Randall and Janelle Watkins - (Item determined to be categorically exempt from environmental review) Minor Use Permit to allow a Bed and Breakfast Home on property zoned A -R (Agricultural Residential) located at 528 Paseo Companeros, identified as AP 040-340-020, Chico. (SB) (95-187) Mr. Hogan read a fax was received from Mr. Watkins withdrawing this project. Mr. Hogan accepted the request for withdrawal and vacated this hearing. B. Mae Cangemi - (Item determined to be categorically exempt from environmental review) Minor Use Permit to allow a second dwelling on property zoned A -R (Agricultural Residential) located at 775 Plumas Avenue, identified as AP 031-211-026, Oroville. (SB) (95-190) Mrs. Cangemi was present and said she agreed with the conditions. Mr. Hogan said no letters have been received objecting to this project. He noted that the applicant and family were present. He said the application meets the requirements for a second dwelling and he confirmed the action recommended in the staff report and requested this item be set for the next Planning Commission meeting of September 14, 1995 on consent. C. Lloyd Hansen - (Item determined to be categorically exempt from environmental review) Minor Use Permit to allow a second dwelling on property zoned A -R (Agricultural Residential) located at 21 Buehler Avenue, identified as AP 068-210-109, Oroville. (SH) (96-01) Mr. and Mrs. Hansen were present. Mr. Hogan said one letter has been received stating a concern regarding adequate water pressure in the area for this dwelling. He said the comments received from OWID indicate there is sufficient water pressure in the area to approve this request. Mr. Hogan said there is an additional condition requiring Oroville Union District school fees of $1.72 per square foot. He said the, applicant would need to go to the school district and talk to them. Mr. Hansen asked if the second unit could be larger than 1200 square feet? Mr. Hogan said the State law states that 1200 square feet is the maximum a second dwelling can be and is determined to be adequate. ■ BUTTE COUNTY PLANNING SERVICES MEETING ■ MINUTES a PAGE 1 ■ '-1 Mr. Hansen asked if the primary dwelling is small, could the primary dwelling be considered the secondary dwelling and the new dwelling be made larger than 1200 square feet? Mr. Hogan said staff is willing to work with him on which one is considered the second dwelling. He said the site plan would have to be revised to reflect which one is the second dwelling. Mr. Hansen said according to his figures, the proposed second dwelling will be very close to 1200 square feet. Mr. Hogan said he should have the Building Division run the figures. If the proposed dwelling is over 1200 square feet, Mr. Hansen needs to write Planning a letter to change the existing dwelling to the second dwelling and submit a new site plan. Mr. Hogan said one letter had been received voicing concerns regarding water pressure in the area and this concern had been answered by OWID. He noted that the Mr. and Mrs. Hansen were present. He said the application meets the requirements for a second dwelling and he confirmed the action recommended in the staff report and requested this item be set for the next Planning Commission meeting of September 14, 1995 on consent adding a new condition "Applicant to pay appropriate Oroville Union School District fees of $1.72 a square foot." FOR: Administrative Hearing August 28, 1995 ABSTRACT: Staff recommends approval of this application. PROJECT CHARACTERISTICS: This request is a Minor Use Permit request to allow the placement of a Second Unit pursuant to Butte County Code Section 24-280 as adopted by Ordinance 3176 on January 22, 1995. The property is currently developed with a primary dwelling and a detached garage. The applicant proposes to expand and finish the interior upstairs of the existing garage/shop to use as a personal residence. The converted residential area will total approximately 1100 square feet. The property is located on the south side of Buehler Avenue, approximately 600 feet west of Arbol Avenue, Oroville. Surrounding parcels on Buehler Avenue vary in size from approximately 1/2 acre to five (5) acres. This parcel is 0.73 acres in size. Domestic water will be provided by OWID which currently supplies water to this parcel. Sewage disposal will be handled by individual septic tanks and leachfields. PROJECT AND SURROUNDING ZONING GENERAL PLAN DESIGNATION AND EXISTING LAND USE: Described below are the project and surrounding zoning, general plan land use designation and the existing land uses. The ■ Butte County Development Services Department - Planning Division ■ E AGENDA ITEM Second Unit Ordinance recently adopted by the Board of Supervisors permits second dwellings subject to the following requirements: 1. The Second Unit may be attached to the primary residence or may be a separate, on site, detached dwelling. 2. An attached Second Unit shall be architecturally compatible with the primary residence and the appearance of the building shall be that of a'single family dwelling. 3. The size of an attached Second Unit shall not exceed' 640 square feet or 30% of the size of the primary dwelling, whichever is greater, in no case shall the Second Dwelling Unit exceed 1200 square feet. A detached Second Unit shall not exceed 1200 square feet. 4. The parcel or lot upon which the Second Unit is to be located must meet the minimum acreage requirement for which the parcel or lot is zoned. 5. In addition to the off-street parking required for the primary dwelling, one off-street parking space shall be provided for Second Units of 640 square feet or less; two additional off street spaces shall be provided for larger units. 6. An attached or detached garage or carport with a maximum exterior dimension of 12' by 20' is permitted for Second Units of 640 square feet or less. A garage or carport with a maximum exterior dimension of 20' by 24' is permitted for larger Second Units. 7. Adequate sewer and potable water facilities shall be provided as determined by the Butte County Environmental Health Division. 8. A Second Unit may not be placed on a parcel or lot where a temporary mobile home, in accordance with Section 24-295 and 24-295.10, has been approved or on a lot that has more than 1 dwelling unit located upon it. 9. Either the existing single family dwelling or the Second Unit shall be owner occupied. Verification of ownership shall be required prior to permit issuance and annually thereafter by submittal of a declaration in a form specified by the Director of Development Services or designee. The applicant proposes a detached Second Unit on a 0.73 acre parcel which meets the requirements of the zone. The request can or does meet all of the other conditions. A garage (3 car) exists, and will comprise the bottom floor of the structure proposed for expansion for the Second Unit. AP 068-210-109 ASSESSOR'S PARCEL NO. Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions set forth below: Lloyd Hansen is hereby granted a Minor Use Permit in accordance with application filed: 7/5/95 to allow a second dwelling on property zoned A -R located at 21 Buehler Avenue, Oroville. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit, constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Section 24-62. 2. Unless otherwise provided for in a condition to a Minor Use Permit, all conditions must be completed by the permittee within 24 months of the delivery of the countersigned permit to the permittee. 3. If any use for which a Minor Use Permit has been granted is not established within two year of the date of receipt of the countersigned permit by the permittee, the permit shall be come null and void and reapplication shall be required to establish the use. 4. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. FINDINGS: Section 1: Environmental Findings. A. That the location, size, design, and operating characteristics of the proposed use will be compatible with and will not adversely affect or be materially detrimental to adjacent uses, residents, buildings, structures, or natural resources, with consideration given to: 1. Harmony in scale, bulk, coverage, and density; 2. The availability of public facilities, services and utilities; 3. The harmful effect, if any, upon desirable neighborhood character; 4. The generation of traffic and the capacity and physical character of surrounding streets; 5. The suitability of the site for the type and intensity of use of development which is proposed; 6. Any other relevant impact of the proposed use. C. That the proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or materially injurious to properties or improvements in the vicinity. D. That the proposed use will comply with each of the applicable provisions of the Chapter, except for an approved Minor Variance. Section 3: Action. A. Subject to the findings indicated in Sections 1 and 2 of this report, move to approve the Use Permit for Lloyd Hansen on AP# 068-210-109 to allow a Second Unit. Approval shall be subject to the following conditions: B. Minor changes may be approved administratively by the Director of Development Services, or designee, upon receipt of a substantiated written request by the applicant. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid, and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. We lived for twenty years at number Three Buehler Avenue. This address is also south of Buehler and West of Arbol. During all of the twenty years we lived at that address the water pressure was not sufficient for two water related events to be conducted simultaneously, especially in the summer months when water was used by all to irrigate the landscape. My question about this granting is concerned with the water pressure. Will there be enough for all of the needs during high demands. During the time we resided there we experienced a fire to the north of Buehler Avenue. No pressure at all was available during that disaster. We currently have a new structure, single family dwelling on number Seven Buehler Avenue. The space there would be'big enough to have a second unit although ofcourse it isn't zoned for that second unit. Is there enough road space, power supply, water pressure for this extra unit? Provide two additional off-street spaces. 3. An attached or detached garage or carport with a maximum exterior dimension 20' by 24' is permitted. 4. Adequate sewer and potable water facilities shall be provided as determined by the Butte County Environmental Health Division. 5. Either the existing single family dwelling or the Second Unit shall be owner occupied. Changes deemed to be major or significant in nature shall requite a formal application for amendment. Conditions of Approval: 1. The Second Unit shall not exceed 1200 square feet. 2. Provide two additional off-street spaces. 3. An attached or detached garage or carport with a maximum exterior dimension 20' by 24' is permitted. 4. Adequate sewer and potable water facilities shall be provided as determined by the Butte County Environmental Health Division. 5. Either the existing single family dwelling or the Second Unit shall be owner occupied. Verification of ownership shall be required prior to permit issuance and annually thereafter by submittal of a declaration in a form specified by the Director of Development Services or designee. 6. No permits for any additional dwelling may be approved unless the Second Unit is first removed. 7. Applicant will need to install septic system under permit from the Butte County Environmental Health Division. 8. Applicant must also comply with all other applicable State and local statutes, ordinances, and regulations. NOTE: Issuance of this Minor Use Permit does not waive requirement of obtaining Building and Health Department permits before starting construction and their approvals prior to use or occupancy, nor does it waive any other requirements.
