APN 043-200-005 (SB) (MUP 03-03) It was moved by Commissioner Leland, seconded by Commissioner Marin, and unanimously carried to approve the Minor Use Permit for Cingular Wireless (Linda Langston) subject to the findings and conditions listed below: Find that the project is exempt from the provisions of the California Environmental Quality Act under Section 15301. Section 15301 (Existing Facilities) consists of the leasing and minor alteration of existing public utility structure(s) involving negligible or no expansion of use. The proposed wireless communication facilities co -located on the existing monopole constitute a negligible expansion of the existing use. II. Approve a Minor Use Permit 03-03 for Cingular Wireless, subject to the conditions in Exhibit "A" and the following findings: A. The proposed location, size, design, and operating characteristics of the proposed use are in accordance with the purpose of this Ordinance, the purpose of the zone in which the site is located, the Butte County General Plan, and the development policies and standards of the County because: Conditions of approval have been applied to this project pursuant to the applicable requirements of Section 24-262 (Wireless Communication Facilities). The project is in accordance with the purpose of the zone in which the land lies and the Butte County General Plan because the project site is designated Commercial and is zoned C-1. The Commercial land use designation allows public utilities as Secondary Uses. The C-1 zone allows colocation of communication facilities with approval of a Minor Use Permit. B. The location, size, design, and operating characteristics of the proposed use would be compatible with, and would not adversely affect, or be detrimental to adjacent uses, residents, buildings, structures, or natural resources, with consideration given to: Harmony in scale, bulk, coverage, and density: The proposed antennas would not increase the height of the existing monopole or extend horizontally beyond the existing antennas. 2. The availability of public facilities, services and utilities: ■ BUTTE COUNTY PLANNING COMMISSION ■ MINUTES ■ SEPTEMBER 26. 2000 ■ PAGE 11 ■ Electrical power service is already established to the property and no additional services or utilities are required. 3. The harmful effect, if any, upon desirable neighborhood character: The project site is already developed with a 141 foot tall monopole. The proposed antennas to be mounted on the existing monopole would not have a harmful effect upon the neighborhood character. The radio-frequency emissions from the proposed antennas must meet FCC standards Only a minor amount of vehicle traffic would be generated during installation of the antennas and equipment cabinets. The communications facility is unmanned and only one to two siie visits per month per wireless carrier would be required after installation of the antennas. 5. The suitability of the site for the type and intensity of use or development which is proposed: The site is ideally suited for the project because the proposed antennas would be mounted on an existing 141 foot tall monopole. The project would not have an impact on the commercial use established on the site. 6. Any other relevant impact of the proposed use: The Planning Division has circulated the proposed communication facility application to County Agencies and has received no evidence that the use would cause any other relevant impact. C. Based on the above findings, the proposed location, size, design, and. operating characteristics of the proposed use and the conditions under which it would be operated or maintained would not be detrimental to the public health, safety, or welfare, or injurious to properties or improvements in the vicinity. D. The proposed use will comply with, each of the applicable provisions of the Chapter 24, Section 262, of the Butte County Code. E. This project would colocate antennas on an existing communications monopole, which eliminates the need for a new communications tower to be erected elsewhere in the project area. F. The radio-frequency 'emissions generated by all of the antennas on the monopole are below the limits set by the Federal Communications Commission. G. . The proposed antennas would not create any impacts to aircraft operations. Conditions of Approval: ■ BUTTE COUNTY PLANNING COMMISSION ■ MINUTES ■ SEPTEMBER 26. 2000 ■ PAGE 12 ■ Planning Division: The new antennas and mounting hardware shall be painted to match the color of the existing monopole. 2. The Facility must meet or fall within current standards and regulations of the FAA, the FCC, the County, and any other agency of the Federal or State government with the authority to regulate such Facilities. The installation of the Facility shall comply with all applicable building and electrical codes. The Facility operator shall submit certification from a registered structural engineer to the' Building Division, that all associated monopoles and towers in excess of thirty (30) feet in height will withstand sustained winds as required by the Uniform Building Code. 4. No advertising or display shall be permitted on the Facility. The placement of any antenna or structure shall not adversely affect any on-site sewage disposal system or its repair area without written approval from the Division of Environmental Health. 6. The installation of the Facility shall not violate any existing deed restrictions. 7. The Facility shall have a twelve (12) -foot wide all-weather access to a publicly maintained road capable of supporting a forty thousand (40,000) -pound fire apparatus with fifteen (15) feet of vertical clearance. There shall be no outdoor vehicle or equipment storage except for emergency purposes. 9. The Facility shall fall within current standards and regulations of the FAA, the FCC, and any other State and/or Federal agency with the authority to regulate such Facility. If such standards and regulations are changed, the property owner or responsible party shall bring the Facility into compliance with such revised standards and regulations within ninety (90) days of the effective date of such standards and regulations, unless a more stringent compliance schedule is mandated by the controlling agency. 10. The Facility or combination of the Facilities on the site shall not generate, at any time, electromagnetic frequency radiation (EMF) or radio frequency radiation (RF) in excess of the FCC adopted standards for human exposure, as amended over time. 11. If it is found that the Facility is or will be detrimental to the health, safety, or welfare of persons working or residing near such facility, then the service provider(s) and property owner shall be jointly and solely responsible for the removal, adjustment, or replacement of the Facility. In no case shall the Facility remain in operation if it is found to create a hazard to health, safety, and welfare. The Facility shall not be found to create a hazard to health, ■ BUTTE COUNTY PLANNING COMMISSION ■ MINUTES ■ SEPTEMBER 26.2000 ■ PAGE 13 ■ safety, or welfare as a result of EMF or RF emissions from the Facility so long as it meets all current standards established by the FCC, pursuant to FCC OET 65. 12. Prior to issuance of the building permit for the installation of the Facility, the applicant shall post a performance security in an amount and form determined by the Director of Development Services that is sufficient to cover the cost of a one-time test by a radio frequency consultant selected by the County, sufficient to determine whether the Facility's RF/EMF emissions comply with FCC standards. If the Facility's emissions are determined to exceed FCC standards, the applicant is required to pay for such other tests and other corrective measures as are necessary to establish compliance with FCC OET 65 and its successors and such noncompliance shall constitute sufficient grounds to commence a permit revocation hearing which may lead to permit revocation. The applicant shall cooperate in all respects with the County's consultant to assist the consultant to reach his/her conclusion. 13. All Facilities that are not in continual use for a period of six (6) months shall be considered abandoned. Abandoned Facilities are hereby designated as unlawful and as public nuisances, requiring no amortization period. If the Director of Development Services determines that the Facility is abandoned, the applicant may be required to remove all equipment belonging to the applicant from the premises and return the site to its original condition within thirty (30) calendar days of receipt of notice to abate. If such Facility is not removed and the site returned to its original condition within thirty (30) days, the County may remove the Facility at the applicant's and/or land owner's joint and several expense. 14. All ground level support Facilities shall be painted and/or screened from view with adequate landscaping appropriate to the surrounding environment. -All aesthetic treatments, including landscaping shall be maintained as approved for the life of the Facility. 15. The Facility may not encroach into, under, over, above, or upon any public street in the unincorporated area of the County in the absence of a valid encroachment permit from the County. 16. The owner/operator of the Facility shall annually submit a written verification, attested to under penalty of perjury, signed by both the owner/operator and an FCC licensee in the employ of or retained by the owner/operator, that the radio frequency radiation/electromagnetic frequency (RF/EMF) emitted by the facility conforms to safety standards set forth in FCC OET 65. The reports prepared for the Facility shall conform to reporting requirements set by the FCC and the County: The reports shall be submitted to the Planning Division no later than January 31 of each year. 17. The Facility shall be secured at all times to prevent access by the public. 18. The project site shall be developed in accordance with the approved project site plan and the conditions contained herein. Said site plan is on file in the Planning Division, is identified as "Exhibit D" and date-stamped August 6, 2002, and is incorporated herein by this reference. ■ BUTTE COUNTY PLANNING COMMISSION ■ MINUTES ■ SEPTEMBER 26. 2000 ■ PAGE 14 ■ 19. Prior to use of this project, the applicant shall contact the Planning Division for a field inspection to verify all conditions of approval and ordinance requirements have been met. 20. Applicant must also comply with all other applicable State and local statutes, ordinances, and regulations. Building Division 21. Building permits are required. Prepare four (4) sets of construction plans and make an application for permit. Construction shall comply with federal, state, and local regulations. Plans shall be prepared, sealed and signed by a California Licensed Architect or Registered Engineer for non-residential buildings and certain residential buildings. F 22. Proposed improvements shall comply with recorded map conditions applicable to construction. 23. Development fees for the proposed residential or non-residential improvements shall be paid prior to the issuance of building permits. The fees shall be those in effect at time of application, and shall include, but not be limited to, School Fees, Park and Recreation District fees, Water and Sewer Service Fees, Permit and Plan Check fees, and Fire Protection Fees. Environmental Health Division 24. Prior to issuance of building permits, submit a Hazardous Material Release Response Plan for the existing propane tanks, as required by Chapter 6.95 of the California Health and Safety Code. ,County Counsel 25. The property is located on the north side of Nord Avenue (SR 32), approximately 0.23 miles north of West Sacramento Avenue, at 12998 Nord Avenue, Chico. APN 043-200-005 (SB) (MUP 03-03) Mr. Betts gave a brief summary of the project. He noted that the Radio Frequency Analysis was completed. He said that Linda Langston from Cingular Wireless asked if the $2,500 bond was necessary. He said that she also questioned the necessity for Condition 14 and Mr. Betts agreed that Condition 14 could be deleted. There was also a question on the fencing and Mr. Betts said that he would like Condition 17 to remain. The hearing was opened to the public. Mr. Mauck, Cingular Wireless, said that he read the staff report and he felt that Condition 17 could be satisfied by the existing fence. Mr. Breedon suggested changing Condition 17 to read: "The existing fence shall be maintained at all times to prevent access by the public." Mr. Mauck agreed with the change to Condition 17. The hearing was closed. Mr. Breedon concurred with staff's recommendation to recommend approval of the Minor Use Permit for Cingular Wireless subject to the findings and conditions listed below deleting Condition 14, changing Condition 17 to read "The existing fence shall be maintained at all times to prevent access by the public."; re -numbering the remaining conditions, and to send this request forward to the Planning Commission on September 26, 2002. Recommend that the Planning Commission find that the project is exempt from the provisions of the California Environmental Quality Act under Section 15301. Section 15301 (Existing Facilities) consists of the leasing and minor alteration of existing public utility structure(s) involving negligible or no expansion of use. The proposed wireless communication facilities co -located on the existing monopole constitute a negligible expansion of the existing use. II. The Commercial land use designation allows public utilities as Secondary Uses. The C-1 zone allows colocation of communication facilities with approval of a Minor Use Permit. B. The location, size, design, and operating characteristics of the proposed use would be compatible with, and would not adversely affect, or be detrimental to adjacent uses, residents, buildings, structures, or natural resources, with consideration given to: Harmony in scale, bulk, coverage, and density: The proposed antennas would not increase the height of the existing monopole or extend horizontally beyond the existing antennas. 2. The availability of public facilities, services and utilities: Electrical power service is already established to the property and no additional services or utilities are required. 3. The harmful effect, if any, upon desirable neighborhood character: : The project.site is already developed with a 141 foot tall monopole. The proposed antennas to be mounted on the existing monopole would not have a harmful effect upon the neighborhood character. The radio-frequency emissions from the proposed antennas must meet FCC standards. Only a minor amount of vehicle traffic would be generated during installation of the antennas and equipment cabinets. The communications facility is unmanned and only one to two site visits per month per wireless carrier would be required after installation of the antennas. The suitability of the site for the type and intensity of use or development which is proposed: The site is ideally suited for the project because the proposed antennas would be mounted on an existing 141 foot tall monopole. The project would not have an impact on the commercial use established on the site. 6. Any other relevant impact of the proposed use: The Planning Division has circulated the proposed communication facility application to County Agencies and has received no evidence that the use ■ BUTTE COUNTY PLANNING SERVICES MEETING ■ MINUTES ■ SEPTEMBER 11, 2002 ■ PAGE 12 ■ would cause any other relevant impact. C. Based on the above findings, the proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it would be operated or maintained would not be detrimental to the public health, safety, or welfare, or injurious to properties or improvements in the vicinity. D. The proposed use will comply with each of the applicable provisions of the Chapter 24, Section 262, of the Butte County Code. , E. This project would colocate antennas on an existing communications monopole, which eliminates the need for a new communications tower to be erected elsewhere in the project area. F. The radio-frequency emissions generated by all of the antennas on the monopole are below the limits set by the Federal Communications Commission. G. The proposed antennas would not create any impacts to aircraft operations. Conditions of Approval: Planning Division: The new antennas and mounting hardware shall be painted to match the color of the existing monopole. 2. The Facility must meet or fall within current standards and regulations of the FAA, the FCC, the County, and any other agency of the Federal or State government with the authority to regulate such Facilities. 3. The installation of the Facility shall comply with all applicable building and electrical codes. The Facility operator shall submit certification from a registered structural engineer to the Building Division, that all associated monopoles and towers in excess of thirty (30) feet in height will withstand sustained winds as required by the Uniform Building Code. 4. No advertising or display shall be permitted on the Facility. The placement of any antenna or structure shall not adversely affect any on-site sewage disposal system or its repair area without written approval from the Division of Environmental Health. 6. The installation of the Facility shall not violate any existing deed restrictions. 7. There shall be no outdoor vehicle or equipment storage except for emergency purposes. 9. The Facility shall fall within current standards and regulations of the FAA, the FCC, and any other State and/or Federal agency with the authority to regulate such Facility. If such standards and regulations are changed, the property owner or responsible party shall bring the Facility into compliance with such revised standards and regulations within ninety (90) days of the effective date of such standards and regulations, unless a more stringent compliance schedule is mandated by the controlling agency. 10. The Facility or combination of the Facilities on the site shall not generate, at any time, electromagnetic frequency radiation (EMF) or radio frequency radiation (RF) in excess of the FCC adopted standards for human exposure, as amended over time. 11. If it is found that the Facility is or will be detrimental to the health, safety, or welfare of persons working or residing near such facility, then the service provider(s) and property owner shall be jointly and solely responsible for the removal, adjustment, or replacement of the Facility. In no case shall the Facility remain in operation if it is found to create_ a hazard to health, safety, and welfare. The Facility shall not be found to create a hazard to health, safety, or welfare as a result of EMF or RF emissions from the Facility so long as it meets all current standards established by the FCC, pursuant to FCC OET 65. 12. Prior to issuance of the building permit for the installation of the Facility, the applicant shall post a performance security in an amount and form determined by the Director of Development Services that is sufficient to cover the cost of a one-time test by a radio frequency consultant selected by the County, sufficient to determine whether the Facility's RF/EMF emissions comply with FCC standards. If the Facility's emissions are determined to exceed FCC standards, the applicant is required to pay for such other tests and other corrective measures as are necessary to establish compliance with FCC OET 65 and its successors and such noncompliance shall constitute sufficient grounds to commence a permit revocation hearing which may lead to permit revocation. The applicant shall cooperate in all respects with the County's consultant to assist the consultant to reach his/her conclusion. 13. All Facilities that are not in continual use for a period of six (6) months shall be considered abandoned. Abandoned Facilities are hereby designated as unlawful and as public nuisances, requiring no amortization period. If the Director of Development Services determines that the Facility is abandoned, the applicant may be required to remove all equipment belonging to the applicant from the premises and return the site to its original condition within thirty (30) calendar days of receipt of notice to abate. If such Facility is not removed and the site returned to its original condition within thirty (30) days, the County may remove the Facility at the applicant's and/or land owner's joint and several expense. 14. The owner/operator of the Facility shall annually submit a written verification, attested to under penalty of perjury, signed by both the owner/operator and an FCC licensee in the employ of or retained by the owner/operator, that the radio frequency radiation/electromagnetic frequency (RF/EMF) emitted by the facility conforms to safety standards set forth in FCC OET 65. The reports prepared for the Facility shall conform to reporting requirements set by the FCC and the County. The reports shall be submitted to the Planning Division no later than January 31 of each year. 16. The existing fence shall be maintained at all times to prevent access by the public. 17. The project site shall be developed in accordance with the approved project site plan and the conditions contained herein. Said site plan is on file in the Planning Division, is identified as "Exhibit D" and date-stamped August 6, 2002, and is incorporated herein by this reference. 18. Prior to use of this project, the applicant shall contact the Planning Division for a field inspection to verify all conditions of approval and ordinance requirements have been met. 19. Prepare four (4) sets of construction plans and make an application for permit. Construction shall comply with federal, state, and local regulations. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 4. If any use for which a Minor Use Permit has been granted is not established within one year of the date of approval, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. A Minor Use Permit subject to lapse may be renewed for an additional period of up to one year, provided that sixty (60) calendar days prior to the expiration date, an application for renewal of the Minor Use Permit is filed with the Planning Division on the prescribed form and accompanied by the necessary data and fees. 5. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. 1 6. Neither the applicant, nor any agent nor representative of the applicant shall intentionally omit or misrepresent any material fact in connection with the application. Any alleged material misrepresentation shall constitute grounds for the Director of Development Services to commence a revocation hearing, and, if proven to exist, shall constitute sufficient grounds to revoke a permit. . Conditions of Approval: Planning Division: 1. The new antennas and mounting hardware shall be painted to match the color of the existing monopole. 2. The Facility must meet or fall within current standards and regulations of the FAA, the FCC,. the County,' and any other agency of the Federal or State government with the authority to regulate such Facilities. 3. The installation of the Facility shall comply with all applicable building and electrical codes. The Facility operator shall submit certification from a registered structural engineer to the Building Division, that all associated monopoles and towers in excess of thirty (30) feet in height will withstand sustained winds as required by the Uniform Building Code. 4. No advertising or display shall- be permitted on the Facility. 5. The placement of any antenna or structure shall not adversely affect any on-site sewage disposal system or its repair area without written approval from the Division of Environmental Health. 6. The installation of the Facility shall not violate any existing deed restrictions. 7. The Facility shall have a twelve (12) -foot wide all-weather access to a publicly maintained road capable of supporting a forty thousand (40,000) -pound fire apparatus with fifteen (15) feet of vertical clearance. 8. There shall be no outdoor vehicle or equipment storage except for emergency purposes. 9. The Facility shall fall within current standards and regulations of the FAA, the FCC, and .any other State and/or Federal agency with the authority to regulate such Facility. If such standards and regulations are changed, the property owner or responsible party shall bring the Facility into compliance with such revised standards and regulations within ninety (90) days of the effective date of such standards and regulations, unless a more stringent compliance schedule is mandated by the controlling agency. 2 10: The Facility or combination of the Facilities on the site shall not generate, at any time, electromagnetic frequency radiation (EMF) or radio frequency radiation (RF) in excess of the FCC adopted standards for human exposure, as amended over time. 11. If it is found that the Facility is or will be detrimental to the health, safety, or welfare of persons working or residing near such facility, then the service provider(s) and property owner shall be jointly and solely responsible for the removal, adjustment, or replacement of the Facility. In no case shall the Facility remain in operation if it is found to create a hazard to health, safety, and welfare. The Facility shall not be found to create a hazard to health, safety, or welfare as a result of EMF or RF emissions from the Facility so long as it meets all current standards established by the FCC, pursuant to FCC OET 65. 12. Prior to issuance of the building permit for. the installation of the Facility, the applicant shall post a performance security in an amount and form determined by the Director of Development Services that is sufficient to cover the cost of a one-time test by a radio frequency consultant selected by the County, sufficient to determine whether the Facility's RF/EMF emissions comply with FCC standards. If the Facility's emissions are determined to exceed FCC standards, the applicant is required to pay for such other tests and other corrective measures as are necessary to establish compliance with FCC OET 65 and its successors and such noncompliance shall constitute sufficient grounds to commence a permit revocation hearing which may lead to permit revocation. The applicant shall cooperate in all respects with the County's consultant to assist the consultant to reach his/her conclusion. 13. All Facilities that are not in continual use for a period of six (6) months 'shall be considered abandoned. Abandoned Facilities are hereby designated as unlawful and as public nuisances, requiring no amortization period. If the Director of Development Services determines that the Facility is abandoned, the applicant may be required to remove all equipment belonging to the applicant from the premises and return the site to its original condition within thirty (30) calendar days of receipt of notice to abate. If such Facility is not removed and the site returned to its original condition within thirty (30) days, the County may remove the Facility at the applicant's and/or land owner's joint and several expense. 14. All ground level support Facilities shall be painted and/or screened from view with adequate landscaping appropriate to the surrounding environment. All aesthetic treatments, including landscaping shall be maintained as approved for the life of the Facility. 15. The Facility may not encroach into, under, over, above, or upon any public street in the unincorporated area of the County in the absence of a valid encroachment permit from the County. 16. The owner/operator of the Facility shall annually submit a written verification, attested to under penalty of perjury, signed by both the owner/operator and an FCC licensee in the employ of or retained by the owner/operator, that the radio frequency 3 radiation/electromagnetic frequency (RF/EMF) emitted by the facility conforms to safety standards- set forth in FCC OET 65. The reports prepared for the Facility shall conform to reporting requirements set by the FCC and the County. The reports shall be submitted to the Planning Division no later than January 31 of each year. IT The Facility shall be secured at all times to prevent access by the public. 18. The project site shall be developed in accordance with the approved project site plan and the conditions contained herein. Parcels to the north of the site are zoned C-1. The parcels to the west, east, and south are located within the City of Chico and are zoned by the City R-2 (Medium Density Residential), R-3 (Medium -High Density Residential), and R-3 respectively. The Union Pacific Railroad tracks are located on the east side of the project site. Land uses on the surrounding parcels include a mosque and commercial uses to the north, apartments to the east (across the railroad tracks) and south, and apartments to the west (across Nord Avenue). The project site is developed with a commercial business (Use Permit 85-38) that retrofits vans with adaptive equipment for use by individuals with disabilities. A 141 -foot tall monopole and related communication equipment shelters/cabinets also occupy the site. The existing monopole was approved in 1994 with Use Permit 95-22, and Minor Use Permit 02-02 to collocate additional antennas. The monopole, which is painted a beige color, supports two vertical antennas and six panel antennas mounted at the top, panel antennas at the 112 -foot level, and microwave dishes at the 123 -foot and 90 -foot levels. The overall height of the existing monopole with the attached vertical antennas is 151 feet above ground level. ANALYSIS: General Plan and Zoning: The project site is designated as Commercial by the Land Use Element Map of the General Plan, which allows public uses as secondary uses (note: cellular phone service providers are considered a public utility). Section 24-141 of Butte County Code states that communications facilities, including the colocation of antennas on existing towers, are not permitted in the C-1 zone unless a permit is obtained (subject to the requirements of Butte County Code Section 24- 262). The Wireless Communication Facilities Ordinance (Butte County Code Section 24-262) allows colocation on existing facilities in the C-1 zone with approval of a Minor Use Permit, subject to numerous requirements. The project has been conditioned to meet the requirements ,of Section 24-262, including: Radio-frequency emissions in excess of FCC standards are not allowed. Facilities that are not in continual use for a period of six (6) months shall be considered to be abandoned. Verification submitted annually attesting that the radio frequency radiation/ electromagnetic frequency (RF/EMF) emitted by the facility conforms to safety standards set forth in FCC OET 65. ■ BUTTE COUNTY PLANNING DIVISION AGENDA REPORT ■ PAGE 2 ■ • Access to the site must be at least 12 feet wide and capable of supporting a 40,000 -pound fire apparatus. The additional antennas mounted on the existing monopole would not create a significant aesthetic impact. The antennas would not increase the height of the monopole, nor would the additional antennas extend horizontally beyond the existing antennas. A photo simulation of the proposed antennas on the existing monopole shows that the antennas would not be highly conspicuous. A condition of the project requires that the proposed antennas and mounting hardware be painted to match the color of the existing monopole. The project site is located in the City of Chico's Sphere of Influence and is contiguous to lands in the City of Chico. The City stated that the project conforms to criteria for collocation under the Chico ordinance, with the exception that the existing tower is located within 500 feet of residentially zoned land. The City of Chico recommended that the project be subject to a radio- frequency study verifying that cumulative emissions are significantly below FCC maximum standards to ensure safety of the public. The radio-frequency study has already been conducted (see the following section). Radio -Frequency Emissions The radio emissions from the proposed antennas are regulated by the Federal Communication Commission (FCC). A radio-frequency (RF) analysis was prepared for the proposed antennas to ensure compliance with the appropriate Federal guidelines for human exposure to radio frequency or electromagnetic fields. The analysis determined that the RF emissions from the existing antennas mounted on the monopole is 0.2% of the FCC standards for public exposure. The analysis determined that the cumulative maximum capacity predicted worst-case power densities would be 0.15% of the FCC public exposure standards. The proposed operation of the site would be in compliance with the FCC requirements for public exposure to RF radiation. ACTIONS FOR CONSIDERATION: Staff recommends that the Planning Manager take the following actions: I. Recommend that the Planning Commission find that the project is exempt from the provisions of the California Environmental Quality Act under Section 15301. Section 15301 (Existing Facilities) consists of the leasing and minor alteration of existing public utility structure(s) involving negligible or no expansion of use. The proposed wireless communication facilities co -located on the existing monopole constitute a negligible expansion of the existing use. II. Recommend approval to the Planning Commission of Minor Use Permit 03-03 for Cingular Wireless, subject to the conditions in Exhibit "A" and the following findings: ■ BUTTE COUNTY PLANNING DIVISION AGENDA REPORT ■ PAGE 3 ■ 0 • A. The proposed location, size, design, and operating characteristics of the proposed use are in accordance with the purpose of this Ordinance, the purpose of the zone in which the site is located, the Butte County General Plan, and the development policies and standards of the County because: Conditions of approval have been applied to this project pursuant to the applicable requirements of Section 24-262 (Wireless Communication Facilities). The project is in accordance with the purpose of the zone in which the land lies and the Butte County General Plan because the project site is designated Commercial and is zoned C-1. The Commercial land use designation allows public utilities as Secondary Uses.. The, C-1 zone allows colocation of communication facilities with approval of a Minor Use Permit. B. The location, size, design, and operating characteristics of the proposed use would be compatible with, and would not adversely affect, or be detrimental to adjacent uses, residents, buildings, structures, or natural resources, with consideration given to: 1. Harmony in scale, bulk, coverage, and density: The proposed antennas would not increase the height of the existing monopole or extend horizontally beyond the existing antennas. 2. The availability of public facilities, services and utilities: Electrical power service is already established to the property and no additional services or utilities are required. 3. The harmful effect, if any, upon desirable neighborhood character: The project site is already developed with a 141 foot tall monopole. The proposed antennas to be mounted on the existing monopole would not have a harmful effect upon the neighborhood character. The radio- frequency emissions from the proposed antennas must meet FCC standards. Only a minor amount of vehicle traffic would be generated during installation of the antennas'and equipment cabinets. The communications facility is unmanned and only one to two site visits per month per wireless carrier would be required after installation of the antennas. ■ BUTTE COUNTY PLANNING DIVISION AGENDA REPORT ■ PAGE 4 ■ The suitability of the site for the type and intensity of use or development which is proposed: The site is ideally suited for the project because the proposed antennas would be mounted on an existing 141 foot tall monopole. The project would not have an impact on the commercial use established on the site. 6. Any other relevant impact of the proposed use:, The Planning Division has circulated the proposed communication facility application to County Agencies and has received no evidence that the use would cause any other relevant impact. C. Based on the above findings, the proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it would be operated or maintained would not be detrimental to the public health, safety, or welfare, or injurious to properties or improvements in the vicinity. D. The proposed use will comply with each of the applicable provisions of the Chapter 24, Section 262, of the Butte County Code. E. This project would colocate antennas on an existing communications monopole, which eliminates the need for a new communications tower to be erected elsewhere in the project area. F. The radio-frequency emissions generated by all of the antennas on the monopole are below the limits set by the Federal Communications Commission. G. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-45.65. 2. Unless otherwise provided for in a special condition to this use permit, all conditions must be completed prior to or concurrently with the establishment of the granted use. The use granted by this permit must be established within 12 months of the date of approval. 3. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 4. If any_ use for which a Minor Use Permit has been granted is not established within one year of the date of approval, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. A Minor Use. Permit subject to lapse may be renewed for an additional period of up to one year, provided that sixty (60) calendar days prior to the expiration date, an application for renewal of the Minor Use ■ BUTTE COUNTY PLANNING DMSION AGENDA REPORT ■ PAGE 6 ■ Permit is filed with the Planning Division on the prescribed form and accompanied by the necessary data and fees. 5. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. 6. Neither the applicant, nor any agent nor representative of the applicant shall intentionally omit or misrepresent any material fact in connection with the application. Any alleged material misrepresentation shall constitute grounds for the Director of Development Services to commence a revocation hearing, and, if proven to exist, shall constitute sufficient grounds to revoke a permit. Conditions of Approval: Planning Division: 1. The new antennas and mounting hardware shall be painted to match the color of the existing monopole. 2. The Facility must meet or fall within current standards and regulations of the FAA, the FCC, the County, and any other agency of the Federal or State government with the authority to regulate such Facilities. 3. The installation of the Facility shall comply with all applicable building and electrical codes. The Facility operator shall submit certification from a registered structural engineer to the Building Division, that all associated monopoles and towers in excess of thirty (30) feet in height will withstand sustained winds as required by the Uniform Building Code. 4. No advertising or display shall be permitted on the Facility. 5. The placement of any antenna or structure shall not adversely affect any on-site sewage disposal system or its repair area without written approval from the Division of Environmental Health. 6. The installation of the Facility shall not violate any existing deed restrictions. 7. The Facility shall have a twelve (12) -foot wide all-weather access to a publicly maintained road capable of supporting a forty thousand (40,000) -pound fire apparatus with fifteen (15) feet of vertical clearance. ■ BUTTE COUNTY PLANNING DIVISION AGENDA REPORT ■ PAGE 7 ■ • 0 8. There shall be no outdoor vehicle or equipment storage except for emergency purposes. 9. The Facility shall fall within current standards and regulations of the FAA, the FCC, and any other State and/or Federal agency with the authority to regulate such Facility. If such standards and regulations are changed, the property owner or responsible party shall bring the Facility into compliance with such revised standards and regulations within ninety (90) days of the effective date of such standards and regulations, unless a more stringent compliance schedule is mandated by the controlling agency. 10. The Facility or combination of the Facilities on the site shall not generate, at any time, electromagnetic frequency radiation (EMF) or radio frequency radiation (RF) in excess of the FCC adopted standards for human exposure, as amended over time. 11. If it is found that the Facility is or will be detrimental to the health, safety, or welfare of persons working or residing near such facility, then the service provider(s) and property owner shall be jointly and solely responsible for the removal, adjustment, or replacement of the Facility. In no case shall the Facility remain in operation if it is found to create a hazard to health, safety, and welfare. The Facility shall not be found to create a hazard to health, safety, or welfare as a result of EMF or RF emissions from the Facility so long as it meets all current standards established by the FCC, pursuant to FCC OET 65. 12. Prior to issuance of the building permit for the installation of the Facility, the applicant shall post a performance security in an amount -and form determined by the Director of Development Services that is sufficient to cover the cost of a one-time test by a radio frequency consultant selected by the County, sufficient to determine whether the Facility's RF/EMF emissions comply with FCC standards. If the Facility's emissions are determined to exceed FCC standards, the applicant is required to pay for such other tests and other corrective measures as are necessary to establish compliance with FCC OET 65 and its successors and such noncompliance shall constitute sufficient grounds to commence a permit revocation hearing which may lead to permit revocation. The applicant shall cooperate in all respects with the County's consultant to assist the consultant to reach his/her conclusion. 13. All Facilities that are not in continual use for a period of six (6) months shall be considered abandoned. Abandoned Facilities are hereby designated as unlawful and as public nuisances, requiring no amortization period. If the Director of Development Services determines. that the Facility is abandoned, the applicant may be required to remove all equipment belonging to the applicant from the premises and return the site to its original condition within thirty (30) calendar days of receipt of notice to abate. If such Facility is not removed and the site returned to its original condition within thirty (30) days, the County may remove the Facility at the applicant's and/or land owner's joint and several expense. ■ BUTTE COUNTY PLANNING DIVISION AGENDA REPORT ■ PAGE 8 ■ 1 . All ground level support Facilities shall be painted and/or screened from view with adequate landscaping appropriate to the surrounding environment. All aesthetic treatments, including landscaping shall be maintained as approved for the life of the Facility. Loll-/ 15. The Facility may not encroach into, under, over, above, or upon any public street in the unincorporated area of the County in the absence of a valid encroachment permit from the County. 16. The owner/operator of the Facility shall annually submit a written verification, attested to under penalty of perjury, signed by both the owner/operator and an.FCC licensee in the employ of or retained by the owner/operator, that the radio frequency radiation/electromagnetic frequency (RF/EMF) emitted by the facility conforms to safety standards set forth in FCC OET 65. The reports prepared for the Facility shall conform to reporting requirements set by the FCC and the County. The reports shall be submitted to the Planning Division no later than January 31 of each year. cvrkrI The Facility shall be secured at all times to prevent access by the public. 18. The project site shall be developed in accordance with the approved project site plan and the conditions contained herein. Said site plan is on file in the Planning Division, is identified as "Exhibit D" and date-stamped August 6, 2002, and is incorporated herein by this reference. 19. Prior to use of this project, the applicant shall contact the Planning Division for a field inspection to verify all conditions of approval and ordinance requirements have been met. 20. Applicant must also comply with all other applicable State and local statutes, ordinances, and regulations. Building Division 21. Building permits are required. Prepare four (4) sets of construction plans and make an application for permit. Construction shall comply with federal, state, and local regulations. Plans shall be prepared, sealed and signed by a California Licensed Architect or Registered Engineer for non-residential buildings and certain residential buildings. 22. The bond would be used by the County to hire an independent RF engineer to perform an analysis to determine if the RF emissions were within FCC standards. I realize that you have already submitted a RF analysis, but that RF study is a calculated estimate of what the RF emissions maybe, and does not necessarily reflect the actual RF emissions in the future. However, I believe that there is already a bond for this site (from another carrier) but what I don't know is if each site only needs one bond or if each additional carrier on a pole has to give us a new bond. I will look into it. #14 landscaping - we are collocating on an existing site and there is currently no landscaping around the facility. Only on the properly lines, The whole area is concrete and our facility will be placed on concrete. Can this be revised to exclude new landscaping? I believe that this condition can be deleted since the lease area is well away from Mord Avenue and the site consists of a commercial business. #17 secured -the existing site is not fenced separately from the building on the property. There is fencing all the way around the property, but the front gate is open during business hours. We don't own the facility so this would be a condition that would effect all the carriers and the owner of the pole. In addition, there apparently have not been any problems in the past with unauthorized access. The fence around the property is sufficient. When the gate is open the landowner is responsible for ensuring that the public does not have access to the monopole. The reason for keeping this condition is in case the fence around the property is removed or not kept up. If the existing fence was to be removed, or the gate left open when the business is closed for the day, a fence would have to be constructed around the lease area. The due date is August 26th. Once that date has passed, I will schedule the project for a hearing. Most likely it will be on Sep. 25th. This is a tentative date only. The application looks good.and I don't expect any negative comments to come back in for County agencies. I have pretty much completed the staff report for this project. Second Question: I will need additional information before I can answer this question. What tower site are you referring too? I will have to look at the approved plans to see what it looks like. I don't see this as being a problem and we may be able to call it a minor change and sign off on it. However, I need to review the plans and other information in the file before I can make a decision.. Be forwarded that the increase in overall height may require another minor use permit. Analysis of the proposed operation with Verizon, Metro PCS and Cingular in operation at maximum capacity predicted worst-case power densities over the area studied of 0.89 µW/cm2 (0.15% of the FCC public exposure standards). Therefore, the current operation and proposed operation of this site is in compliance with the FCC, ANSI and IEEE requirements for public exposure to RF radiation. Moore Broadcast Consulting was retained by the Cingular Wireless to make an independent assessment of the RF environment for the proposed site at 1298 Nord Avenue, Chico, CA. The assessment was made to comply with the requirements of Butte County zoning rules paragraph 12 cited below: "12) A report, signed by a qualified radio frequency engineer licensed by the FCC, prepared pursuant to FCC OET 65, stating whether the maximum radio frequency radiation/electromagnetic radiation (RF/EMF) to be emitted by the proposed Facility, taking into account all other Facilities, both existing and known future Facilities, at the proposed site and adjacent properties, conforms to safety standards adopted by the FCC, if applicable. Measurements were taken at the site in its current configuration with Verizon Wireless, Metro PCS and their microwaves in operation. Also provided are predictions for the site with the addition of Cingular Wireless proposed facilities. The facility studied consists of a tower with the above cellular/PCS and proposed PCS services. Figure 1 is a photograph of the existing tower installation with Verizon Wireless at 149 feet and the Metro PCS at 110 feet up the tower plus 2 microwave dish antennas. The analysis predicted worst-case power densities over the area studied of less than 0.9 gW/cm2 (0.15% of standard). Predictions were made per OET Bulletin No. 65. Measurements in the area surrounding the tower found levels below 1 11W/cm2. Fields of up to 0.12 were measured. Methodology Measurements Measurements were made with the use of the Holaday Industries, Inc. meter shown in Figure 2 above. The meter is designed to detect and measure signals from 0.5 MHz to 6.0 GHz down to a level of 1 µW/cm2. The probes are isotropic (omnidirectional throughout the sphere) and accurate regardless of orientation. The meter indicates the field strength on the analog meter. The levels during test periods were also recorded on a digital recorder HI -3320 in specified units at 4 measurements per second. Measurements were taken throughout the area surrounding the tower, in the fenced mobile home park north west of the site (Tag No. 1001), in the vacant lot west of the site (Tag No. 1002), at the apartment complex across the railroad tracks north of the site (Tag No. 1003) and on the property of the apartment complex across the railroad tracks north east of the site (Tag No. 1004. 0 Analysis 0 The ANSVIEEE/FCC standards are expressed in terms of power density, electric field strength squared and magnetic field strength squared. FIGURE 3 Power densities are calculated at 6 feet above ground AGL, to represent the height of a person's head. The head is the closest part of the body to the antenna, therefore, the point where the highest level is received by the body. The results are shown graphically as a function of distance from the antenna base (D). _ The cellular antenna is designed to radiate most efficiently in the horizontal plan. Therefore, the power at angles below the horizontal is reduced. The reduction is expressed as the vertical pattern of the antenna. The Gain(A) of the antenna varies as a function of the angle below the main beam, 0. The angle 0, R and Gain(A) are determined by H - the height above ground of the antenna center of radiation and D - the distance on the ground from a point directly below the antenna. OET Bulletin 65 states, "For a truly worst-case approximation, 100% ground reflection should be assumed resulting in a potential doubling of predicted field strength and a four -fold increase in (far -field equivalent) power density." Equation (6) provides that worst-case approximation. 4 Results Measurements The area near the cell tower was walked and measurements taken. The first set of measurements, Tag No. 1001, was taken in the mobile home park to the north west of the site. The second set, Tag No. 1002, was taken in a vacant lot between the mobile home park and the Chico Islamic Center to the west of the site. The third set, Tag No. 1003 was taken in the parking lot of the apartment complex north of the site, which is across the railroad tracks. The fourth set, Tag No. 1004 was taken walking around the apartment complex across the railroad tracks to the north east of the site. The measurements are printed out from the HI3320 dataloger at the end of this report. No signal was detected above 0.12 gW/cm2. This level is less than 0.02% of the FCC standard for public exposure at the lowest transmitting frequency of 880 MHz. These areas designated as Tag No. 1001 through 1004 are shown on Figure 4. Analysis The predicted received fields in gW/cm2 are as shown in Figure 5. The predictions were calculated at 6 feet AGL. The most stringent standard for the facilities at this site is 587 gW/cm2 per the American National Standards Institute (ANSI)/Institute of Electrical and Electronic Engineers (IEEE) C95.1-1992 and the Federal Communications Commission Rules and Regulation as of August 1, 1996. The lowest transmitted frequency is 880 MHz. PCS, like cellular telephone systems, employs transceiver stations that carry and hand off phone signals as the caller moves from one area to another. In addition to wireless voice communication, PCS technology offers paging, message sending, and data transmission on a wireless platform. Project Description The proposed telecommunications facility will be located on Assessor's Parcel Number 043-200-005, collocated on existing 151' ATC monopole. The proposed PCS facility consists of six antenna panels mounted on the tower at a centerline height of 846", one 4' microwave dish mounted at 77' and one 2' microwave dish mounted at 97'. In addition, Cingular Wireless will occupy a 16 X 18' .lease area within the existing ATC lease area. This area will contain 4 BTS equipment cabinets (2 proposed, 2 future) and all associated telephone and electrical equipment. The site will be operation 24/7 and will be unmanned requiring no additional parking spaces for employees. This Wireless Telecommunications Facilities Permit proposal includes: Add to existing 151' monopole, 6 dual polar antennas (3 proposed, 3 future) on three sectors at a centerline height of 846". Four Base Transceiver Station (BTS) equipment cabinets will be located within the 16' X 18' Cingular lease area. This site is needed to provide coverage and additional capacity in the west Chico area where additional coverage as well as capacity is needed.
