carried to approve the Consent Agenda.' Each hearing subject to individual findings and conditions
for that project.
I. Find that the application is not a project as defined by CEQA.
II. Approve a Minor Use Permit for Amber Andrews for a large family day care facility for 12
or fewer children, MUP 02-21, on APN'068-330-012, based on the following findings and
the conditions found in Exhibit "A":
A. The location, size, design, and operating characteristics of the proposed use will be
compatible with, and will not adversely affect, or be detrimental to adjacent uses,
residents, buildings, structures, or natural resources, with consideration given to:
1. Harmony in scale, bulk, coverage, and density:
The project is in harmony with scale, bulk, coverage, and density because the
large family day care facility will not create a need for any new structures or
an alteration to any existing structures.
2. ' The availability of public facilities, services, and utilities:
The large day care facility will not create a need for new public facilities,
services, and utilities because water, telephone, gas, and electrical services
already extend to the project parcel. The project site is provided with
municipal' water and existing septic facilities. The Butte County Fire
Department requires compliance with State Fire Marshall requirements for
large day care facilities.
3. The harmful effect, if any, upon desirable neighborhood character:
The proposed large day care facility will not change the traditional
architectural style that is of a character consistent with an urban residential
neighborhood. The large day care facility will not lead to a significant
increase in noise levels due to children playing outside or significant
increase in vehicle traffic.
4. The generation of traffic and the capacity and physical character of
surrounding streets:

The proposed large day care facility will not significantly increase vehicle
traffic in the area, nor will it create any vehicle circulation impacts.
5. The suitability of the site for the type and intensity of use or development
which is proposed:
The site has adequate area for off-site parking spaces for the residents of the
dwelling and for *employees of the large family day care facility. There is
also adequate parking for an off-street loading area.
6. Any other relevant impact of the proposed use:
The Planning Division has circulated the proposed large family day care
facility application to County agencies and has received no evidence that the
use will cause any other relevant impact.
C. The proposed location, size, design, and operating characteristics of the proposed use
and the conditions under which it would be operated or maintained will not be
detrimental to the public health, safety, or welfare, or injurious to properties or
improvements in the vicinity.
D. The proposed use will comply with each of the applicable provisions of the Chapter
24, Section 265, of the Butte County Code.
Conditions of Approval:
The facility is a single family residence that shall be the principal residence of the provider
and the large day care facility shall be clearly incidental and secondary to the use of the
property for residential purposes.
2. Minimum off-street parking shall be provided pursuant to the following standards:
(a) Two (2) off-street parking spaces for the residents of the dwelling.
(b) One (1) off-street parking space for each employee. The two (2) required residential
spaces may not be used for employees.
(c) One (1) off-street parking space/loading area.
3. One sign, not to exceed 3 square feet, is allowed. This sign shall not be placed in the front
yard building setback.
4. The large family day care home shall be licensed by the California Department of Social
Services, Community Care Licensing.
The day care structure shall meet all California Building Code regulations pertaining to large
family day care facilities, including, but not limited to, the installation of smoke detectors, a

device for sounding alarm, fire extinguishers, and exit doors operable from the inside
without the use of a key or any special knowledge or effort.
6. Prior to use of the large day care, the `facility shall be inspected by the Butte County Fire
Department/CDF and the State Fire'Marshal and it shall meet the requirements of CCR Title
19. ,
7. Prior to issuance of the Minor Use Permit, applicant shall obtain any necessary building
permits required by code.
8. The capacity of the Large Family Day Care facility may be increased to 14 children when
the Butte County Code is amended to conform to the State statute.
9. Applicant must also comply with all other applicable State and local statutes, ordinances,
and regulations.
10. The applicant shall screen garbage containers sufficient to block view from the road.

from Mr. and Mrs. Smith. The two letters concerned noise and that the approval of the subject
project would open the door for other businesses. Rowland Strang also submitted another letter.
Mr. Betts said that this would not be a commercial business.
The hearing was opened to the public.
Amber Andrew explained that the traffic is from people using the road as a short cut to the school
and not from people coming to the day care. She said that the neighbors generate more traffic than
her day care. She told staff that the trash is always picked up and that she got an extra trash can to
take care of the problem. She asserted that only one car arrives at a time for the day care. She said
that she has always had problems with the older neighbors.
Rawland Strang said that he would like to see the garbage kept in the back yard out of sight and not
in the front yard. He said that this was a residential neighborhood of retired people. He discussed a
vacant piece of land that is used as a short cut and should be barricaded by the County. He said that
he has complained to Public Works, but in vain. He mentioned that another concern is the noise
from the proposed additional children, and he does not like when the children are screaming.
Ms. Andrew said that her day care is open from 6:30 a.m. to 6:00 p.m., 7 days a week. She attested
that the children are brought inside when it gets dark. She alleged that the music and noise was
coming from another neighbor and not her day care facility.
Mr. Strang asserted that the screaming does come from the day care.
Joan Smith claimed that she has lived on Hildale since 1981 and would like her property to remain
valuable; she felt that the addition to the day care would affect her property values. She expressed
concern about the garbage overflowing and the fact that the garbage can be seen from the road. She
was also concerned about the screaming from the children in the day care facility. She contended
that there was not sufficient room between Mr. Strang's house and the day care to allow for any
peace and quiet for Mr. Strang. She concluded that she had previously submitted a letter and she did
not feel there was enough room for parking.
Ms. Andrew assured Ms. Smith that she had room to park 15 cars on her property.
Ms. Smith said that the day care should not be allowed to operate on the weekends.

children.
Ms. Andrew informed staff that she wants the permit for the full number of children allowed and
stated that she has her own children and the noise would always be there.
Mr. Meleka asked whether Ms. Andrew is willing to communicate with her neighbors to come up
with mutually agreeable solutions to the discussed issues. She and the neighbors answered
affirmatively.
Mr. Meleka continued this hearing to August 21, 2002, at 9:00 a.m.

Mr. Betts explained the reason this hearing was continued. He said that Ms. Andrew was going to
attempt to work out the concerns of the neighbors.
The hearing was opened to the public.
Amber Andrew said she would not agree to restrict the day care to the weekdays only. She said she
was willing to restrict the large day care to weekdays, but she said she would have some children on
the weekends. She stated that her garbage cans are 60 feet from the road. She said that she is going
to move the cans to the back yard until she can afford to have them screened from view in the front
yard.
Mr. Breedon suggested adding a condition that the garbage be screened.
Mr. Betts noted that there is nothing in the ordinance limiting a day care facility to Monday through
Friday only.
Ms. Andrews said that she has no problems.with any of the conditions.
The hearing was closed.
Mr. Breedon concurred with Staff's recommendation to recommend approval of the Minor Use
Permit to Amber Andrews subject to the findings and conditions listed below, adding a condition to
state: "The applicant shall screen garbage containers sufficient to block view from the road."

Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions
set forth below: Amber Andrew is hereby granted a Minor Use Permit in accordance with
application filed: Minor Use Permit to change ownership of an existing large family day care
allowing up to 12 children.
Failure to comply with the conditions specified herein as the basis for approval of
application and issuance of Permit constitutes cause for the revocation of said permit in
accordance with the procedures set forth in the Butte County Zoning Ordinance, including
Butte County Code Sec. 24-41.
2. Unless otherwise provided for in a special condition to this Minor Use Permit, all conditions
must be completed prior to or concurrently with the establishment of the granted use. The
use granted by this permit must be established within 12 months of the delivery of the
countersigned permit to the Permittee.
Minor changes may be approved administratively by the Directors of Development Services,
Environmental Health, or Public Works upon receipt of a substantiated written request by the
applicant, or their respective designee. Prior to such approval, verification shall be made by
each Department or Division that the modification is consistent with the application, fees
paid and environmental determination as conditionally approved. Changes deemed to be
major or significant in nature shall require a formal application for amendment.
4. If any use for which a Minor Use Permit has been granted is not established within one year
of the date of receipt of the countersigned permit by the Permittee, the permit shall become
null and void and reapplication and a new permit shall be required to establish the use.
5. The terms and conditions of this permit shall run with the land and shall be binding upon and
be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee.
Conditions of Approval:
The facility is a single family residence that shall be the principal residence of the provider
and the large day care facility shall be clearly incidental and secondary to the use of the
property for residential purposes.

2. Minimum off-street parking shall be provided pursuant to the following standards:
(a) Two (2) off-street parking spaces for the residents of the dwelling.
(b) One (1) off-street parking space for each employee. The two (2) required residential
spaces may not be used for employees.
(c) One (1), off-street parking space/loading area.
3. One sign, not to exceed 3 square feet, is allowed. This sign shall not be placed in the front
yard building setback.
4. The large family day care home shall be licensed by the California Department of Social
Services, Community Care Licensing.
5. The day care structure shall meet all California Building Code regulations pertaining to large
family day care facilities, including, but not limited to, the installation of smoke detectors, a
device for sounding alarm, fire extinguishers, and exit doors operable from the inside
without the use of a key or any special knowledge or effort.
6. Prior to use of the large day care, the facility shall be inspected by the Butte County Fire
Department/CDF and the State Fire Marshal and it shall meet the requirements of CCR Title
19.
7. Prior to issuance of the Minor Use Permit, applicant shall obtain any necessary building
permits required by code.
8. The capacity of the Large Family Day Care facility may be increased to 14 children when
the Butte County Code is amended to conform to the State statute.
9. Applicant must also comply with all other applicable State and local statutes, ordinances,
and regulations.
10. The. applicant shall screen garbage containers sufficient to block .view from the road.
NOTE: Issuance of this Minor Use Permit does not waive requirement of obtaining Building and
Health Department permits before starting construction, nor does it waive any other requirements.

At the regular meeting of the Butte County Planning Commission held September 12, 2002, your
request for a Minor Use Permit, was approved subject to the conditions listed on the permit.
Should you desire to appeal any of the conditions imposed by the Planning Commission, you must
do so in writing, to the Clerk of the Board of Supervisors, 25 County Center Drive, Oroville,
California, prior to 5:00 p.m., Monday, September 23, 2002. The appeal fee of $50.00 must be paid

period, the action of the Planning Commission is final.
For purposes of the California Environmental Quality Act, a Notice of Exemption must be filed.

Staff recommends approval of the Minor Use Permit with conditions.
PROJECT DESCRIPTION/SITE CHARACTERISTICS:
This is a proposal to expand a family day care facility from 6 children to 12 children with the provision
that 14 children may be permitted when the Butte County Zoning Ordinance is changed to reflect
current State Law.
Per Butte County Zoning Code Section 24-265(b)(2), large -family day care homes may have up to
twelve (12) children. The current state law has limits of eight (8) children for small day care and
fourteen (14) for large family day care centers. The County Code has not been changed to reflect these
new limits. This proposal is being processed under the existing County Code and at such time as the
code is revised to the new state standards, the limits on the allowed number of children may be
administratively adjusted for existing small and large child care centers.
The project site is located at 3561 Hildale Avenue in the Oroville area. The parcel is developed with a
single family home on a''/z-acre sized residential lot. The rear of the property is fenced and has an area
of sufficient size to accommodate the proposed use. The project is in a neighborhood characterized by
urban/suburban residential development. There are similar sized parcels bordering the property.

Parcel size in the area range from 0.3 to 2 -acres. Access to the dwelling is from Hildale Avenue, which
is a paved, County maintained, road. Domestic water is supplied by OWID. The dwelling has a septic
system. The applicant lives in the residence and is currently the primary care provider. With approval
of a large day care facility, the applicant proposes to have as many as twelve (12) children, with one
additional full-time employee.
ANALYSIS:
The property is zoned AR (Agricultural Residential) and has a General Plan land use designation of
LDR (Low Density Residential). The AR zoning classification allows large family day care facilities
with approval of a Minor Use Permit and subject to the requirements of Section 24-265 of the Zoning
Code. The General Plan states that the Primary Use of the Low Density Residential land use
designation is single family homes at urban densities. Secondary Uses include group quarters and care
homes. The applicant is currently operating a small family day care facility on this site.
Butte County Code Section 24-265(e)(2) requires that new large family day care facility be located at
least 500 feet driving distance from any other large family day care center. Staff conducted an analysis
of the location of other large family day care centers in the area of the project and determined that there
are no other similar facilities within the 500 foot driving distance. This facility will not cause any
residence to be bounded on more than one side with a large family day care center.
There is sufficient area for off-street parking for the residents of the dwelling, one or more employees,
and drop-off and pick-up of children. Located on a fairly quiet residential street, the location provides a
measure of traffic safety during drop-off and pick-up times. The property has a wide driveway 60 feet
in length that is adequate to meet the require parking. Additional parking area is available on-site.
The Butte County Environmental Health Department recommends approval with a condition that the
applicant shall maintain the septic system in compliance with Butte County ordinance. The Butte
County Fire Department requires standard conditions to comply with Public Resources Code 4290.
Currently, there is an existing small family day care facility at this location. The expansion will result
in a minor change in traffic to the location. However, as previously noted, Hildale Avenue and the
surrounding streets do not carry large traffic volumes and the increase is not expected to create a
significant problem.
CEQA ISSUES:
Family day care facilities are by definition a use that is accessory to the residential use on-site.
Residential uses are a permitted use in the zone, are not subject to discretionary review, and are exempt
from CEQA review. The Commission's discretion in these applications is limited to reviewing the
application for compliance with local regulations. If the application meets the local ordinance, the
Commission must approve the application. No further discretion is allowed. Because the project is
defined as an accessory residential use and discretion in approving the project is essentially ministerial,
the project is not subject to CEQA review.

Staff recommends that the Planning Manager take the following actions:
I. Find that the application is not a project as defined by CEQA.
II. Recommend approval to the Planning Commission for a Minor Use Permit for Amber Andrews
for a large family day care facility for 12 or fewer children, MUP 02-21, on APN 068-330-012,
based on the following findings and the conditions found in Exhibit "A":
A. The location, size, design, and operating characteristics of the proposed use will be
compatible with, and will not adversely affect, or be detrimental to adjacent uses,
residents, buildings, structures, or natural resources, with consideration given to:
Harmony in scale, bulk, coverage, and density:
The project is in harmony with scale, bulk, coverage, and density because the
large family day care facility will not create a need for any new structures or
an alteration to any existing structures.
2. The availability of public facilities, services, and utilities:
The large day care facility will not create a need for new public facilities,
services, and utilities because water, telephone, gas, and electrical services
already extend to the project parcel. The project site is provided with
municipal water and existing septic facilities. The Butte County Fire
Department requires compliance with State Fire Marshall requirements for
large day care facilities.
3. The harmful effect, if any, upon desirable neighborhood character:
The proposed large day care facility will not change the traditional
architectural style that is of a character consistent with an urban residential
neighborhood. The large day care facility will not lead to a significant
increase in noise levels due to children playing outside or significant
increase in vehicle traffic.
4. The generation of traffic and the capacity and physical character of
surrounding streets:
The proposed large day care facility will not significantly increase vehicle
traffic in the area, nor will it create any vehicle circulation impacts.
5. The suitability of the site for the type and intensity of use or development
which is proposed:
The site has adequate area for off-site parking spaces for the residents of the
dwelling and for employees of the large family day care facility. There is
also adequate parking for an off-street loading area.

6. Any other relevant impact of the proposed use:
The Planning Division has circulated the proposed large family day care
facility application to County agencies and has received no evidence that the
use will cause any other relevant impact.
C. The proposed location, size, design, and operating characteristics of the proposed use
and the conditions under which it would be operated or maintained will not be
detrimental to the public health, safety, or welfare, or injurious to properties or
improvements in the vicinity.
D. The proposed use will comply with each of the applicable provisions of the Chapter
24, Section 265, of the Butte County Code.

Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions
set forth below: Amber Andrew is hereby granted a Minor Use Permit in accordance with
application filed: Minor Use Permit to change ownership of an existing large family day care
allowing up to 12 children.
1. Failure to comply with the conditions specified herein as the basis for approval of
application and issuance of Permit constitutes cause for the revocation of said permit in
accordance with the procedures set forth in the Butte County Zoning Ordinance, including
Butte County Code Sec. 24-41.
2. Unless otherwise provided for in a special condition to this Minor Use Permit, all conditions
must be completed prior to or concurrently with the establishment of the granted use. The
use granted by this permit must be established within 12 months of the delivery of the
countersigned permit to the Permittee.
3. Minor changes may be approved administratively by the Directors of Development Services,
Environmental Health, or Public Works upon receipt of a substantiated written request by the
applicant, or their respective designee. Prior to such approval, verification shall be made by
each Department or Division that the modification is consistent with the application, fees
paid and environmental determination as conditionally approved. Changes deemed to be
major or significant in nature shall require a formal application for amendment.
4. If any use for which a Minor Use Permit has been granted is not established within one year
of the date of receipt of the countersigned permit by the Permittee, the permit shall become
null and void and reapplication and a new permit shall be required to establish the use.
The terms and conditions of this permit shall run with the land and shall be binding upon and
be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee.
Conditions of Approval:
The facility is a single family residence that shall be the principal residence of the provider

and the large day care facility shall be clearly incidental and secondary to the use of the
property for residential purposes.
2. Minimum off-street parking shall be provided pursuant to the following standards:
(a) Two (2) off-street parking spaces for the residents of the, dwelling.
(b) One (1) off-street parking space for each employee. The two (2) required residential
spaces may not be used for employees.
(c) One (1) off-street parking space/loading area.
3. One sign, not to exceed 3 square feet, is allowed. This sign shall not be placed in the front
yard building setback.
4. The large family day care home shall be licensed by the California Department of Social
Services, Community Care Licensing.
5. The day care structure shall meet all California Building Code regulations pertaining to large
family day care facilities, including, but not limited to, the installation of smoke detectors, a
device for sounding alarm, fire extinguishers, and exit doors operable from the inside
without the use of a key or any special knowledge or effort.
6. Prior to use of the large day care, the facility shall be inspected by the Butte County Fire
Department/CDF and the State Fire Marshal and it shall meet the requirements of CCR Title
19.
7. Prior to issuance of the Minor Use Permit, applicant shall obtain any necessary building
permits required by code.
8. The capacity of the Large Family Day Care facility may be increased to 14 children when
the Butte County Code is amended to conform to the State statute.
9. Applicant must also comply with all other applicable State and local statutes, ordinances,
and regulations.
NOTE: Issuance of this Minor Use Permit does not waive requirement of obtaining Building and
Health Department permits before starting construction, nor does it waive any other requirements.

This is a statement in OPPOSITION to the application of Amber Andrew on the property
located on the northside of Hildale Ave. and the proposal to grant a permit for a large
family day care facility.
The undersigned homeowner lives two houses away from the proposed location. I am
new to the neighborhood and one of the selling items when I bought the home 6 months
ago was that it was a quiet and safe neighborhood. In that time the Andrew residence has
been taking in children for the purpose of daycare..,My major concern is the additional
traffic pulling in and out of their driveway, whic ..has become a safety hazard due to it's
close proximity to the intersection of Glen Ave. The amount of garbage they have piled
up is a safety issue as well as an eyesore. In addition is the extreme amount of noise
heard until late in the evening. I work shift work and it has been a hardship on me.
It is my hope and concern that Hildale Ave remain:the quiet residential area it is. My
neighbors are primarily retired citizens and I am concerned for their safety and well-
being as well as my own. I would like for it to remain a safe and quiet place for them and
myself.
I therefore oppose the approval of this operation.

The undersigned homeowners live in the third house away from the proposed location,
and can hear the noise from what is in operation there already.
If this proposed business application is allowed,.it would seem to open the door for other
business enterprises to be established in this area.
Hildale Avenue is not suitable for extra traffic which business enterprises would bring.
There are no side walks and it is not a wide street. It should remain strictly residential.

Dear Sirs:
I wish to protest the granting of such a use permit allowing for a day care facility up to 12
children for the following reasons:
1. I bought my home at the above address, adjacent to the proposed day care center,
because of the peaceful quiet neighborhood . It is a very pleasant area with well -kept
properties and good property values. It is my concern that a facility open to 12 children
would reduce the property values.
2. There is already an operating Day care there with several children. It is bad enough with
the small number of children there now with so much traffic in and out, limited parking
space.
3. They would have to have a gardener to adequately care for the property; keep the
garbage, which would naturally increase to a great degree, in closer to the back of the
house ; and find a way to provide more parking space to prevent accidents when children
are dropped off and picked up.
For these reasons I would like to request a NO vote on the proposed extension of the Day
Care permit of Amber Andrew.

NOTICE OF PROPOSED MINOR USE PERMIT
Notice is hereby given that the Butte County Planning Manager is proposing to grant a Minor Use
Permit for a large family day care facility for up to 12 children for Amber Andrew on property
zoned A -R (Agricultural Residential). The property is located on the north side of Hildale Avenue,
approximately 200 feet west of Glen Avenue, Oroville. APN 068-330-012 (CBS) (MUP 02-21)
Persons wishing to comment on the project may submit written comments to the Butte County
Planning Division any time prior to July 23, 2002. The Development Services Director shall
consider all comments in determining if the application meets all of the conditions and criteria.
Upon finding that the proposed use does or will meet all of the conditions and criteria, the Director
of Development Services will hold a hearing on July 24, 2002, at 9:00 a.m., at 7 County Center
Drive, Oroville. Any interested person may attend this hearing. The decision of the Director of
Development Services will be submitted to the Planning Commission for final approval: If
recommended for approval, this item will be on the Planning Commission Consent Agenda.
