Mr. Wannenmacher said on Page 6, Attachment C should be Attachment D The hearing was opened to the public. No one was present to speak on this item. The hearing was closed. It was moved by Commissioner Mann, seconded by Commissioner Evans, and unanimously carried to approve a Minor Use Permit for Coreen Lautin-Davis subject to the findings and conditions listed below, changing "Attachment C" to "Attachment D." I. Find that this project is Categorically Exempt from environmental review under Section 15303(a), as defined by CEQA. The collection of fees pursuant to Fish and Game Code Section 711.4 and 14 CCR 753.5. is not required. II. Approve Minor Use Permit MUP 04-08 for Coreen Lautin-Davis for a bed and breakfast home, on APN 006-670-003, based on the following findings and the conditions found in Exhibit "A": A. The location, size, design, and operating characteristics of the proposed use will be compatible with, and will not adversely affect, or be materially detrimental to adjacent uses, residents, buildings, structures, or natural resources, with consideration given to: 1. Harmony in scale, bulk, coverage, and density: The project is in harmony with scale, bulk, coverage, and density because the bed and breakfast home use will be located in an existing dwelling and will not create a need for any new structures. The applicant's proposed 750 square foot addition to the dwelling would be consistent with other dwellings in the project area. 2. The availability of public facilities, services, and utilities: The bed and breakfast home use will not create a need for new public facilities, services, and utilities because telephone and electrical services already extend to the project parcel. The Butte County Fire Department requires compliance with State Fire Marshall requirements for bed and breakfast homes. 3. The harmful effect, if any, upon desirable neighborhood character: ■ BUTTE COUNTY PLANNING COMMISSION ■ AGENDA ■ SEPTEMBER 23, 2004 ■ PAGE 7 ■ The proposed bed and breakfast home will not change the traditional architectural style that is of a character consistent with a rural/agricultural area. The bed and breakfast home use has the potential for a small increase in noise levels due to a minor increase in vehicle traffic and due to the higher number of people on the project site. 4. The generation of traffic and the capacity and physical character of surrounding streets: The proposed bed and breakfast home use will not significantly increase vehicle traffic in the area, nor will it create any significant vehicle circulation impacts. 5. The suitability of the site for the type and intensity of use or development which is proposed: The existing septic systems on the project site, with an extension of the leach lines, would be able to handle the increase in waste water generated by the proposed bed and breakfast home. The site has adequate area for off-site . parking spaces for the guests in the bed and breakfast home and for the residents. The project site would not have an impact to any adjoining or nearby agricultural uses. 6. Any'other relevant impact of the proposed use: The Planning Division has circulated the proposed bed and breakfast home application to County agencies and has received no evidence that the use will cause any other relevant impact. B. The proposed location, size, design, and operating characteristics of the proposed 'use and the conditions under which it would be operated or maintained will not be detrimental. to the public health, safety, or welfare, or materially injurious to properties or improvements in the vicinity. Conditions of Approval: Planning Division 1. The project site shall be developed in accordance with the approved project site plan and the conditions contained herein. Said site plan is on file in the Planning Division, is identified as "Attachment D" and date-stamped June 7, 2004, and is incorporated herein by this reference. 2. - No more than three (3) bedrooms shall be rented for overnight lodging: ■ BUTTE COUNTY PLANNING COMMISSION ■ AGENDA ■ SEPTEMBER 23, 2004 ■ PAGE 8 ■ 3. The rooms for rent shall not contain cooking facilities. 4. Meals may be provided to overnight guests only; subject to applicable County health regulations. 5. No parking shall be allowed on Nord Highway. 6. One sign, not to exceed 3 square feet, is allowed. This sign shall not be placed in the front yard building setback. r 7. Applicant must'also comply with all other applicable State and local statutes, ordinances, and regulations. Public Works Department 8. Prior to the issuance of building permits, obtain an encroachment permit for all new or existing driveway approaches and construct them to County standards, as specified in County Improvement Standards. Environmental Health Division 9. Sewage disposal systems shall be upgraded to meet increased discharge requirements. Upgrades to the sewage disposal systems shall be under permit issued by the Environmental Health Division. 10. All food facilities shall meet all applicable requirements of the California Retail Food Facilities Law. Any person constructing or remodeling a food establishment or opening a new food establishment shall submit plans and plan check fee to Butte County Environmental Health for approval. Fire Department/CDF 11. Construction, installation or development of structures or facilities on the parcel/lot shall comply with the latest California Fire Safe Regulations, (Public Resources Code 4290), and all other applicable State and County codes, ordinances and regulations in effect at the time of application for improvement permits. 12. Building identification and/or addresses shall be installed. in conformance with Public Resources Code 4290 and shall be posted at the beginning of building construction and maintained continuously thereafter. 13. Prior to use, the facility shall be inspected by the Butte County Fire Departnent/CDF and shall meet the requirements of CCR Title 19. If this entire matter or any finding, action or condition of this matter is appealed to the Board of Supervisors, the applicant or any other developer/operator other than the applicant agrees to indemnify the County of Butte from liability or loss related to the approval of this project and agrees to sign an indemnification agreement in a form approved by County Counsel before the Board's appeal hearing. If the application is not appealed, this condition is deemed satisfied. It is nestled in the farming district. There are walnut orchards on its east side and a hayfield and cornfield on its west side. To the north, across Nord Highway, are an open field and an almond orchard. There is a 5 -acre eucalyptus grove on the south half of the property, with a hayfield and homes beyond that. The land has been used for the last 15 years as our home and accorrtmodation for our horses. The existiq} structures consist of the residence, a steel barn (6 stalls, tack room, hay storage), a mv4tipurpose shop (storage, garage, wood -stied),, and a swimming pool and pool -house. Numerous large trees surround the home, the garden, and the front dive. #33 - As stated above, orchards and farms surround the parcel of land. To our west, Dutro Farms grows many different row crops. To our west and south, the McDuggles grow hay. To our east, Richard and Terry Attenger have a walnut orchard. To our north, across Nord Highway, Dirk and Sandy Toews, have an open field, which was not planted this season but often is planted to row crops. Also to our north, and to the west of the Toews property, Mr. And Mrs. Lapes have an almond orchard. Each of those property owners resides on their land in single-family dwellings. Minor changes may. be approved administratively by the Directors of Development Services, Environrne'ntal Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee. Prior to such approval, verification. shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. The approving authority may' grant or deny an application for renewal of a minor use permit. 5. Butte County Code Section 24-305.042 defines a bed and breakfast home as a structure designed as a single-family dwelling with one (1) family in permanent residence, where no more than three (3) bedrooms, without individual cooking facilities, are rented for overnight lodging. Meals may be provided to overnight guests only, subject to applicable County health regulations. • The applicant is the owner of the property and lives in the dwelling on the parcel. Minor interior changes to the dwelling would also be accomplished to allow the three bedrooms utilized for the bed and breakfast home use to have individual bathrooms. • Access to the existing dwelling is from Nord Highway. No new driveway encroachinents onto Nord Highway would be required. • Sewage disposal for the existing dwelling is handled via two on-site septic systems. The project would require that additional leach lines be installed to handle the increase in waste water. Domestic water is obtained fiom an on-site well. • The project site is developed with a dwelling unit, two septic systems, well, detached garage, swimming pool, pool house, horse corral, and a large barn. Approximately five acres of the project site consists of eucalyptus trees. Horses are kept on the parcel. • The project site is located in an area that is zoned A-20, and has a General Plan Land Use designation of Orchard and Field Crops. • Most of the surrounding parcels are 10 acres or less in size and are developed with single family dwelling units. • Existing agricultural uses on the surrounding parcels includes orchards, row crops, and field crops. The dwelling on the project site is located approximately 150 feet from the parcels to the north and west, which currently consist of open, fallow fields. An orchard is located to the east of the site, which is located approximately 330 feet from the dwelling on the site. Another open, fallow field is located on the parcel to the south of the site, and which is approximately 570 feet from the dwelling on the project site. • Nord Highway, which is a public road and is paved, is classified as a major arterial roadway. • The project site is not located within a 100 -year flood zone, an earthquake fault zone, or an airport compatibility zone. ANALYSIS: • The A-20 zoning district allows a bed and breakfast home with approval of a Minor Use Permit (Butte County Code Section 24-90(d)(2)). The General Plan states that the Primary Use of the Orchard and Field Crops land use designation is agricultural. Secondary. Uses include dwellings. • The impacts caused by the dwelling on the project site to the adjoining agricultural uses already exist, and the project is not expected to create any additional impacts. The Butte County Agricultural Commissioner's Office stated that the project would not have any significant impacts on agricultural uses. • The proposed bed and breakfast use would generate approximately 10 vehicle trips per occupied room. With all three bedrooms occupied approximately 30 vehicle trips per day would be generated due to the bed and breakfast use. The increase in vehicular traffic would be minor and would not cause any significant impacts to traffic circulation in the project area. • The proposed bed and breakfast use would cause a slight increase in noise in the project area. The additional vehicles entering and exiting the site would generate some noise, along with the increase in human activity on the site. Bed and breakfast homes are usually quiet and generally do not create loud noises. The noise generated by the proposed bed and breakfast use would be consistent with the surrounding parcels, which consists of agricultural and rural residential uses. • There is adequate area for off-street parking for the guests staying at the proposed bed and breakfast home. There is good sight vision of Nord Highway from the project site's driveway. • The kitchen in the dwelling is required to meet applicable requirements of the California Retail Food Facilities Law. ENVIRONMENTAL REVIEW: This application for a Minor Use Permit to allow a bed and breakfast home is determined to be Categorically Exempt from environmental review under Section 15303 — New Construction or Conversion of Small Structures. Class 3 consists of construction and location of limited numbers of new, small facilities or structures; installation of small new equipment and facilities in small structures; and the conversion of existing small structures from one use to another where only minor modifications are made in the exterior of the structure. ACTIONS FOR CONSIDERATION: Staff recommends that the Planning Commission take the following actions: I. Find that this project is Categorically Exempt from environmental review under Section 15303(a), as defined by CEQA. The collection of fees pursuant to Fish and Game Code Section 711.4 and 14 CCR 753.5. is not required. II. Approve Minor Use Permit MUP 04-08 for Coreen Lautin-Davis for a bed and breakfast home, on APN 006-670-003, based on the following findings and the conditions found in Exhibit "A": A. The location, size, design, and operating characteristics of the proposed use will be compatible with, and will not adversely affect, or be materially detrimental to adjacent uses, residents, buildings, structures, or natural resources, with consideration given to: 1. Hannony in scale, bulk, coverage, and density: The project is in harmony with scale, bulk, coverage, and density because the bed and breakfast home use will be located in an existing dwelling and will not create a need for any new structures. The applicant's proposed 750 square foot addition to the dwelling would be consistent with other dwellings in the project area. 2. The Butte County Fire Department requires compliance with State Fire Marshall requirements for bed and breakfast homes. 3. The harmful effect, if any, upon desirable neighborhood character: The proposed bed and breakfast home will not change the traditional architectural style that is of a character consistent with a rural/agricultural area. The bed and breakfast home use has the potential for a small increase in noise levels due to a minor increase in vehicle traffic and due to the higher number of people on the project site. 4. The generation of traffic and the capacity and physical character of surrounding streets: The proposed bed and breakfast home use will not significantly increase vehicle traffic in the area, nor will it create any significant vehicle circulation impacts. 5. The suitability of the site for the type and intensity of use or development which is proposed: The existing septic systems on the project site, with an extension of the leach lines, would be able to handle the increase in waste water generated by the proposed bed and breakfast home. The site has adequate area for off-site parking spaces for the guests in the bed and breakfast home and for the residents. The project site would not have an impact to any adjoining or nearby agricultural uses. 6. Any other relevant impact of the proposed use: The Planning Division has circulated the proposed bed and breakfast home application to County agencies and has received no evidence that the use will cause any other relevant impact. B. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a fon-nal application for amendment. The terms and conditions of this pen -nit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. Conditions of Approval: Planning Division 1. The project site shall be developed in accordance with the approved project site plan and the conditions contained herein. The septic system on the North side of the residence currently consists of a 1250 -gallon tank with 62 feet of 36- inch wide leach linwhich serves 4 bedrooms and related baths. The septic system on the South side of the residence consists of a 1000 -gallon tank with 100 feet of 36 -inch wide leach line, which serves the kitchen, laundry room, office and a bathroom. The applicant proposes to remodel the existing structure to include the addition of a new master bedroom and bathroom on the South end, and conversion of the North end into 4 bedrooms with individual bathrooms, three of which are to be rented for the B &B. Suggested Conditions: Both of the existing septic systems are deficient in size to accommodate the remodel and B &B. The North end of the house with 4 bedrooms and baths requires 275 feet of 36 -inch wide leach trenches; approximately 220 feet would need to be added. The South end of the house requires 160 feet of 36 -inch wide leach trenches; 60 feet would need to be added. A repair permit is required from Environmental Health to upgrade the systems. Upon upgrade, this department would recommend approval of the Use Permit. This review should not be construed as a blanket approval of your project since participation in Page 2 May 12, 2004 the Use Permit process may change the project due to other agency requirements.
