The property is zoned TM -5 (Timber Mountain — 5 acre parcels) and is located on the west side of Cohasset Road, approximately 1.3 miles north of Mud Creek Road, at 11045 Cohasset Road, Cohasset. APN 056-070-079' (SB) .(MUP 03-06) It was moved by Commissioner Leland, seconded by Commissioner Marin, and unanimously carried to approve the Minor Use Permit for Alan Tompkins subject to the findings and c6nditions listed below. I. Find that the project is exempt from the provisions of the California Environmental Quality Act under Section 15301. Section 15301 (Existing Facilities) consists of the leasing and minor alteration of existing public utility structure(s) involving negligible or no expansion of use. The proposed antenna co -located on the existing tower constitutes a negligible expansion of the existing use. II. Approve the Minor Use Permit 03-06 for Alan Tompkins', subject to the conditions found in Exhibit A and subject to the following findings: A. That the proposed location, size, design, and operating characteristics of the proposed use is in accordance with the purpose of this Ordinance, the purpose of the zone in which the site is located, the Butte- County General Plan, and the development policies and standards of the County because: The project is in accordance with the purpose of the zone in which the land lies and the Butte County General Plan because the project site is designated Agricultural - Residential and is zoned TM -5. The Agricultural -Residential land use designation allows public and utilities as Secondary Uses. The TM -5 zone allows communication facilities upon approval of a Minor Use Permit. B. That the location, size, design, and operating characteristics of the proposed use will be compatible with, and will not adversely affect, or be detrimental to adjacent uses, residents, buildings, structures, or natural resources, with consideration given to: 1. Harmony in scale, bulk, coverage, and density: The proposed antenna would extend only slightly from the side of the existing tower and would not create a significant visual impact. The proposed antenna would not increase the height of'the existing tower. 2. The availability of public facilities, services and utilities: Electrical power service is already established to the property and no additional services or utilities are required. ■ BUTTE COUNTY PLANNING COMMISSION ■ MINUTES ■ JANUARY 9, 2003 ■ PAGE 1 i .y 3. The harmful effect, if any, upon desirable neighborhood character: The project site is already developed with two 400 foot tall towers and four buildings, The proposed antenna would not be highly visible to the public due to the shape and size of the antenna and due to the tall trees in the 'project area. The proposed antenna would not have a harmful effect upon the neighborhood character. 4.. The generation of traffic and the capacity and physical character of surrounding streets: Very little vehicle traffic will be generated during installation of the antenna and equipment. The communications facility is unmanned and only one to two site visits per month will be required after construction. 5. The suitability of the site for the type and intensity of use or development which is proposed: The site is ideally suited for the project because the proposed antenna would be placed on existing 400 foot tall tower. The project will not have an impact to any agricultural or timber operations. 6. Any other relevant impact of the proposed use: The Planning Division has circulated the project to County Agencies and has received no evidence that the use will cause any other relevant impact. C. Based on the above findings, the proposed location, size," design, and operating characteristics of the proposed use and the conditions under which it would be operated or maintained would not be detrimental to the public health, safety, or welfare, or injurious to properties or improvements in the vicinity. D. The proposed use will comply with each of the applicable provisions of the Chapter 24, Section 262, of the Butte County Code. E. This project would colocate an antenna on an existing communications tower, which eliminates the need for a new tower to be erected elsewhere in the project area. F. The radio-frequency emissions from the proposed antenna are within Federal Communications Commission guidelines. G. The proposed antennas would not create any impacts to aircraft operations. Conditions of Approval: Planning Division: ■ BUTTE COUNTY PLANNING COMMISSION ■ MINUTES ■ JANUARY 9, 2003 ■ PAGE 2 ■ All Facilities must fall within current standards and regulations of the FAA, the FCC, and any other State and/or Federal agency with the authority to regulate such Facilities. If such standards and regulations are changed, the property owner or.responsible party shall bring such Facilities into compliance with such revised standards and regulations within ninety (90) days of the effective date of such standards and regulations, unless a more stringent compliance schedule is mandated by the controlling agency. 2. No Facility or combination of Facilities shall generate, at any time, electromagnetic frequency radiation (EMF) or radio frequency radiation (RF) in excess of the FCC adopted standards for human exposure, as amended over time. 3. If it is found that Facilities are or will be detrimental to the health, safety, or welfare of persons working or residing near such facilities, then the service provider(s) and property owner shall be jointly and solely responsible for the removal, adjustment, or replacement of the Facilities. In no case shall a Facility remain in operation if it is found to create a hazard to health, safety, and welfare. A Facility shall not be found to create a hazard to health, safety, or welfare as a result of EMF or RF emissions from the Facility so long `as it meets all current standards established by the FCC, pursuant to FCC OET 65. 4. The installation of the Facility shall comply with all applicable building and electrical codes. 5. The Facility shall have at least a twelve (12) foot wide all-weather access to a publicly maintained road capable of supporting a forty thousand (40,000),pound fire apparatus with fifteen (15) feet of vertical clearance. 6. There shall be no outdoor vehicle or equipment storage except for emergency purposes. 7. The Facility shall be secured at all times to prevent access by the public. 8. No advertising or display shall be permitted on the Facility. 9. The project site shall be developed in accordance with the approved project site plan and the conditions contained herein. Said site plan is on file in the Planning Division, is identified as "Exhibit E" and date-stamped November 13, 2002, and is incorporated herein by this reference. ■ BUTTE COUNTY PLANNING COMMISSION ■ MINUTES ■ JANUARY 9, 2003 ■ PAGE 3 ■ 10. All outstanding application processing fees shall be paid prior to issuance of the Minor Use Permit. 1 1. Applicant must also comply with all other applicable State and local statutes, ordinances and regulations. Building Division: 12. Building Permits Required. Prepare four (4) sets of construction plans and make an application for permit. Construction shall comply with federal, state, and local regulations. Plans shall be prepared, sealed and signed by a California Licensed Architect or Registered Engineer for non-residential buildings and certain residential buildings. County Counsel 13. APN 056-070-079 (SB) (MUP 03-06) Mr. Betts gave a brief summary of the project. The hearing was opened to the public. The applicant, Alan Tompkins, was present. He had no comments. The hearing was closed. Mr. Baker concurred with staff's recommendation to recommend approval of the Minor Use Permit for Alan Tompkins subject to the findings and conditions listed below I. Recommend that the Planning Commission find that the project is exempt from the provisions of the California Environmental Quality Act under Section 15301. Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions set forth below: Alan Tompkins is hereby granted a Minor Use Permit in accordance with application filed: Minor Use Permit to place an antenna for digital television broadcasts on an existing 400 -foot tall tower and to place transmitting equipment inside an existing building. Failure to. comply with the conditions specified herein as the basis for approval of application and issuance of Permit, constitutes cause for the revocation of said permit in accordance with the procedures set forth, in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-45.65. 2. Unless otherwise provided for in a special condition to this use permit, all conditions must be completed prior to or concurrently with the establishment of the granted use. The use granted by this permit must be established within 12 months of the date of approval. 3. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works, or their respective designee, upon receipt of a substantiated written request by the applicant. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 4. If any use for which a Minor Use Permit has been granted is not established within one year of the date of approval, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. A Minor Use Permit subject to lapse may be renewed for an additional period of up to one year, provided, that sixty (60) calendar days prior to the expiration date, an application for renewal of the Minor Use Permit is filed with the Planning Division on the prescribed form and accompanied by the necessary data and fees. 5. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. 6. Neither the applicant, nor any agent nor representative of the applicant shall intentionally omit or misrepresent any material fact in connection with the application. Any alleged :1 material misrepresentation shall constitute grounds for the Director of Development Services to commence a revocation hearing, and, if proven to exist, shall constitute sufficient grounds to revoke a permit. Conditions of Approval: Plannine Division: All Facilities must fall within current standards and regulations of the FAA, the FCC, and any other State and/or Federal agency with the authority to regulate such Facilities. If such standards and regulations are changed, the property owner or responsible party shall bring such Facilities into compliance with such revised standards and regulations within ninety (90) days of the effective date of such standards and regulations, unless a more stringent compliance schedule is mandated by the controlling agency. 2. No Facility or combination of Facilities shall generate, at any time, electromagnetic frequency radiation (EMF) or radio frequency radiation (RF) in excess of the FCC adopted standards for human exposure, as amended over time. 3. If it is found that Facilities are or will be detrimental to the health, safety, or welfare of persons working or residing near such facilities, then the service provider(s) and property owner shall be jointly and solely responsible for the removal, adjustment, or replacement. of the Facilities. In no case shall a Facility remain in operation if it is found to create a hazard to health, safety, and welfare. A Facility shall not be found to create a hazard to health, safety, or welfare as a result of EMF or RF emissions from the Facility so long as it meets all current standards established by the FCC, pursuant to FCC OET 65. 4. The installation of the Facility shall comply with all applicable building and electrical codes. 5. The Facility shall have at least a twelve (12) foot wide all-weather access to a publicly maintained road capable of supporting a forty thousand (40,000) pound fire apparatus with fifteen (15) feet of vertical clearance. 6. There shall be no outdoor vehicle or equipment storage except for emergency purposes. 7. The Facility shall be secured at all times to prevent access by the public. 8. No advertising or display shall be permitted on the Facility. 9. The project site shall be'developed in accordance with the approved project site plan and the conditions contained herein. Said site plan is on file in the Planning Division, is identified as "Exhibit E" and date-stamped November 13, 2002, and is incorporated herein by this reference. I I - 10. All outstanding application processing fees shall be paid prior to issuance of the Minor Use Permit. 7 11. Applicant must also comply with all other applicable State and local statutes, ordinances and regulations. Building Division: 12. Building Permits Required. Prepare four (4) sets of construction plans and make an application for permit. Construction shall comply with federal, state, and local regulations. PROJECT DESCRIPTION/SITE CHARACTERISTICS: This project would allow the installation of a side mounted antenna on an existing 400 -foot tall tower and the installation of transmitting equipment inside an existing building. The proposed antenna would transmit digital television signals. The antenna would be mounted at the top of the tower, slightly projecting from the side of the tower. The antenna would not increase the height of the tower. The project site is developed with two 400 -foot tall towers, communication shelters/buildings, a caretaker's residence, and a septic system. Access to the towers is via an existing 15 -foot wide gravel driveway from Cohasset Road. A locked gate prevents access to the site road and the site is surrounded by a chain link fence. The two existing towers were installed at a time when a Minor Use Permit was not required for communication facilities. The two towers are painted with alternating red and white stripes and are lighted with red obstruction lights. The 2,800 square foot building that the transmitting equipment would be placed in was approved by Minor Use Permit 01-15. ■ BUTTE COUNTY PLANNING CONBUSSION AGENDA REPORT 0 PAGE 1 ■ ANALYSIS: The project site is designated as Agricultural -Residential by the Land Use Element Map of the General Plan, which allows public uses and utilities as secondary uses. Section 24-216 of Butte County Code states that wireless communication facilities are not permitted in the TM -5 zone unless a Minor Use Permit is obtained, subject to the requirements of Butte County Code Section 24-262. As already note above, the proposed antenna would be added to an existing 400 -foot tall tower. The proposed antenna would not increase the height of the existing tower. A radio-frequency analysis study for the proposed antenna shows that the radiation level at any point at least two meters above ground level would be well within Federal Communication Commission requirements for both controlled and uncontrolled exposure. This project will not have an impact to the environment because the proposed antenna would be installed on an existing 400 -foot tower and the building that would house the transmitting equipment is currently being constructed. No grading or other soil disturbance activities would be necessary as a result of this project. The new antenna would not create a significant visual impact because it will only extend slightly from the side of the existing tower. Additionally, numerous tall trees in the area would help shield the proposed antenna from public view. ACTIONS FOR CONSIDERATION: Staff recommends that the Planning Manager take the following actions: I. Recommend that the Planning Commission find that the project is exempt from the provisions of the California Environmental Quality Act under Section 15301. Section 15301 (Existing Facilities) consists of the leasing and minor alteration of existing public utility structure(s) involving negligible or no expansion of use. The proposed antenna co - located on the existing tower constitutes a negligible expansion of the existing use. H. Recommend approval to the Planning Commission of Minor Use Permit 03-06 for Alan Tompkins, subject to the conditions found in Exhibit A and subject to the following findings: A. That the proposed location, size, design, and operating characteristics of the proposed use is in accordance with the purpose of this Ordinance, the purpose of the zone in which the site is located, the Butte County General Plan, and the development policies and standards of the County because: The project is in accordance with the purpose of the zone in which the land lies and the Butte County General Plan because the project site is designated Agricultural -Residential and is zoned TM -5. The Agricultural - Residential land use designation allows public and utilities as Secondary Uses. Harmony in scale, bulk, coverage, and density: The proposed antenna would extend only Blighty from the side of the existing tower and would not create a significant visual impact. The proposed antenna would not increase the height of the existing tower. 2. The availability of public facilities, services and utilities: Electrical power service is already established to the property and no additional services or utilities are required. 3. The harmful effect, if any, upon desirable neighborhood character: The project site is already developed with two 400 foot tall towers and four buildings. The proposed antenna would not be highly visible to the public due to the shape and size of the antenna and due to the tall trees in the project area. The proposed antenna would not have a harmful effect upon the neighborhood character. 4. The generation of traffic and the capacity and physical character of surrounding streets: Very little vehicle traffic will be generated during installation of the antenna and equipment. The communications facility is unmanned and only one to two site visits per month will be required after construction. 5. The suitability of the site for the type and intensity of use or development which is proposed: The site is ideally suited for the project because the proposed antenna would be placed on existing 400 foot tall tower. The project will not have an impact to any agricultural or timber operations. 6. PROJECT DESCRIPTION/SITE CHARACTERISTICS: This project would allow the installation of a side mounted antenna on an existing 400 -foot tall tower and the installation of transmitting equipment inside an existing building. The proposed antenna would transmit digital television signals. The antenna would be mounted at the top of the tower, slightly projecting from the side of the tower. The antenna would not increase the height of the tower. The project site is developed with two 400 -foot tall towers, communication shelters/buildings, a caretaker's residence, and a septic system. Access to the towers is via an existing 15 -foot wide gravel driveway from Cohasset Road. A locked gate prevents access to the site road and the site is surrounded by a chain link fence. The two existing towers were installed at a time when a Minor Use Permit was not required for communication facilities. The two towers are painted with alternating red and white stripes and are lighted with red obstruction lights. The 2,800 square foot building that the transmitting equipment would be placed in was approved by Minor Use Permit 01-15. ■ BUTTE COUNTY PLANNING COMMISSION AGENDA REPORT 0 PAGE 1 0 C� ANALYSIS: The project site is designated as Agricultural -Residential by the Land Use Element Map of the General Plan, which allows public uses and utilities as secondary uses. Section 24-216 of Butte County Code states that wireless communication facilities are not permitted in the TM -5 zone unless a Minor Use Permit is obtained, subject to the requirements of Butte County Code Section 24-262. As already note above, the proposed antenna would be added to an existing 400 -foot tall tower. The proposed antenna would not increase the height of the existing tower. A radio-frequency analysis study for the proposed antenna shows that the radiation level at any point at least two meters above ground level would be well within Federal Communication Commission requirements for both controlled and uncontrolled exposure. This project will not have an impact to the environment because the proposed antenna would be installed on an existing 400 -foot tower and the building that would house the transmitting equipment is currently being constructed. No grading or other soil disturbance activities would be necessary as a result of this project. The new antenna would not create a significant visual impact because it will only extend slightly from the side of the existing tower. Additionally, numerous tall trees in the area would help shield the proposed antenna from public view. ACTIONS FOR CONSIDERATION: Staff recommends that the Planning Manager take the following actions: I. Recommend that the Planning Commission find that the project is exempt from the provisions of the California Environmental Quality Act under Section 15301. Section 15301 (Existing Facilities) consists of the leasing and minor alteration of existing public utility structure(s) involving negligible or no expansion of use. The proposed antenna co - located on the existing tower constitutes a negligible expansion of the existing use. II. Recommend approval to the Planning Commission of Minor Use Permit 03-06 for Alan Tompkins, subject to the conditions found in Exhibit A and subject to the following findings: A. The harmful effect, if any, upon desirable neighborhood character: The project site is already developed with two 400 foot tall towers and four buildings. The proposed antenna would not be highly visible to the public due to the shape and size of the antenna and due to the tall trees in the project area. The proposed antenna would not have a harmful effect upon the neighborhood character. 4. The generation of traffic and the capacity and physical character of surrounding streets: Very little vehicle traffic will be generated during installation of the antenna and equipment. The communications facility is unmanned and only one to two site visits per month will be required after construction. 5. The suitability of the site for the type and intensity of use or development which is proposed: The site is ideally suited for the project because the proposed antenna would be placed on existing 400 foot tall tower. The project will not have an impact to any agricultural or timber operations. 6. It will beside mounted at the top of an existing 400' tower. The tower is currently empty. It is designed to accommodate several broadcast and communication antennas. The construction permit for erecting the tower (# 98-1056) included two side mounted antennas that were never installed. We now wish to install the topmost of these antennas. The addition of this antenna will have minimal visual and environmental impact on the area. The building that will house the equipment for this antenna is currently under construction (Permit # 02-260). We anticipate completion of the building by mid December. The equipment and antenna will broadcast a digital TV signal for our Fox affiliate station. This signal is mandated by the FCC to be on the air by Jan 31, 2003 if we are to retain our commercial broadcast license. The antenna center of radiation would be at 119 meters above ground level with circularly polarized effective radiated power of 4.03 kW on TV Channel 20 (506-512 kHz) and the vertical radiation characteristic of the antenna provides for a relative power gain of 0.22. Application of these parameters to the pertinent algorithm of F.C.C. O.E.T. Bulletin No. 65 results in a radiation level at any point at least two meters above ground of 0.0005 mW/cm2, a value well within F.C.C. guidelines for both controlled and uncontrolled exposure.
