Each hearing subject to individual findings and conditions for that project. I. Find that.the application is not a project as defined by CEQA. II. Approve a Minor Use Permit for Clara McKenzie for a large family day care facility for 12 or fewer children, MUP 02-20, on APN 007-072-014, based on the following findings and the conditions found in Exhibit "A": A. The location, size, design, and operating characteristics of the proposed use will be compatible with, and will not adversely affect, or be detrimental to adjacent uses, residents, buildings, structures, or natural resources, with consideration given to: Harmony in scale, bulk, coverage, and density: The project is in harmony with scale, bulk, coverage, and density because the large family day care facility will not create a need for any new structures or an alteration to any existing structures. The availability of public facilities, services, and utilities: The large day care facility will not create a need for new public facilities, services, and utilities because water, telephone, gas, and electrical services already extend to the project parcel. The project site is provided with municipal water and existing septic' facilities. The Butte County Fire Department requires compliance with State Fire Marshall requirements for large day care facilities. 3. The harmful effect, if any, upon desirable neighborhood character: The proposed large day care facility will not change the traditional architectural style that is of a character consistent with an urban residential neighborhood. The large day care facility will not lead to any significant increase in noise levels due to children playing outside or significant increase in vehicle traffic. 4. The suitability of the site for the type and intensity of use or development which is proposed: The site has adequate area for off-site parking spaces for the residents of the dwelling and for employees of the large family day care facility. There is also adequate parking for an off-street loading area. 6. Any other relevant impact of the proposed use: The Planning Division has circulated the proposed large family day care facility application to County agencies and has received no evidence that the use will cause any other relevant impact. C. The proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or injurious to properties or improvements in the vicinity: D. The proposed use will comply with each of the applicable provisions of the Chapter 24, Section 265, of the Butte County Code. Conditions of Approval: I . The facility is a single family residence that shall be.the principal residence of the provider and the large day care facility shall be clearly incidental and secondary to the use of the property for residential purposes. 2. Minimum off-street parking shall be provided pursuant to the following *standards: (a) Two (2) off-street parking spaces for the residents of the dwelling. (b) One (1) off-street parking space for each employee. The two (2) required residential spaces may not be used for employees. (c) One (1) off-street parking space/loading area. 3. One sign, not to exceed 3 square feet, is allowed. This sign shall not be placed in the front yard building setback. 4. The large family day care home shall be licensed by the California Department of Social Services, Community Care Licensing. 5. Prior to use of the large day care, the facility shall be inspected by the Butte County Fire Department/CDF and the State Fire Marshal and shall meet the requirements of CCR Title 19. 7. Prior to issuance of the Minor Use Permit, applicant shall obtain any necessary building permits required by code. 8. The.capacity of the Large Family Day Care facility may be increased to 14 children when the Butte County Code is amended to conform to the State statute. 9. Applicant must also comply with all other applicable State and local statutes, ordinances, and regulations. APN 007-072-014 (CBS) (MUP 02-20) Stephen Betts gave a brief summary of the project and why it was continued. He submitted a letter received from Mary Anna Ekman dated August 12, 2002, who was concerned with the increase in children and objected to this permit. He discussed a letter from the State Community Care Licensing Division stating that a day care can be called a school. The hearing was opened to the public. Jim McKenzie said that the hours will be less for this request than a regular day care facility and he did not understand the neighbors concerns. Mr. Betts said that Ms. Ekman was concerned with there being a morning session with 12 children and then an afternoon session with a different set of children. Clara McKenzie said that there will be children who are only there in the morning because their parent works part time and there will be children there all day and sometimes there will be an overlap of children for one to one and a half hours in the middle of the day. She said that is the reason for the request for a large day care facility in order to be flexible if there is an overlapping of children. She discussed taking down her sign to try to appease the neighbors. She said that if this is approved she would add to the sign "a family child care home." She agreed to the conditions. Mr. McKenzie said that he had spoken with Mr. and Mrs. Ekman and was told that the Ekmans had no problem with this request, and now they send in a letter stating the opposite. Mrs. McKenzie said that she contacted Mr. Bain after the meeting and not Mrs. Ekman. She said that Mr. Bain was concerned that the property was being rezoned and she assured Mr. Bain that was not the case. The hearing was closed. Mr. Breedon concurred with staff's recommendation to recommend approval of the Minor Use Permit for Clara McKenzie subject to the findings and conditions listed below: I. Recommend approval to the Planning Commission for a 'Minor Use Permit for Clara McKenzie for a large family day care facility for 12 or fewer children, MUP 02-20, on APN 007-072-014, based on the following findings and the conditions found in Exhibit "A": A. The project site is provided with municipal water and existing septic facilities. The Butte County Fire Department requires compliance with State Fire Marshall requirements for large day care facilities. The harmful effect, if any, upon desirable neighborhood character: The proposed large day care facility will not change the traditional architectural style that is of a character consistent with an urban residential neighborhood. The large day care facility will not lead to any significant increase in noise levels due to children playing outside or significant increase in vehicle traffic. 4. The generation of traffic and the capacity and physical character of surrounding streets: The proposed large day care facility will not significantly increase vehicle traffic in the area, nor will it create any vehicle circulation impacts. The suitability of the site for the type and intensity of use or development which is proposed: The site has adequate area for off-site parking spaces for the residents of the dwelling and for employees of the large family day care facility. There is also adequate parking for an off-street loading area. 6. Any other relevant impact of the proposed use: The Planning Division has circulated the proposed large family day care' facility application to County agencies and has received no evidence that the use will cause any other relevant impact. C. The proposed use will comply with each of the applicable provisions of the Chapter 24, Section 265, of the Butte County Code. Conditions of Approval: 1. The facility is a single family residence that shall be the principal residence of the provider and the large day care facility shall be clearly incidental and secondary to the use of the property for residential purposes. 2. Minimum off-street parking shall be provided pursuant to the following standards: (a) Two (2) off-street parking spaces for the residents of the dwelling. (b) One (1) off-street parking space for each employee. The two (2) required residential spaces may not be used for employees. (c) One (1) off-street parking space/loading area. 3. One sign, not to exceed 3 square feet, is allowed. This sign shall not be placed in the front yard building setback. 4. The large family day care home shall be licensed by the California Department of Social Services, Community Care Licensing. 5. The day care structure shall meet all California Building Code regulations pertaining to large family day care facilities, including, but not limited to, the installation of smoke detectors, a device for sounding alarm, fire extinguishers, and exit doors operable from the inside without the use of a key or any special knowledge or effort. 6. Prior to use of the large day care, the facility shall be inspected by the Butte County Fire Department/CDF and the State Fire Marshal and shall meet the requirements of CCR Title 19. 7. Prior to issuance of the Minor Use Permit, applicant shall obtain any necessary building permits required by code. 8. The capacity of the Large Family Day Care facility may be increased to 14 children when the Butte County Code is amended to conform to the State statute. 9. The letters objecting to the project expressed concerns regarding increases in traffic and noise. The hearing was opened to the public. Clara McKenzie said that she sent a letter to all the parents to sign. In this letter, she asked parents to drive carefully down Lindo Lane and keep their children quiet while dropping them off and picking them up. She also said that she is planning to have a few more children so she can afford to hire an aide. She assured staff that she has informed the neighbors of her plans. She concluded that she can easily park eight vehicles on her property if necessary. Mark Bain said that there would be an impact to the level of the traffic. He also said that a number of the neighbors feel that the added traffic would be a problem. He remarked that the area has one of the nicest, tree -lined streets in Chico. In addition, he noted that the people speeding on Lindo Lane are a hazard to the children who live on the street. He concluded that people use Lindo Lane as a short cut which adds to the traffic. ' Mr. Meleka asked the applicant about the potential for the number of children arriving at the same time. Ms. McKenzie answered only one or two would arrive at the same.ti`me. Mr. Bain said that he is concerned with the character of the neighborhood. He said that 12 out of thirty residents are retired. He asked that the number be limited to the capacity of only 8 or 10. Joe Gabski was opposed to this project because of adding to the septic system. He remarked that he was denied adding a third bedroom because of the capacity of his septic system. Amel Akman submitted a letter indicating a conversation he had with Craig Sanders. He said that he likes to see people succeed, but there are conflicts with noise and traffic with type of use. He asked if the subject property was going to be a school or a day care. Ms. McKenzie said that the license allows her to call the proposed day care a school and have a school type curriculum. She also said that she would follow a school type schedule with morning and afternoon session. Monday through Friday only. Mr. Ekman commented that in Title XI, firearms are not allowed within 1000 of a day care facility and asked about the neighbors who own firearms. Ms. McKenzie explained that Title XI refers to her having weapons and that the weapons must be locked away from the children. She added that the children would be pre-school age and the day care can be called by any choice of name she chooses. She concluded that she wants the permit for up to 12 children. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. Conditions of Approval: The facility is a single family residence that shall be the principal residence of the provider and the large day care facility shall be clearly incidental and secondary to the use of the property for residential purposes. 2. Minimum off-street parking shall be provided pursuant to the following standards: (a) Two (2) off-street parking spaces for the residents of the dwelling. (b) One (1) off-street parking space for each employee. The two (2) required residential spaces may not be used for employees. (c) One (1) off-street parking space/loading area. One sign, not to exceed 3 square feet, is allowed. This sign shall not be placed in the front yard building setback. 4. The large family day care home shall be licensed by the California Department of Social Services, -Community Care Licensing. The day care structure shall meet all California Building Code regulations pertaining to large family day care facilities, including, but not limited to, the installation of smoke detectors, a device for sounding alarm, fire extinguishers, and exit doors operable from the inside without the use of a key or any special knowledge or effort. 6. Prior to use of the large day care, the facility shall be inspected by the Butte County Fire Department/CDF and the State Fire Marshal and shall meet the requirements of CCR Title 19. 7. Public Notice Map D: Site Plan Staff recommends approval of the Minor Use Permit with conditions. PROJECT DESCRIPTION/SITE CHARACTERISTICS: This is a proposal to expand a family day care facility from 6 children to 12 children with the provision that 14 children may be permitted when the Butte County Zoning Ordinance is changed to reflect current State Law. Per Butte County Zoning Code Section 24-265(b)(2), large -family day care homes may have up to twelve (12) children. The current state law has limits of eight (8) children for small day care and fourteen (14) for large family day care centers. The County Code has not been changed to reflect these new limits. This proposal is being processed under the existing County Code and at such time as the code is revised to the new state standards, the limits on the allowed number of children may be administratively adjusted for existing small and large child care centers. The project site is located at 764 Lindo Lane in the Chico area. The parcel is developed with a single family home, approximately 1124 square feet in size, on an urban sized residential lot of approximately 0.34 acre. The property has a 6 -foot high fencing completely around the child care area. The project is in a neighborhood characterized by urban residential development. There are similar sized parcels bordering the property. Parcel sizes range from 0.25 -acre to 0.45 -acre. Access to the dwelling is from 0 BUTTE COUNTY PLANNING MANAGER 0 AGENDA REPORT ■ PAGE 1 0 0 • Lindo Lane a paved, County maintained, road. Domestic water is supplied by Cal Water. The dwelling has a septic system. The applicant lives in the residence and is currently the primary care provider. With approval for a large day care facility, the applicant proposes to have as many as twelve (12) children, with two additional full-time employees. ANALYSIS: The property is zoned R-1 (Residential) and has a General Plan land use designation of LDR (Low Density Residential). The R-1 zoning classification allows large family day care facilities with approval of a Minor Use Permit and subject to the requirements of Section 24-265 of the Zoning Code. The General Plan states that the Primary Use of the Low Density Residential land use designation is single family homes at urban densities. Secondary Uses include group quarters and care homes. Butte County Code Section 24-265(e)(2) requires that new large family day care facility be located at least 500 feet driving distance from any other large family day care center. Staff conducted an analysis of the location of other large family day care centers in the area of the project and determined that there are no other similar facilities within the 500 -foot driving distance. This facility will not cause any residence to be bounded on more than one side with a large family day care center. There is sufficient area for off-street parking for the residents of the dwelling, one or more employees, and drop-off and pick-up of children. Located on a fairly quiet residential street, the location provides a measure of traffic safety during drop-off and pick-up times. The property has two driveways with adequate capacity to provide the required parking spaces including a parking area in the rear of the lot. The Butte County Environmental Health Department recommends approval with a condition that the applicant shall maintain the septic system in compliance with Butte County ordinance. The Butte County Fire Department requires standard conditions to comply with Public Resources Code 4290. Currently, there is an existing small family day care facility at this location. The expansion will result in a minor change in traffic to the location. However, as previously noted, Lindo Lane and the surrounding streets do not carry large traffic volumes and the increase is not expected to create a significant problem. CEQA ISSUES: Family day care facilities are by definition a use that is accessory to the residential use on-site. Residential uses are a permitted use in the zone, are not subject to discretionary review, and are exempt from CEQA review. The Commission's discretion in these applications is limited to reviewing the application for compliance with local regulations. If the application meets the local ordinance, the Commission must approve the application. No further discretion is allowed. Because the project is defined as an accessory residential use and discretion in approving the project is essentially ministerial, the project is not subject to CEQA review. The Butte County Fire Department requires compliance with State Fire Marshall requirements for large day care facilities. 3. The harmful effect, if any, upon desirable neighborhood character: The proposed large day care facility will not change the traditional architectural style that is of a character consistent with an urban residential neighborhood. The large day care facility will not lead to any significant increase in noise levels due to children playing outside or significant increase in vehicle traffic. 4. The generation of traffic and the capacity and physical character of surrounding streets: The proposed large day care facility will not significantly increase vehicle traffic in the area, nor will it create any vehicle circulation impacts. 5. The suitability of the site for the type and intensity of use or development which is proposed: The site has adequate area for off-site parking spaces for the residents of the dwelling and for employees of the large family day care facility. There is also adequate parking for an off-street loading area. 6. If any use for which a Minor Use Permit has been granted is not established within one year of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. Conditions of Approval: 1. Minimum off-street parking shall be provided pursuant to the following standards: (a) Two (2) off-street parking spaces for the residents of the dwelling. (b) One (1) off-street parking space for each employee. The two (2) required residential spaces may not be used for employees. (c) One (1) off-street parking space/loading area. 3. One sign, not to exceed 3 square feet, is allowed. This sign shall not be placed in the front yard building setback. 4. The large family day care home shall be licensed by the California Department of Social Services, Community Care Licensing. 5. The day care structure shall meet all California Building Code regulations pertaining to large family day care facilities, including, but not limited to, the installation of smoke detectors, a device for sounding alarm, fire extinguishers, and exit. doors operable from the inside without the use of a key or any special knowledge or effort. 6. Prior to use of the large day care, the facility shall be inspected by the Butte County Fire Department/CDF and the State Fire Marshal and shall meet the requirements of CCR Title 19. Prior to issuance of the Minor Use Permit, applicant shall obtain any necessary building permits required by code. The capacity of the Large Family Day Care facility may be increased to 14 children when the Butte County Code is amended to conform to the State statute. 9. Applicant must also comply with all other applicable State and local statutes, ordinances, and regulations. These are letters dated July 16, 2002, July 18, 2002, and a brochure entitled The Acorn Montessori School. It appears to me that Clara McKen7le's school is. indeed. diff rent f-om the average day care. facility. She clearly intits her hours so ;:hat she is open only from 8:30 a.m. until 3:30 p.m. She also indicates that there is a difference in enrollment in the morning and the afternoon. This facility obviously is not set up to serve parents who must work full time. For this reason, I question whether this facility should be entitled to the kind of protection the state provides facilities which are open sufficient hours for parents who must work 40 or more hours a week. Ms. McKenzie's facility appears to be serving a more affluent population which has at least one parent free to pick up and deliver children. during the middle part of the day and, perhaps, even to care for them when they are nolir attending The Acorn Montessori School. The school may be limited to no more than 12 children at one time. However, it is certainly possible that enrollment could be as high as 24 children with 12 children attending a morning shift and 12 children attending an afternoon shift. This is, to me, a significant amount of traffic since I live directly across the street from the school: It is my understanding that the McKenzie's were advised in the hearing held on July 24 that they should contact neighbors to attempt to reach a compromise on the number of students enrolled at the school. To date, I have not heard from either of the McKenzie's regarding such a compromise. Before it makes a final decision, the Planning Department must determine whether the McKenzie Montessori school is a school or a large family day care facility. If it is a school, do the same government. codes apply to both preschools and large family day care facilities? It has come to our attention that there is a concerted effort to block our application for a minor use permit from Butte County to.expand our license. It greatly saddens us that no one has approached us directly with any questions or concerns about our school or our request for the expanded license. Rather, they have taken measures to defeat our request without informing us of their intentions. Please consider these facts regarding the nature of our school and our reasons for requesting the expanded license. • The school hours are from 8:30 AM to 3:30 PM. Parents usually arrive within a half-hour window of time rather than all at once, between 8:30 to 9:00, for instance. • Children play in the backyard for about 40 minutes before noon and about 40 minutes after 1:00 PM. • The current license limits us to not more than six preschool aged children in our home at any time. • Because we have two young daughters of our own, we have no more than four paying students at a time. This translates into a gross earning potential (with full enrollment) of about $16 per hour. With the low afternoon enrollment, expenses, and self-employment tax on top of income tax this translates into very little net income. • Due to the logistics of scheduling, our school_ currently has the full capacity of six students (including our children) only two mornings a week. Since parents prefer mornings, the afternoons typically have only one or two paying students. Attendance in the afternoons is unlikely to increase much with the expanded. license.. , • Jim isnot a teacher in our school, and Clara is the only teacher.'The nature of the instruction and supervision of the students is such that it is more work and stress than Clara should have to manage alone. • With a current average-gross'monthly income from the school of less than $1,300, we cannot afford to hire an aid. • An aid is necessary to help with supervision, instruction, activities, and addressing individual student's needs. During the brief outdoor intervals, two adults would better manage the children's noise level. An aid will allow Clara the flexibility to speak with parents, take important phone calls, or carryout some other necessary activity that prevents her from being able to devote her full attention to teaching and supervision. This would increase the quality of education we can provide, and greatly reduce her stress level. • We hope that the expanded license would allow us to expand to a total of six to eight paying students in the mornings, hire an aid, accommodate more flexibility in scheduling, and provide a more classroom -like environment for the children. • Our immediate nei hbors have voiced their acceptance and support to us regarding the 9 P PP 9 9 S� expansion. • We predict the impact on traffic would be to add two to four cars during pick-up or drop-off intervals, and we have plenty of parking available. Jim is completing coursework to become a music teacher in the public school system. His prospects for teaching locally are quite good. We understand a petition is circulating in protest to our application for the expanded license. We ask only that you consider the facts about our school and our plans before you sign the petition. Upon reading the letter, we were greatly shocked and dismayed as it implies that we plan to-estabfisha-large-commercial daycare center. That is very different from the family chime home__ we have. We understand your outrage to this, and wish to assure you that the minor use permit'alk ws nothing of that sort. Califomia licensing laws do not allow a family childcare home to exceed 14 children, and leave the actual number up to each county. Current Butte County code does not allow for more than 12 at any one time. The permit allows no other changes to our home or property. It is not a request for commercial rezoning. It is considered a fair secondary use in a residential neighborhood with R-1 zoning. Please know that it is not our intent even to maintain the maximum allowable number of students for the following reasons. We have two children .of our own. They must be included in the total. If we were to have 10 children present plus our own two, there could never be any other children present. Our kids could never have a friend come over, and our relatives could not visit with their children during school hours (8:30 AM - 3:30 PM). With our current limit of four students plus our two children, we cannot have any additional children present, neither friends nor family. Also, because of the logistics of scheduling, it is impossible to maintain a full capacity on a daily basis.sThese reasons have-made.us� decide to not exceed eight children plus our own, on a regular basis. Enrollment in the afternoons is certain to be significantly fewer than eight since parents prefer mommgs. Because:the Acorn,Montessori'School'is a preschool.and not a daycare,,we have imposed'a 'thfurther -restriction of keeping to the hours of 8:30. AM to 3:30. PM. In regard to.traffic, we have requested that the parents: drive respectably, park in our driveways rather than on the street whenever possible, not allow their children to play in our front yard, and not to linger overlong to avoid any pileup of cars. As for noise, we believe that with a second adult present, it will be much easier to manage the volume level, even with a few more children. - Attached is a letter we wrote to everyone when we heard about the letter of protest, which we had not yet read for ourselves. I am licensed and insured (facility #45403110) for up to 8 children. I provide an environment where children can learn at their individual pace and •ability, and are encouraged to be independent, responsible, caring, and cooperative. The Montessori materials in my classroom prepare children for and motivate them toward intellectual, physical, social, and creative learning. There is a slight emphasis on Christian values and learning through books, songs, and study of science. We also focus on other cultures and countries so that the children can grow to understand the world around them. I have a deep respect for children and children's learning. I have been teaching preschool aged children since 1990 and I worked with older children before that. *All children are considered for enrollment without regard to race, religion,or national origin. Work gime: The children are free to use materials from the shelves and work by themselves or with other children. They may also paint at the easel, cut and glue paper, and do water play. I give lessons and assist the children in choosing and working with the materials. Snack'J time: The children sit at the table and pass around the snack which is provided by the school. Fruits, vegetables, cheese, crackers, etc. are served with juice or milk. Often, the children help prepare the snack. Grace is said before we eat. PCay `rime: The first part of outdoor playtime is spent In the gated driveway where the children ride wheel toys and play ball. Then we go to the shady lawn area which has a slide, swing set, sand box, and a play structure. On rainy. days the children play dress -ups or large movement games in the classroom. Occasionally, I take the children on neighborhood walks. group `rime: At the end of the morning we have a group time. We sing songs, use rhythm band instruments, read books, and do group lessons such as science, Bible stories, or geography. Once a week we have sharing day when each child can tell about an interesting experience or bring a special item from home. We end with a short prayer of thanks. Afternoon: After group time the children are dismissed to go home or to wash up for lunch. Children bring their lunches from home. Afterwards, we go outside for another playtime and then come in for a short group time and another work time. This is also nap time for those children who need to nap. Maria Montessori had a unique understanding of young children. Her educational method is based on her observations of children for who they are. Based on her understanding that children have a need to do purposeful work simply for the sake of the activity, rather than the completion of the job, she devised a total learning environment. This environment helps children gain self-respect and nurtures their natural desire to learn. As you are probably aware, Health and Safety Code Section 1597.46 specifies that local planning commissions cannot prohibit large family day care homes on single family zoned lots, but allows three options in these situations (see attachment.) I would encourage you to consider adoption of option 1, "permitted use" or option 2, °nondiscretionary permit." Over the last several years, the Child Care Advocate Program has worked with local zoning staff and large family day care providers throughout the state to establish or update local ordinances relative to LFDC. We have found that either option 1 or option 2 works well—depending on your community needs. We have also found that option 3, "conditional use permit' often acts as a barrier to providers who wish to expand their small family day care home to a large family day care home. The a reasons for this usually are: 1. high cost (often in the $1,000--$2,000 range) and 2. a long administrative process (including notification of neighbors and at least one hearing) The Child Care Advocate Program is committed to the development and'expansion,of quality;,licensed child care. Once again, I urge you to consider an option that will meet the zoning needs of your community as well as encourage experienced family day care providers to expand so that the critical need for child care can be met. BUTTE COUNTY PLANNING DI\IISII during a limited time of day and do not require the attendance of a large number of employees and equipment. - (b) The uses of congregate care facilities are distinguishable from the uses of family day care homes operated under the standards of state law. For purposes of this section, a "congregate care facility" means a "residential facility," as defined in paragraph (1) of subdivision (a) of Section 1502. Congregate care facilities are used throughout the day and night, and the institutional uses of these facilities are primary uses of the facilities, not accessory uses, and draw a large number of employees, vehicles, and equipment compared to that drawn to family day care homes. (c) The expansion permitted for family day care homes by Sections 1597.44 and 1597.465 is not appropriate with respect to congregate care facilities, or any other facilities with quasi -institutional uses. I Therefore, with these provisions, the Legislature does not intend to alter the legal standards governing congregate care facilities and these provisions are not intended to encourage, or be a precedent for, changes in statutory and case law governing congregate care I acilities. § 1597.44. Small Family Day Care Home; Schoolage Children A small family day care home may provide care for more than six and up to eight children, without an additional adult attendant, if all of the following conditions are met: (a) At least two of the children are at least six years of age. (b) No more than two infants are cared for during any time when more than six children are cared for. (c) The licensee notifies each parent that the facility is caring for two additional schoolage children and that there may be up to seven or eight children in the home at one time. (d) The licensee obtains the written consent of the property owner when the family day care home is operated on property that is leased or rented. § 1597.45. Small Family Day Care domes All of the following.shall apply to small family day care homes: (a) The use of single-family residence as a small family day care home shall be considered a residential use of property for the purposes of all local ordinances. (b) No local jurisdiction shall impose any business license, fee, or tax for the privilege of operating a small family day care home. (c) Use of a single-family dwelling for purposes of a small family day care home shall not constitute a change of occupancy for purposes of Part 1.5 (commencing with Section 17910) of Division 13 (State Housing Law) or for purposes of local building codes. (d) A small family day care home shall not be subject to Article 1 (commencing with Section 13100) or Article 2 (commencing with Section 13140) of Chapter 1 of Part 2, except that a small family day care home shall contain a fire extinguisher and smoke detector device that meet standards established by the State Fire Marshal. § 1597.46._.wLarge_family day-care homes - m All of the following shall apply to large family day care homes: (a) A city, county, or city and county shall not prohibit large family day care homes on lots zoned for single-family dwellings, but shall do one of the following: (1) Classify these homes as a permitted use of residential property for zoning purposes. (2) Grant a nondiscretionary permit to use a lot zoned for a single-family dwelling to any large family day care home that complies with local ordinances prescribing reasonable standards, restrictions, and requirements concerning- pacing and concentration, traffic control,_ pa_rkinq._and_noise control relating to such homes, and complies with subdivision (d) and any regulations adopted by the State Fire Marshal pursuant to that subdivision. Any noise standards shall be consistent with local noise ordinances .implementing the noise element of the general plan and shall take into consideration the noise level generated by children. The permit issued pursuant to this paragraph shall be granted by the zoning administrator, if any, or if there is no zoning administrator by the person or persons designated by the planning agency to grant such permits, upon the certification without a hearing. (3) Require any large family day care home to apply for a permit to use a lot zoned for single-family dwellings. The zoning administrator, if any, or if there is no zoning administrator,'the person or persons designated by the planning agency to handle the use permits shall review and decide the applications. The use permit shall be granted if the large family day care home complies with local ordinances, if any, prescribing reasonable standards, restrictions, and requirements concerning spacing and concentration, traffic control, parking, and noise control relating to such homes, and complies with subdivision (d) and any regulations adopted by the State Fire Marshal pursuant to that subdivision. Any noise standards shall be consistent with local noise ordinances implementing the noise element of the general plan and shall take into consideration the noise levels generated by children. The local government shall process any required permit as economically as possible, and fees charged for review shall not exceed the costs of the review and permit process. Not less than 10 days .prior to the date on which the decision will be made on the application, the zoning administrator or person designated to handle such use permits shall give notice. of the proposed use by mail or delivery to all owners shown on the last equalized assessment roll as owning real property within a 100 foot radius of the exterior boundaries of the proposed large family day care home. No hearing on the application for a permit issued pursuant to this paragraph shall be held before a decision is made unless a hearing is requested by the applicant or other affected person. The applicant or other affected person may appeal the decision. The appellant shall pay the cost, if any of the appeal. (b) A large family day care home shall not be subject to the provisions of Division 13 (commencing with Section 21000) of the Public Resources Code. (c) Use of a single-family dwelling for the purposes of a large family.day care home shall not constitute a change of occupancy for purposes of Part 1.5 (commencing with Section 1791.0) of Division 13 (State Housing Law), or for purposes of local building and fire codes. (d) Large family day care homes shall be considered as single-family residences for the purposes of the State Uniform Building Standards Code and local building and fire codes, except with respect to any additional standards specifically designed to promote the fire and life safety of the children in these homes adopted by the State Fire Marshal pursuant to this subdivision. The 79 State Fire Marshal shall adopt separate building standards specifically relating to the subject of fire and life safety in large family day care homes which shall be published in Title 24 of the California Administrative Code. These standards shall apply uniformly throughout the state and }� shall include, but not be limited to: (1) the requirement that a large family day care home contain a fire extinguisher or smoke detector device, or both, which meets standards established by the State Fire Marshal; (2) specification as to the number of required exits from the home; and (3) specification as to the floor or floors on which day care may be provided. Enforcement of these provisions shall be in accordance with Sections 13145 and 13146. No city, county, city and county, or district shall adopt or enforce any building ordinance or local role or regulation relating to the subject of fire and life safety in large family day care homes which is inconsistent with those standards adopted by the State Fire Marshal, except to the extent the building ordinance or local rule or regulation applies to single-family residences in which day care is not provided. (e) No later than April 1, 1984, the State Fire Marshal shall adopt the building standards required in subdivision (d) and any other regulations necessary to implement the provisions of this section. § 1597.465. Large Family Day Care Home; Schoolage Children A large family day care home may provide care for more than 12 children and up to and including 14 children, if all of the following conditions are met: (a) At least two of the children are at least six years of age. (b) No more than three infants are cared for during any time when more than 12 children are being cared for. (c) The licensee notifies a. parent that the facility is caring for two additional schoolage children and that there may be up to 13 or 14 children in the home at one time. (d) The licensee obtains the written consent of the property owner when the family, day care home is operated on property that is leased or rented. § 1597.47. Applicability of Chapter The provisions of this chapter shall not be construed to preclude any city, county, or other local public entity from placing restrictions on building heights, setback, or lot dimensions of a family day care facility as long as such restrictions are identical to those applied -toother single-family residences. The. provisions of this chapter shall not be construed to preclude the application to a family day care facility for children of any local ordinance which deals with health and safety, building standards, environmental impact standards, or any other matter within the jurisdiction of a local public entity. The provisions of this chapter also shall not be construed to prohibit or restrict the abatement of nuisances by a city, county, or city and county. However, such ordinance or nuisance abatement shall not distinguish family day care facilities from other single-family dwellings, except as otherwise provided in this chapter. § 1597.52. It appears to' me that Clara McKenzie's school. is indeed. different. from the average day care facility. She clearly iiniits her hours .su .°gat she is open only from 8:30 a.m. until 3:30 p.m. She also indicates that there is a difference in enrollment in the morning and the afternoon. This facility obviously is not set up to serve parents who must work full time. For this reason, I question whether this facility should be entitled to the kind of protection the state provides facilities which are open sufficient hours for parents who must work 40 or more hours a week. Ms. McKenzie's facility appears to be serving a more affluent population which has at least one parent free to pick up and deliver children. during the middle part of the day and, perhaps, even to care for them when they are not attending The Acorn Montessori School. What this means to the neighbors is additional traffic. The school may be limited to no more than 12 children at one time. However, it is certainly possible that enrollment could be as high as 24 children with 12 children attending a morning shift and 12 children attending an afternoon shift. This is, to me, a significant amount of traffic since I live directly across the street from the school. It is my understanding that the McKenzie's were advised in the hearing held on July 24 that they should contact neighbors to attempt to reach a compromise on the number of students enrolled at the school. To date, I have not heard from either of the McKenzie's regarding such a compromise. Before it makes a final decision, the Planning Department must determine whether the McKenzie Montessori school is a school or a large family day care facility. It has come to our attention that there is a concerted effort to block our application for a minor use permit from Butte County to'ezpand our license. It greatly saddens us that no one has approached us directly with any questions or concerns about our school or our request for the expanded license. Rather, they have taken measures to defeat our request without informing us of their intentions. Please consider these facts regarding the nature of our school and our reasons for requesting the expanded license. • The school hours are from 8:30 AM to 3:30 PM. Parents usually arrive within a half-hour window of time rather than all at once, between 8:30 to 9:00, for instance. • Children play in the backyard for about 40 minutes before noon and about 40 minutes after 1:00 PM. • The current license limits us to not more than six preschool aged children in our home at any time. • Because we have two young daughters of our own, we have no more than four paying students at a time. This translates into a gross earning potential (with full enrollment) of about $16 per hour. With the low afternoon enrollment, expenses, and self-employment tax on top of income tax this translates into very little net income. • Due to the logistics of scheduling, our school. currently has the full capacity of six students (including our children) only two mornings a week. Since parents prefer mornings, the afternoons typically have only one or two paying students. Attendance in the afternoons is unlikely to increase much with the expanded license. • Jim is not a teacher in our school, and Clara is the only teacher. The nature of the instruction and supervision of the students is such that it is more work and stress than Clara should have to manage alone. • With a current average gross monthly income from the school of less than $1,300, we cannot afford to hire an aid. • An aid is necessary to help with supervision, instruction, activities, and addressing individual student's needs. During the brief outdoor intervals, two adults would better E Cl manage the children's noise level. An aid will allow Clara the flexibility to speak with parents, take important phone calls, or carryout some other necessary activity that prevents her from being able to devote her full attention to -teaching and supervision. This would increase the quality of education we can provide, and greatly reduce her stress level. • We hope that the expanded license would allow us to expand to a total of six to eight paying students in the mornings, hire an aid, accommodate more flexibility in scheduling, and provide a more classroom -like environment for the children. • Our immediate neighbors have voiced their acceptance and support to us regarding the PPo 9 9 SO expansion. • We predict the impact on traffic would be to add two to four cars during pick-up or drop-off intervals, and we have plenty of parking available. Please consider if the the current two to four cars has really been a problem, or is even noticeable. • The expansion of the license will not change the outer appearance of our home in any way. • At this time, the school is our family's primary source of income. Jim is completing coursework to become a music teacher in the public school system. His prospects for teaching locally are quite good. Upon reading the letter, we were greatly shocked and dismayed as it implies that we plan to establish a large commercial daycare center. That is very different from the family childcanedwim we have. We understand your outrage to this, and wish to assure you that the minor use permit allows nothing of that sort. California licensing laws do not allow a family childcare home to exceed 14 children, and leave the actual number up to each county. Current Butte County code does not allow for more than 12 at any one time. The permit allows no other changes to our home or property. It is not a request for commercial rezoning. It is considered a fair secondary use in a residential neighborhood with R-1 zoning. Please know that it is not our intent even to maintain the maximum allowable number of students for the following reasons. We have two children of our own. They must be included in the total. If we were to have 10 children present plus our own two, there could never be any other children present. Our kids could never have a friend come over, and our relatives could not visit with their children during school hours (8:30 AM - 3:30 PM). With our current limit of four students plus our two children; we cannot have any additional children present, neither friends nor family. Also, because of the logistics of scheduling, it is impossible to maintain a full capacity on a daily basis. These reasons have made us decide to not exceed eight children plus our own, on a regular'basis. Enrollment in the afternoons is certain to be significantly fewer than eight since parents prefer momings. Because the Acorn Montessori School is a preschool and not a daycare, we have imposed a the further restric m of keeping to the hours of 8:30 AM to 3:30 PM. In regard to traffic, we have requested that the parents: drive respectably, park in our driveways rather than on the street whenever possible, not allow their children to play in our front yard, and not to linger overlong to avoid any pileup of cars. As for noise, we believe that with a second adult present, it will be much easier to manage the volume level, even with a few more children. Attached is a letter we wrote to everyone. when we heard about the letter of protest, which we had not yet read for ourselves. Our letter describes in greater detail our plans and reasons for them. I provide an environment where children can learn at their individual pace and •ability, and are encouraged to be independent, responsible, caring, and cooperative. The Montessori materials in my classroom prepare children for and motivate them toward intellectual, physical, social, and creative learning. Then we go to the shady lawn area which has a slide, swing set, sand box, and a play structure. On rainy days the children play dress -ups or large movement games in the classroom. Occasionally, I take the children on neighborhood walks. group Time: At the end of the morning we have a group time. We sing songs, use rhythm band instruments, read books, and do group lessons such as science, Bible stories, or geography. Once a week we have sharing day when each child can tell about an interesting experience or bring a special item from home. We end with a short prayer of thanks. Afternoon: After group time the children are dismissed to go home or to wash up for lunch. Children bring their lunches from home. Afterwards, we go outside for another playtime and then come in for a short group time and another work time. This is also nap time for those children who need to nap. Maria Montessori had a unique understanding of young children. Her educational method is based on her observations of children for who they are. Based on her understanding that children have a need to do purposeful work simply for the sake of the activity, rather than the completion of the job, she devised a total learning environment. Upon inspection of the Ekmans' letter (hear after referred to as "the letter"), and after speaking with the Ekmans, we have determined that the letter was based on the misinformation and misconception that we were seeking commercial rezoning to create a large commercial daycare center. In light of the truth, the Ekmans have changed their position on this issue, now support our plans, and say that they are writing a letter of retraction. We have since spoken with a number of our neighbors, some of whom signed the letter. Most were relieved to hear the true details. Some still have some concerns about traffic. One, who actually lead the crusade against us, refused to even listen to the true facts, clings to his misconceptions, and maintains that we are liars bent on destroying the neighborhood. Below is a point by point rebuttal of the letter. We ask that you consider their petition to be invalid since the individuals signing it had been misinformed and mislead regarding our application for Minor Use Permit, AP 007-072-014,#UP 02-20. We have included a copy of the letter so that you may cross reference our rebuttal. 1. The statements in point 1 are true. 2. The letter states that our house is small. At 1735 square feet (not counting the detached shop) on .34 acre, we do not consider our house or lot to be small. . Regarding noise, we predict that noise management actually will improve with the additional adult supervision. The letter states that the children make 'the usual noises that children at play make'. Since children are allowed in an R-1 neighborhood, their "usual noises" can hardly be used as an argument against us. Furthermore, there are several residences in our immediate area with noisy children. Perhaps their contributions to the noise level are being attributed to us. 3. We are, in fact, not experiencing a shortage of parking space. Our car that was parked across the street was clearly marked for sale, and was parked in front of 761 Lindo Lane (an unoccupied house) not the Ekmans house. We parked it there while we were in the process of selling it so that it would not be hit by our lawn sprinklers, which leave water spots. Our car was there for less than three weeks and was sold on 7/15/02. During pick up and drop off, parents exclusively park on our side of the street, and usually only our driveways are occupied. In a personal communication Mary Ekman said that they actually have and no problems entering or exiting their driveway due to the parents' cars. 4. The letter states that we plan to add "at least 12 more children" to the current enrollment. The Ekmans agree that they were misinformed about the type of permit we have requested. We will comply with all the conditions that the Minor Use Permit in Butte County requires, which currently states no more than 12 children at any one time. Also,your office is aware that we have a septic system, and we supplied the location of the leach lines. Your office has not indicated that this is a problem. 5. In this point, the letter states that we are requesting a zoning change. Clearly, we are not. It is our understanding that the minor use permit allows the establishment of a child care home under R-1 zoning and that is a permitted secondary use of a residential home. There is further speculation about commercial development and expansion of our school. This is impossible, as the license for 12 to 14 children is the state mandated limit on any Family Child Care Home. At the time that we found out about the letter, none of the neighbors had ever spoken to us about the concerns stated in the letter, or much of this confusion might have been avoided. After we found out about the petition from another neighbor, we wrote a letter to all the neighbors stating our side of the argument (also included with this letter) and, after we acquired a copy of the petition, we went door to door to discuss the issue with everyone personally. We strenuously object to this proposal to allow the establishment of a small business in this long-established residential neighborhood for the following reasons: 1. This is a stable neighborhood of smaller houses. Many of the residents are original owners and have lived here since its inception in 1950. Places like this deserve the continued protection by the county. 2. It would deprive the immediate neighbors from the peace and tranquility they have come to expect in an R -t area after devoting years in the workplace. The McKenzie house is small, and children do spill out into the yard making the usual noises that children at play make. Currently, this noise carries for some distance. Currently, the McKenzie's are, in fact, experiencing a shortage of parking space as- eyidenced by the fact that they have parked one of their cars across the street from their house on a permanent basis. Even now, when parents drop off and pick up their children, it is very difficult for us to exit our own driveway because cars are parked on both sides of the street and are entering and exiting two driveways in the. McKenzie front yard. 4. All homes in this neighborhood are on septic systems and have restrictions regarding expansion. We realize that it was a laps in good judgment on our part not to inform the neighborhood about our plan to add a few more students and to hire an aid. We are very sorry for that. The actual change we planned was relatively minor, and perhaps we assumed that no one would even notice the change. We also want you to know how we appreciate the way this community has come together to protect its integrity. The letter.of protest that recently circulated was based on incorrect information given by the county office. Upon reading the letter, we were greatly shocked and dismayed as it implies that we plan to establish a large commercial daycare center. That is very different from the family childcare home we have. We understand your outrage to this, and wish to assure you that the minor use permit allows nothing of that sort. California licensing laws do not allow a family childcare home to exceed 14 children, and leave the actual number up to each county. Current Butte County code does not allow for more than 12 at any one time. The permit allows no other changes to our home or property. It is not a request for commercial rezoning. It is considered a fair secondary use in a residential neighborhood with R-1 zoning. Please know that it is not our intent even to maintain the maximum allowable number of students for the following reasons. We have two children of our own. They must be included in the total. If we were to have 10 children present plus our own two, there could never be any other children present. Our kids could never have a friend come over, and our relatives could not visit with their children during school hours (8:30 AM - 3:30 PM). With our current limit of four students plus our two children, we cannot have any additional children present, neither friends nor family. Also, because of the logistics of scheduling, it is impossible to maintain a full capacity on a daily basis. These reasons have made us decide to not exceed eight children plus our own, on a regular basis. Enrollment in the afternoons is certain to be significantly fewer than eight since parents prefer momings. Because the Acorn Montessori School is a preschool and not a daycare, we have imposed a the further restriction of keeping to the hours of 8:30 AM to 3:30 PM. In regard to traffic, we have requested that the parents: drive respectably, park in our driveways rather than on the street whenever possible, not allow their children to play in our front yard, and not to linger overlong to avoid any pileup of cars. As for noise, we believe that with a second adult present, it will be much easier to manage the volume level, even with a few more children. Attached is a letter we wrote to everyone when we heard about the letter of protest, which we had not yet read for ourselves. Our letter describes in greater detail our plans and reasons for them. Then we go to the shady lawn area which has a slide, swing set, sand box, and a play structure. On rainy. days the children play dress -ups or large movement games in the classroom. Occasionally, I take the children on neighborhood walks. C3. roup Time: At the end of the morning we have a group time. We sing songs, use rhythm band instruments, read books, and do group lessons such as science, Bible stories, or geography. Once a week we have sharing day when each child can tell about an interesting experience or bring a special item from home. We end with a short prayer of thanks. Afternoon: After group time the children are dismissed to go home or to wash up for lunch. Children. bring their lunches from home. Afterwards, we go outside for another playtime and then come in for a short group time and another work time. This is also nap time for those children who need to nap. With the low afternoon enrollment, expenses,,and self-employment tax on top of income tax this translates into very little net income. • Due to the logistics of scheduling, our school, currently has the full capacity of six, students (including our children) only two mornings a week. Since parents prefer mornings, the afternoons typically have only one or two paying students. Attendance in the afternoons is unlikely to increase -much with the expanded license. • Jim is not a teacher in our school, and Clara is the only teacher. The nature of the instruction and supervision of the students is such that it is more work and stress than Clara should have to manage alone. • With a current average gross monthly income from the school of less than $1,300, we cannot afford to hire an aid. • An aid is necessary to help with supervision, instruction, activit O rW aI&ASS Y LS individual student's needs. As an educator and a grandmother, I know that good child care with qualified, credentialed early childhood teachers is a treasure for any neighborhood. The children at the school next door to me, and right next to my open windows where I do my own studying and school work, are well behaved, quiet and obviously involved in the kinds of creative activities associated with the Montessori technique. I know that some of you (neighbors) are concerned about increased traffic, relaxing of codes and zoning. Rest assured that the traffic issue is a non -problem. I have already assured Clara that parents may use the curb in front of my house which is big enough to accommodate all therpa ents! Many people already park there and I hardly notice. As for relaxing of the zoning in our neighborhood, this is not going to happen. Several child care centers have existed in the neighborhood, including one at the location of the Acorn school. Parents usually arrive within a half-hour window of time .rather than all at once, between 8:30 to 9:00, -for instance. • Children play in the backyard for about 40 minutes before noon and about 40 minutes after 1:00 PM. • The current license limits us to not more than six preschool aged children in our home at any time. • Because we have two young daughters of our own, we have no more than four paying students at a time. This translates into a gross earning potential (with full enrollment) of about $16 per hour. With the low afternoon enrollment, expenses, and self-employment tax on top of income tax this translates into very little net income. • Due to the logistics of scheduling, our school currently has the full capacity of six students (including our children) only two mornings a week. Since parents prefer mornings, the afternoons typically have only one or two paying students. Attendance in the afternoons is unlikely to increase much with the expanded license. • Jim is not a teacher in our school, and Clara is the only teacher. The nature of the instruction and supervision of the students is such that it_ is more work and stress than Clara should have to manage alone. • With a current average gross monthly income from the -school of less than $1,300, we cannot afford to hire an aid. • An aid is necessary to help with 'supervision, instruction,'- activities, and addressing individual student's needs. During the brief outdoor intervals, two adults would better w w manage the children's noise level. An aid will allow Clara the flexibility to speak with parents, take important phone calls, or carryout some other necessary activity that prevents her from being able to devote her full attention to teaching and supervision. This would increase the quality of education we can provide, and greatly reduce her stress level. • We hope that the expanded license would allow us to expand to a total of six to eight paying students in the mornings, hire an aid, accommodate more flexibility in scheduling, and provide a more classroom -like environment for the children. • Our immediate neighbors have voiced their acceptance and support to us regarding the expansion. • We predict the impact on traffic would be to add two to four cars during pick-up or drop-off intervals, and we have plenty of parking available. Please consider if the the current two to four cars has really been a problem, or is even noticeable. • The expansion of the license will not change the outer appearance of our home in any way. • At this time, the school is our family's primary source of income. Jim is completing coursework to become a music teacher in the public school system. His prospects for teaching locally are quite good. We like Chico very much, and hope to stay. • We have included an informative mailer about the Acorn Montessori School, and invite you to come to observe and meet us if you have any further concerns. We understand a petition is circulating in protest to our application for the expanded license. We ask only that you consider the facts about our school and our plans before you sign the petition. On Thursday, I received a call from Craig Sanders, a Planner for Butte County. The following is a summary of the two main points he made: The State mandates that the County cannot disprove a day care use permit. The County is allowed to put restrictions in the permit. Those restrictions relate to things like driveways available and the number of children allowed. The State allows 14 children and the County allows 12 children. This means that because of the current county code, the maximum number of children allowed will be no more than 12. The County allows a wide range of activities in an R-1.zone as long as they do not create excessive noise, such as the sound of wood saws or the whine of tools used in a wheel alignment/brake business, or cause any other environmental disturbance air pollution. In those cases, environmental studies have to be done. It would deprive the immediate neighbors from the peace and tranquility they have come to expect in an R-1 area after devoting years in the workplace. The McKenzie house is small, and children do spill out into the yard making the usual noises that children at play make. Currently, this noise carries for some distance. An increase in the number of children can only increase the level of noise. J. An increase in the size of the facility would also cause an increase in traffic. Currently, the McKenzie's are, in fact, experiencing a shortage of parking space as evidenced by the fact that they have parked one of their cars across the street from their house on a permanent basis. Even now, when parents drop off and pick up their children, it is very difficult for us to exit our own driveway because cars are parked on both sides of the street and are entering and exiting two driveways in the McKenzie front yard. 4.
