The property is located on the north side of Foothill Boulevard, approximately 2,000 feet west of Dunstone Drive, at 4497 Foothill Blvd., east of Oroville. APN 036-330-044 (SB) (MUP 03-09) Mr. Betts gave a brief summary of the project. He changed the General Plan designation on the report to Agricultural Residential, and changed UP to MUP on the attached permit. He said the property already has an approved Use Permit for a church that has not been built. Mr. Wannenmacher asked that the findings under II be changed to read: "Find that because the project is Categorically Exempt, and a "de minimis" exemption regarding impacts to fish and wildlife or their habitat is recommended; the payment of fees pursuant to Fish and Game Code Section 711.4 and 14 CCR 753.5. is not required." The hearing was opened to the public. Chris Williams asked if granting this permit would set a precedent to divide property around this parcel. Mr. Betts explained that this application would not set a precedent because this request is for a second dwelling only. He said the application for the parcel split will come later and the neighbors will again be notified. Mr. Wannenmacher said a parcel split is decided on a case-by-case basis. He discussed the change in the State law as of July 1, 2003, regarding second dwellings. He said that people will still have to meet the standards of the zone. The hearing was closed. It was moved by Commissioner Evans, seconded by Commissioner Nelson, and unanimously carried to approve the Minor Use Permit for Nathan Giesbrecht subject to the findings and conditions listed below, changing Finding II to read: "Find that because the project is Categorically Exempt and a "de minimis" exemption regarding impacts to fish and wildlife or their habitat is recommended. The payment of fees pursuant to Fish and Game Code Section 711.4 and 14 CCR 753.5. is not required." and change "UP" to "MUP" on the permit. Find that this project is exempt from the provisions of the California Environmental Quality Act under Section 15303 Class 3(a). Section 15303 includes construction and location of limited numbers of new structures. II. Find that because the project is Categorically Exempt, and a "de minimis" exemption regarding impacts to fish and wildlife or their habitat is recommended. The payment of fees pursuant to Fish and Game Code Section 711.4 and 14 CCR 753.5. is not required. III. Approve Minor Use Permit 03-09 for Nathan Giesbrecht, subject to the following findings and the conditions listed in Exhibit A: ■ BUTTE COUNTY PLANNING COMMISSION ■ MINUTES ■ JUNE 26, 2003 ■ PAGE 5 ■ A. The proposed location, size, design, and operating characteristics of the proposed use is in accordance with the purpose of this Ordinance, the purpose of the zone in which the site is located, the Butte County General Plan, and the development policies and standards of the County because: Conditions of approval have been applied to this project pursuant to the applicable requirements of Section 24-280(c) "Standards and conditions outside of Urban Areas" of the Butte County Zoning Code and the. Butte County Fire Department. The project is in accordance with the purpose of the zone in which the land lies and the Butte County General Plan because the project site is designated Agricultural Residential and is zoned AR -5. The Agricultural Residential land use designation list dwellings at rural densities as Primary Uses. The overall density of the project site with. the proposed second dwelling unit — one dwelling per 7.5 acres - is conditionally consistent with the Agricultural Residential land use designation. With the proposed Tentative Parcel Map, the density on the new parcel would be one dwelling per 5.9 acres. The AR -5 zone allows second dwelling units upon approval of a Minor Use Permit. B. -The location, size, design, and operating characteristics of the proposed use will be compatible with, and would not adversely affect, or be detrimental to adjacent uses, residents, buildings, structures, or natural resources, with consideration given to: Harmony in scale, bulk, coverage, and density: The project is in harmony with scale, bulk, coverage, and density because the Second Dwelling does not represent a coverage issue due to the large size of the parcel. The structure to be used for the second dwelling would not be out of character for the area because many parcels in the rural areas of Butte County are developed with mobile and manufactured homes. 2. The availability of public facilities, services, and utilities: The second dwelling unit would not create a need for new public facilities, services, and utilities because telephone and electrical services already extend to the project parcel. The Butte County Fire Department requires compliance with standard California Fire Safe Regulations, Public Resources Code 4290. The harmful effect, if any, upon desirable neighborhood character: The proposed second dwelling unit would not change the traditional architectural style that is of a character consistent with a rural residential neighborhood. The proposed second dwelling unit cannot' be seen from Foothill Boulevard or from any existing off-site dwelling. 4. The generation of traffic and the capacity and physical character of surrounding streets: ■ BUTTE COUNTY PLANNING COMMISSION ■ MINUTES ■ JUNE 26, 2003 ■ PAGE 6 ■ The proposed second dwelling unit would not significantly increase vehicular traffic in the area nor would it create any vehicular circulation impacts. The suitability of the site for the type and intensity of use or development, which is proposed: I The site has adequate area for off-street parking spaces for the residents of the second dwelling unit. There is adequate soil on the site.for a septic system to service the proposed second dwelling unit. The site does not contain any significant geological features (steep slopes, known earthquake faults, or flood zones) that would preclude additional development of the site. 6. Any other relevant impact of the proposed use: The Planning Division has circulated the proposed second dwelling unit application to County Agencies and has received no evidence that the use would cause any other relevant impact. C. Based on the above. findings, the proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or injurious to properties or improvements in the vicinity, because the dwelling unit will be located on a large parcel that can adequately handle the additional dwelling unit. D. The proposed use will comply with each of the applicable provisions of Chapter 24, Section 280, of the Butte County Code. E. The project is consistent with the five conditionally consistent criteria for parcels less than 20 acres in size located in the Agricultural Residential General Plan land use designation. . F. The church use allowed on the project site under Use Permit 02-16 will not conflict with the proposed second dwelling unit. The proposed second dwelling unit will not conflict with the church use. G. The proposed second dwelling unit would be consistent with the recently submitted Tentative Parcel Map project to divide the project site into an 11.82± acre parcel and a 5.5± acre parcel. Conditions of Approval: Planning Division 1. Prior to issuance of a building permit for the second dwelling unit, the property owner shall execute and record a covenant running with the land. A copy of the recorded covenant shall be submitted to the Planning Division and the Building Division. The covenant shall be on a form approved by the Department of Development Services and shall: ■ BUTTE COUNTY PLANNING COMMISSION ■ MINUTES ■ JUNE 26, 2003 ■ PAGE 7 ■ (a) Stipulate the occupancy requirement of Condition 2, below; (b) Prohibit any land division, merger, or lot line adjustment that results in a parcel containing the two dwellings, which is less than twice the minimum parcel size requirement of the zone; , (c) Stipulate that any land division proposing to'place the dwellings on separate parcels must meet all the zoning and development requirements for dividing land in Butte County, including, but not limited to: lot size, lot configuration, septic requirements, and setback standards of the zone in which the parcel is located; and (d) Stipulate that if all such zoning and development requirements cannot be met, the parcel shall not be divided. The owner of the parcel or lot must occupy either the main dwelling or the Second Dwelling Unit. The Second Dwelling Unit shall contain kitchen and bathroom facilities separate from the main dwelling unit and shall have a separate entrance. 4. Applicant must also comply with all other applicable State and local statutes, ordinances, and regulations. Environmental Health 5. Prior to issuance of a building permit, obtain sewage disposal permit to service the second dwelling unit. Fire Department/CDF 6. Construction, installation or development of.structures or facilities on the parcels/lots shall comply with the latest California Fire Safe Regulations, (Public Resources Code 4290), and all other applicable State and County codes, ordinances and regulations in effect at the time of application for improvement permits. 7. Building identification and/or addresses shall be installed in conformance with Public Resources Code 4290 and shall be posted at the beginning of building construction -and maintained continuously thereafter. In lieu of a pressurized water system or water storage tank, payment of $200.00 per created parcel into the Battalion 6 water tender fund is required prior to the issuance of a building permit. County Counsel 9. Conditions of Approval: Planning Division Prior to issuance of a building perinit for the second dwelling unit, the property owner shall execute and record a covenant running with the land. A copy of the recorded 1 covenant shall be submitted to the Planning Division and the Building Division. The covenant shall be on a form approved by the Department of Development Services and shall: (a) Stipulate the occupancy requirement of Condition 2, below; (b) Prohibit any land division, merger, or lot line adjustment that results in a parcel containing the two dwellings, which is less than twice the minimum parcel size requirement of the zone; (c) - Stipulate that any land division proposing to place the dwellings on separate parcels must meet all the zoning and development requirements for dividing land in Butte County, including, but not limited to: lot size, lot configuration, septic requirements, and setback standards of the zone in which the parcel is located; and (d) Stipulate that if all such zoning and development requirements cannot be met, the parcel shall not be divided. 2. The owner of the parcel or lot must occupy either the main dwelling or the Second Dwelling Unit. 3. The Second Dwelling Unit shall contain kitchen and bathroom facilities separate from the main dwelling unit and shall have a separate entrance. 4. The applicant proposes to install a detached 924 -square foot manufactured dwelling unit. Sewage disposal for the proposed dwelling would be handled by a new septic system. Domestic water for the proposed second dwelling unit would be obtained from an on-site well. Access to the proposed second dwelling unit would be from an existing gravel driveway off of Foothill Boulevard. The second dwelling unit would not be seen from Foothill Boulevard due to intervening topography and extensive vegetation. The area where the proposed second dwelling unit would be located has already been cleared of vegetation. The property is located in the lower foothills and topography consists of rolling hills with an average slope of approximately 13%. The site is vegetated with numerous oaks, scattered pines, brush, and grasses. The site is developed with a dwelling, accessory structures, well, and septic system. Use Permit 02-16 was approved in September 2002 for a church on the site, but the church has not yet been constructed. The project site is not within the Oroville Wyandotte Irrigation District's boundaries. The site is not located within a 100 -year flood zone or an Airport Compatibility Zone, and is not within an Alquist-Priolo Earthquake Fault Zone. On May 28, 2003, the applicant submitted a Tentative Parcel Map application to divide the project site into two parcels; one of 5.5± acres, and one of 11.82± acres. The proposed second dwelling would be located on the 11.82± acre parcel, while the future church would be placed on the 5.5± acre parcel. ANALYSIS: The AR -5 zone allows a second dwelling unit with approval of a Minor Use Permit. The Second Dwelling Ordinance (Butte County Code Section 24-280) permits a second dwelling unit in a non -Urban Area when the parcel has at least twice the minimum parcel size stipulated by the zone. At 17.3 acres in size, the project site is more than triple the size as required by the AR -5 zone. With the proposed Tentative Parcel Map,* the parcel on which the proposed second dwelling would be located would have a little more than double the size as required by the AR -5 zone. The project site is designated Agricultural Residential by the Butte County General Plan, which lists dwelling units as a Primary Use. No significant impacts are expected due to the proposed second dwelling unit. The second dwelling unit would result in a small number of additional vehicle trips on the roads in the area, but the increase would not cause any significant impacts to vehicle circulation. No new encroachments onto Foothill Boulevard would be required. There is adequate soil on the project site for a new septic system. Groundwater supplies in the project area are generally good and could support a new dwelling. The Environmental Health Department requests that sanitation clearance be obtained prior to issuance of a building permit for the second dwelling unit. The Butte County Fire Department/CDF requests that development of the second dwelling unit comply with the latest California Fire Safe Regulations, (Public Resources Code 4290), including the installation of building identification and/or addresses. The Fire Department also requires the payment of water tender fees, which are currently $200.00. Butte County Code Section 24-280(c) 2. lists the development standards for second dwelling units that are not within an Urban Area. Some of these standards include: The second dwelling unit may be any size. • The second dwelling unit shall contain kitchen and bathroom facilities separate from the main dwelling unit and shall have a separate entrance. ■ BUTTE COUNTY PLANNING COMMISSION AGENDA REPORT ■ PAGE 2 ■ • The second dwelling unit may be a- detached structure or may be attached to the main dwelling. • The owner of the parcel must occupy one of the two dwellings. • The second dwelling unit must have adequate sewage disposal facilities and potable water facilities, as determined by the Butte County Environmental Health Division. The project is conditioned to meet these standards. The project site is designated by the Butte County General Plan Land Use Element Map as Agricultural Residential. The project would meet the density requirement of the Agricultural Residential land use designation, which allows a parcel size of as little as 1 acre. Consistent zones in the Agricultural Residential designation- are 20 acres or greater in size, while conditionally consistent zones are 1 to 19 acres in size. The AR -5 zone is not listed as either a consistent or conditionally consistent zone by the Agricultural Residential designation. Based upon the 5 -acre minimum parcel size and the uses allowed, the AR -5 zone would be conditionally consistent with the Agricultural Residential designation. The Agricultural Residential designation lists five development criteria for parcels less than 20 acres in size. The five conditional development criteria are listed below, along with a response: 1. Compatible with neighboring agricultural activities. Agricultural uses in the project area consist primarily of olive orchards, none of which abut the project site. Agricultural uses in the area also include scattered livestock grazing. The project is not expected to create any impacts to agricultural activities. 2. Evidence of adequate water and sewage disposal capacity. Sewage disposal for the proposed second dwelling unit would be handled by a new, on- site septic system. The Butte County Environmental Health Division 'requires that a sewage disposal permit for a new septic system to serve the proposed second dwelling unit be obtained prior to issuance of a building permit. The Environmental Health Division states that the soil on the site in the area of the proposed second dwelling unit is adequate for a new septic system. Domestic water for the proposed second dwelling unit would be obtained from an on-site well. There maybe a minor reduction in groundwater supplies in the project area due to the increased usage of ground water. The reduction is not expected to be significant. 3. Availability of adequate fire protection facilities. The nearest fire station is Station 66 (Wyandotte), which is located approximately 0.6 miles east of the site on Foothill Boulevard. Station 66 is a volunteer station. The nearest full-time fire station is located in Kelly Ridge, approximately 6 miles from the site. The Butte County Fire Department/CDF did not object to the project, but recommended that water tender fees ($200) must be paid at the time of issuance of a ■ BUTTE COUNTY PLANNING COMMISSION AGENDA REPORT ■ PAGE 3 ■ building permit. The water tender fees would help offset the cost of providing fire protection services to the project area. 4. Adequately maintained approved road access with sufficient capacity to service area. The project parcel fronts on Foothill Boulevard, which is a public road. Foothill Boulevard is in good condition and has sufficient capacity to handle the minor increase in traffic generated by the project. Dwelling units generate approximately ten vehicle trips per day. No significant vehicle circulation impacts are expected due to the low number of vehicle trips that the proposed second dwelling unit would generate. 5. Reasonable accessibility to commercial services and schools. The nearest commercial services are located in Oroville, approximately seven miles to the northwest of the site. Driving time from the project site to Oroville is approximately 10 minutes. The project site is located within the Oroville Union High and Oroville Elementary School Districts. K-12 schools are located in Oroville and the surrounding area. Based upon the above responses, the project appears to meet the conditional development criteria found in the Agricultural Residential General Plan land use designation. It should be noted that the conditional development criteria are very subjective and are open to interpretation. CEQA ISSUES: This application for a Minor Use Permit to allow a Second Dwelling Unit is Categorically Exempt from environmental review under Section 15303 Class 3(a) of the California Environmental Quality Act. Class 3 includes construction and location of limited numbers of new, small facilities, or structures. Subsection (a) includes one single-family residence, or a second dwelling unit in a residential zone. ACTIONS FOR CONSIDERATION Staff recommends that the Planning Commission take the following actions: I. Find that this project is exempt from the provisions of the California Environmental Quality Act under Section 15303 Class 3(a). Section 15303 includes construction and location of limited numbers of new structures. II. The design of the proposed project improvements will not cause significant environmental damage to fish and wildlife or their habitat, and a "de minimis" exemption regarding impacts to fish and wildlife or their habitat is recommended. The payment of fees pursuant to Fish and Game Code Section 711.4 and 14 CCR 753.5. is not required. III. The project is in accordance with the purpose of the zone in which the land lies and the Butte County General Plan because the. project site is designated Agricultural Residential and is zoned AR -5. The Agricultural Residential land use designation list dwellings at rural densities as Primary Uses. The overall density of the project site with the proposed second dwelling unit — one dwelling per 7.5 acres - is conditionally consistent with the Agricultural Residential land use designation. With the proposed Tentative Parcel Map, the density on the new parcel would be one dwelling per 5.9 acres. The AR -5 zone allows second dwelling units upon approval of a Minor Use Permit. B. The location, size, design, and operating characteristics of the proposed use will be compatible with, and would not adversely affect, or be detrimental to adjacent uses, residents, buildings, structures, or natural resources, with consideration given to: 1. Harmony in scale, bulk, coverage, and density: The project is in harmony with scale, bulk, coverage, and density because the Second Dwelling does not represent a coverage issue due to the large size of the parcel. The structure to be used for the second dwelling would not be out of character for the area because many parcels in the rural areas of Butte County are developed with mobile and manufactured homes. 2. The availability of public facilities, services and utilities: The second dwelling unit would not create a need for new public facilities, services, and utilities because telephone and electrical services already extend to the project parcel. The Butte County Fire Department requires compliance with standard California Fire Safe Regulations, Public Resources Code 4290. 3. The harmful effect, if any, upon desirable neighborhood character: The proposed second dwelling unit would not change the traditional architectural style that is of a character consistent with a rural residential neighborhood. The generation of traffic and the capacity and physical character of surrounding streets: The proposed second dwelling unit would not significantly increase vehicular traffic in the area nor would it create any vehicular circulation impacts. . 5. The suitability of the site for the type and intensity of use or development which is proposed: The site has adequate area for off-street parking spaces for the residents of the second dwelling unit. There is adequate soil on the site for a septic system to service the proposed second dwelling unit. The site does not contain any significant geological features (steep slopes, known earthquake faults, or flood zones) that would preclude additional development of the site. 6. Any other relevant impact of the proposed use: The Planning Division has circulated the proposed second dwelling unit . application to County Agencies and has received no evidence that the use would cause any other relevant impact. C. Based on the above findings, the proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or injurious to properties or improvements in the vicinity, because the dwelling unit will be located on a large parcel that can adequately handle the additional dwelling unit. D. The proposed use will comply with each of the applicable provisions of Chapter 24, Section 280, of the Butte County Code. E. The project is consistent with the five conditionally consistent criteria for parcels less than 20 acres in size located in the Agricultural Residential General Plan land use designation. F. ' The church use allowed on the project site under Use Permit 02-16 will not conflict with the proposed'second dwelling unit. The proposed second dwelling unit will not conflict with the church use. G. The covenant shall be on a form approved by the Department of Development Services and shall: (a) Stipulate the occupancy requirement of Condition 2, below; (b) Prohibit any land division, merger, or lot line adjustment that results in a parcel containing the two dwellings, which is less than twice the minimum parcel size requirement of the zone; (c) Stipulate that any land division proposing to place the dwellings on separate parcels must meet all the zoning and development requirements for dividing land in Butte County, including, but not limited to: lot size, lot configuration, septic requirements, and setback standards of the zone in which the parcel is located; and (d) Stipulate that if all such zoning and development requirements cannot be met, the parcel shall not be divided. 2.
