SPECIAL CONDITIONS: 1. The Sec and Unit may be attached to the primary residence or may be a separate, on-site, detached dwelling. 2. An attached Second Unit shall be architecturally compatible with the primary residence and the appearance of the building shall be that of a single family dwelling. 3. The size of an attached Second Unit shall not exceed 640 square feet or 30% of the size of the primary dwelling, whichever is greater, in no case shall the Second Dwelling Unit exceed 1200 square feet. A detached Second Unit shall not exceed 1200 square feet. 4. The parcel or lot upon which the Second Unit is to be located must meet the minimum acreage requirement for which the parcel or lot is zoned. 5. In addition to the off-street parking required for the primary dwelling, one off-street parking space shall be provided for Second Units of 640 square feet or less; two additional off-street spaces shall be provided for larger units. • .1 6. An attached or detached garage or carport with a maximum exterior dimension of 12' by 20' is permitted for Second Units of 640 square feet or less. A garage or carport. with a maximum exterior dimension of 20' by 24' is permitted for larger Second Units. 7. Adequate sewer and potable water facilities shall be provided as determined by the Butte County Environmental Health Division. 8. A Second Unit may not be placed on a parcel or lot where a temporary mobile home, in accordance with Section 24-295 and 24-295.10, has been. approved or on a lot that has more than 1 dwelling unit located upon it. 9. Either the existing single family dwelling or the Second Unit shall be owner occupied. Verification of ownership shall be required prior to permit issuance and annually thereafter by submittal of a declaration in a form specified by the Director of Development Services or designee. Minor changes may be approved administratively by the Director of Development Services upon receipt of a substantiated written request by the applicant. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. RELATED ITEMS: None FOR: Administrative Hearing Committee on June 12, 1995 ABSTRACT: This request is for a minor use permit for a Second Unit. The proposal conforms to the zoning and the General Plan. Staff recommends approval of this application. PROJECT CHARACTERISTICS: This request is for a minor use permit to allow the placement of a Second Unit pursuant to Butte County Code Section 24-280 as amended by Ordinance 3164. The property is a 1.32 acre parcel, and is located on the west side of Skyway, in Paradise Pines, and is zoned Highway -Commercial (H -C). The General Plan designates the property as both Agricultural -Residential and Commercial. The property is currently developed with a 1440 square foot single-family house, a 576 square foot garage, a 768 square foot storage building, three utility sheds, and an office. The new second unit will be a 1,200 square foot mobile home and will be located approximately 120 feet southwest of the existing dwelling on a flat, cleared area. Domestic water will be supplied by Del Oro Water Company. Sewage disposal will be handled by an individual septic tank and leachfield. Surrounding zoning is H -C, Neighborhood -Commercial, and ARMH-3. The General Plan designation for the surrounding properties is Agricultural -Residential and Commercial. The surrounding existing land uses are mostly residential. ANALYSIS: This project will allow a 1200 square foot mobile home as a second dwelling unit . The second dwelling unit will have its own septic tank and leachfield, which has been approved by the Butte County Environmental Health Department. The Butte County Fire Department has stated that this project must meet the Fire Safe Regulations of Butte County and PRC 4290. This requires property owners to reduce fuel within 30 feet of structures. In order to meet this requirement, the second dwelling unit for this project will be required to have 30 -foot setbacks instead of the normal 10 foot setbacks for residential use in a H -C zone. The Second Unit Ordinance permits second dwellings subject to the following requirements: The Second Unit may be attached to the primary residence or may be a separate, on-site, detached dwelling. 2. An attached Second Unit shall be architecturally compatible with the primary residence and the appearance of the building shall be that of a single family dwelling. 3. The size of an attached Second Unit shall not exceed 640 square feet or 30% of the size of the primary dwelling, whichever is greater, in no case shall the Second Dwelling Unit exceed 1200 square feet. PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be held. Notices of the hearing will be mailed to the nearest 10 property owners.
