El ❑ Provide specifications for noise attenuation/acoustical shielding structures/enclosures for the diesel engine. c. BUTTE COUNTY DEC 10 2008 (DEVELOPMENT SERVICES 10.0 ❑ Written evidence demonstrating that the selected facility structure or tower design is as visually unobtrusive as possible, given technical and engineering considerations. This evidence shall indicate which type of facility is required to provide reasonably effective service and also the best technology and/or construction available to maximally achieve visual unobtrusiveness. The use of best available technology and/or construction to maximally achieve visual unobtrusiveness is mandatory. 11. ❑ ❑ Annlicants who overate common carrier facilities (snecifically. but not limited to cellular, PCS, SMR and paging service licensees of the FCC) shall provide written evidence that the applicant has provided notice to all FCC licensed wireless communication service carriers operating within the County of Butte of the plans to develop the site. 12. ❑ ❑ Evidence of a valid, current operating license or construction permit from the FCC or, if the applicant is not a wireless communications service provider, a user operating agreement for each and every such provider to which the applicant intends to rent space on the proposed facility. 13. ❑ ❑ A report, signed by a qualified radio frequency engineer licensed by the FCC, prepared pursuant to FCC OET 65, stating whether the maximum radio frequency radiation/electromagnetic radiation (RF/EMF) to be emitted by the proposed facility, taking into account all other facilities, both existing and known future facilities, at the proposed site and adjacent properties, conforms to safety standards adopted by the FCC, if applicable. The reports prepared for facilities shall conform to the reporting requirements set by the County and FCC OET 65 human exposure standards. The report shall also analyze the evidence provided in support of the proposed facility location, height and radiated power, frequency, the number of channels, and all other related data and present alternatives for the location, height and radiated power, pursuant to the requirements of this section. If the proposed facility exceeds FCC OET 65 human exposure standards, applicant shall also provide additional comprehensive technical and planning information regarding how the applicant shall protect all persons from such excessive exposure consistent with all Federal and State requirements, and any additional County requirements. 14. 1)0 ❑ Landscaping and painting plans for the completed project. 15. ❑ ❑ Projects in Agricultural Zones (A-5 through A-160) shall, prior to submitting an application for a proposed facility, submit a site plan of the proposed facility to the Butte County Agricultural Commissioner for comment and send a notification letter to all aerial agricultural applicators registered in the County informing them of the proposed site location and tower height. Comprehensive Airport Land Use Plan or Airport Area of Influence, as adopted or designated from time to time by the Butte County Airport Land Use Commission, shall be submitted to the Department of Development Services, Planning Division, and a copy C� submitted to the Butte County Airport Land Use Commission for review regarding Zp4 consistency with adopted Comprehensive Airport Land Use Plans and for recommendations addressing potential impacts to air navigation within the Airport Area of Influence. The County may in its sole discretion retain an independent consultant to review either individual elements of or the entire application and advise the County at the applicant's sole expense. After approval and prior to issuance of the building permit, the applicant shall post a performance security to cover the cost of a one-time test by a radio frequency consultant selected by the county, sufficient to determine whether the facility's MEW emissions comply with FCC standards. In addition, the applicant shall post a separate performance security to cover the cost of removal of the facility in the event that such facility is abandoned, or the permit has been terminated for violation of its conditions by the county after hearing, or has expired, or after notice has been given to the owner/operator by the county, no application for renewal has been filed. Additional information may be required in order to clarify, correct or supplement the above submittal information or to complete any required environmental review documents, as deemed necessary by the Department of Development Services, Public Works, Environmental Health Division, Butte County Fire Department, or Agriculture Commissioner. In layman terms, each and every cellular facility needs power and telephone to operate, as your signal from your cell phone reaches the antennas, the signal is sent electronically to our equipment which utilizes a "telephone" line similar to an office building. However, remote locations such as a cellular facility have reliability issues with more frequency, and the cost can be very high depending on usage. To mitigate the constant cost increases, and to increase our reliability for our customers, we ' are proposing to remove the existing "hard line" telephone lines and replace with a panel antenna which will transfer the signal wirelessly, thereby connecting with other cellular sites in the area. Statement of Operations The existing AT&T communication facility only requires electrical services which are readily available to the building/site. No nuisances will be generated by the proposed facility; nor will the facility injure the public health, safety, morals or general welfare of the community. The additions/maintenance of this facility will actually enhance wireless communications for residents or motorists traveling by providing seamless service to numerous customers. No additional parking spaces are needed at the project site for maintenance activities. The site is entirely self monitored and connects directly to a central office where sophisticated computers alert personnel to any equipment malfunction or breach of security. Because AT&T's facility will be un -staffed, there will be no regular hours of operation and no impact to existing traffic patterns. An existing dirt road will provide ingress and egress allowing access to the technician who arrives infrequently to service the site. Every development project which requires a discretionary governmental approval will require at least some environmental review pursuant to CEQA, unless an exemption applies. The environmental review required imposes both procedural and substantive requirements. At a minimum, an initial review of the project and its environmental effects must be conducted. Depending upon the potential effects, a furlier and more substantial review may be conducted in the form of an environmental impact report (EIR). A project may not be approved if feasible alternatives or mitigation measures cannot substantially lessen the significant environmental effects of the project. At the state level, CEQA requires that public agencies consider the effects of their actions on historical resources eligible for listing on the California Re&ter of Historical Resources. "Historical resource" refers to buildings, structures, sites (prehistoric and historic), objects, districts, and all maaner, of properties containing material remains of past human life or activity. Six new equipment cabinets will be housed inside the building beside the tower, similar to the existing carriers. The tower is enclosed with 6' chain link fence and gates. These antennas transmit radio frequency power in a well-defined collimated beam with little angular divergence which is highly directional in nature. Because of the mounting height of the antennas, the power densities existing at locations where people may be typically exposed are substantially less than on -axis power densities, and the RF exposure contribution can be considered insignificant compare to panel antennas. PROTOCOL: This study, and the calculations performed therein, is based on OET Bulletin 65, which adopts ANSI C95.1-1992 and NCRP standards. In particular, equation 10 from section 2 of the guideline is used as a model (in conjunction with known antenna radiation patterns) for calculating the power density at different points of interest. This information will be used to judge the RF exposure level incident upon the general population, and any employee present in the area. It should be noted that ground reflection of RF waves has been taken into account. ' Cleveland, Robert F, et al. In addition, the azimuths of the antennas of all carriers are assumed to be in the direction of the studied location. Please refer to scenario 1 in appendix A for the complete geometry and analysis. The Maximum Permissible Exposure (MPE) limit for 1900 MHz PCS facility for general population/uncontrolled exposure is 1000 uW/cm2, and 580 µW/cm2 for 850 MHz facility2. At this location, the power density from the facility is calculated to be 0.62% of the MPE limit. Scenario 2: Maximum Exposure on nearby buildings There are commercial and low density residential buildings in the surrounding area. The RF exposure levels on the rooftop of nearby buildings are evaluated. Again, we assume all antennas are transmitting with maximum power level at the same time. Please refer to scenario 2 in appendix A for the complete geometry and analysis. The highest exposure location is found to be approximately 49' from the tower. There is a relatively low level of RF energy directed either above or below the horizontal plane of the antennas, and there are no locations in the surrounding areas near the compound that will have RF exposure levels close to the MPE limit. Conclusion: Under "worst-case" conditions, the calculations shown above predict that the maximum possible RF exposure is 0.94% of the MPE limit. There will be less RF exposure ori the ground level or nearby buildings as a person moves away from the site. Therefore, the proposed modifications to AT&T facility in co -location with the existing wireless telecommunications facilities will comply with the general population/uncontrolled limit. FCC COMPLIANCE: Only trained persons will be permitted to access the facilities and the antennas. They will be made fully aware of the potential for RF exposure and can choose to exercise control over their exposure that is within the occupational/controlled limits which is 5 times higher than the uncontrolled limits.
