(SB) (MUP96-03) Stephen Betts said that concerns have been expressed about drainage coming onto a neighbor's']°j€� property. The second unit is an illegal, non -conforming use which the applicant wishes to expand, but cannot do so without a Minor Use Permit. There was a discussion of whether or not the second unit has an existing bathroom. Commissioner Cage noted that the applicant stated at the Planning Services Meeting that she is not putting in another bathroom. Commissioner Lynch said the letter of opposition was concerned about a second bathroom and a problem with septic. .Commissioner Seegert said,:that-the Crosbys were advised by the Building Dept. that the Masons were adding a bathroom, kitchen and bedroom. Commissioner Seegert said that might be ' difficult in 120 sq. ft. There was no one present to speak on this item. Commissioner Lambert said that the concern about drainage is a relevant impact which is not covered by a condition. Commissioner Seegert said it appears that the concern about drainage was resolved, and Mr. Hogan said at the previous meeting that "the drainage is covered by existing law and should not be a problem." 4 Commissioner Lynch noted that building permits do not allow drainage problems to be created It was moved by Commissioner Seegert, seconded by Commissioner Lynch, and carried unanimously for approval of the Shelly Mason Minor Use Permit subject to the findings and conditions contained in the Agenda Report dated November 1, 1995, noting that there should be no additional bathroom or kitchen facilities. Certification .of ownership shall be required prior to permit issuance and annually thereafter by submittal of a declaration in a form specified by the Director of Development Services or designee. 6. (SB) (MUP96-03) Mr. Hogan explained the Minor Use Permit process. He said N the application is recommended for approval it will be set on the consent portion of the next Planning Commission agenda for the final action. He said this is an application to legalize an already existing conversion of a garage into a second dwelling. This request is also to add to the conversion 120 square feet of living area. Mr. Hogan noted the receipt of a letter from Mr. Crosby stating concerns regarding drainage onto his property. Mr. Hogan said approval of. this permit will not allow an increase in drainage off-site. He said the 120 sq. ft. addition would add minimal runoff drainage. Ms. Mason said the dwelling already exists and she would like to add 120 square feet of living area. She said the dwelling has existing since before 1979. She said she is not adding another bathroom. She said she is trying to make the second dwelling legal. Mr. Hogan commented that one of the two dwellings will have to be owner occupied. Ms. Mason, the owner will be Irving in one of the dwellings. Ms. Mason said she has a building permit in process pending the approval of this Minor Use Permit, to bring the second dwelling up to Building Code. Mr. Crosby said he was concerned with drainage coming onto his property. Mr. Hogan said the drainage is adequately covered by existing law and should not be a problems. Mr. Hogan said the application meets the requirements for a second dwelling and he confirmed the action recommended in the staff report and requested this item be set for the next Planning Commission meeting of November 30, 1995. _ G Y Butte Co. Hogan, Planning Manager FROM: Stephen Betts, Assistant Planner DATE: November 1, 1995 0 AGENDA ITEM REQUEST: File # MUP 96-03 - Shelly Mason, APN 036-340-026: A request for a Minor Use Permit for a Second Dwelling on property zoned AR (Agricultural -Residential), located at 45 Inglewood Drive, Oroville, approximately 500 ft. South of Oroville-Garden Ranch Rd. This project is located in Supervisorial District 1. RELATED ITEMS: None FOR: Administrative Hearing for November 13, 1995 ABSTRACT: This request is for a Minor Use Permit for a Second Unit. The proposal conforms to the zoning and the General Plan. Staff recommends approval of this application. PROJECT CHARACTERISTICS: This request is for a Minor Use Permit to allow a Second Unit pursuant to Butte County Code Section 24-280 as amended by Ordinance 3176. The property is a.70 acre (30,492 sq. ft.) parcel and is zoned AR (Agricultural -Residential). The Land Use Element of the Butte County General Plan designates the property as Low -Density Residential. A 1,580 sq. ft. home is the primary residence. A 442 sq. ft. residence, which was converted from a garage sometime between the years .1957 and 1978, shares a common roof with the primary residence. The garage was converted to a residential use without the proper building permits and it is not known when the garage was converted. If it was prior to 1964, the date when the A -R zoning took effect; then the converted garage is a legal, non -conforming use and requires a Minor Use Permit for expansion of the residential use. If the garage was converted after 1964, then it is an illegal, non -conforming use and requires a Minor Use Permit for continued use as a second dwelling. The converted garage had been functioning as a second dwelling unit prior to the applicant purchasing the property in 1978. The applicant intends to expand the 442 sq. ft. converted -garage residence by 120 sq. feet. A 598 sq. ft. carport and a 504 sq. ft. workshop also occupy the site. Domestic water for both residences is obtained from the Oroville Wyandotte Irrigation District. An on-site septic tank and leachfield system handles sewage disposal for both residences. Surrounding parcels are zoned AR (Agricultural -Residential) and have a General Plan designation of Low -Density Residential. Surrounding parcels are similar in size to the subject parcel. ANALYSIS: This project will ensure that the 442 sq. ft. residence is a legal and conforming second dwelling unit and will allow expansion of this residence. The .70 acre parcel exceeds the minimum ■ Butte County Department of Development Services ■ Planning Division ■ AGENDA ITEM lot size requirements of the zone and the lot will not become overcrowded due to the second unit. There is adequate space for off-street parking for at least two vehicles for the second dwelling unit. No new vehicle traffic will be generated because the proposed second dwelling unit has already been functioning as a second dwelling unit for many years. This request is consistent with the intent and requirements of Section 24-280 of the Butte County Code. Upon review of this second unit application, staff has determined that the proposed second unit will not significantly impair the integrity of the zone in which it lies, nor will it be detrimental to the health, safety, and welfare of the intended occupants or the immediate neighborhood. ENVIRONMENTAL DOCUMENTATION: This application has been determined to be categorically exempt from the provisions of CEQA under a Class 3 exemption. PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be held. Notices of the hearing will be mailed to the nearest 10 property owners. RECOMMENDATION: Staff recommends that the Planning Commission approve the Minor Use Permit on APN 036-340-026, File # MUP 96-03, for Shelly Mason, subject to the findings and conditions listed in Exhibit A. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit, constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-45.65. 2. Unless otherwise provided for in a special condition to this use permit, all conditions must be completed by the Permittee within 12 months of the delivery of the countersigned permit to the Permittee. 3. If any use for which a use permit has been granted is not established within one year of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. 4. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. Section 1: Environmental Findings. A. This application for a Minor Use Permit to allow a Second Dwelling Unit is Categorically Exempt from environmental review; and Section 2: Zoning Ordinance Findings. A. The proposed location, size, design, and operating characteristics of the proposed use is in accordance with the purpose of Chapter 24 of the Butte County Code, the purpose of the zone in which the site is located, the Butte County General Plan, and the development policies and standards of the County; and B. The proposed location, size, design, and operating characteristics of the proposed use will be compatible with and will not adversely affect or be materially detrimental to adjacent uses, residents, buildings, structures or natural resources, with consideration given to: 1. Harmony in scale, bulk, coverage and density; 2. The availability of public facilities, services and utilities; 3. The harmful effect, if any, upon desirable neighborhood character; 4. The generation of traffic and the capacity and physical character of surrounding streets; 5. The suitability of the site for the type and intensity of use or development which is proposed; 6. Any other relevant impact of the proposed use. C. The proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it will be operated or maintained will not be detrimental to the public health, safety and general welfare, or materially injurious to properties or improvements in the vicinity; and D. The proposed use will comply with each of the applicable provisions of Chapter 24, . Section 280, of the Butte County Code. Section 3: Action. A. Subject to the findings indicated in Sections 1 and 2 of this Exhibit A, Minor Use Permit for Shelly Mason on APN 036-340-026 to allow a Second Unit is approved subject to the conditions listed herein. B. Minor changes may be approved administratively by the Director of Development Services, or designee, upon receipt of a substantiated written request by the applicant. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid, and environmentaldetermination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. C. . Conditions of Approval: 1. The Second Unit shall not exceed 1200 square feet. 2. Provide two additional off-street • spaces. 3. An attached or detached garage or carport with a maximum. exterior dimension 20' by 24' is permitted. 4. Adequate sewer and potable water facilities shall be provided under permit 2 as determined by the Butte County Environmental Health Division. 5. Either the existing single family dwelling or the Second Unit shall be owner occupied. Certification of ownership shall be required prior to permit issuance and annually thereafter by submittal of a declaration in a form specified by the Director of Development Services or designee. 6. No permits for any additional dwelling may be approved unless the Second Unit is first removed. 7. Applicant must also comply with all other applicable State and local statutes, ordinances, and regulations. The permit will be granted subject to the following conditions: 1. The Second Unit shall not exceed 1,200 square feet. 2. Provide two additional off-street spaces. 3. An attached or detached garage or carport with a maximum exterior dimension 20' by 24' is permitted. 4. Adequate sewer and potable water facilities shall be provided under permit as determined by the Butte County Environmental Health Division. 5. Either the existing single family dwelling or the Second Unit shall be owner occupied. Certification of ownership shall be required prior to permit issuance and annually thereafter by submittal of a declaration in a form specified by the Director of Development Services or designee. 6. No permits for any additional dwelling may be approved unless the Second Unit is first removed. 7. Applicant must also comply with all other applicable State and local statutes, ordinances, and regulations. NOTE: "Minor changes may be approved administratively by the Director of Development Services upon receipt of a substantiated written request by the applicant. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for an amendment." Persons wishing to comment on the project may submit written comments to the Butte County Planning Division any time prior to November 9, 1995. The Planning Manager shall consider all comments in determining if the application meets all of the above conditions and criteria. Upon finding that the proposed use does or will meet all of the conditions and criteria, the Planning Manager will hold a hearing on November 13, 1995 at 10:00 a.m. Any interested person may attend this hearing. The decision of the Planning Manager will be submitted, to the Planning Commission for final approval. South of Oroville-Garden Ranch Rd. This project is located in Supervisorial District 1. RELATED ITEMS: None FOR: Administrative Hearing for November 13, 1995 ABSTRACT: This request is for a Minor Use Permit for a Second Unit. The proposal conforms to the zoning and the General Plan. Staff recommends approval of this application. PROJECT CHARACTERISTICS: This request is for a Minor Use Permit to allow a Second Unit pursuant to Butte County Code Section 24-280 as amended by Ordinance 3176. The property is a.70 acre (30,492 sq. ft.) parcel and 'is zoned AR (Agricultural -Residential). The Land Use Element of the Butte County General Plan designates the property as Low -Density. Residential. A 1,580 sq. ft. home is the primary residence. A 442 sq. ft. residence, which was converted from a garage sometime between the years 1957 and 1978, shares a common roof with the primary residence. The garage was converted to a residential use without the proper building permits and it is not known when the garage was converted. If it was prior to 1964, the date when the A -R zoning took effect, then the converted garage is a legal, non -conforming use and requires a Minor Use Permit for expansion of the residential use. If the garage was converted after 1964, then it is an illegal, non -conforming use and requires a Minor Use Permit for continued use as a second dwelling. The converted garage had been functioning as a second dwelling unit prior to the applicant purchasing the property in 1978. The applicant intends to expand the 442 sq. ft. converted -garage residence by 120 sq. feet. A 598 sq. ft. carport and a 504 sq. ft. workshop also occupy the site. Domestic water for both residences is obtained from the Oroville Wyandotte Irrigation District. An on-site septic tank and leachfield system handles sewage disposal for both residences. Surrounding parcels are zoned AR (Agricultural -Residential) and have a General Plan designation of Low -Density Residential. Surrounding parcels are similar in size to the subject parcel. ANALYSIS: This project will ensure that the 442 sq. ft. residence is a legal and conforming second dwelling unit and will allow expansion of this residence. The .70 acre parcel exceeds the minimum ■ Butte County Department of Development Services ■ Planning Division ■ AGENDA ITEM lot size requirements of the zone and the lot will not become overcrowded due to the second unit. There is adequate space for off-street parking for at least two vehicles for the second dwelling unit. No new vehicle traffic will be generated because the proposed second dwelling unit has already been functioning as a second dwelling unit for many years. This request is consistent with the intent and requirements of Section 24-280 of the Butte County Code. Upon review of this second unit application, staff has determined that the proposed second, unit will not significantly impair the integrity of the zone in which it lies, nor will it be detrimental to the health, safety, and welfare of the intended occupants or the immediate neighborhood. ENVIRONMENTAL DOCUMENTATION: This application has been determined to be categorically exempt from the provisions of CEQA under a Class 3 exemption. PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be held. Notices of the hearing will be mailed to the nearest 10 property owners. The proposed location, size, design, and operating characteristics of the proposed use will be compatible with and will not adversely affect or be materially detrimental to adjacent uses, residents, buildings, structures or natural resources, with consideration given to: 1. 'Harmony in scale, bulk, coverage and density; 2. The availability of public facilities, services and utilities; 3. The harmful effect, if any, upon desirable neighborhood character; 4. The generation of traffic and the capacity and physical character of surrounding streets; 5. The suitability of the site for the type and intensity of use or development which is proposed; 6. Any other relevant impact of the proposed use. C. The proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it will be operated or maintained will not be detrimental to the public health, safety and general welfare, or materially injurious to properties or improvements in the vicinity; and D.
