, telephone; gas, and electrical services already extend to the project parcel. The project site is provided with 0 BUTTE COUNTY PLANNING MANAGER 0 AGENDA REPORT ■ 3 0 municipal water and existent septic facilities. The large day care facility will not lead to any increases in noise levels due to children playing outside, increase in vehicle traffic, as the large family day care use is currently exists and has existed at this location for the past seven years. 4. The generation of traffic and the capacity and physical character of surrounding streets: The proposed large day care facility will not significantly increase vehicle traffic in the area, nor will it -create any vehicle circulation impacts. 0 BUTTE COUNTY PLANNING MANAGER ■ AGENDA REPORT 0 4 ■ EXHIBIT A MINOR USE PERMIT BUTTE COUNTY PLANNING COMMISSION DATE: (Certified Mail Rec.)
