At the Zoning Administrator meeting held July 20, 2016, your request for a Minor Use Permit for a solar array
with a height of 10.3 feet in the VLDR zone was approved, subject to findings and conditions. Should you
desire to appeal the decision by the Zoning Administrator, you must do so in writing, prior to 4:00 p.m., Monday,
August 1, 2016 to the:

The appeal fee of $400.00 must be paid at that time. If you do not appeal within the 10 calendar -day appeal
period, the action of the Zoning Administrator is final.
APPROVAL OF PROJECT SUBJECT TO PAYMENT OF ALL APPLICABLE FEES
Payment of all applicable outstanding processing fees is required as a condition of approval for your project.
Prompt payment of invoiced amounts will expedite the approval process in satisfying this condition. Final minor
use permit processing invoice to follow.
The conditions of approval must be met within twenty-four (24) months from the date of approval by the
Butte County Planning Commission or the approval will be considered null and void. The applicant may request
an Extension of Time (Article 34, BCC Section 24-247 C), up to one additional year, with the Zoning
Administrator.
Enclosed is a copy of the Conditional Use Permit with the Conditions of Approval. Your signature is required
on the last page. Please sign and return one copy to Development Services within 15 days (August 5, 2016) of

Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special
conditions set forth below: Chris Saeturn is hereby granted a Minor Use Permit
1. As provided by Butte County Code §24-243, the effective .date of this Minor Use Permit
shall be ten days following the action of the Zoning Administrator, unless appealed or
called up for review. Permits or other approvals may be issued only upon or following the
effective date, provided no appeal has been filed.
2. This approval shall expire and become void if not exercised within two years from the date
of approval, except where an extension of time is approved as provided in Butte County
Code §24-247.
3. The terms and conditions of this Minor Use Permit shall run with the land. and shall be
binding upon and be to the benefit of the heirs, legal representatives, successors, and
assigns of the Permitee, provided the use has not been abandoned.
4. This Minor Use Permit may be revoked, or the conditions of approval modified, as
provided in Butte County Code §24-251.
5. Minor changes as provided by BCC Chapter 24, Article 34, Section 26 C, may be approved
administratively by the Zoning Administrator upon receipt of a substantiated written
request by the applicant, or their respective designee. Prior to such approval, verification
shall be made by each Department or Division that the modification is consistent with the
application, fees paid, and environmental determination as conditionally approved.
Changes deemed to be major or significant in nature shall require a formal application for
amendment.
6. The applicant shall comply with all applicable federal, State and local statues and
regulations.

1. Prior to issuance of the Minor Use Permit, pay any outstanding project -related processing
fees.
2. Prior to any construction, secure building permits from the Building Division of the
Department of Development Services.

Subject: Your inquiry regarding MUP16-0006
Felix,
Thanks for inquiring about how close the solar arrays would be from adjacent homes, (not just property lines as
reported.
Based on building permit records, the structure near the back property line, just south of the back property line, is a
garage.
From the solar array, adjacent homes appears to be 230 feet to the east, 250 feet to the south, over 300 feet to the
west, and across Shorthorn Drive more than 300. feet to the north.
This additional information supports our conclusion that two feet of additional height at this location would not result in
a negative viewshed for. adjacent residents.

EXECUTIVE SUMMARY:
The Minor Use Permit would allow construction of solar arrays at a height of 10.3 feet on a 1 acre
parcel in the VLDR zone; the height allowed `by right' in the zone is 8 feet. The project is
Categorically Exempt from environmental review under Section 15303(c). Staff recommends
approval of this Minor Use Permit with findings and conditions.
PROJECT DESCRIPTION:
Construction of solar arrays at a height of 10.3 feet on a 1 -acre parcel in the ,VLDR zone.
SITE CHARACTERISTICS AND SURROUNDING USES:
• The project parcel is developed with an existing residence, garage, barn and outbuildings.
• The project parcel is 1.001 acres.
• The site and surrounding properties are developed with low-density residential land uses.
• The site and surrounding properties are located within the North Chico Specific Plan Area.

• The Zoning Ordinance contains height standards for ground mount solar in Table 24-157-2,
(BCC §24-157 C.3). The table specifies a maximum building height of 8 feet for parcels under
two acres in size, but allows exceptions where a minor use permit has been approved allowing
different standards.
• The subject parcel is 1.001 acre in size.
Given human perspective, objects appear smaller from a greater distance and appear larger
from a shorter distance. The proposed solar array is located adjacent to the undeveloped back
yards of immediate neighbors to the south, east and west. Setbacks from the array are proposed
as follows:

A 10.3' high solar array would not result in negative views, with setbacks between 10 feet and
136.6 feet, as proposed. The array would not be located in a primary viewshed for adjacent
properties or create a demonstrable negative affect on adjacent properties.
Lot Coverage in North Chico Specific Plan
As noted above, the site and surrounding properties are located within the North Chico Specific
Plan (NCSP) area. Table 7-2 of the NCSP contains a summary of development standards by zone
district at time of adoption. Since adoption of the updated Zoning Ordinance in 2012, the current
zoning district (Very Low Density Residential) is matched to the SR -1 zone district in the Specific
Plan, because both allow large lot development with a minimum parcel size of one acre. The
maximum lot coverage allowed in the SR -1 zone district is 15%. Addition of the solar array would
not cause lot coverage to exceed 15% on the subject property.
Minor Use Permit Findings
Section 24-222 of Butte County Code specifies the following findings that must be made if
approving a use permit or minor use permit. Facts in support of the necessary findings are provided
in italics below.
A. The location, size, design, and operating characteristics of the proposed use will be
compatible with the existing and future land uses in the vicinity of the subject property.

The height of the proposed solar array will be 10.3 feet at its highest point. The array will
be located adjacent to the backyards of existing parcels, and within ten feet of the property
to the west. Although visible from adjacent residences, the array will not dominate the
view or tower above adjacent uses or properties. The size, design and operating
characteristics of the proposed solar array are compatible with the existing and future land
uses in the vicinity of the subject property and align with the intent and purpose of the Very
Low Density Residential zoning designation.
B. The proposed use will not be detrimental to the public health, safety_, and welfare of the
County.
The proposed array's maximum height of 10.3 feet, with 10 foot interior side setback to
the west, will not be detrimental to the public health, safety, and welfare of the County. A
building permit is required for construction of the solar array, which will ensure it will
adhere to building safety standards in the California Building Code.
C. The proposed use is properly located within the County and adequately served by existing
or proposed services and infrastructure.
4251 Shorthorn Drive is accessed from Garner Lane and is adequately served by existing
or proposed services and infrastructure necessary to support the solar array.
D. The size, shape, and other physical characteristics of the subject property are adequate to
ensure compatibility of the proposed use with the existing and future land uses in the
vicinity of the of the subject property.

the vicinity of the subject property. The proposed use is compatible with the allowed
accessory structures described in Table 24-156-1 and should not change current or future

ENVIRONMENTAL REVIEW
This application is for a Minor Use Permit to allow a maximum height of 10.3 feet for a solar
array. The project is Categorically Exempt from environmental review under Section 15303(c)
(New Construction of Conversion of Small Structures).
PUBLIC COMMENTS
Staff had not received any comments at the time staff report was prepared.
ACTIONS FOR CONSIDERATION
Staff recommends that the Zoning Administrator find the project is exempt from CEQA and
approve MUP:16-0006 with conditions.

A Minor Use Permit (MUP) to exceed height standards in section 24-157 C.3 if Butte County Code
(Table 24-157-2) for a solar array is granted. This MUP authorizes construction of a solar array
10.3 feet in height in the VLDR zone, not less than 10 feet from the western property line at 4251
Shorthorn Drive, Chico.

I. Find this project is categorically exempt from the California Environmental Quality Act
(CEQA) provisions under 14 CCR Section 15303(c). Section 15303(c) exempts new
construction or conversion of small structures.
A. Because the project is exempt from the provisions of CEQA, the payment of fees pursuant
to Fish and Game Code Section 711.4 and 14 CCR 753.5 is not required.
B. The custodian of the record is the Department of Public Works. The location of the record
is 7 County Center Drive, Oroville CA 95965.
II. Make the following Minor Use Pennit findings and approve Minor Use Permit MUP16-0006,
subject to the following findings:
A. The location, size, design, and operating characteristics of the proposed use will be
compatible with the existing and future land uses in the vicinity of the subject property.

Permits. Conditions of approval have been applied to this project pursuant to the applicable
requirements of Butte County Code Chapter 24.

Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special
conditions set forth below: Chris Saeturn is hereby granted a Minor Use Permit
1. As provided by Butte County Code §24-243, the effective date of this Minor Use Permit
shall be ten days following the action of the Zoning Administrator, unless appealed or
called up for review. Permits or other approvals may be issued only upon or following the
effective date, provided no appeal has been filed.
2. This approval shall expire and become void if not exercised within two years from the date
of approval, except where an extension of time is approved as provided in Butte County
Code §24-247.
3. The terms and conditions of this Minor Use Permit shall run with the land and shall be
binding upon and be to the benefit of the heirs, legal representatives, successors, and
assigns of the Permitee, provided the use has not been abandoned.
4. This Minor Use Permit may be revoked, or the conditions of approval modified, as
provided in Butte County Code §24-251.-
5. Minor changes as provided by BCC Chapter 24, Article 34, Section 26 C, may be approved
administratively by the Zoning Administrator upon receipt of a 'substantiated written
request by the applicant, or their respective designee. Prior to such approval, verification
shall be made by each Department or Division that the modification is consistent with the
application, fees paid, and environmental determination as conditionally approved.
Changes deemed to be major or significant in nature shall require a formal application for
amendment.
6. The applicant shall comply with all applicable federal, State and local statues and
regulations.

Conditions of Approval:
1. Prior to issuance of the Minor Use Permit, pay'any outstanding project -related processing
fees.
2. Prior to any construction, secure building permits from the Building Division of the
Department of Development Services.
