(SL) (95-59) This item was pulled from the consent agenda at the request of Commissioner Lambert for discussion only, since it is the first Minor Use Permit to be considered on the consent agenda. Mr. Hogan explained the new process for Minor Use Permits. Commissioner Erisman was present at this time. Commissioner Lambert thought that it should be more clear if this application is for a second unit or a senior citizen unit, is it owner occupied, and is it 30% of the primary dwelling regardless of whether it is attached or detached? She thought the format of the reports should contain this information. Chairman Nelson suggested that Commissioner Seegert should step down from the podium while his . application is being considered. Commissioner Seegert stepped down from the podium during the discussion and vote on his application. Mr. Hogan said that the conditions of approval require. owner occupancy. it is not required that a senior citizen occupy the second unit. Mr. Lucas said that a detached unit requires a maximum of 1200 square feet. An attached unit must be a maximum 30% of the area of the primary dwelling. Commissioner Lynch suggested that the Staff Report include the square footage of the primary dwelling. Approval of the consent agenda was. moved by Commissioner.Lynch, seconded by Commissioner Lambert, and carried by the following vote: . If applicant is not the owner, written authorization by the owner or other proof of must be submitted in order for the applicant to legally sign the application. The "Application for Administrative Permit" is subject to review by County Staff and approval by the Planning Director. Any special conditions of approval shall be -made a part of the approved "Administrative Permit" and shall be binding on the applicant. The procedures for County action on Administrative permit applications are stated in Chapter 24 of the Butte County Code. 6. In approving an Administrative Permit, the Planning Director may include such conditions as are deemed reasonable and necessary under the circumstances to preserve the integrity and character of the zone and to secure the general purposes of the Butte County General Plan and Chapter 24, of the Butte County Code. In general, said conditions will be listed as standards in Chapter 24 for each use. In unique situations additional conditions may be added so long as they are reasonably related to the use for which the permit is requested. 7. RELATED ITEMS: None FOR: Planning Manager Public Hearing of March 13, 1,995 ABSTRACT: This application for a Minor Use Permit for Christopher Seegert meets all the requirements of Section 24-280 of the Butte County Code. Staff recommends approval of this request, with conditions. PROJECT CHARACTERISTICS: This request is for a Minor Use Permit to allow a Second Unit on a 104 acre parcel located at 6103 Old Olive Highway in Oroville. The parcel is zoned FR -10 with a General Plan designation of Agricultural Residential. The parcel is served by the Oroville Wyandotte Irrigation District and by a private septic system. The parcel presently contains a single family house, a 608 sq. ft. barn, and a 1120 sq. ft. shop which will be converted to the senior unit. ANALYSIS: In this application, Christopher Seegert is asking to utilize an existing 1120 sq. ft. wood frame structure as a second unit. This request is consistent with the intent of Section 24-280 of the Butte County Code. Upon review of this second unit application, staff has determined that the proposed second unit will not significantly impair the integrity of the zone in which it is in nor will it be detrimental to the health, safety and welfare of the intended occupants or the immediate neighborhood. This determination was made by reviewing the quantity of second units in the immediate area and finding that the total number of second units does not cause a noticeable change in density, or a reduction in the availability, or quality, of county services. The applicant will be required by the Environmental Health Department to install a new septic tank and connect to the existing leach lines. This action will require the applicant to obtain a permit and inspection of the required facilities. The Butte County Fire Department requires that all new structures meet the Fire Safe Regulations of Butte County and PRC 4290. The Department of Public Works has required no additional conditions in their response to this application. ENVIRONMENTAL DOCUMENTATION: This project has been determined by the Secretary of Resources to be Categorically Exempt under CEQA Section 15303 (Class 3)(a). PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be held. Notices will be mailed to all property owners within a 300 foot radius of the subject property, but not less than 30 parcels. RECOMMENDATION: Staff recommends approval of the application for a Minor Use Permit for Christopher Seegert on APN 072-200-049, subject to the following findings and conditions. Section 1: Environmental Findings. A. Find that this application for an Administrative Use Permit to allow a Senior Citizens Dwelling Unit is Categorically Exempt under CEQA, and; Section 2: Zoning Ordinance Findings. A. RELATED ITEMS: None FOR: Development Review Committee Meeting ABSTRACT: This application for an Administrative Use Permit for Christopher Seegert meets all the requirements of Section 24-202 of the Butte County Code. Staff recommends approval of this request, with conditions. PROJECT CHARACTERISTICS: This request is for an Administrative Use Permit to allow a Senior Citizen Dwelling Unit on a 104 acre parcel located at 6103 Old Olive Highway in Oroville. The parcel is zoned FRA 0 with a General Plan designation of Agricultural Residential. The parcel is served by the Oroville Wyandotte Irrigation District and by a private septic system. The parcel presently contains a single family house, a 608 sq. ft. barn, and a 1120 sq. ft. shop which will be converted to the senior unit. . PROJECT AND SURROUNDING ZONING, GENERAL PLAN DESIGNATION, AND EXISTING LAND USE: Direction Zoning General Plan Existing Land Use Project: FR -10 Agricultural Residential Residential North:. FR -10 Agricultural Residential Residential South: FR -10 Agricultural Residential Residential East: FR -10 Agricultural Residential Residential West: AR Agricultural Residential Residential ANALYSIS: In this application, Christopher Seegert is asking to utilize an existing 1120 sq. ft. wood frame structure as a senior citizens dwelling unit (62-1200). This request is consistent with the intent of Section 24-202 of the Butte County Code and the applicant has demonstrated the ability to meet all the requirements of Section 24-202 of the Butte County Code restricting the size of the building to no larger than 1200 sq. ft. and to be occupied by persons 62 years of age or older. Upon review of this second unit application, staff has determined that the proposed second unit will not significantly impair the integrity of the zone in which it is in nor will it be detrimental to the health, safety and welfare of the intended occupants or the immediate neighborhood. This detrmination was made by reviewing the quantity of second units in the immediate area and finding that the total number of second units does not cause a noticeable change in density, or a reduction in the availability, or quality, of county services. The applicant will be required by the Environmental Health Department to install a new septic tank and connect to the ebsting leach lines. This action will require the applicant to obtain a permit and inspection of the required facilities. The Butte County Fire Department requires that all new structures meet the Fire Safe Regulations of Butte County and PRC 4290. The Department of Public Works has required no additional conditions in their response to this application Ar Butte County Department of Development Services - Planning Division Ar 1 AGENDA ITEM ENVIRONMENTAL DOCUMENTATION: This project has been determined by the Secretary of Resources to be Categorically Exempt under CEQA Section 15303 (Class 3)(a). PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be held. Notices will be mailed to all property owners within a 300 foot radius of the subject property, but not less than 30 parcels. RECOMMENDATION: Staff recommends approval of the application for a Administrative Use Permit for Christopher Seegert on APN 072-200-049, subject to the following findings and conditions. Section 1: Environmental Findings. A. Find that this application for an Administrative Use Permit to allow a Senior Citizens Dwelling Unit is Categorically Exempt under CEQA, and; Section 2: Zoning Ordinance Findings. A. Find that this application meets the requirements of Section 24-202 of the Butte County Code with the following conditions. Section 3: Action. A. Subject to the findings indicated in Sections 1 and 2 of this report, move to approve the Administrative Use Permit for Christopher Seegert on APN 072-200-049, subject to the following conditions. B. Conditions of Approval. The "living area" meaning the interior habitable floor space area of a dwelling unit including basements and attics, but not including a garage or any accessory structure, shall not exceed 1,200 square feet. 2. The senior citizen dwelling unit is intended for the sole occupancy of one (1) adult 62 years of age or over or two (2) adult persons, one of whom is 62 years of age or over. An affidavit of compliance with the age requirements of this section shall be recorded in the office of the Recorder prior to issuance of building permits. Said affidavit shall include the legal description of the lot or parcel and shall constitute a covenant running with the land, binding upon the original owners and their heirs, successors and assigns, limiting the e occupancy of the senior citizen dwelling unit to the conditions described in this section. 3. The senior citizen dwelling unit shall not be sold as a separate unit unless a parcel containing the unit is created in compliance with the existing zoning and subdivision ordinances and the resulting density is in conformance with the General Plan. 4. Two off-street parking spaces shall be provided for the senior citizen dwelling unit in addition to the parking spaces required for the primary dwelling unit. 5. Adequate sewer and water facilities shall be provided subject to the approval of Environmental Health Department. 6. All site development standards as required by the zoning district in which the unit is located shall be met. 7. The senior citizen dwelling unit shall be a conventionally constructed building or a mobile home that complies with the National Manufactured Housing Construction and Safety Standards Act of 1974, except that in the "A", "FR", and "TM" series of zones a mobile home, as defined in Section 24-21.28, may be used.
