Present: Bary Hogan, Planning Manager, Lynn Richardson, Record Secretary I Also Present: Alan and Cheryl Kuentz ITEM FOR CONSIDERATION A. Staff Recommendation - Approval Alan and Cheryl Kuentz - (Item determined to be categorically exempt from environmental review) Minor Use Permit to allow a second dwelling on property zoned "U" (Unclassified) located on the northwest side of Cherokee Road, approximately 6 miles north of Table Mountain Blvd., at 2689 Cherokee Road, identified as AP 041-590-009, Oroville. (LPW) (95- 148) Mr. Kuentz asked the procedure for a minor use permit and what happens next? Mr. Hogan said this item, if recommended for approval, will go forward to the Planning Commission and be placed on their Consent Agenda for final action. Mr. Hogan said the annual renewal forms will be mailed two months prior to the expiration of the renewal date. Mr. Hogan said the file contains no correspondence, for or against the project. The application meets the requirements for a second dwelling unit and seeing no objections Mr. Hogan confirmed the action recommend in the staff report and requested this item be set for the next available Planning Commission meeting. If applicant is not the owner, written authorization by the owner or other proof of agency must be submitted in order for the applicant to legally sign the application. Application shall be considered void if not signed by the owner or legal agent. 2. All items on application shall be filled in as completely as possible. The "Application for Use Permit" is subject to public hearings and approval by the Planning Commission. Any special conditions of approval shall be made a part of the approved "Use Permit" and shall be binding on the applicant. The procedures for County action on use per- mit applications are stated in Chapter 24 of the Butte County Code. 6. The Planning Commission, on the basis of the evidence submitted at thepublic hearing,may grant use permits when it finds that the proposed uses of the property .will not impair the integrity and character of the zone in which the land lies and that the use would not be un- reasonably incompatible with or injurious to surrounding properties nor detrimental to the health and general welfare of the persons residing or working in the neighborhood nor to the general health, safety and welfare of the county. 7. In approving a use permit, the Planning Commission may include such conditions as are deemed reasonable and necessary under the circumstances to preserve the integrity and character of the zone and to secure. the general purposes of the Butte County General Plan and Chapter 24, of the Butte County Code. Such conditions may include, but are not limited to: time limitations, development plan approval, hours of operation, fencing, dedication of right-of-way, and street and drainage improvements. Conditions imposed upon issuance of a use permit must be reasonably related to the use for which the permit is requested. 8. SPECIAL CONDITIONS: The Second Unit shall be a separate, on-site, detached dwelling. A detached Second Unit shall not exceed 1200 square feet. 2. The property owner must maintain the minimum acreage requirement of the zone for the parcel or lot upon which the Second Unit is to be located. 3. In addition to the off-street parking required for the primary dwelling, one off-street parking space shall be provided for Second Units of 640 square feet or less. An attached or, fi a detached garage or carport with a maximum exterior dimension of 12' by 20' is permitted for Second Units of 640 square feet or less. 4.. Adequate sewer and potable water facilities shall be provided as determined by the County Environmental Health Division. 5.. A Second unit may not be placed on a lot or parcel where a temporary mobile home, in accordance with Section 24-295 and 24-295.10 of the Butte County Code, has been approved or on a lot that has more than.one dwelling located upon it. 6. Either the existing single family dwelling or the second unit shall be owner occupied. Verification of ownership residency shall be required prior to permit issuance and annually thereafter by. submittal of a recorded declaration in a form specified by the Director of Development Services or designee. 7. Applicant must pay $200.00 into the Battalion 6 water tender fund and meet the fire safe regulations of Public Resources Code 4290 and Butte County. 8. Applicant must also comply with all other applicable State and local statutes, ordinances and regulations. Minor changes may be approved administratively by the Director of Development Services upon receipt of a substantiated written request by the applicant. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. Subject to the findings indicated in Sections 1 and 2 of this report, approve the Minor Use Permit for Alan and Cheryl Kuentz on AP#041-590-009. Approval shall be subject to the following conditions. Minor changes may be approved administratively by the Director of Development Services, or designee, upon receipt of a substantiated written request by the applicant. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid, and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. The Second Unit shall be a separate, on-site, detached dwelling. A detached Second Unit shall not exceed 1200 square feet. 2. The property owner must maintain the minimum acreage requirement of the zone for the parcel or lot upon which the Second Unit is to be located. 3. In addition to the off-street parking required for the primary dwelling, one off-street parking space shall be provided for Second Units of 640 square feet or less. An attached or detached garage or carport with a maximum exterior dimension of 12' by 20' is permitted for Second Units of 640 square feet or less. 4. Adequate sewer and potable water facilities shall be provided as determined by the County Environmental Health Division. Either the existing single family dwelling or the second unit shall be owner occupied. Verification of ownership residency shall be required prior to permit issuance and annually thereafter by submittal of a recorded declaration in a form specified by the Director of Development Services or designee. 7. Applicant must pay $200.00 into the Battalion 6 water tender fund and meet the fire safe regulations of Public Resources Code 4290 and Butte County. 8.
