Documentation which identifies failure characteristics of the Facility, structure or tower and demonstrates that the site and setbacks are of adequate size to contain falling debris. 15. ❑ 4EWritten evidence demonstrating that the selected Facility structure or tower design is as QS' visually unobtrusive as possible, given technical and engineering considerations, which indicate what type of Facility is required to provide reasonably effective service and also the best technology and/or construction available to maximally achieve visual unobtrusiveness. IF INSUFFICIENT INFORMATION IS SUBMITTED, THE APPLICATION WILL BE DEEMED INCOMPLETE. 4 • The use of best available technology and/or construction to maximally achieve visual unobtrusiveness is mandatory. 16. . �TT'Applicants which operate common carrier facilities,(specifically, but not limited to cellular, 6l� PCS, SMR and paging service licensees of the FCC) shall provide written evidence that the applicant has provided notice to all FCC licensed wireless communication service carriers operating within the County of Butte of the plans to develop the site. 17. ® LLJ' Evidence of a valid, current operatinglicense or construction permit from the FCC p or, if the applicant is not a wireless communications service provider, a user operating agreement for each and every such provider to which the applicant intends to rent space on the proposed Facility. 18. ® A report, signed by a qualified radio frequency engineer` licensed by the FCC, prepared pursuant to FCC OET 65, stating whether the maximum radio frequency radiation/electromagnetic radiation (RF/EMF) to be emitted by the proposed Facility, taking into account all other Facilities,. both existing and known future Facilities, at the proposed site and adjacent properties, conforms to safety standards adopted by the FCC, if applicable. The reports. prepared for Facilities shall conform to the reporting requirements set by the County and FCC OET 65 human exposure standards. The. report shall also analyze the evidence provided in support of the proposed Facility location, height and radiated power, frequency, the number of channels, and all other related data and present alternatives for the location, height and radiated power, pursuant to the requirements of this section. If the proposed Facility exceeds FCC OET 65 human exposure standards, applicant shall also provide additional comprehensive technical and planning information regarding how the applicant shall protect all persons from such excessive exposure consistent with all Federal and State requirements, and any additional County requirements. 19. ❑ -Et�-Eandscaping and painting plans for the completed project. H'k 20. ❑ -Projects in Agricultural Zones (A-5 through A-160) shall, prior to submitting an application N� for a proposed Facility, submit a site plan of the proposed Facility to the Butte County Agricultural Commissioner for comment and send a notification letter to all aerial agricultural applicators registered in the County informing them of theproposed site location and tower height. No hearing on an application for a proposed facility in any agricultural zone will be scheduled, nor shall any Administrative Permit for any such facility be issued without proof that the Butte County Agricultural Commissioner and all aerial agricultural applicators registered in the County have been notified, as specified herein. IF INSUFFICIENT INFORMATION IS SUBMITTED, THE APPLICATION WILL BE DEEMED INCOMPLETE. 5 1al ir, ie ❑ ❑ All applications for Facilities that are proposed to be located within the boundaries of any Comprehensive Airport Land Use Plan or Airport Area of Influence, as adopted or designated from time to time by the Butte County Airport Land Use Commission, shall be submitted to the Department of Development Services, Planning Division, and a copy submitted to the Butte County Airport Land Use Commission for review regarding consistency with adopted Comprehensive Airport Land Use Plans and for recommendations addressing potential impacts to air navigation within the Airport Area of Influence. he County may in its sole discretion retain an independent consultant to review either individual ements of or the entire application and advise the County at the applicant's sole expense. For purposes of this Permitting Authorization, ATLP shall be deemed to include any affiliate or subsidiary of ATLP. RECITALS 1. Customer and ATLP desire to enter into an agreement for the use of space (the "Agreement") at a tower site leased by ATLP located at 1298 Nord Avenue, Chico, California, (the "Tower Site"); 2. Customer has determined that certain local government permits or approvals will be required as .a condition to installing and operating its equipment at the Tower Site; 3. Customer desires to commence operations at the Tower Site as soon as possible after executing the Agreement; 4. Customer desires to commence applications for permits and approvals ("Permits") at Customer's sole risk prior to executing the Agreement and ATLP is willing to allow Customer to do so, contingent upon certain terms and conditions and the execution of this Permitting Authorization by Customer. NOW THEREFORE, in consideration of the foregoing and the payment of One Dollar ($1.00) from Customer to ATLP, receipt of which is acknowledged, Customer and ATLP agree as follows: - 1. Notwithstanding anything to the contrary in this Permitting Authorization, this Permitting Authorization is expressly contingent on the authorization of the owner or landlord of property underlying the Tower Site if applicable. 2. Upon the execution of this Permitting Authorization and continuing for a period of La— days, Customer may, under the applicable terms and conditions set forth in the right of entry agreement attached hereto as Exhibit A and incorporated by this reference ("Right of Entry"), enter the Tower Site and conduct such studies, investigations and surveys necessary in connection with the filing and prosecution of Permits. 3. Customer shall submit any and all plans, surveys, permit applications and other documentation to ATLP for ATLP's review and approval prior to filing with government authorities or agencies having jurisdiction. No plans or documentation shall be submitted to any government authority or agency without ATLP's prior express written approval. 4. The rights granted Customer hereunder shall automatically lapse upon the earlier of (i)days following the execution of this Permitting Authorization or (ii) execution of the Agreement. If the rights granted hereunder shall lapse without Insert Name of Customer and ATLP having executed the Agreement, then Customer shall immediately terminate all activities in connection with the pursuit of Permits, including withdrawal from any scheduled hearings, or at ATLP's sole option, assign to ATLP the right to pursue and obtain Permits in its own name. In no event shall Customer record any Permit in the public records without ATLP's prior express written consent. 5. If Customer shall obtain any Permits without having executed the Agreement within Jtdays of the date of execution of this Permitting Authorization, Customer shall, at ATLP's sole option and 9 direction (i) assign to ATLP all such Permits that are permitted to be assigned by the issuing authority; or (ii) file a statement with the Permit issuing authorities and ATLP relinquishing the Permits. If Customer shall fail to make such assignment or filing as directed by ATLP, then ATLP may elect to act as agent of Customer for such purpose, without any further action being required of Customer or ATLP. 6. Customer shall indemnify and hold harmless ATLP, its directors, officers, employees, shareholders, successors and assigns from all loss, claims, costs or damage to persons or to the Tower Site arising out of Customer's breach of this Permitting Authorization. The indemnity provisions contained herein shall survive the expiration of this Permitting Authorization. The process of developing a PCS system is similar to cellular development in that the regions are divided into small geographic sections or "cells". Each cell site holds the equipment that provides the air interface to the subscriber units and must be precisely located relative to other sites creating a communication grid system. The grid system must reflect the topography and traffic (user population and building density) of the "cells" as well as the radius of the respective antenna's reliable transmission area. The proposed location (N 39-44-04.17 W121-51-41.84) will allow Point BTA 79 to provide coverage in the North Chico area. Zoning Code Compliance Pursuant to section 24-262 of the Butte Counties Zoning Ordinance, facilities mounted on an existing tower are subject to a Minor Use Permit.. The proposed project is a collocation on an existing tower located on a parcel, which is commercially zoned. This is an ideal proposal that has virtually little, if any, visual impact and meets Butte County's siting criteria in letter and spirit. These projects were received in the years 1998 to 2001. No action has been taken by the applicants of these projects to make their application complete or to give the Planning Division the go ahead to start working on the project again. Letters were sent to each applicant and/or their representative requesting they respond back to Planning Division staff as to how they would like to proceed with their project. No written replies were received. In order to close out these files, staff recommends that these six projects be denied without prejudice. The project descriptions are provided below, along with a status of the proj ects. Michael Caprealian, Tentative Parcel Map to divide 21.52 acres into two parcels of 11.51 acres and 10.01 acres on property zoned FR -10 (Foothill Recreational — 10 .acre parcels). The property is located on the east side of Helltown Road, approximately two miles north of Centerville. APN 011-400-039. File # TPM 00-12. This project, which was received on February 23, 2000, was deemed incomplete by the Environmental Health Division because test holes for soil testing were not dug by the applicant. The areas where the test holes are required are not accessible by a backhoe. A letter dated September 20, 2002, sent to the applicant requesting the status of the project went unanswered. Another letter dated January 31, 2003, sent to the applicant also went unanswered. The Environmental Health Division stated that they have had no recent contact with applicant. Staff spoke with the applicant who stated that the property owner who originated this application, Gilbert Kinney, passed away several years ago. Janice Kinney and the Estate of Gilbert Kinney sold the property in 2002. 1 The new owner of the project parcel, Grant Peterson, wrote a letter stating that he would like the project to continue until he decides what to do. The letter is attached to this memorandum. A copy of the letter was forwarded to County Counsel for review. Bryce M. A letter dated January 31, 2003, sent to the church and to the church's representative went unanswered. The Environmental Health Division stated that they have had no recent contact with applicant. APN 007-390-001. File # N UP 02-06. This project, which was received on August 3, 2001, was put on hold at the applicant's representative's request. The property is located on the east side of Cohasset Road immediately south of Plummers Lane, north of Chico. APN 048-010-066 and 067. File # TPM 99-17. This project, which was received on June 7, 1999, was deemed incomplete by the Environmental Health Division because winter groundwater monitoring is required. The required tests have not been completed. A letter dated September 20, 2002, requesting status of the project and sent to the applicant's engineer and the applicant went unanswered. Another letter dated January 31, 2003, to these two individuals also went unanswered. The Environmental Health Division stated that they have had no recent contact with applicant. All of the above projects have been around for a long period of time and the applicants are not actively seeking getting their projects to hearing. Denying these projects without prejudice would allow Planning Division staff to close out the projects, but still allow the applicants to resubmit their projects at any time. A new application would have to be submitted, along with the normal processing fee, if an applicant wanted to resubmit their application. As noted above, letters were sent to the applicants and/or their representatives requesting the status of the project. No written replies were received. Additionally, the applicants and/or their representatives were notified of the August 14, 2003, Planning Commission meeting. The facility will be comprised of nine (9) antennas mounted at 110 feet on an existing 14 P monopole. A concrete pad with up to 7 equipment cabinets plus power and telco will be located adjacent to the pole to house the necessary electronic equipment. The equipment cabinets are each approximately 30" x 40" x 72" high. Backeround Metro PCS, Inc. is a privately held telecommunications service provider that has been authorized by the Federal Communications Commission to provide Personal Communication Services (PCS) in the Butte County area. The Company plans to implement an innovative and affordable pricing structure to capitalize on wireless customers' sensitivity to price. The Company believes that a substantial market opportunity exists to essentially eliminate the pricing gap between existing heavy usage cellular airtime and wire line telephone rates. Relative to current wireless service packages, Metro PCS expects to offer service packages that include large blocks of minutes consisting of anytime airtime at significantly lower effective prices per minute. Justification Statement Metro PCS is requesting a Minor Use Permit to add antennas to an unmanned telecommunications facility located at 12998 Nord Avenue. The entitlement is requested in accordance with the guidelines set forth in the zoning code regarding wireless communication facilities. The proposed antenna panels will be co -located on an existing monopole; will be attached below the topmost existing antenna array; and will blend in visually to the monopole. Svstem Benefits Metro PCS's telecommunications facility will provide Personal Communication Services to the residents of the Butte County area. This service will be offered to local police, fire, and public safety entities as well as to the local businesses and the general public. The proposed site located at 12998 Nord Avenue in the County of Butte is part of a network that will cover Northern California. Metro PCS's goal is to provide service to the Butte County area in the fall of 2001. Environmental Impacts The Metro PCS communication facility will result in no significant impacts to the environment or the area in which it is located. The unmanned facility (visited on an average of twice per month for routine maintenance purposes) will not be lit, nor emit noise or glare and will not interfere with television or radio reception. The subject site will be such that the location, size, design, and operating characteristics of the proposed facility will be compatible with and will not adversely affect the livability or appropriate development of adjacent parcels and the surrounding area. They are capable of eleven channels but these will not use the additional channels until capacity warrants their use. This limit includes several margins for safety, and to account for potential variations in a real world environment. Therefore, the FCC does not assume or require any additional margins relative to the limit of 1mW/cm2. This memo describes a method to compute power density levels at various distances from the site. The method uses a free space path model in the far -field; the far -field being defined by the Fraunhofer equation. This method to compute power density is fairly conservative and actual levels in reality would be much smaller. Power densities of 0.00028 mW/cm2, 0.00052 mW/ cm2 and 0.00038 mW/cm2 were computed at distances of 25 feet, 100 feet and 1000 feet from the site. These power densities take into account a reflection factor of 2.56, plus contributions from 2 other carriers. Refer to Tables 1 to 3 for power densities at other distances. Table 4 takes into account contributions from other carriers. The above computations are 0.028%, 0.052%, and 0.0038% of the ANSI standard respectively. Power density now becomes: Pd = 1.62 (Pt x Gt)/4IIr2 In this memo, a 1.6 increase in field strength is assumed due to reflections, leading to an increase in power density of 2.56 Directional Antennas All of Point BTA's antennas will be directional antennas, with typical side lobe suppression of 20 dB. (See Figure 3). This means that right under the antenna, signal strength will be 20 dB (100 times) lower than the main beam.
