Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions set forth below: Stott Advertising is hereby granted a Minor Use Permit in accordance with application filed: Minor Use Permit for the installation of a double -sided off-site advertising sign on parcel 040-490-002. 1. As provided by Butte County Code §24-243, the effective date of this Minor Use Permit shall be ten days following the action of the Zoning Administrator, unless appealed or called up for review. Permits or other approvals may be issued only upon or following the effective date, provided no appeal has been filed. 2. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Chapter 24, Article 34, §24-251. 3. As provided by Butte County Code §24-247, the permit or approval not exercised within two years after the date of approval shall expire and become void, except where an extension of time is approved. A permit or approval shall also expire and become void if the permitted use is abandoned for one year. 4. The Zoning Administrator may authorize minor changes to an approved project if the changes comply with all of the following criteria: a. The requested changes are consistent with all applicable requirements of the Zoning Ordinance; b. The requested changes are consistent with. the spirit and intent of the original approval; c. The requested changes do not involve a feature of the project that was a basis for conditions of approval for the project; d. The requested changes do not involve a feature of the project that was a specific . consideration by the review authority in granting the approval; and e. The requested changes do not involve any expansion or intensification of the use or structure. 5. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. 6. The applicant shall comply with all applicable federal, State and localstatues and regulations. Conditions of Approval: 1. Prior to issuance of the Minor Use Permit, pay any outstanding project-related processing fees. 2. Installation of and maintenance on the sign shall only take place during dry soil conditions to avoid impacts to the ground and any species present on the parcel. 3. Access across the subject property to the sign from Oroville-Chico Highway shall be limited to along the southerly and easterly property lines only. 4. IPU IIt ('OUNTY SEP ® 9 2015 DEVELOPMENT SERVICES Supplemental Project Description for New Off -Site Advertising Sign at 870 Oro Chico Highway, APN 040-490-002 This supplemental project description is intended to be read in conjunction with the formal application materials submitted to the Butte County Planning Division the week of September 8th, 2015. The project site is a 31.94 acre parcel located between Oro Chico Highway and Highway 99, approximately 0.8 miles north of Durham -Dayton Highway. The site is generally level. Drainage features exist along the eastern and northern property lines, and convey storm water from culverts under Highway 99 to the northwest corner of the property, where it passes under Oro Chico Highway. The property is vacant, but is occasionally used for grazing. The ground is disturbed, having been used for rice farming several decades ago. Remnant berms associated with the previous rice farming operation can be seen in various locations on the site. The site is zoned GI (General Industrial), a zoning district which normally allows off-site advertising signs by right. However, a use permit is required due to the presence of an old conditional zoning agreement (CZA) approved for the property in 1990. The old CZA requires use permits for all uses normally allowed by right, except for those uses on a very short list which was included in the CZA. Two residences are located in the vicinity of the project site, but neither is close to the actual sign location. One is located 900 feet to the southwest across Oro Chico Highway on industrially -zoned land, and the other is located 1,500 feet to the northwest on agriculturally -zoned land. No residentially - zoned property exists anywhere near the project site. Industrial uses and zoning are located to the south of the project site. Agricultural uses and zoning are located to the north, east, and west. The off-site advertising sign will be a steel structure with two 14' x 48' faces. Overall height will be 42.5 feet above grade, and the edge of the sign will be 29 feet from the eastern property line. (These are the same dimensions and distance from the eastern property line for the sign located on the property to the south.) A single steel pole located 40 feet from the eastern property line will support the sign, and will be set in a concrete foundation. Each sign face will be externally illuminated by specialized outdoor advertising light fixtures, with electricity brought to the sign from the power lines at the southwest corner of the property. All construction will occur in a location and manner so.that existing drainage patterns are unaffected. Construction will occur during the dry season so that the ground can adequately support the weight of construction vehicles. Construction time will be less than a week. Resources Code §21152) the fee required under Fish and Game Code section 711.4, subdivision (d). Without the appropriate fee, statutory or categorical exemption, or a valid No Effect Determination issued by the California Department of Fish and Wildlife (CDFW), the Notice of Determination is not operative, vested, or final, and shall not be accepted by the county clerk. COLLECTION PROCEDURES FOR COUNTY GOVERNMENTS 1. The original cash receipt is to be issued to a project applicant when payment is made in conjunction with filing a Notice of Determination. The second copy is to be submitted to the CDFW on a monthly basis. The remaining copies will be retained by the county (one for the lead agency and one for the county clerk). 2. For projects that are statutorily exempt or categorically exempt (Cal. Code Regs., tit. 14, §§15260-15285, 15300-15333) and are filed with the county clerk, the cash receipt shall be completed and attached to the Notice of Exemption. No fee is due for statutorily exempt or categorically exempt projects. 3. For projects that CDFW has found to have no effect, the cash receipt shall be completed, and attached to the Notice of Determination; it is mandatory that a copy of CDFW No Effect Determination be attached to the Notice of Determination. If the project applicant does not have a No Effect Determination from CDFW, then the appropriate filing fee is due. 4. Within 30 days after the end of each month in which the filing fees are collected, each county will summarize and record the amount collected on the monthly State of California Form No. CA25 (TC31) and remit the amount collected to the State Treasurer. Identify the remittance on the State of California Form No. CA25 (TC31) as "Environmental Document Filing Fees" per Fish and Game Code section 711.4. DO NOT COMBINE THE ENVIRONMENTAL FEES WITH THE STATE SHARE OF FISH AND WILDLIFE FINES. The following documents are to be mailed by the county clerk to CDFW on a monthly basis: (A) A photocopy of the monthly State of California Form No. CA25 (TC31); (B) CDFW/ASB copies of all cash receipts (including all voided receipts); (C) A copy of all CDFW No Effect Determinations filed in lieu of fee payment; (D) A copy of all Notices of Determination filed with the county during the preceding month; and (E) A list of the complete name, address and telephone number of all project applicants for which a Notice of Determination has been filed. If this information is contained on the cash receipt filed with CDFW under California Code of Regulations, title 14, section 753.5, subdivision (e)(6), no additional information is required.
