Mr. Durling gave a brief summary of the project. Mr. Wannenmacher commented that the site plan marked Attachment C has a date on it. He said there is a computer generated site plan with no date. He said they need to be sure which site plan they are approving. Mr. Durling said the full map, Attachment C, is the correct one. The hearing was opened to the public. Barbara Knutson said she agreed with the conditions. She said she did not know why there are road improvement conditions. Ms. Christopher said this is a discretionary permit.where the County can ask for certain improvements. The hearing was closed to the public and comments confined to, the Commission and staff. It was moved by Commissioner Leland, seconded by Commission Nelson, and unanimously carried to the Minor Use Permit for Barbara Jean Knutson, listing Attachment C in Condition 8, and subject to the following findings and conditions: I. Find that this project is exempt from the provisions of the California Environmental Quality Act under Section 15274(a), which states that the California Environmental Quality Act does not apply to establishment or operation of a large family day care home, which provides in-home care for up to fourteen children, as defined in Section 1596.78 of the Health and Safety Code. The payment of fees pursuant to Fish and Game Code Section 711.4 and 14 CCR 753.5 are not required. II. Approve Minor Use Permit MUP 05-03 for Barbara Jean Knutson for a large family day care facility for up to 12 (14) children, on APN 030-110-040, based on the following findings and the conditions found in Exhibit "A": A. The location, size, design, and operating characteristics of the proposed use will be compatible with, and will not adversely affect, or be materially detrimental to adjacent uses, residents, buildings, structures, or natural resources, with consideration given to: Harmony in scale, bulk, coverage, and density: The project is in harmony with scale, bulk, coverage, and density because the large family day care facility will not create a need for any new structures or an alteration to any existing structures. The availability of public facilities, services, and utilities: The large day care facility will not create a need for new public facilities, services, . and utilities because telephone and electrical services already extend to the project parcel. The Butte County Fire Department requires compliance with State Fire Marshall requirements for large day care facilities. , 3. The harmful effect, if any, upon desirable neighborhood character: The proposed large day care facility will not change the traditional architectural style that is of a character consistent with a rural residential neighborhood. The A -R zone permits large family day care facilities. The large family day care facility has the potential for a small increase in noise levels due to children playing outside and a small increase in vehicle traffic and vehicle noise. 4. The generation of traffic and the capacity and physical character of surrounding streets: The proposed large family day care facility will not significantly increase vehicle traffic in the area, nor -will it create any significant vehicle circulation impacts: . 5. The suitability of the site for the type and intensity of use or development which is proposed: The site has adequate area for off-site parking spaces for the residents of the dwelling and for employees of the large family day care facility. There is also adequate area for an on -street loading area. 6. Any other relevant impact of the proposed use: The Planning Division has circulated the proposed large family day care facility application to County agencies and has received no evidence that the use will cause any other relevant impact. B. The proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or materially injurious to properties or improvements in the vicinity in that the size of the parcel provides sufficient space for the children, and the play area is located adjacent to the rear yards of adjoining parcels. C. The proposed use will comply with each of the applicable provisions of the Chapter ■ BUTTE COUNTY PLANNING COMMISSION ■ MINUTES ■ JULY 14, 2005 ■ PAGE 26 ■ 24, Section 265, of the Butte County Code that addresses Day Care Facilities. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees, paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. The approving authority may grant or deny an application for renewal of a minor use permit. 5. The Minor Use Permit shall expire and the permit shall thereafter be of no further force or effect if the use, business, or service for which the minor use permit was issued terminates or ceases operation for a continuous period of time in excess of one hundred eighty (180) calendar days except for: (1) Destruction or damage by acts of God; or (2) Destruction or damage by malicious acts; or (3) Remodeling or rehabilitation requiring prolonged closure with prior approval of.the plarming manager. 6. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. The existing dwelling has a 15' x 22' napping room within the dwelling. The ■ Butte County Department of Development Services ■ ■ July 14, 2005 ■ Agenda Report - Knutson MUP 05-03 ■ Page 1 of 12 ■ • existing facility includes a large outdoor play area, rumpus room in the garage, and restroom facilities for children and adults. • All food preparation/cooking for the large day care facility occurs in the dwelling unit. • The large day care facility will continue to operate Monday through Friday, from 6:00 a.m. to 5:30 p.m. • Children would be dropped off in front of the house on Feather Avenue. • Sewage disposal is handled via public sewer. Domestic water is obtained by public water. • The project site is currently developed with a single family dwelling unit and a large workshop not part of the day care facility. The site is level with no drainages. The large back yard has mulberry and pine trees. • The project site is located in an area that is zoned A -R (Agricultural -Residential), and has a General Plan Land Use designation of LDR (Low -Density Residential). • Surrounding uses include a single family subdivision west across 18th street, single family dwelling to the north fronting on 18th street, and vacant parcels to the east and south across Feather Avenue. • Feather Avenue, which is a public road and is paved, is classified as a minor local street. Eighteenth Street is a collector street. Both streets are at an "A" level of service. • The project site is not located within a 100 -year flood zone, or an earthquake zone. The project site is located in Compatibility Zone "C" of the Oroville Airport. Family care centers are permitted in this zone per Note 11, page 2-15 of the Compatibility Plan. • The applicant currently lives in the single family dwelling. ANALYSIS: • Per Butte County Zoning Code Section 24-265(b)(2), large family day care homes may have up to twelve (12) children. The current state law has limits of fourteen (14) for large family day care centers. The County Code has not been changed to reflect these new limits. This proposal is being processed under the existing County Code and at such time as the code is revised to the new state standards, the limits on the allowed number of children may be administratively adjusted to fourteen (14) children for existing large child care centers. • The A -R zoning classification allows large family day care facilities with approval of a Minor Use Permit and subject to the requirements of Section 24-265 of the Butte County Zoning Code. The General Plan states that a Primary Use of the Low Density Residential land use designation is single family homes at suburban densities. Secondary Uses include group quarters and care homes. • Butte County Code Section 24-265(e)(2) requires that a large family day care facility be located at least 500 feet driving distance from any other large family day care center. There are no family day care centers within 500 feet. Pursuant to Butte County Code Section 24-41(f)(4), a Minor Use Permit shall expire and the permit shall thereafter be of no further force or effect if the use for which the Minor Use Permit was issued terminates or ceases operation for a continuous period of time in excess of 180 calendar days. ■ Butte County Department of Development Services ■ ■ July 14, 2005 ■ Agenda Report - Knutson MUP 05-03 ■ Page 2 of 12 ■ • 0 • No orchards are located within 300 feet of the proposed large day care facility. The proposed day care facility is not expected to create any impacts to adjacent uses. • The project would not result in a significant increase in air emissions, fugitive dust emissions, light, noise, or vehicle traffic. • There is adequate on-site area for off-street parking for the residents of the dwelling. Feather Avenue property frontage has sufficient area for drop-off and pick-up of children. • The Butte County Environmental Health Division did not recommend any conditions of project approval. • The applicant is required to provide plans and specifications to the Butte County Fire Chief to determine compliance with fire and life safety standards of Titles 19 and 24, California Code of Regulations. A large workshop on the property is used for storage of hazardous materials. • The applicant is required to be licensed by the California Department of Social Services, Community Care Licensing. ENVIRONMENTAL REVIEW: This application for a Minor Use Permit to allow a large family day care is Statutorily Exempt fi-om environmental review under Section 15274(a), which states that the California Environmental Quality Act does not apply to establishment or operation of a large family day care home, which provides in-home care for up to fourteen children, as defined in Section 1596.78 of the Health and Safety Code. ACTIONS FOR CONSIDERATION: Staff recommends that the Planning Commission take the following actions: I. Find that this project is exempt from the provisions of the California Environmental Quality Act under Section 15274(a), which states that the California Environmental Quality Act does not apply to establishment or operation of a large family day care home, which provides in-home care for up to fourteen children, as defined in Section 1596.78 of the Health and Safety Code. The payment of fees pursuant to Fish and Game Code Section 711.4 and 14 CCR 753.5 are not required. II. Approve Minor Use Permit MUP 05-03 for Barbara Jean Knutson for a large family day care facility for up to 12 (14) children, on APN 030-110-040, based on the following findings and the conditions found in Exhibit "A": A. The location, size, design, and operating characteristics of the proposed use will be compatible with, and will not adversely affect, or be materially detrimental to adjacent uses, residents, buildings, structures, or natural resources, with consideration given to: 1. The availability of public facilities, services, and utilities: The large day care facility will not create a need for new public facilities, services, and utilities because telephone and electrical services already extend to the project parcel. The Butte County Fire Department requires compliance with State Fire Marshall requirements for large day care facilities. 3. The harmful effect, if any, upon desirable neighborhood character: The proposed large day care facility will not change the traditional architectural style that is of a character consistent with a rural residential neighborhood. The A -R zone permits large family day care facilities. The large family day care facility has the potential for a small increase in noise levels due to children playing outside and a small increase in vehicle traffic and vehicle noise. 4. The generation of traffic and the capacity and physical character of surrounding streets: The proposed large family day care facility will not significantly increase vehicle traffic in the area, nor will it create any significant vehicle circulation impacts. The suitability of the site for the type and intensity of use or development which is proposed: The site has adequate area for off-site parking spaces for the residents of the dwelling and for employees of the'large family day care facility. There is also adequate area for an on -street loading area. 6. Any other relevant impact of the proposed use: The Planning Division has circulated the proposed large family day care facility application to County agencies and has received no evidence that the use will cause any other relevant impact. B. There are no other Family Day Care centers located within 500 feet driving distance from another large family day care facility as required by Butte County Code Section 24-265(e)(2). Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-41. 2. Unless otherwise provided for in a special condition to this Minor Use Permit, all conditions must be completed prior to or concurrently with the establishment of the granted use. The use granted by this permit must be established within 12 months of the delivery of the countersigned permit to the Permittee. 3. If any use for which a Minor Use Permit has been granted is not established within one year of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. 4.. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. The approving authority may grant or deny an application for renewal of a minor use permit. 5. The Minor Use Permit shall expire and the permit shall thereafter be of no further force or effect if the use, business, or service for which the minor use permit was issued terminates or ceases operation for a continuous period of time in excess of one hundred eighty (180) calendar days except for: (1) Destruction or damage by acts of God; or (2) Destruction or damage by malicious acts; or (3) Remodeling or rehabilitation requiring prolonged closure with prior approval of the planning manager. 6. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. Conditions of Approval: Planning Division 1. The facility is a single family residence that shall be the principal residence of the provider and the large family day care facility shall be clearly incidental and secondary to the use of the property for residential purposes. 2. The large family day care facility shall use existing kitchen facilities and all food preparation/cooking shall occur in the primary dwelling unit. 3. Minimum off-street parking shall be provided pursuant to the following standards: (a) Two (2) off-street parking spaces for the residents of the dwelling. (b) One (1) off-street parking space for each employee/volunteer. The two (2) required residential spaces may not be used for employees/volunteers. (c) Two (2) off-street parking space/loading area. 4. One sign, not to exceed 3 square feet, is allowed. This sign shall not be placed in the front yard building setback. 5. The large family day care home shall be licensed by the California Department of Social Services, Community Care Licensing. 6. The capacity of the large family day care facility may be increased administratively to 14 children when the Butte County Code is amended to conform to the State statute. 8. Said site plan is on file in the Planning Division, is identified as "Attachment B" and date-stamped December 29, 2004, and is incorporated herein by this reference. 9. Applicant must also comply with all other applicable State and local statutes, ordinances, and regulations. 10. All outstanding application processing fees shall be paid prior to issuance of the Minor Use Permit. 11. The dwelling's garage shall not be used for day care activities of any kind. 12. Provide disabled accessibility, upon request, per the California Building Code. Public Works 13. Prior to the issuance of the Minor Use Permit, obtain an encroachment permit for all new or existing driveway approaches and construct them to County standards, as specified in County Improvement Standards. 14. Prior to the issuance of Minor Use Permit, deed to Butte County, in fee simple, 30 feet of right-of-way from the centerline of Feather Ave. and 40 feet right-of-way from the centerline of 181h St. The right of way shall be sufficient for the installation of standard No. S-5 at all street intersections. 15. Prior to the issuance of Minor Use Permit, relinquish abutters rights to Butte County, along the 18`h Street frontage of subject parcel. 16. This proposal is being processed under the existing County Code and at such time as the code is revised to the new state standards, the limits on the allowed number of children may be administratively adjusted to f e r(,14) children for existing large child care centers. • The A -R zoninclassification allows large family day care facilities with approval of a Minor Use Permit and'subject to the requirements of Section 24-265 of the Butte County Zoning Code. Prevention Bureau GUIDELINES FOR LARGE FAMILY DAY CARE HOMES REQUIREMENTS The California State Department of Social Services/Community Care Licensing (CCL) requires a Fire Clearance for large family day care homes. While processing a licensing application, the CCL staff orders the clearance from the local fire department and within 30 days a fire inspector is sent out to do a pre -inspection. Once the prospective licensee completes the necessary requirements a final inspection is done. There is no charge for Butte County Fire Department inspections. A Large Family Day Care Home is a providers' own home licensed to provide family day care for nine to fourteen children for periods of less than 24 hours per day. This shall include children who reside at the home. The State Fire Marshal classifies large. Family Day Care homes as Group R-3 occupancies. PURPOSE It is the intent of this guideline to provide minimum requirements for large family day care homes within single-family dwellings. The purpose of the inspection is to ensure that the home is free of fire and life safety hazards, and. that it has proper and sufficient fire prevention devices/equipment, evacuation plans and escape routes. PROCESS The fire inspection can take 20-60 minutes depending on the size and condition of the home and number of questions of the provider. If unsafe conditions are cited which need attention (e.g. repairs to electrical wiring, or installation of smoke alarms or fire extinguishers), approval will not be granted until these conditions are corrected. If, during a visit, the fire inspector notes possible building code violations, a County building inspector will be called in. ZONING AND BUILDING PERMITS A fire clearance does not constitute zoning or building clearance A conditional use permit'may be required. CONSTRUCTION REQUIREMENTS Large Family Day Care Homes shall be provided with two (2) exit doorways. Every required exit door shall be capable of opening so that the clear width is not less than 32 inches and the clear height is not less than 6 feet and 8 inches. A manually operated, horizontal sliding door may be used as one of the two required exits. One exit may pass through the kitchen. Every required exit door shall be operable from the inside without the use of a key or any . special knowledge or effort. A single turn of the knob must release the latch and lock bolts. In the event a "door open" alarm is necessary it must sound a tone, buzzer or siren distinctly different than the fire alarm and smoke detectors. It must be audible over the ambient noise level of the home. Where basements are used for day care, one of the two exits required shall open directly to the exterior of the building without entering the first floor. Rooms used for day care purposes shall not be located above the first story. Exception: Buildings equipped with an automatic sprinkler system throughout and which have at least one of the required exits providing access directly to the exterior of the building. Hallways must be a minimum of 36" in width. Ramps are required if serving non-ambulatory clients. Smoke detectors must be located in each sleeping room and the hallway leading to them. There must be at least one installed on each floor of the residence. They should be installed according to manufacturer's instructions and tested monthly. Large Family Day Care shall provide and maintain a device or devices suitable for manually sounding a fire alarm. Such devices shall be attached to the structure, be distinctive in tone, and be audible throughout the structure A portable fire extinguisher with a minimum rating of 2A: IOBC shall be provided. Provide one per floor per 3,000 sq. ft. Extinguishers should be conspicuously located where they are readily visible; preferably located along normal paths of travel. A maximum 75' of travel between extinguishers shall be maintained. Extinguishers shall be mounted so that the top is not higher than five (5) feet or lower than three (3) feet from the floor.
