Find that the application is Categorically Exempt from environmental review under Section 15303(a), as defined by CEQA. II. Approve the Minor Use Permit for Tim Wall for a permanent second dwelling, MUP 03-08, on APN 068-150-112, based on the following findings and the conditions found in Exhibit "A": A. The location, size, design, and operating characteristics of the proposed use will be compatible with, and will not adversely affect, or be materially detrimental to adjacent uses, residents, buildings, structures, or natural resources, with consideration given to: 1. Harmony in scale, bulk, coverage, and density: The project is in harmony with scale, bulk, coverage, and density because the Second Dwelling Unit is small in relation to the main house on-site and does not represent a coverage issue because the parcel is 5 acres in size. The structure to be used for the second dwelling is not out of character for the area.. 2. The availability of public facilities, services, and utilities: The permanent second will not create a need .for new public facilities, services, and utilities because water, telephone, gas, and electrical services already extend to the project parcel. The project site is provided with municipal water and will be serviced by septic systems. 3. The harmful effect, if any, upon desirable neighborhood character: The proposed use would not have deleterious impacts on the surrounding neighborhood character due to the wide range of parcel sizes and condition of existing residences. The proposed density is in keeping with the surrounding area. 4. The generation of traffic and the capacity and physical character of surrounding streets: The development of a permanent second dwelling will not significantly increase vehicle traffic in the area. The suitability of the site for the type and intensity of use or development that is proposed: The site is suited for the project with the respect to the zoning (Agricultural Residential) and Butte County General Plan designation (Low Density Residential) which allow for up to five dwelling units per acre. The Minor Use Permit for the permanent second dwelling would create a density of 0.40 dwelling units per acre. Any other relevant impact of the proposed use: The Planning Division has circulated the proposed Minor Use Permit application to County Agencies and other interested parties and has received no evidence that the use, with appropriate conditions, would cause any other relevant impact. B. The proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or injurious to properties or improvements in the vicinity. Conditions of Approval: Planning Division Prior to issuance of a building permit for the second dwelling unit, the property owner shall execute and record a covenant running with the land. A copy of the recorded covenant shall be submitted to the Planning Division and the Building Division. The covenant shall be on a form approved by the Department of Development Services and shall: (a) Stipulate the occupancy requirement of Condition 2, below; (b) Prohibit any land division, merger, or lot line adjustment that results in a parcel containing the two dwellings, which is less than twice the minimum parcel size requirement of the zone, or two (2) acres, whichever is greater; (c) Stipulate that any land division proposing to place the dwellings on separate parcels must meet all the zoning and development requirements for dividing land in Butte County, including, but not limited to: lot size, lot configuration, septic requirements, and setback standards of the zone in which the parcel is located; and (d) Stipulate that if all such zoning and development requirements cannot be met, the parcel shall not be divided. No more than one (1) Second Dwelling Unit shall be allowed on any parcel or lot. 4. The Second Dwelling Unit shall contain kitchen and bathroom facilities separate from the main dwelling unit and shall have a separate entrance. 5. Two (2) off-street parking 'spaces shall be provided for the Second Dwelling Unit. The spaces shall be in addition to the existing off-street parking requirements for the main dwelling. 6. Development fees for the proposed second dwelling shall be paid prior to the issuance of the Minor Use Permit. The fees shall be those in effect at time of application and shall include, but not be limited to, School Fees, Park and Recreation District fees, Water and Sewer Service Fees, Permit and Plan Check Fees, and Fire Protection Fees. 7. All outstanding application processing fees shall be paid prior to issuance of the Minor Use Permit. 8. Applicant must also comply with all other applicable State and local statutes, ordinances, and regulations. Environmental Health 9. An . additional septic tank is required for the second dwelling unit. A septic permit is required for the installation of the additional septic tank California Department of Forestry 10. Construction, installation or development of structures or facilities on the parcels/lots shall comply with the latest California Fire Safe Regulations, (Public Resources Code 4290), and all other applicable State and County codes, ordinances and regulations in effect at the time of application for improvement permits. 11. Building identification and/or addresses shall be installed in conformance with Public Resources Code 4290.and shall be posted at the beginning of building construction and maintained continuously thereafter. 12. In lieu of a pressurized water system or water storage tank, payment of $200.00 into the Battalion 6 water tender fund is required prior to the issuance of a building permit. Pacific Gas and Electric 13. Any relocation or rearrangement of any existing PG&E facilities in the area to accommodate this project will be at the expense of the developer. 14. Unless otherwise. provided for in a special condition to this Minor Use Permit, all conditions must be completed prior to or concurrently with the establishment of the granted use. The use granted by this. permit must be established within two years of the date of approval. 3. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as- conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 4. A Minor Use Permit shall lapse and shall become void one (1) year following the date on which it was approved, unless prior to expiration: (a) A Building permit is issued and construction is commenced and diligently pursued toward completion on the site which was the subject of the Minor Use Permit application; or (b) A certificate of occupancy is issued for the structure which was the subject of the Minor Use Permit application; or (c) The site is occupied in accordance with the Minor Use Permit, if no building permit or certificate of occupancy is required; or 1 (d) The use which was the subject of the Minor Use Permit application is commenced, provided that a Minor Use Permit for a public utility installation may not become void for a longer period if specified by the Planning Manager. 5. A Minor Use Permit subject to lapse may be renewed for an additional period of up to one (1) year, provided that sixty (60) calendar days prior to the expiration date, an application for renewal of the Minor Use Permit is filed with the Planning Manager on the prescribed form and accompanied by the necessary data and fees. The approving authority may grant or deny an application renewal of a Minor Use Permit. 6. The terms and conditions of this Minor Use Permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. 7. Neither the applicant, nor any agent nor representative of the applicant shall intentionally omit or misrepresent any material fact in connection with the application. Any alleged material misrepresentation shall constitute grounds for the Director of Development Services to commence a revocation hearing, and, if proven to exist, shall constitute sufficient grounds to revoke a Permit. Conditions of Approval: Planning Division 1. Prior to issuance of a building permit for the second dwelling unit, the property owner shall execute and record a covenant running with the land. A copy. of the recorded covenant shall be submitted to the Planning Division and the Building Division. The covenant shall be on a form approved by the Department of Development Services and shall: (a) Stipulate the occupancy requirement of Condition 2, below; (b) Prohibit any land division, merger, or lot line adjustment that results in a parcel containing the two dwellings, which is less than twice the minimum parcel size requirement of the zone, or two'(2) acres, whichever is greater; (c) Stipulate that any land division proposing to place the dwellings on separate parcels must meet all the zoning and development requirements for dividing land in Butte County, including, but not limited to: lot size, lot configuration, septic requirements, and setback standards of the zone in which the parcel is located; and (d) Stipulate that if all such zoning and development requirements cannot be met, the parcel shall not be divided. 2. The owner of the parcel or lot must occupy either the main dwelling or the Second Dwelling Unit. 3: No more than one (1) Second Dwelling Unit shall be allowed on any parcel or lot. 2 4. The Second Dwelling Unit shall contain kitchen and bathroom facilities separate from the main dwelling unit and shall have a separate entrance. 5. Two (2) off-street parking spaces shall be provided for the Second Dwelling Unit. The spaces shall be in addition to the existing off-street parking requirements for the main dwelling. 6. Development fees for the proposed second dwelling shall be paid prior to the issuance of the Minor Use Permit. The fees shall be those in effect at time of application and shall include, but not be limited to, School Fees, Park and Recreation District fees, Water and Sewer Service Fees, Permit and Plan Check Fees, and Fire Protection Fees. 7. All outstanding application processing fees shall be paid prior to issuance of the Minor Use Permit. 8. Applicant must also comply with all other applicable State and local statutes, ordinances, and regulations. Environmental Health 9. An additional septic tank is required for the second dwelling unit. A septic permit is required for the installation of the additional septic tank California Department of Forestry 10. Construction, installation or development of structures or facilities on the parcels/lots shall comply with the latest California Fire Safe Regulations, (Public Resources Code 4290), and all other applicable State and County codes, ordinances' and regulations in effect at the time of application for improvement permits. 11. Building identification and/or addresses shall be . installed in conformance with Public Resources Code 4290 and shall be posted at the beginning of building construction and maintained continuously thereafter. 12. In lieu of a pressurized water system or water storage tank, payment of $200.00 into the Battalion 6 water tender fund, is required prior to the issuance of a building permit. Pacific Gas and Electric 13. Any relocation or rearrangement of any existing PG&E facilities in the area to . accommodate this project will be at the expense of the developer. 14. There shall be no building of structures, or the storage of any materials allowed over or under any existing PG&E facilities, or inside any easements that exist. County Counsel 3 15. The property is currently zoned A -R (Agricultural Residential) and the Butte County General Plan designation is Low Density Residential. The property is presently undeveloped. The site will include a primary 3,000 sq. ft. three bedroom single family dwelling and a 2,000 sq. ft. detached second dwelling, for which the Minor Use Permit is being requested, that includes a garage, studio and one bedroom. Domestic water for the parcel would be provided by the Oroville Wyandotte Irrigation District and sewer would be by septic. Surrounding land use is primarily residential ranging in size from 0.5 of an acre to 12.6 acres. Zoning on the surrounding parcels are A -R (Agricultural Residential) and AR -1 (Agricultural Residential, 1 acre minimum). There is also a C-1 (Light Commercial) zone approximately 500 feet to the north. 0 BUTTE COUNTY PLANNING MANAGER 0 AGENDA REPORT ■ PAGE 1 0 — a.6 The project site is located outside the Oroville Urban Area east of Oroville near the intersection of Olive Highway (State Highway 162) and Oakvale Avenue. The site is generally level, ranging from approximately 530 to 560 feet above sea level. The parcel is not in a 100 -year flood zone. ANALYSIS: This Minor Use Permit would allow for a permanent second dwelling on the project site. The project is consistent with the A -R zone which allows for second dwellings (Section 24-280 of the Butte County Code) in a non -urban area with a Minor Use Permit, provided the parcel is at least twice the minimum size allowed by the zone (8,125 sq.ft.), or two acres, whichever is greater. The project is over five acres which meets the second dwelling lot size requirements. The project is consistent with the Butte County General Plan Low Density Residential designation which allows for developments with densities up to four (4) units per gross acre utilizing septic waste disposal systems. Implementation of Project Conditions imposed by the Planning Commission will ensure compliance with all land use plans and policies and that the proposed project would not impair the health, welfare, or safety of Butte County residents. No significant impacts are expected due to the proposed second dwelling unit. The second dwelling unit has the potential to result in additional vehicle traffic on area roads, but the increase would not cause any significant impacts to vehicle circulation. Adequate area exists on the project site to accommodate all parking needs for both dwellings. Existing vegetation on the property consists of a few scattered oaks, grassland and non native trees. The proposed area for the dwellings will not have an impact on any existing oak trees. The Environmental Health Department requests that an additional septic tank will be required for the second dwelling. The Fire Department/CDF requests that development of the second dwelling unit comply with the latest California Fire Safe Regulations, (Public Resources Code 4290), including the installation of building identification and/or addresses. The Agricultural Commissioner had no significant issues, except that setbacks may apply if adjacent agricultural production exists on adjacent properties. There is no agricultural production on adjacent lots. Other agencies and departments had no comments, including Public Works, Oroville Wyandotte Irrigation District, and City of Oroville. CEQA ISSUES: This application for a Minor Use Permit to allow for a permanent second dwelling is determined to be Categorically Exempt from environmental review under Section 15303 — New Construction or Conversion of Small Structures, which states, "the conversion of existing small structures from one use to another where only minor modifications are made in the exterior of the structure", and subsection (a), "One single-family residence, or a second dwelling unit in a residential zone. Find that the application is Categorically Exempt from environmental review under Section 15303(a), as defined by CEQA. II. Approve the Minor Use Permit for Tim Wall for a permanent second dwelling, MUP 03-08, on APN 068-150-112, based on the following findings and the conditions found in Exhibit «A A. The structure to be used for the second dwelling is not out of character for the area 2. The availability of public facilities, services, and utilities: The permanent second will not create a need for new public facilities, services, and utilities because water, telephone, gas, and electrical services already extend to the project parcel. The project site is provided with municipal water and will be serviced by septic systems. 3.. The harmful effect, if any, upon desirable neighborhood character: The proposed use would not have deleterious. impacts on the surrounding neighborhood character due to the wide range of parcel sizes and condition of existing residences. The proposed density is in keeping with the surrounding area. 4. The generation of traffic and the capacity and physical character of surrounding streets: The development of a permanent second dwelling will not significantly increase vehicle traffic in the area. Based on the Trip Generation Manual of the Institute of Traffic Engineers for a single family residential use in non -urban areas, an increase of 9.55 vehicle trips/day per for the permanent second dwelling is possible. Any other relevant impact of the proposed use: The Planning Division has circulated the proposed Minor Use Permit application to County Agencies and other interested parties and has received no evidence that the use, with appropriate conditions, would cause any other relevant impact. Changes deemed to be major or significant in nature shall require a formal application for amendment. 4. A Minor Use Permit shall lapse and shall become void one (1) year following the date on which it was approved, unless prior to expiration: (a) A Building permit is issued and construction is commenced and diligently pursued toward completion on the site which was the subject of the Minor Use Permit application; or (b) A certificate of occupancy is issued for the structure which was the subject of the Minor Use Permit application; or (c) The site is occupied in accordance with the Minor Use Permit, if no building permit or certificate of occupancy is required; or 0 BUTTE COUNTY PLANNING MANAGER ■ AGENDA REPORT 0 PAGE 5 ■ (d) The use which was the subject of the Minor Use Permit application is commenced, provided that a Minor Use Permit for a public utility installation may void for a longer period if specified by the Planning Manager. 5. A Minor Use Permit subject to lapse may be renewed for an additional period of up to one (1) year, provided that sixty (60) calendar days prior to the expiration date, an application for renewal of the Minor Use Permit is filed with the Planning Manager on the prescribed form and accompanied by the necessary data and fees. The approving authority may grant or deny an application renewal of a.Minor Use Permit. 6. The terms and conditions of this Minor Use Permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. 7. Neither the applicant, nor any agent nor representative of the applicant shall intentionally omit or misrepresent any material fact in connection with the application. Any alleged material misrepresentation shall constitute grounds for the Director of Development Services to commence a revocation hearing, and, if proven to exist, shall constitute sufficient grounds to revoke a Permit. Conditions of Approval: Planning Division 1. Prior to issuance of a building permit for the second dwelling unit, the property owner shall execute and record a covenant running with the land. A copy of the recorded covenant shall be submitted to the Planning Division and the Building Division. The covenant shall be on a form approved by the Department of Development Services and shall: (a) Stipulate the occupancy requirement of Condition 2, below; (b) Prohibit any land division, merger, or lot line adjustment that results in a parcel containing the two dwellings, which is less than twice the minimum parcel size requirement of the zone, or two (2) acres, whichever is greater; (c) Stipulate that any land division proposing to place the dwellings on separate parcels must meet all the zoning and development requirements for dividing land in Butte County, including, but not limited to: lot size, lot configuration, septic requirements, and setback standards of the zone in which the parcel is located; and (d) Stipulate that if all such zoning and development requirements cannot be met, the parcel shall not be divided. 2. The owner of the parcel or lot must occupy either the main dwelling or the Second Dwelling Unit. 3. The Second Dwelling Unit shall contain kitchen and bathroom facilities separate from the main dwelling unit and shall have a separate entrance. 5. Two (2) off-street parking spaces shall be provided for the Second Dwelling Unit. The spaces shall be in addition to the existing off-street parking requirements for the main dwelling. 6. Development fees for the proposed second dwelling shall be paid prior to the issuance of the Minor Use Permit. The fees shall be those in effect at time of .application and shall include, but not be limited to, School Fees, Park and Recreation District fees, Water and Sewer Service Fees, Permit and Plan Check Fees, and Fire Protection Fees. 7. All outstanding application processing fees shall be paid prior to issuance of the Minor Use Permit. 8. Applicant must also comply with all other applicable State and local statutes, ordinances, and regulations. Environmental Health 9. An additional septic tank is required for the second dwelling unit. A septic permit is required for the installation of the additional septic tank California Department of Forestry 10. Construction, installation or development of structures or facilities on the parcels/lots shall comply with the latest California Fire Safe Regulations, (Public Resources Code 4290), and all other applicable State and County codes, ordinances and regulations in effect at the time of application for improvement permits. 11. Building identification and/or addresses shall be installed in conformance with Public Resources Code 4290 and shall be posted at the beginning of building construction and maintained continuously thereafter. 12. In lieu of a pressurized water system or water storage tank, payment of $200.00 into the Battalion 6 water tender fund, is required prior to the issuance of a building permit. Pacific Gas and Electric 13. Any relocation or rearrangement of any. existing PG&E facilities in the area to accommodate this project will be at the expense of the developer. 14.
