The property is zoned A-5 (Agricultural, 5 -acre minimum parcel size), and is located on the south side of Dakota Avenue, approximately 0.78 miles west of SR -99, at 331 Dakota Avenue, Biggs. APN 022-180-110 (SB) (MUP 04-04) ,Stephen Betts gave a brief summary of the project and showed a power point presentation. He noted thdt the correct site plan for this project is the one dated July 8, 2004. He made a correction to Condition 8 changing "Attachment B" to "Attachment C." Commissioner Lambert questioned the change of location for the day care where the Minor Use Permit goes with the land and not the person. Mr. Wannenmacher explained the provision for extinguishing the Minor Use Permit if abandoned for 6 months or more. He said the original day care was abandoned for over 6 months. The Agenda Report was corrected on Page 4 to delete "Bay Avenue" and insert "Dakota Avenue." The hearing was opened to the public. No one was present to speak on this item. ' The hearing was closed. Commissioner Lambert questioned the day care building being built before the conclusion of this hearing. Mr. Betts explained that the structure can be used as other than a day care and, therefore, can be constructed without this permit. , The hearing was re -opened. Joanna Lang said for clarification the Minor Use Permit for a day care would be used in the entire house. The hearing was re -closed. It was moved by Commissioner Nelson, seconded by Commissioner Marin, and unanimously carried to approve the Minor Use Permit for Joanna Lang subject to the findings and conditions listed below, changing Condition 8 to read "Attachment C." I. Find that this project is exempt from the provisions of the California Environmental Quality Act wider Section 15274(a), which states that the California Environmental Quality Act does not apply to establislmment or operation of a large family day care home, which provides in-home care for up to fourteen children, as defined in Section 1596.78 of the Health and Safety Code. Approve Minor Use Permit MUP 04-04 for JOArma L"ang for a large family day care facility for tip to 12 (14) children, on APN 022-180-110, based on the following findings and the conditions found in Exhibit "A": A. The location, size, design, and operating characteristics of the proposed use will be compatible with, and will not adversely affect, or be materially detrimental to adjacent uses, residents, buildings, structures, or natural resources, with consideration given to: . 1. Harmony in scale, bulk, coverage, and density: The project is in harmony with scale, bulk, coverage, and density because the large family clay care facility will not create a need for any new structures or an alteration to any existing structures. - 2. The availability of public facilities, services, and utilities: The large day care facility will not create a need for new public facilities, services, and utilities because telephone and electrical services already extend to the project parcel. The Butte County Fire Department requires compliance with State Fire Marshall requirements for large clay care facilities. 3. The harmful effect, if any, upon desirable neighborhood character: The proposed large clay care facility will not change the traditional architectural style that is of a character consistent with a rural residential neighborhood. The A-5 zones permits large family clay care facilities. The large family clay care facility has the potential for a small. increase in noise levels due to children playing outside and a small increase in vehicle traffic and vehicle noise. 4. The generation of traffic and the capacity and physical character of surrounding streets: The proposed large family day care facility will not significantly increase vehicle traffic in the area, nor will it create any significant vehicle circulation impacts. 5. The suitability of the site for the type and intensity of use or development which is proposed: The site has adequate area for off-site parking spaces for the residents of the dwelling and for employees of the large family day care facility. There is also adequate area for an off-street loading area. 6. Any other relevant impact of the proposed use: ■ BUTTE COUNTY PLANNING COMMISSION ■ AGENDA ■ SEPTEMBER 23, 2004 ■ PAGE 4 ■ The Planning Division has circulated the proposed large family day care facility application to County agencies and has received no evidence that the use will cause any other. relevant impact. B. The proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or materially injurious to properties or improvements in the vicinity. C. The proposed use will comply with each of the applicable provisions of the Chapter 24, Section 265, of the Butte County Code. D. The project is consistent with the five Develop Criteria found in the Agricultural Residential General Plan land use designation. E. Minor Use Permit 99-01 for a large family day care facility at 286 Dakota Avenue (APN 022-180-104) that is located approximately 195 feet to the east of the project site was declared void on June 1, 2004. With the voiding of this Minor Use Permit, the project site is located more than 500 feet driving distance from another large family day care facility as required by Butte County Code Section 24-265(e)(2). Conditions of Approval: Planning Division 1. The facility is a single family residence that shall be the principal residence of the provider and the large family day care facility shall be clearly incidental and secondary to the use of the property for residential purposes. , 2. The large family day care facility structure shall not contain kitchen facilities and all food preparation/cooking shall occur in the primary dwelling unit. 3. Minimum off-street parking. shall be provided pursuant to the following standards: (a) Two (2) off-street parking spaces for the residents of the dwelling. (b) One (1) off-street parking space for each employee/volunteer. The two (2) required residential spaces may not be used for employees/volunteers. (c) Two (2) off-street parking space/loading area. 4. One sign, not to exceed 3 square feet, is allowed. This sign shall not be placed in the front yard building setback. 5. Prior to issuance of the Minor Use Permit, applicant shall obtain any necessary building permits required by code. The capacity of the large family day care facility may be increased administratively to 14 children when the Butte County Code is amended to conform to the State statute. The project site shall be developed in accordance with the approved project site plan and the conditions contained herein. Said site plan is on file in the Planning Division, is identified as "Attaclunent C" and date-stamped July 8, 2004, and is incorporated herein by this reference. 9. Applicant must also comply with all other applicable State and local statutes, ordinances, and regulations. 10. All outstanding application processing fees shall be paid prior to issuance of the Minor Use Permit. Public Works 11. Traffic shall not be allowed to back out of driveways onto Dakota Avenue. 12. Obtain an encroaclument permit for all new or existing driveway approaches and construct them to County standards, as specified in County Improvement Standards. Fire Department/CDF 13. Prior to the start of the large family day care facility use provide plans and specifications to the Butte County Fire Chief to determine compliance with fire and life safety standards of Titles 19 and 24, California Code of Regulations. County Counsel 14. If this entire matter or any finding, action or condition of this matter is appealed to the Board of Supervisors, the applicant or any other developer/operator other than the applicant agrees to indemnify the County of Butte .from liability or loss related to the approval of this project and agrees to sign an indemnification agreement in a form approved by County Counsel before the Board's appeal hearing. If the application is not appealed, this condition is deemed satisfied. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a fon-nal application for amendment. The Minor Use Permit shall expire and the permit shall thereafter be of no further force or effect if the use, business, or service for which the minor use permit was issued terminates or ceases operation for a continuous period of time in excess of one hundred eighty (180) calendar days except for: (1) Destruction or damage by acts of God; or (.2) Destruction or damage by malicious acts, or (3) Remodeling or rehabilitation requiring prolonged closure with prior approval of the planning manager. 6. The terms and conditions of this permit shall run with the land and shall be binding upon and be. to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. Conditions of Approval: Planning Division 1. The facility is a single family residence that shall be the principal residence of the provider and the large family day care facility shall be clearly incidental and secondary to the use of the property for residential purposes. 2. The large family day care facility structure shall not contain kitchen facilities and all food preparation/cooking shall occur in the primary dwelling unit. 3. Minimum off-street parking shall be provided pursuant to the following standards: (a) Two (2) off-street parking spaces for the residents of the dwelling. (b) One (1) off-street parking space for each employee/volunteer. The two (2) required residential spaces may not be used for employees/volunteers. (c) Two (2) off-street parking space/loading area. 4. One sign, not to exceed 3 square feet, is allowed. This sign shall not be placed in the front yard building setback. 5. The large family day care home shall be licensed by the California Department of Social Services, Community Care Licensing. 6. Prior to issuance of the Minor Use Permit, applicant shall obtain any necessary building permits required by code. 7. The capacity of the large family day care facility may be increased administratively to 14 children when the Butte County Code is amended to conform to the State statute. 8. The.project site shall be developed in accordance with the approved project site plan and the conditions contained herein. If this entire matter or any finding, action or condition of this matter is appealed to the Board of Supervisors, the applicant or any other developer/operator other .than the applicant agrees to indemnify the County of Butte from liability or loss related to the approval of this project and agrees to sign an indemnification agreement in a form approved by County Counsel before the Board's appeal hearing. Staff recommends approval of this Minor Use Permit with findings and conditions. PROJECT DESCRIPTION/SITE CHARACTERISTICS: • The project would allow the establishment of a large family day care facility. Butte County Code Section 24-265((b)(2) defines a large family day care facility as having seven (7) to twelve (12) children as defined in chapter 3.4, article I, section 1596.79 of the California Health and Safety Code, Child Care Act. (note: this state law was revised several years ago to allow up to fourteen (14) children in a large family day care facility, but the Butte County Code had not been revised to reflect this change) • The large family day care facility would be operated out of a 1,300 square foot structure that would be attached via a covered breezeway to a single family dwelling (both structures are currently under construction). The day care facility structure would include a large play area, painting room, cleaning room, an office, and restroom facilities for children and adults. • The large family day care facility structure would not contain kitchen facilities and all food preparation/cooking for the large day care facility would occur in the dwelling unit. ■ Butte County Department of Development Services ■ ■ September 23, 2004 ■ Agenda Report - Lang MUP 04-04 ■ Page 1 of 9 ■ • The proposed large day care facility is proposed to operate Monday through Friday, from 6:00 a.m. to 5:30 p.m. • Access to the day care facility is proposed to be from an on-site loop road (one end connecting to Dakota Avenue and the other end connecting to the driveway on the site). Children would not be dropped off on Dakota Avenue and backing out onto Dakota Avenue would not be necessary. • Sewage disposal would be handled via an on-site septic system. Domestic water would be obtained from an on-site well. • The project site is currently being developed with a single family dwelling unit and an attached day care facility structure. The site is level with no drainages. A few oaks and other trees are located on the west side of the project site. • The project site is located in an area that is zoned A-5, and has a General Plan Land Use designation of Agricultural Residential. • Most of the surrounding parcels are 5 acres in size and are developed with single family dwelling units. • Existing agricultural uses in the project area include livestock on a parcel approximately 700 feet to the west of the project site, an orchard approximately 500 feet to the north; another orchard approximately 670 feet to the northeast, and organic grapes approximately 400 feet to the northeast. • Dakota Avenue, which is a public road and is paved, is classified as a minor local street. Dakota Avenue does not have high traffic volumes. • The project site is not located within a 100 -year flood zone, an earthquake zone, or an airport compatibility zone. • The applicant would live in the single family dwelling that would be attached to the day care facility. ANALYSIS: • Per Butte County Zoning Code Section 24-265(b)(2), large family day care homes may have up to twelve (12) children. The current state law has limits of fourteen (14) for large family day care centers. The County Code has not been changed to reflect these new limits. This proposal is being processed under the existing County Code and at such time as the code is revised to the new state standards, the limits on the allowed number of children may be administratively adjusted for existing large child care centers. • The A-5 zoning classification allows large family day care facilities with approval of a Minor Use Permit and subject to the requirements of Section 24-265 of the Butte County Zoning Code. The General Plan states that the Primary Use of the Agricultural Residential land use designation is single family homes at suburban/rural densities. Secondary Uses include group quarters and care homes. • Butte County Code Section 24-265(e)(2) requires that a large family day care facility be located at least 500 feet driving distance from any other large family day care center. The applicant was previously granted Minor Use Permit 99-01 for a large family day care facility at 286 Dakota Avenue (APN 022-180-104) that is located approximately 195 feet to the east of the project site. Pursuant to Butte County Code Section 24-41(f)(4), a Minor Use Permit shall expire and the permit shall thereafter be of no further force or effect if the use for which the Minor Use Permit was issued terminates or ceases operation for a continuous period of time in excess of 180 calendar day. Minor Use Permit 99-01 became void on June 1, 2004, since the large family day care use permitted by that Minor Use Permit had been discontinued for more than 180 days. A letter was sent to the owners of 286 Dakota Avenue that stated MUP 99-01 was void. No other large family day care centers are located within 500 feet of the project site. The project site is located in agricultural zone that consists primarily of 5 -acre ranchettes. No orchards are located within 300 feet of the proposed large day care facility. The proposed day care facility is not expected to create any impacts to nearby agricultural operations. Nearby agricultural operations are not expected to create any impacts to the children at the proposed day care facility due to the long distances between these uses. The Butte County Agricultural Commissioner's Office did not object to this project and did not recommend any conditions of project approval. • The project would not result in a significant increase in air emissions, fugitive dust emissions, light, noise, or vehicle traffic. • There is adequate area for off-street parking for the residents of the dwelling and for drop-off and pick-up of children. The proposed loop road on the site would not require vehicles to back out onto Dakota Avenue. • The project has been conditioned to prohibit the installation of kitchen facilities in the large day care facility. • The Butte County Environmental Health Division did not recommend any conditions of project approval. The Environmental Health Division issued a sewage disposal permit on the project site and the septic system has been sized to accommodate the proposed large family day care facility use. • The applicant is required to provide plans and specifications to the Butte County Fire Chief to determine compliance with fire and life safety standards of Titles 19 and 24, California Code of Regulations. • The applicant is required to be licensed by the California Department of Social Services, Community Care Licensing. • The Agricultural Residential General Plan designation lists five development criteria. The criteria are as follows, along with staff's response: 1. Compatible with neighboring agricultural activities. No agricultural activities currently occur on any of the parcels that surround the project site. Existing agricultural uses in the project area include livestock on a parcel approximately 700 feet to the west of the project site, an orchard approximately 500 feet to the north; another orchard approximately 670 feet to the northeast, and organic grapes approximately 400 feet to the northeast. The Butte County Agricultural Commissioner's Office stated that the project would not have an impact to agricultural activities. ■ Butte County Department of Development Services ■ ■ September 23; 2004 ■ Agenda Report - Lang MUP 04-04 ■ Page 3 of 9 ■ 2. Evidence of adequate water and sewage disposal capacity. Usable sewage disposal area as required by Appendix VII of the Butte County Improvement Standards exists on the project site. A septic permit for the project parcel was issued by the Butte County Environmental Health Division, which incorporated the proposed large family day care use. Domestic water for the project site is obtained from an on-site well. The project would not have a significant impact on ground water supplies in the area because the project does not require the use of large amounts of water and because of the large groundwater aquifers located in the project area. 3. Availability of adequate fire protection facilities. The nearest staffed County fire station is Station # 73 (Biggs), which is located approximately 0.9 road miles from the project site in the City of Biggs. The dwelling unit and the attached day care facility will be equipped with interior fire sprinkler systems, which was a requirement of the parcel map that created the project parcel. 4. Adequately maintained approved road access with sufficient capacity to se is area. The project site fronts on Dakota Avenue, which is a public road. Avenue is classified as a minor local roadway and has very little vehicular traffic on it. The roads in the project area can safely handle the minor increase in vehicle traffic generated by the project. 5. Reasonable accessibility to commercial services and schools. The project site is located just outside of the City of Biggs, where commercial services and K-12 schools are located. Based upon the above responses, the project can be considered to be consistent with the Development Criteria found in the Agricultural Residential General Plan land use designation. ENVIRONMENTAL REVIEW: This application for a Minor Use Permit to allow a large family day care is Statutorily Exempt from environmental review under Section 15274(a), which states that the California Environmental Quality Act does not apply to establishment or operation of a large family day care home, which provides in-home care for up to fourteen children, as defined in Section 1596.78 of the Health and Safety Code. ACTIONS FOR CONSIDERATION: Staff recommends that the Planning Commission take the following actions: I. The location, size, design, and operating characteristics of the proposed use will be compatible with, and will .not adversely affect, or be materially detrimental to adjacent uses, residents, buildings, structures, or natural resources, with consideration given to: 1. Harmony in scale, bulk, coverage, and density: The project is in harmony with scale, bulk, coverage, and density because the large family day care facility will not create a need for any new structures or an alteration to any existing structures. 2. The availability of public facilities, services, and utilities: The large day care facility will not create a need for new public facilities, services, and utilities because telephone and electrical services already extend to the project parcel. The Butte County Fire Department requires compliance with State Fire Marshall requirements for large day care facilities. 3. The harmful effect, if any, upon desirable neighborhood character: The proposed large day care facility will not change the traditional architectural style that is of a character consistent with a rural residential neighborhood. The A-5 zones permits large family day care facilities. The large family day care facility has the potential for a small increase in noise levels due to children playing outside and a small increase in vehicle traffic and vehicle noise. 4. The generation of traffic and the capacity and physical character of surrounding streets: The proposed large family day care facility will not significantly increase vehicle traffic in the area, nor will it create any significant vehicle circulation impacts. 5. The suitability of the site for the type and intensity of use or development which is proposed: The site has adequate area for off-site parking spaces for the residents of the dwelling and for employees of the large family day care facility. Any other relevant impact of the proposed use: The Planning Division has circulated the proposed large family day care facility application to County agencies and has received no evidence that the use will cause any other relevant impact. The proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or materially injurious to properties or improvements in the vicinity. C. The proposed use will comply with each of the applicable provisions of the Chapter 24, Section 265, of the Butte County Code. D. The project is consistent with the five Develop Criteria found in the Agricultural Residential General Plan land use designation. E. Minor Use Permit 99-01 for a large family day care facility at 286 Dakota Avenue (APN 022-180-104) that is located approximately 195 feet to the east of the project site was declared void on June 1, 2004. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. Conditions of Approval: Planning Division The facility is a single family residence that shall be the principal residence of the provider and the large family day care facility shall be clearly incidental and secondary to the use of the property for residential purposes. 2. The large family day care facility structure shall not contain kitchen facilities and all food preparation/cooking shall occur in the primary dwelling unit. Minimum off-street parking shall be provided pursuant to the following standards: (a) Two (2) off-street parking spaces for the residents of the dwelling. (b) One (1) off-street parking space for each employee/volunteer. The two (2) required residential spaces may not be used for employees/volunteers. (c) Two (2) off-street parking space/loading area. 4. One sign, not to exceed 3 square feet, is allowed. This sign shall not be placed in the front yard building setback. 5. The large family day care home shall be licensed by the California Department of Social Services, Community Care Licensing. 6. Prior to issuance of the Minor Use Permit, applicant shall obtain any necessary building permits required by code. 7. The capacity of the large family day care facility may be increased administratively to 14 children when the Butte County Code is amended to conform to the State statute. 8. The project site shall be developed in accordance with the approved project site plan and the conditions contained herein. We have in the record the fact that Ms. Lang abandoned the large day care facility approved under MUP 99-01 in October of 2003. 1 confirmed this with her on the phone yesterday. I also checked the California Department of Social Services on-line list of the day care licensees in Butte County and it shows that the new owners of the parcel do not have a license to operate a large day care facility.
