Complete a Pre -Application Review with the Environmental Health Division for
on-site sewage disposal requirements for the proposed use. The Environmental
Health Division charges a $100.50 fee for.this review. (This fee will be applied
towards the $201.00 Environmental Health Division fee required at the time of
application submittal).

A RESOLUTION OF THE BUTTE COUNTY PLANNING COMMISSION APPROVING
MINOR USE PERMIT 06-08
WHEREAS, the Planning Commission has considered Minor Use Permit 06-08, for Kerri
Rubio, in accordance with Section 24-265 of the Butte County Code on Assessor's Parcel
Number 047-300-066; and
WHEREAS, the Planning Commission has determined the Minor Use Permit is
Statutorily Exempt in accordance with the California Environmental Quality Act; and
WHEREAS, said Minor Use Permit, was referred to various affected public and private
agencies, County departments, and referral agencies for review and comments; and
WHEREAS, a duly noticed public hearing was held on October 26, 2006; and
WHEREAS, the Planning Commission has considered, public comments and a report
from the Planning Division.
NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission
I. Find that this project is exempt from the provisions of the California Environmental
Quality Act under Section 15274(a), which states that the California Environmental
Quality Act does not apply to establishment or operation of a large family day care
home, which provides in-home care for up to fourteen children, as defined in
Section 1596.78 of the Health and Safety Code.
A. Because the project is exempt from the provisions of CEQA, the payment of fees
pursuant to Fish and Game Code Section 711.4 and 14 CCR 753.5 is not required.
B. The custodian of the record is the Department of Development Services. The
location of the record is 7 County Center Drive, Oroville CA 95965.
H. Approve Minor Use Permit 06-08 for Kerri Rubio for a large family day care
facility for up to fourteen (14) children in an existing residential home, on APN
047-300-066, based on the following findings and the conditions found in Exhibit
«A,,:
A. The location, size, design, and operating characteristics of the proposed
use will be compatible with, and will not adversely affect, or be materially
detrimental to adjacent uses, residents, buildings, structures, or natural
resources, with consideration given to:
1. Harmony in scale, bulk, coverage, and density:
The project is in harmony with surrounding parcel, regarding scale, bulk,
coverage, and density. The single family dwelling's character will not be
altered by the large family daycare, because it will not create the need for
any new structures or an alteration to any existing structures.
2. The availability of public facilities, services, and utilities:
The large day care facility will not create a need for new public facilities,
services, and utilities. However, the Butte County Fire Department
requires compliance with State Fire Marshall requirements for large day
care facilities.
3. The harmful effect, if any, upon desirable neighborhood character:
The proposed large day care facility will not change the aesthetic
character that is consistent with a rural residential neighborhood. The
large family day care facility has the potential for an insignificant
increase in noise levels due to children playing outside and an
insignificant increase in vehicle traffic and vehicle noise.
4. The generation of traffic and the capacity and physical character of
surrounding streets:
The proposed large family day care facility will not significantly increase
vehicle traffic in the area, nor will it create any significant impact to
vehicle circulation.
5. The suitability of the site for the type and intensity of use or
development which is proposed:
The site has adequate area for the facility, and off-site parking spaces for
the residents of the dwelling and for employees of the large family day
care facility. There is also adequate area for an off-street drop-off and
pick-up area.
6. Any other relevant impact of the proposed use:
The Planning Division has circulated the proposed large family day care
facility application to County agencies and has received no evidence that
the use will cause any other relevant impact.
B. The proposed location, size, design, and operating characteristics of the
proposed use and the conditions under which it would be operated or
maintained will not be detrimental to the public health, safety, or welfare,
or materially injurious to properties or improvements in the vicinity in that
the size of the parcel provides sufficient space for the children, and the
play area is located adjacent to the rear yards of adjoining parcels.
C. The proposed use does comply with each of the applicable provisions of
the Chapter 24, Section 265, of the Butte County Code that addresses Day
Care Facilities.
1. In addition to providing the required number of parking spaces for
the residential use, one (1) off-street parking space for each
employee of the facility and one (1) off-street parking
space/loading area shall be provided. The drive way area may be

used to meet this requirement. There are six vehicle parking
spaces, which are accommodated onsite.
2. Large family day care homes located on principal or minor arterial
roads as designated by the general plan circulation element shall
provide drop-off and pick-up areas which prevent vehicles from
backing onto such roads. There is an existing onsite drop-off and
pick-up area.
3. Properties proposed for large family day care homes shall have
frontage on and access off a paved road. Roads that are constructed
for the purpose of meeting this requirement shall meet the RS -4C
standard as contained in the Butte County improvement standards
contained in chapter 20 of the Butte County Code. The parcel has
frontage on and access off a paved road.
4. One (1) sign, not to exceed three (3) square feet, shall be allowed.
The proposal meets the identified requirement.
5. The large family daycare home shall be licensed by the California
Department of Social Services Community Care Licensing. The
project has been conditioned to comply with the applicable
licensing requirements.
6. Meet all state fire marshal regulations pertaining to large family
day care facilities. The fire requirements are complied with
through the state and applicable building codes.
7. The applicant must meet all other applicable county and state
ordinances, statutes and regulations.
III. Approves Minor Use Permit 06-08 and the special conditions as set forth in the
attachment (Exhibit A) to the resolution.

request by the applicant, or their respective designee. Prior to such approval, verification
shall be made by each Department or Division that the modification is consistent with the
application, fees paid and environmental determination as conditionally approved.
Changes deemed to be major or significant in nature shall require a formal application for
amendment. The approving authority may grant or deny an application for renewal of a
minor use permit.
5. The Minor Use Permit shall expire and the permit shall thereafter be of no further force

terminates or ceases operation for a continuous period of time in excess of one hundred
eighty (180) calendar days except for:

(c) Two (2) off-street parking space/loading area.
4. One sign, not to exceed 3 square feet, is allowed. This sign shall not be placed in the
front yard building setback.
5. The large family day care home shall be licensed by the California Department of Social
Services, Community Care Licensing.
6. Prior to issuance of the Minor Use Permit, applicant shall obtain any necessary building
permits required by code.
7. The project site shall be developed in accordance with the approved project site plan and the

• Children will be dropped off at the house on Keith Lane.
• The applicant/owner currently lives in the single family dwelling.

• The site is developed with a single family dwelling and attached garage.
• Sewage disposal is and will continue to be managed by a septic system, and water is and will
continue be supplied by a private well.
• Surrounding uses consist of single family residential uses, and the parcels range in size from
a half acre to one acre.
• The project site is located in Compatibility Zone D of the Chico Airport. Family care centers
are permitted in this zone per note 11, page 2-15 of the Compatibility Plan.
ANALYSIS:
Consistency with State Law
• The project would allow the establishment of a large family day care facility, which is
governed the California Health and Safety Code and Butte County Zoning Code section 24-
265.
• Per Zoning Code Section 24-265(b)(2), large family day care homes may have up to twelve
(12) children. However, the current state law preempts local ordinance in this instance.
• Health and Safety Code section 1597.46(a) specifies that large family day care homes cannot
be prohibited on "lots zoned for single-family dwellings." "Family day care home" is defined
in Health and Safety Code section 1596.78. It means providing day care in the provider's
own home. A large family day care home includes seven to fourteen (14) children.
• With regard to the allowed number of children, this proposal is being processed under the
existing state law allowing fourteen (14) children.
Consistency with Zoning
• The SR -1 Zone allows large family day care facilities through a minor use permit, which
shall meet the requirements of Butte County Zoning Code Section 24-265.
• Section 24-265(e) "Standards and Conditions" establishes seven requirements that must be
met for the proposal to be approved through a minor use permit. Where applicable, the

requirements are conditions of approval. All seven requirements are identified and discussed
(the discussion is italicized) below.
• The facility is a single-family residence that is the principal residence of the provider and
the use is clearly incidental and secondary to the use of the property for residential
purposes. The residence is the primary residence of the owner/operator and the daycare
is incidental and secondary to the residential use.
• Properties proposed for large family day care shall be located at least five hundred (500)
feet driving distance from any other large family day care property and the granting of
the permit shall not result in any residence being bounded on more than one (1) side by a
large family day care. The proposed property for the daycare is located, at minimum, five
hundred (500) feet from any other daycare, and the establishment of the proposal will not
result in any residence being bounded on more than one (1) side by a large family
daycare.
• Large family day care homes shall meet the following traffic Code requirements:
• In addition to providing the required number of parking spaces for the residential use,
one (1) off-street parking space for each employee of the facility and one (1) off-
street parking space/loading area shall be provided. The drive way area may be used
to meet this requirement. There are six vehicle parking spaces, which are
accommodated onsite.
• Large family day care homes located on principal or minor arterial roads as
designated by the general plan circulation element shall provide drop-off and pick-up
areas which prevent vehicles from backing onto such roads. There is an existing
onsite drop-off and pick-up area.
• Properties proposed for large family day care homes shall have frontage on and
access off a paved road. Roads that are constructed for the purpose of meeting this
requirement shall meet the RS -4C standard as contained in the Butte County
improvement standards contained in chapter 20 of the Butte County Code. The parcel
has frontage on and access off a paved road.
• One (1) sign, not to exceed three (3) square feet, shall be allowed. The proposal meets
the identified requirement.
• The large family daycare home shall be licensed by the California Department of
Social Services Community Care Licensing. The project has been conditioned to
comply with the applicable licensing requirements.
• Meet all state fire marshal regulations pertaining to large family day care facilities.
The fire requirements are complied with through the state and applicable building
codes.
• The applicant must meet all other applicable county and state ordinances, statutes and
regulations.

MINOR USE PERMIT 06-08
WHEREAS, the Planning Commission has considered Minor Use Permit 06-08, for Kern
Rubio, in accordance with Section 24-265 of the Butte County Code on Assessor's Parcel
Number 047-300-066; and
WHEREAS, the Planning Commission has determined the Minor Use Permit is
Statutorily Exempt in accordance with the California Environmental Quality Act; and
WHEREAS, said Minor Use Permit was referred to various affected public and private
agencies, County departments, and referral agencies for review and comments; and
WHEREAS, a duly noticed public hearing was held on October 26, 2006; and
WHEREAS, the Planning Commission has considered public comments and a report
from the Planning Division.
NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission
I. Find that this project is exempt from the provisions of the California Environmental
Quality Act under Section 15274(a), which states that the California Environmental
Quality Act does not apply to establishment or operation of a large family day care
home, which provides in-home care for up to fourteen children, as defined in
Section 1596.78 of the Health and Safety Code.
A. Because the project is exempt from the provisions of CEQA, the payment of fees
pursuant to Fish and Game Code Section 711.4 and 14 CCR 753.5 is not required.
B. The custodian of the record is the Department of Development Services. The
location of the record is 7 County Center Drive, Oroville CA 95965.
II. Approve Minor Use Permit 06-08 for Kern Rubio for a large family day care
facility for up to fourteen (14) children in an existing residential home, on APN
047-300-066, based on the following findings and the conditions found in Exhibit
A. The location, size, design, and operating characteristics of the proposed
use will be compatible with, and will not adversely affect, or be materially
detrimental to adjacent uses, residents, buildings, structures, or natural
resources, with consideration given to:

1. Harmony in scale, bulk, coverage, and density:
The project is in harmony with surrounding parcel, regarding scale, bulk,
coverage, and density. The single family dwelling's character will not be
altered by the large family daycare, because it will not create the need for
any new structures or an alteration to any existing structures.
2. The availability of public facilities, services, and utilities:
The large day care facility will not create a need for new public facilities,
services, and utilities. However, the Butte County Fire Department
requires compliance with State Fire Marshall requirements for large day
care facilities.
3. The harmful effect, if any, upon desirable neighborhood character:
The proposed large day care facility will not change the aesthetic
character that is consistent with a rural residential neighborhood. The
large family day care facility has the potential for an insignificant
increase in noise levels due to children playing outside and an
insignificant increase in vehicle traffic and vehicle noise.
4. The generation of traffic and the capacity and physical character of
surrounding streets:
The proposed large family day care facility will not significantly increase
vehicle traffic in the area, nor will it create any significant impact to
vehicle circulation.
5. The suitability of the site for the type and intensity of use or
development which is proposed:
The site has adequate area for the facility, and off-site parking spaces for
the residents of the dwelling and for employees of the large family day
care facility. There is also adequate area for an off-street drop-off and
pick-up area.
6. Any other relevant impact of the proposed use:
The Planning Division has circulated the proposed large family day care
facility application to County agencies and has received no evidence that
the use will cause any other relevant impact.

C. The proposed use does comply with each of the applicable provisions of
the Chapter 24, Section 265, of the Butte County Code that addresses Day
Care Facilities.

Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special
conditions set forth below: Kerri Rubio is hereby granted a Minor Use Permit in accordance with
application filed: Minor Use Permit for a large family day care facility allowing up to fourteen
(14) children in an existing residential home.
1. Failure to comply with the conditions specified herein as the basis for approval of
application and issuance of Permit constitutes cause for the revocation of said permit in
accordance with the procedures set forth in, the Butte County Zoning Ordinance,
including Butte County Code Sec. 24-41.
2. Unless otherwise provided for in a special condition to this Minor Use Permit, all
conditions must be completed prior to or concurrently with the establishment of the
granted use. The use granted by this permit must be -established within 12 months of the
delivery of the countersigned permit to the Permittee.
3. If any use for which a Minor Use Permit has been granted is not established within one
year of the date of receipt of the countersigned permit by the Permittee, the permit shall
become null and void and reapplication and a new permit shall be required to establish
the use.
4. Minor changes may be approved administratively by the Directors of Development
Services, Environmental Health, or Public Works upon receipt of a substantiated written
request by the applicant, or their respective designee. Prior to such approval, verification
shall be made by each Department or Division that the modification is consistent with the
application, fees paid and environmental determination as conditionally approved.
Changes deemed to be major or significant in nature shall require a formal application for
amendment. The approving authority may grant or deny an application for renewal of a
minor use permit.
The Minor Use Permit shall expire and the permit shall thereafter be of no further force
or effect if the use, business, or service for which the minor use permit was issued

terminates or ceases operation for a continuous period of time in excess of one hundred
eighty (180) calendar days except for:
(1) Destruction or damage by acts of God; or
(2) Destruction or damage by malicious acts; or
(3) Remodeling or rehabilitation requiring prolonged closure with prior approval
of the planning manager.
6. The terms and conditions of this permit shall run with the land and shall be binding upon
and be to the benefit of the heirs, legal representatives, successors, and assigns of the
Permittee.
Conditions of Approval:
Planning Division
1. The facility is a single family residence that shall be the principal residence of the
provider and the large family day care facility shall be clearly incidental and secondary to
the use of the property for residential purposes.
2. The large family day care facility shall use existing kitchen facilities and all food
preparation/cooking shall occur in the primary dwelling unit.
3. Minimum off-street parking shall be provided pursuant to the following standards:
(a) Two (2) off-street parking spaces for the residents of the dwelling.
(b) One (1) off-street parking space for each employee/volunteer. The two (2) required
residential spaces may not be used for employees/volunteers.
(c) Two (2) off-street parking space/loading area.
4. One sign, not to exceed 3 square feet, is allowed. This sign shall not be placed in the
front yard building setback.
5. The large family day care home shall be licensed by the California Department of Social
Services, Community Care Licensing.
6. Prior to issuance of the Minor Use Permit, applicant shall obtain any necessary building
permits required by code.
The project site shall be developed in accordance with the approved project site plan and the
conditions contained herein. Said permit is on file in the Planning Division, 7 County
Center Drive, Oroville, California. The site plan is identified as "Attachment D" and date-
stamped June 22, 2006, and is incorporated herein by this reference.
Applicant must also comply with all other applicable State and local statutes, ordinances,
and regulations.

9. All outstanding application processing fees shall be paid prior to issuance of the Minor
Use Permit.
10. The dwelling's garage shall not be used for day care activities of any kind.

12. Prior to the issuance of the Minor Use Permit, obtain an encroachment permit for all new
or existing driveway approaches and construct them to County, standards, as specified in
County Improvement Standards.
Fire Dgpartment/CDF
13. Prior to the start of the large family day care facility use provide plans and specifications
to the Butte County Fire Chief to determine compliance with fire and life safety standards
of Titles 19 and 24, California Code of Regulations.
County Counsel
14. If this entire matter or any finding, action or condition of this matter is appealed to the
Board of Supervisors, the applicant or any other developer/operator other than the
applicant agrees to indemnify the County of Butte from liability or loss related to the
approval of this project and agrees to sign an indemnification agreement in a form
approved by County Counsel before the Board's appeal hearing. If the application is not
appealed, this condition is deemed satisfied.
NOTE: Issuance of this Minor Use Permit does not waive requirement of obtaining
Building and Health Department permits before starting construction, nor does it waive any other
requirements.

Butte County Archaeological Resources Project Review By
The Northeast Information Center (NEIC)
The California Environmental Quality Act (CEQA) is the California State statute that requires the Butte County Department of
Development Services to perform an environmental review on all discretionary land use projects, to identify the significant
environmental impacts of the project and to avoid or mitigate those impacts, if feasible.
Every development project which requires a discretionary governmental approval will require at least some environmental review
pursuant to CEQA, unless an exemption applies. The environmental review required imposes both procedural and substantive
requirements. At a minimum, an initial review of the project and its environmental effects must be conducted. Depending upon the
potential effects, a further and more substantial review may be conducted in the form of an environmental impact report (EIR). A
project may not be approved if feasible alternatives or mitigation measures cannot substantially lessen the significant environmental
effects of the project. At the state level, CEQA requires that public agencies consider the effects of their actions on
historical resources eligible for listing on the California Register of Historical Resources. "Historical resource" refers to
buildings, structures, sites (prehistoric and historic), objects, districts, and all manner of properties containing material
remains of past human life or activity.
The Department of Development Services utilizes the Northeast Information Center (NEIC) of the California Historical
Resources Information System (CHRIS) to identify projects that may have archaeological significance. The CHRIS is a
statewide system for managing information on the full range of historical resources identified in California. This system is
under the authority and direction of the Office of Historic Preservation (OHP), the State Historic Preservation Officer(SHPO), and the State Historical Resources Commission (SHRC). The Northeast Center of the CHRIS system, located at
California State University, Chico, manages the historical resource records for 11 counties, including Butte County.
The Northeast Information Center will furnish a Record Search to Development Services indicating the
archaeological/historical significance and sensitivity of the applicant's project area and additionally providing a
recommendation as to whether further archaeological survey is warranted. If further archaeological survey is required,
the application would be considered incomplete until the appropriate archaeological survey is completed and reviewed.
The Department of Development Services will forward applicant's payment (by" check) of $60.00 and relevant project
application information required for the Records Search to NEIC. NEIC will provide the results of the Records Search to
Development Services. Development Services will notify the applicant if further archaeological survey is warranted. The
$60.00 fee does not cover the cost of further archaeological survey work.
If further archaeological survey work is required, Development Services will work with the applicant to see that it is
accomplished, according to set standards, by a qualified archaeologist. The applicant shall bear all costs associated with
further archaeological survey work required to continue processing of the planning project application.
THIS FORM MUST BE ACCOMPANIED BY A COPY OF A 7.5' TOPO MAP, WITH THE PROJECT AREA OUTLINED. THIS IS USED
DURING THE REVIEW TO RESEARCH CULTURAL SITES.
The undersigned applicant for the project as identified below has read and understood the Butte County Archaeological
Resources Project Review process and agrees to fund the required Record Search to be provided by NEIC.
Attached is a check for $60.00 made payable to the Northeast Information Center for NEIC to perform the Records
Search. Failure of payment to NEIC for this Records Search would result in the planning project application to be
considered incomplete until payment of the $60.00 Records Search fee along with any related fees associated with non-
payment (returned check charges, etc.) paid in full to NEIC.

H. FIRE PROTECTION
❑ 1. Construction, installation or development of buildings and/or roads; driveways, gates and
bridges on parcels/lots shall comply with the latest California Fire Safe Regulations—
Public Resources Code 4290, 4291 and current Butte County Improvement Standards,
whichever is stricter.

A. STREETS
1. Prior to the issuance of building permits, obtain an encroachment permit and improve all new and
existing driveway approaches to publicly maintained roads as specified in the County
Improvement Standards and the terms of the encroachment permit.

way from the centerline of along the entire property frontage. The right-of-

along the frontage of parcels except at approved access

B. DRAINAGE
❑ 1. Prior to the issuance of building permits, a plan for a permanent solution for drainage shall be
submitted to and approved by the Department of Public Works. The drainage plans shall detail
existing drainage conditions and shall specify how drainage waters shall be detained or retained
on- site and/ or conveyed to the nearest natural or publicly maintained drainage channel or facility
and shall provide that there shall be no increase in the peak flow runoff to said channel or facility.
❑ 2. Prior to the issuance of building permits, establish 100 year flood plain elevations and the lowest
floor elevations for any structures, in accordance with Butte County Code §26-25. Show on the
additional map sheet the elevations (by contours) and the location of an accepted NGVD29
(National Geodetic Vertical Datum of 1929) benchmark and a temporary benchmark on-site.
C. LEGAL LOT STATUS

Ouestion Presented:
You asked me to determine whether state law preempts our local
ordinance on large family day care homes.
Response:
State law on large family day care homes is intended to preempt
local ordinance. State law sets the rules, but it does allow us
options in processing large family day care home applications. As
long as we conform to the options in state law, we may maintain a
local ordinance.
Analysis:
State law on family day care homes is found in the Health and
Safety Code (all section references. ate to this code unless
otherwise indicated). "Family day care home" is defined in
§1596.78. Itmeans providing day care in the provider's own home.
A small family day care home includes up to eight children, while
a large family day care home includes seven to fourteen children.

The --rest of :the rules are found in. -Chapter 3:6, Family -Day Care, _
Homes. §1597.40 expresses the Legislature's intent. It specifies
that family day care homes are of statewide concern and state law
on the matter is intended to occupy the field to the exclusion of
municipal zoning, building, and fire codes. Any restrictions on
family day care homes can only be imposed to the extent allowed by
state law.

and 91597.45. §1597.45(a) specifies that a small family day care
home is considered a residential use to be allowed wherever a
single-family residence is present. Although we generally list it
as a separate permitted use in all residential zones, state law
does not focus on zoning, but on whether there is a single-family
residence. Thus, even where a single-family residence has been
allowed only by use permit, such as in the M-1 zone at Butte County
Code (BCC) §24-175(c)(1) for example, and there is no accompanying
statement that a small family day care home is similarly permitted,
since state law makes a small family day care home a residential
use in a single-family residence, it would be allowed in the
residence.
§1597.44 indicates under which conditions a small family day care
home can have more than six and up to eight children. Thus, a
small family day care home may have up to six children as a norm,
but may increase up to eight if additional conditions are met.
These conditions are not enforced by the County, but by the
licensing authority. Thus, state law has allowed small family day
care homes to care for up to eight children., and we should amend
the BCC to reflect this change in state law.
Rules relating to large family day care homes are found at §1597.46
and §1597.465. §1597.46(a) specifies that large family day care
homes cannot be prohibited on "lots zoned for single-family
dwellings." In contrast to small family day care homes, it is not
the presence of a residence that controls, but zoning. Any time a
zone lists a single-family residence as a permitted use, we must
allow large family day care homes. Although they must be allowed,
there are three options for allowing them. We could allow them as
a permitted use, by nondiscretionary permit, or by use permit. The
BCC indicates that we have chosen the latter option since zones
that list a single-family residence as a permitted use also list a
large family day care home as a use subject to a minor use permit.
In contrast to small family day care homes, large family day care
homes do not need to be allowed in zones that only allow a single-
family residence by use permit.
State law specifies that the use permit "shall be granted" if the
use complies with "reasonable standards, restrictions, and
requirements concerning spacing and concentration., traffic control,
parking, and noise control" set forth in a local ordinance. The
use must also meet State Fire Marshall regulations. These above
requirements are reflected in -BCC §24-265 (e) . The minor .use permit
process set forth at BCC §24-41 indicates the conditions and
findings to be generally considered. However, in the case of large
family day care homes, the standards and conditions set forth in
BCC §24-265 should be the basis of any analysis and decision.
§1597.46(a)(3) dealing with use permits for large family day care
homes contains one sentence that is difficult to harmonize with the
use permit process. The sentence reads: "No hearing on the

application for a permit issued pursuant to this paragraph shall be
held before a decision is made unless a hearing is requested by the
applicant 'or other affected person." The assumption of this
paragraph is that the decision will be made by a zoning
administrator who may be able to act without holding a hearing.
The duties of a zoning administrator are set forth at Government
Code §.65901. However, Butte County does not have, and is not
required to have, a zoning administrator. Government Code §65902
specifies that if there is no zoning administrator, the Planning
Commission shall. exercise the functions and duties of the zoning
administrator. The Planning Commission cannot act without holding
a meeting, and it cannot decide anything before holding.a meeting.
Acting at a public meeting is essentially holding a hearing.
Further, state law does require limited notice before making the
decision. It requires that at least ten days before making the
decision, notice of the proposed use shall be given to all property
owners within 1.00 feet of the exterior boundaries of the home. So
we are required to give notice by state law, and the only way for
the Planning Commission to make a decision is in a public meeting.
The best way to harmonize these requirements is to -put use permits
for large family day care homes on the Planning Commission's
consent agenda with a note that the matter should only be pulled
off by request of the applicant, other affected person, or if one
of the requirements of BCC §24-265 is not met. The latter would
probably lead to a staff recommendation of denial which should
prompt the applicant.to pull the matter off the consent agenda.
§1597.465 indicates under which conditions a large family day care
home can have more than twelve and up to fourteen children. Thus,
a* large family day care home may have up to twelve children as a
norm, but may increase up to fourteen if additional conditions are
met. These conditions are not enforced by the County, but by the
licensing authority. Thus, state law has allowed large family day
care homes to care for up to fourteen children, and we should amend
the BCC to reflect this change in state law.
As an aside, both small and large family day care homes are exempt
from CEQA. CEQA Guideline §15274 makes clear that a small family
day care home is ministerial and not subject to CEQA, while a large
family day care home is statutorily exempt from CEQA under
§1597.46(b).
BCC §24-265 contains Butte County's ordinance on day care
-facilities. ; This -ordinance should, be modified _to conform to state
law. First, the word "family" should be placed before day care.
Next, the word "facilities" should be replaced with the word
"homes," and the word "home" should be added after "day care." Our
ordinance is not about day care facilities generally, but only
related to family day care homes.
In §24-265(b)(1), "six (6)" should be replaced by "eight (8)."
Also, the correct section reference is 1596.78. In (b)(2), "twelve

' (12)" should be replaced by "fourteen (14)'," and the correct
section reference is.1596.78. (c) should be reworded to..indicate
the use is synonymous with a single-family residence unrelated to
zoning. In (e), you should add "be granted if they" between
"shall".and "meet." In (e)(2), replace "property'" .after day care
with ""home. " (e) (8 ) should either be deleted or set forth in a
separate section tied to a separately listed use.. For us to allow
day care facilities other than. in homes or when not meeting the
specified re.quirements is not addressed.here or any.of the zones,
so it should.be addressed separately if we wish to allow it.
§247265 should include the notice standard set forth in state law.
It should also specify that large family day care home applications.
will be put on the Planning Commission's consent agenda unless they
are.pulled off by the applicant or other affected party.
The language used for small family day care homes asa permitted
use, such as in BCC 24-95(a) (2) , will also need to be. modified. In
this case, it would not be as simple as changing "six (6)." to
"eight (8.)" because. other uses are also listed, and they may .not
have increas:ed'. We will need to discuss how to modify 'this
language.

Hey Chris, Iam open M -F 7:30am-5:30pm, I close for 10 Holidays a year and weekends. I am required to have 2 people
on site when my numbers reach over 8, including myself. I go a step further and employ two additional people besides
myself from 8am-Ipm M&W&F(my preschool program hours) and 8am-5pm T&TH, so I can be free to do paperwork
and grocery shopping or take the occational "provider R&R".

Chris here is a break down of what I use each room for in my home fo`r daycare. You already know that the green
crossed off areas are not for use.
I will describe each room from the front yard view looking straight on with the front door in the middle as it is in my
drawing. The large "bedroom" to the left off the kitchen is our "classroom" this room is the main area of our structured
play and preschool program, it has a walk in closet that we use for all the art and play supplies, and it is used for nap anc.
quiet time after we have lunch. This room also has a full bath & is the only rest room the daycare uses.
Kitchen area is used to prepare & serve meals. We do breakfast from 7:30am - 8:30am, a morning snack at 10:00am ,
lunch at 12:OOpm and more snacks at 2:OOpm & 4:OOpm. We like to enjoy some of our snacks and lunches outdoors,
picnic style, weather permitting. This is done on our back covered patio right out the back kitchen door.
Livingroom area is not closed to the kids, but not encouraged for use over the ages of 2 years, this room is used for the
infants "floor time" and "cruising" space for the toddlers.
The two smaller bedrooms to the right of the front door (my sons rooms) are only used for infant napping which is done

Chris here is a break down of what I use each room for in my home for daycare. You already know that the green
crossed off areas are not for use.
I will describe each room from the front yard view looking straight on with the front door in the middle as it is in my
drawing. The large "bedroom" to the left off the kitchen is our "classroom" this room is the main area of our structured
play and preschool program, it has a walk in closet that we use for all the art and play supplies, and it is used for nap and
quiet time after we have lunch. This room also has a full bath & is the only rest room the daycare uses.
Kitchen area is used to prepare & serve meals. We do breakfast from 7:30am - 8:30am, a morning snack at 10:00am ,
lunch at 12:00pm and more snacks at 2:00pm & 4:00pm. We like to enjoy some of our snacks and lunches outdoors,
picnic style, weather permitting. This is done on our back covered patio right out the back kitchen door.
Livingroom area is not closed to the kids, but not encouraged for use over the ages of 2 years, this room is used for the
infants "floor time" and "cruising" space for the toddlers.
The two smaller bedrooms to the right of the front door (my sons rooms) are only used for infant napping which is done

(a) CEQA does not apply to actions undertaken by a public agency relating to any
thermal power plant site or facility, including the expenditure, obligation, or
encumbrance of funds by a public agency for planning, engineering, or design
purposes, or for the conditional sale or purchase of equipment, fuel, water
(except groundwater), steam, or power for such a thermal power plant, if the
thermal power plant site and related facility will be the subject of an EIR or
negative declaration or other document or documents prepared pursuant to a
regulatory program certified pursuant to Public Resources Code Section
21080.5, which will be prepared by:
(1) The State Energy Resources Conservation and Development
Commission,
(2) The Public Utilities Commission, or
(3) The city or county in which the power plant and related facility would be
located.
(b) The EIR, negative declaration, or other document prepared for the thermal
power plant site or facility, shall include the environmental impact, if any, of
the early activities described in this section.
(c) This section acts to delay the timing of CEQA compliance from the early
activities of a utility to the time when a regulatory agency is requested to
approve the thermal power plant and shifts the responsibility for preparing the
document to the regulatory agency.
5272. Olympic Games.
CEQA does not apply to activities or approvals necessary to the bidding for,
hosting or staging of, and funding or carrying out of, Olympic Games under the
authority of the International Olympic Committee, except for the construction of
facilities necessary for such Olympic Games. If the facilities are required by the
International Olympic Committee as a condition of being awarded the Olympic
Games, the lead agency need not discuss the "no project" alternative in an EIR with
respect to those facilities.
15273. Rates, Tolls, Fares, and Charges.
(a) CEQA does not apply to the establishment, modification, structuring,
restructuring, or approval of rates, tolls, fares, and other charges by public
agencies which the public agency finds are for the purpose of:
(1) Meeting operating expenses, including employee wage rates and fringe
benefits,
(2) Purchasing or leasing supplies, equipment, or materials,
(3) Meeting financial reserve needs and requirements,

existing service areas, or
(5) Obtaining funds necessary to maintain such intra -city transfers as are
authorized by city charter.
(b) Rate increases to fund capital projects for the expansion of a system remain
subject to CEQA. The agency granting the rate increase shall act either as the
lead agency if no other agency has prepared environmental documents for the
capital project or as a responsible agency if another agency has already
complied with CEQA as the lead agency.
(c) The public agency shall incorporate written findings in the record of any
proceeding in which an exemption under this section is claimed setting forth
with specificity the basis for the claim of exemption.
15274. FamilyDay Care Homes. /
(a) CEQA does not apply to establishment or operation of a large family day care
home, which provides in-home care for up to fourteen children, as defined
Section 1596.78 of the Health and Safety Code.
(b) Under the Health and Safety Code; local agencies cannot require use permits
for the establishment or operation of a small family day care home, which
provides in-home care for up to eight children, and the establishment or
operation of a small family day care home is a ministerial action which is not
subject to CEQA.
15275. Specified Mass Transit Projects.
CEQA does not apply to the following mass transit projects:
(a) The institution or increase of passenger or commuter service on rail lines or
high -occupancy vehicle lanes already in use, including the modernization of
existing stations and parking facilities;
(b) Facility extensions not to exceed four miles in length which are required for
transfer of passengers from or to exclusive public mass transit guideway or
busway public transit services.
15276. Transportation Improvement and Congestion
Management Programs. 10
(a) CEQA does not apply to the development or adoption of a regio
transportation improvement program or the state transportation improvement
program. Individual projects developed pursuant to these programs shall
remain subject'to CEQA.
(b) CEQA does not apply to preparation and adoption of a congestion
management program by a county congestion management agency pursuant to
Government Code Section 65089, et seq.
15277. Projects Located Outside California.
CEQA does . not apply to any project or portion thereof located outside of
California which will be subject to environmental impact review pursuant to the
National Environmental Policy Act of 1969 or pursuant to a law of that state
requiring preparation of a document containing essentially the same points of
analysis as in an environmental impact statement prepared under the National
Environmental Policy Act of 1969. Any emissions or discharges that would have a

Article V. Specific Use Requirements
24-265 Day care facilities.
(a) Purpose and intent. Quality, affordable, conveniently located, licensed child care is essential
to the well being of the citizens of Butte County The purpose of this code section is to facilitate
the establishment of licensed family day care facilities in a manner which simplifies the review
process while ensuring conformance. with applicable standards to protect residential
neighborhoods.
(b) Definitions:
(1) Small family day care. A residential day care facility for six (6) or fewer children, as defined in
chapter 3.4, article I, section 1596.79 of the California Health and Safety Code, Child Care Act.
(2) Large family day care. A residential day care facility for seven (7) to twelve (12) children, as
defined in chapter 3.4, article I, section 1596.79 of the California Health and Safety Code, Child
Care Act.
(c) Allowed uses. Small family day care facilities shall be permitted in all zones that allow a
single-family residential use subject to the permitting requirements of each zone.
(d) Minor use permit required. Large family day care facilities shall be an allowed use in all zones
that allow a single-family residential use, subject to obtaining a minor use permit pursuant to
section 24-41 of the Butte County Code.
(e) Standards and conditions. Large family day care facilities allowed by minor use permit shall
meet all of the following minimum standards and conditions:
(1) The facility is a single-family residence that is the principal residence of the provider and the
use is clearly incidental and secondary to the use of the property for residential purposes.
(2) Properties proposed for large family day care shall be located at least five hundred (500) feet
driving distance from any other large family day care property and the granting of the permit shall
not result in any residence being bounded on more than one (1) side by a large family day care.
(3) Large family day care homes shall meet the following traffic control measures:
a. In addition to providing the required number of parking spaces for the residential use, one (1)
off-street parking space for each employee of the facility and one (1) off-street parking
space/loading area shall be provided. The driveway area may be used to meet this requirement.
b. Large family day care homes located on principal or minor arterial roads as designated by the
general plan circulation element shall provide drop-off and pick-up areas which prevent vehicles
from backing onto such roads.
c. Properties proposed for large family day care homes shall have frontage on and access off a
paved road. Roads that are constructed for the purpose of meeting -this requirement -shall -meet
the RS -4C standard as contained in the Butte County improvement standards contained in
chapter 20 of the Butte County Code.
(4) One (1) sign, not to exceed three (3) square feet, shall be allowed.
(5) The large family day care home shall be licensed by the California Department of Social
Services, Community Care Licensing.
(6) Meet all state fire marshal regulations pertaining to large family day care facilities.
(7) The applicant must meet all other applicable county and state ordinances, statutes, and
regulations.
(8) Facilities not meeting the above standards shall require a conditional use permit to operate.
