"SKYWAY" 4842 Media Way Paradise, California 95969 COUNTY Project Description/Justification Statement DEC 2 2 2005 DEVELOPMENT SERVICES Introduction Sacramento Valley Limited Partnership, d/b/a Verizon Wireless, formerly AirTouch Cellular is a partnership of Bell Atlantic Wireless, GTE Mobilnet and AirTouch Cellular, organized to bid on radio frequency spectrum licenses auctioned by the Federal Communications Commission ("FCC"). In addition to mobile phone services, Verizon Wireless also offers wireless email, textmessaging, internet access, paging, photo messaging and data transmission. As the nation's largest wireless service provider, Verizon Wireless is continuing to expand its network in California and the Sacramento area. The existing wireless communication site includes an existing 56 -foot monopole with various Verizon antennas and 2 radio cabinets for Verizon Wireless. No changes are proposed to the tower and antennas. Proposal Verizon Wireless is seeking permission of to upgrade the equipment for an existing wireless communication facility located at 4842 Media Highway east of Chico in the vicinity of Paradise. (APN 040-520-045). The service objective is primarily to improve emergency service in the area east of Chico to Paradise by adding the emergency only generator and improve the capacity of the radio equipment at the site by adding additional cabinets. The proposed generator is a Generac SD030. Copies of a description of the unit are attached. Also attached is a Statement of Exhaust Emissions for Diesel Fueled Generator. The generator hours of operation are limited to testing once a week for about one hour. The generator will operate 24/7 if the power grid fails due to an emergency. The generators are fueled with diesel, which is stored on site in a duel walled tank that is alarmed to detect leaks. Noise levels are 65 db when operating as measured 7 meters or 23 feet from the center of the generator. Verizon Wireless will install equipment four (4) cabinets on a concrete pad to be located in the equipment compound. The additional cabinets are 66" tall by 56" wide by 34" deep. The cable will run from the pole to the equipment shelter, connecting the antennas in the pole with the equipment. November 9, 2005 Verizon Wireless "Skyway" Page 1 Once the construction work is complete and the telephone switching equipment is fine-tuned, visitation to the site by service personnel for routine maintenance typically occurs an.average of once per month. The site is entirely self -monitored and connects directly to a central office where sophisticated computers alert personnel to any equipment malfunction. This includes the testing and operation of the generator. Because the wireless facility will be unstaffed, there will be no regular hours of operation and no impact to existing local traffic patterns. No water or sanitation service is required for this facility. No advertising or signage is proposed, except signs required by the FCC and facility emergency contact information. Verizon Wireless will comply with safety requirements of the Uniform Building Code, as well as all other applicable regulations and permits, FCC rules governing construction requirements, technical standards, interference protection, power, height limitations, radio frequency standards and FAA rules governing construction and operation. If the Verizon Wireless equipment is unused or becomes obsolete, it will be removed within six months after its operation has ceased. Justification Statement The economic, business and residential growth along with increased general public usage of Verizon Wireless' services in Yuba County and surrounding area have significantly increased the volume of calls on the Verizon Wireless facilities. Verizon Wireless users have expressed major concerns about the poor coverage, dropped and blocked calls on the network throughout the area. Verizon Wireless radio engineers have conducted analysis of the existing network and services in the area and have determined that Verizon Wireless capacity is very marginal in the area. This general location is necessary for Verizon Wireless to provide seamless coverage in the area. The FCC mandates that. licensed service providers comply with stringent requirements such as providing high quality in -building coverage to the general public within a very aggressive timeframe. The FCC mandates 911 -locator functionality and the maintenance of sufficient capacity to accommodate developing wireless data transmission technology for internet access, instant messaging and other wireless services. Sufficient wireless coverage not only meets the general service expectations of wireless customers, but also enhances the safety of travelers by allowing immediate access to emergency assistance. Land Use Compatibility The proposed project is not inconsistent with the other existing uses. The facility is proposed in an area used as support for the farming function. The facility will not interfere with the farming function and is a reasonable use for the FR zone district. Visually, no alterations are being made at the site that the public will notice. The Verizon Wireless facility will result in no impact to the environment to the area in which it is located. The facility will not contribute significantly noise, smoke or odor. RFR/EMF Description The total output and for the Skyway site is 120 watts. No changes are proposed for the antennas and therefore this will remain the same. The 6 cabinets will generate 20 watts each for a total of 120 watts. These additions would be contained within the original footprint of the approved facility. Each of the above facilities is essentially identical interims of layout and composition of equipment on the site. The proposed additional equipment cabinets include batteries to backup the electronic communications equipment, bridging the time gap between grid -power outage and generator startup. Mr. Kortick of Verizon explained that the backup generators are started remotely as a test each Thursday morning, and run for about 15 minutes, and remotely monitored as to electrical output. Each facility is serviced once per month, at which time the generators would also receive any required service. Each of the use permit approvals that granted the original wireless facility contained the following standard special condition of approval #3: Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid, and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. Staff assessed the following potential impacts of the proposed changes: • Noise impacts from generator/hours of operation. • Air quality impacts from generator operations. • Hazards/toxics issues with storage of diesel fuel on the site. • Hazards/toxics issues with backup batteries on the site. DETERMINATIONS: The Development Services Department has made the following determinations: 1) The applications for use permit listed above, are deemed to be requests for "minor changes" to the approved use permit/minor use permit on each site. 2) The proposed changes are consistent with the environmental determination for the originally -approved use permit or minor use permit. 3) The proposed changes are consistent with the County Code 24-262 Wireless Communications Facilities purpose, intent, applicability, exemptions, permit requirements, application requirements, development criteria, and general standards for the zones in which each is respectively located. 4) As no fee structure exists as yet for minor changes to use permits, the original fees paid will be refunded to the applicant minus the cost of the actual staff time spent in processing these minor changes. EPIC -Verizon Wireless Use Permit(Minor Use Permit Minor Changes Approval Memo, March 10, 2006 0) Environmental Health Department (EHD) Fee: Program Manager Mike Huerta has determined that the Environmental Health Department will assess a $90 fee for the processing of'each of these applications, to cover the required staff time. ' The applicant will need to complete a separate Request for Service Environmental Health Department application for each project. Planning Department Fee: The Planning Department has expended approximately 3.5 hours to process each of these applications. At the standard weighted planning staff rate of $137 per hour (3.5 X $137 = $4.79.50), it is reasonable to conclude that a $480 fee will be deducted from the Use Permit fees already paid for processing each of the five applications. The balance of fees already paid will then be refunded to the applicant. REQUIREMENTS REGARDING THE APPROVED MINOR CHANGES: Planning Division: 1. All previous conditions for Use Permits or Minor Use Permit still apply. 2. The project site shall be developed in accordance with the approved project site plan and the conditions for each Use Permits/Minor Use Permit. All new equipment additions must be installed within the original footprint of the approved facility. Said site plan is on file in the Planning Division. 3. The minor changes are limited to addition of one 25-30 KW/3-liter diesel - powered emergency electrical generator, four equipment cabinets, and backup batteries. All new facilities shall be painted and/or screened from view :with .adequate landscaping appropriate. to the surrounding environment. All aesthetic treatments, including landscaping shall be maintained as approved for the life of the facility. 4. Minor change ' approval includes a requirement that the weekly generator tests take place only between the hours of 8:00 a.m. 5:00 p.m., Monday through Friday. 5. As noise impacts are anticipated to be infrequent and short-term, prior to issuance of building permit, the applicant is required to provide technical documentation certifying that the noise levels from generator operation will be less than 70 dB at the perimeter of the facility, per General Plan Noise Element Chart No. 4, conditionally -acceptable level for residential 1ow7density housing. (see attached GENERAC specification sheet of 5/22/03 and comment by Verizon Wireless Engineers of 11/10/05). The applicant is required to install the Series 2000 Sound Attenuated Enclosure for which noise attenuation data wasprovided. The reports prepared for Facilities shall conform to the reporting requirements set by the County and FCC OET 65 human exposure standards. The report shall also analyze the evidence provided in support of the proposed Facility location, height and radiated power, frequency, the number of channels, and all other related data and present alternatives for the location, height and radiated power, pursuant to the requirements of this section. If the proposed Facility exceeds FCC OET 65 human exposure standards, applicant shall also provide additional comprehensive technical and planning information regarding how the applicant shall protect all persons from such excessive exposure consistent with all Federal and State requirements, and any additional County requirements. ❑ Landscaping and painting plans for the completed project. 1/J ❑ Proiects in Agricultural Zones (A-5 throuL7h A-160) shall_ nrior to suhmittina an annlication for a proposed Facility, submit a site plan of the proposed Facility to the Butte County �✓/ Agricultural Commissioner for comment and send a notification letter to all aerial agricultural applicators registered in the County informing them of the proposed site location and tower height.
