These projects were received in the years 1998 to 2001. No action has been taken by the applicants of these projects to make their application complete or to give the Planning Division the go ahead to start working on the project again. Letters were sent to each applicant and/or their representative requesting they respond back to Planning Division staff as to how they would like to proceed with their project. No written replies were received. In order to close out these files, staff recommends that these six projects be denied without prejudice. The project descriptions are provided below, along with a status of the proj ects. Michael Caprealian, Tentative Parcel Map to divide 21.52 acres into two parcels of 11.51 acres and 10.01 acres on property zoned FR -10 (Foothill Recreational — 10 acre parcels). The property is located on the east side of Helltown Road, approximately two miles north of Centerville. APN 011-400-039. File # TPM 00-12. This project, which was received on February 23, 2000, was deemed incomplete by the Environmental Health Division because test holes for soil testing were not dug by the applicant. The areas where the test holes are required are not accessible by a backhoe. A letter dated September 20, 2002, sent to the applicant requesting the status of the project went unanswered. Another letter dated January 31, 2003, sent to the applicant also went unanswered. The Environmental Health Division stated that they have had no recent contact with applicant. Staff spoke with the applicant who stated that the property owner who originated this application, Gilbert Kinney, passed away several years ago. Janice Kinney and the Estate of Gilbert Kinney sold the property in 2002. 1 The new owner of the project parcel, Grant Peterson, wrote a letter stating that he would like the project to continue until he decides what to do. The letter is attached to this memorandum. A copy of the letter was forwarded to County Counsel for review. Bryce M. Herndon, Certificate of Correction to change a map condition to delete the mandatory home site locations on Lots 10, 22, 23, and 24 on property zoned "U" (Unclassified), located on Walden Pound Road, west of Big Fir Road, Forbestown. APN 073-340-041, 042, 043, 044. File # COR 98-02. This project, which was received on April 8, 1998, was deemed incomplete by the Planning Division for errors and/or omissions in the application material submitted with the project and because authorization from the California Department of Fish and Game to allow the proposed change was not received. A letter dated September 24, 1999, sent to the applicant's representative requesting status of the project went unanswered. Another letter dated January 31, 2003, sent to the applicant's representative and to the applicant also went unanswered. Champion Christian School, Use Permit to expand an existing gymnasium at the Champion Christian School from 5,400 sq. ft. to approximately 9,000 sq. ft. and to increase the height of the ceiling from 20 feet to 30 feet, on property zoned P -Q (Public — Quasi -Public), located on the north side of East Avenue, approximately 400 feet west of Floral Avenue, at 1184 East Avenue (First Church of the Nazarene), Chico. APN 048- 300-049. File # UP 01-05. This project, which was received on August 30, 2000, was put on hold at the applicant's request on November 1, 2000, because the Environmental Health Division required that the project site annex to the City of Chico or connect the proposed upgraded facility to the City of Chico sewer system. A letter dated January 31, 2003, sent to the church and to the church's representative went unanswered. The Environmental Health Division stated that they have had no recent contact with applicant. Point BTA 79LLC (Silverbell), Minor Use Permit f6r collocating antennas at a height of 70 feet on an existing 120 foot. tower and connecting the antennas to telecommunications equipment mounted to the wall within Suite 8 of the existing adjacent building on property zoned C-2 (General Commercial), located at 3415 Silverbell Road, Suite 8, Chico. APN 007-390-001. File # MUP 02-06. This project, which was received on August 3, 2001, was put on hold at the applicant's representative's request. A letter dated August 19, 2002 sent to the applicant and to the applicant's representative went unanswered. Another letter dated January 31, 2003, also went unanswered. Since this project was submitted, the tower on which the proposed antennas would be placed has been modified by other antennas, and the site plan and radio frequency analysis submitted for this project would have to be revised to reflect the changes to the tower. 2 Point BTA 79 LLC (Nord Avenue), Minor Use Permit to collocate six panel antennas on an existing monopole tower at a height of 98 feet and to connect the antennas to telecommunications equipment within an existing building. The antennas will be used for digital cellular communications systems on property zoned C-1 (Light Commercial). The property is located within a 1.9 acre parcel northeast of and adjacent to State Route 32 (Nord Avenue), approximately'/4 mile northwest of Sacramento Avenue, Chico. APN 043-200-005. File # MUP 02-07. This project, which was received on August 3, 2001, was put on hold at the applicant's representative's request. A letter dated August 19, 2002 sent to the applicant and to the applicant's representative went unanswered. Another letter dated January 31, 2003, also went unanswered. Since this project was submitted, the monopole on which the proposed antennas would be placed has been modified by other antennas, and the site plan and radio-frequency analysis submitted for this project would have to be revised to reflect the changes to the tower. Thomas Reed, Tentative Parcel Map dividing a 40 acre parcel into two parcels of 15 acres and 25 acres each on property zoned SR -3 (Suburban Residential — 3 acre parcels) and M-1 (Light Industrial). The property is located on the east side of Cohasset Road immediately south of Plummers Lane, north of Chico. APN 048-010-066 and 067. File # TPM 99-17. This project, which was received on June 7, 1999, was deemed incomplete by the Environmental Health Division because winter groundwater monitoring is required. The required tests have not been completed. A letter dated September 20, 2002, requesting status of the project and sent to the applicant's engineer and the applicant went unanswered. Another letter dated January 31, 2003, to these two individuals also went unanswered. The Environmental Health Division stated that they have had no recent contact with applicant. All of the above projects have been around for a long period of time and the applicants are not actively seeking getting their projects to hearing. Denying these projects without prejudice would allow Planning Division staff to close out the projects, but still allow the applicants to resubmit their projects at any time. A new application would have to be submitted, along with the normal processing fee, if an applicant wanted to resubmit their application. As noted above, letters were sent to the applicants and/or their representatives requesting the status of the project. No written replies were received. Additionally, the applicants and/or their representatives were notified of the August 14, 2003, Planning Commission meeting. Public notices of the meeting were placed in the appropriate newspapers and notices were sent to property owners in the project areas. C Recommendation Staff recommends that the Planning Commission take the following action: I. Find that the denial of these projects is statutorily exempt from the requirements of the California Environmental Quality Act (CEQA) under Sections 15270(a) and (b) of Title 14, California Code of Regulations, Chapter 3 (Guidelines for Implementation of the California Environmental Quality Act). These sections state that CEQA does not apply to projects for which a public agency rejects or disapproves. H. Deny the following projects without prejudice based upon the following findings: a. Denial of these projects is for one or more of the following reasons: 1. The project was deemed incomplete by County staff due to errors or omissions in the application materials submitted with the proj ect; 2. The project was deemed incomplete by County staff because required soil testing for on-site sewage disposal systems was not completed; 3. We have not had any correspondence with you or Mr. Leverenz regarding these projects since that time and would like to know if you intend to go forward with these projects in a timely manner. Chico 364A site) Dear Mr. Souder: Thank you for you submittal of the above referenced Minor Use Permit applications, which were received by the Planning Division on August 3, 2001. As I believe you were aware, another wireless carrier, Metro PCS, applied before you to collocate additional antennas on the existing towers on Silverbell Road and Nord Avenue. Upon my review of your projects, I noticed that the Nord Avenue site plan shows the proposed Metro PCS antennas but the photosimulation does not. Your Silverbell Road site plan and photosimulation do not show the proposed Metro PCS antennas. I also reviewed the radio-frequency analysis for both projects and could not determine if the analysis took into account the proposed Metro PCS antennas. Because the materials submitted with you applications are not accurate, both projects are deemed "incomplete" and the Planning Division will stop further processing of your applications until such time as the necessary material is submitted. In order to make your application complete, we required the following material: • Revised photosimulation for the Nord Avenue site showing the proposed Metro PCS antennas. (a copy of the Metro PCS photosimulation is enclosed). • Revised site plan for the Silverbell Road site showing the proposed Metro PCS antennas (a copy of the Metro PCS site plan is enclosed). • Revised photosimulation for the Silverbell Road site showing the proposed Metro PCS antennas. (a copy of the Metro PCS photosimulation is enclosed). 10 • Revised RF analysis for both sites that takes into account the RF from the existing antennas, the proposed Metro PCS antennas, and your proposed antennas. (Copies of Metro PCS RF studies are enclosed). We only require one (1) full-size copy of the revised site plan for the Silverbell Road site. Other copies can be ledger size. The facility will consist of antennas mounted at the height of 70 feet on an existing tower located at the above mentioned address. The facility will also consist of related 9 (nine) equipment cabinets mounted on a 12'X4" plywood placed within an existing building adjacent_to the tower. This project is a collocation on an existing approximately 120 feet lattice tower. Technology and site selection CDMA is a new generation of wireless communication which uses advanced digital technology for transmission of voice, data and video. Digital communication offers superior transmission of voice, data and video., Digital communication offers superior quality, safety and services, utilizing low powered antennas which have ten (10) to twenty (20) times the call capacity of the current analog systems. The process of developing a PCS system is similar to cellular development in that the regions are divided into small geographic sections or "cells". Each cell site holds the equipment that provides the air interface to the subscriber units and must be precisely located relative to other sites creating a communication grid system. The grid system must reflect the topography and traffic (user population and building density) of the "cells" as well as the radius of the respective antenna's reliable transmission area. The proposed location (N 39-46-15 W121-52-11) will allow Point BTA 79 to provide coverage in the North Chico area. Zoning Code Compliance Pursuant to section 24-262 of the Butte Counties Zoning Ordinance, facilities mounted on an existing tower are subject to a Minor Use Permit. The proposed project is a collocation on an existing tower located on a parcel, which is commercially zoned. This is an ideal proposal that has virtually little, if any, visual impact and meets Butte County's siting criteria in letter and spirit. Approval of this Minor Use Permit minimizes adverse visual impacts, protects the publics interests in the safe operation of emergency services, and allows wireless communications services to provide such services to the community in a safe effective and efficient manner. I Issue Date: 11/26/97 i Page 2 of 2 • at t14 WIN NO alkyj I IN I Memorandum POWER DENSITY CALCULATIONS FOR WE 368 (POINT BTA 79: SILVERBELL RD) TO: Distribution FROM: Dean Parmar DATE: 7/25/01 DIST: Brian Gavin David Andre Andre Smith Ringo Gulati The American National Standards Institute (ANSI) standard C95.1-1992 recommends that, for PCS frequencies (1.8 GHz to 1.9 GHz), the general population should not be exposed to power density levels in excess of 1 mW/cm2. This limit includes several margins for safety, and to account for potential variations in a real world environment. Therefore, the FCC does not assume or require any additional margins relative to the limit of 1mW/cm2. This memo'describes a method to compute power density levels at various distances from the site. The method uses a free space path model in the far -field; the far -field being defined by the Fraunhofer equation. This method to compute power density is fairly conservative and actual levels in reality would be much smaller. Power densities of 0.000302 mW/cm2, 0.00045 mW/ cm2 and 0.00028 mW/cm2 were computed at distances of 25 feet, 100 feet and 1000 feet from the site. These power densities take into account a reflection factor of 2.56, plus contributions from the other carrier. Refer to Tables 1 and 2 for power densities at other distances. Table 3 takes into account contributions from both carriers. The above computations are 0.03%, 0.045%, and 0.0028% of the ANSI standard respectively. Dean Parmar RF Engineering Manager 916-772-3010 D EC EOMC AUG 3 2001 BUTTE COUNTY PLANNING DIVISION ANALYSIS 0 • EIRP/4IIr2 Power extracted with a receiving antenna Pr=PdxA, where A, = effective area of receiving antenna. FIGURE 1 Power flux density at a distance r from a point source A prediction for power density in the far field of an antenna can be made from the use of equation 1. This equation is generally accurate in the far -field of an antenna. For PCS frequencies, the near -field is within several feet of the antenna, therefore, all power density levels calculated for this study are in the far -field. Power density, Pd = (Pt x Gt)/4IIr2 mW/cm2 1 Where P, = Transmitted Power in mW r = Tx, Rx separation in cm Gt = Transmit antenna gain For a truly worst-case prediction of power at or near a surface, such as at ground level or on a rooftop, 100% reflection of incoming radiation can be assumed, resulting in a potential doubling of predicted field strength and a four -fold increase in power density (far -field equivalent). In this case equation 1 can be modified to: Pd = 22 (Pt x Gt)/4IIr2 2 The EPA has recommended a more realistic approach for ground reflection by assuming a maximum of 1.6 - fold increase in field strength. Power density now becomes: Pd = 1.62 (Pt x Gt)/4IIr2 In this memo, a 1.6 increase in field strength is assumed due to reflections, leading to an increase in power density of 2.56 Directional Antennas All of Point BTA's antennas will be directional antennas, with typical side lobe suppression of 20 dB. (See Figure 3). This means that right under the antenna, signal strength will be 20 dB (100 times) lower than the main beam. Figure 2 shows distances x and y from a 52.5 -ft pole, where signal is 20 dB (100 times) and 15 dB (32 times) below the main lobe respectively. x and y compute to 52.5 ft and 196 ft. FIGURE 2 Distances x and y from pole where signal is 20 dB and 15 dB below main beam respectively tan 45 = 52.5/x ; x = 52.5 /tan45 = 52.5 ft tan 15 = 52.5/y y = 52.5/tan 15 = 52.5/.2679 = 196 ft FIGURE 3 Vertical Antenna Pattern for one of Point BTA's directional antennas 3 Examples of power densities at 35 ft, 50 ft, 100 ft, and 1000 ft from the site: Using values of: Gt = 16.5 dBi and 2 dB cable loss Pt = 16 W at R connector Gt,ff= 28.183 linear Power density at 35 ft = 16000 x 28.183 4171 X 1067^2 = 0.0315 mW/ cm2 Taking into account reflection factor of 2.56 and side lobe suppression of 20 dB, the above value becomes 0.000807 mW/cm2 If we assume four carriers co located at a site, then the power density is assumed to be 4 times the above figure i.e. 0.0032 mW/ cm2 Power density at 50 ft = 16000 x 28.183 4171 X 1524^2 = 0.0154 m W/ cm2 Taking into account reflection factor of 2.56 and side lobe suppression of 20 dB, the above value becomes 0.000395 mW/cm2 If we assume four carriers co located at a site, then the power density is assumed to be 4 times the above figure i.e. 0.00158 mW/ cm2 Power density at 100 ft = 16000 x 28.183 4171 X 3048^2 0.00386 mW/ cm2 Taking into account reflection factor of 2.56 and side lobe suppression of 20 dB, the above value becomes 0.000313 mW/cm2 If we assume four carriers co located at a site, then the power density is assumed to be 4 times the above figure i.e. 0.00125 mW/ cm2 Power density at 1000 ft = 16000 x 28.183 4171 X 30480^2 0.000039 mW/ cm2 Taking into account reflection factor of 2.56,the above value becomes 9.89x10'5 mW/cm2 If we assume four carriers co located at a site, then the power density is assumed to be 4 times the above figure i.e. 0.003955 mW/ cm2 See Tables 1 to 4 for power densities at other distances.
