(SB) (File MUP96-07) Stephen Betts explained that the previous second dwelling on the property was not done with an Administrative Permit. Actually the trailer had been installed in 1976 as a Permanent Second Unit without any type of Use Permit or Administrative Permit. The mobile home was removed in 1987 according to the owner. Environmental Health approved the application based upon the fact that the proposed Second Unit was replacing the mobile home, and also the previous mobile home was a two bedroom unit and the proposed dwelling is a one bedroom unit. The Building Dept. file did not have any records as to the actual date of removal of the mobile home. Mr. Nelson asked how the Nitrate Action Plan would allow a Second Dwelling. Mr. Betts said that he relied on the judgement of the Environmental Health Dept. which had approved the proposal with no conditions. VIDEO Mr. Hogan noted that this neighborhood has been identified as an area that might be sewered in the future. Mr. Farrel said that the Environmental Health Dept. is charged with reviewing permits within the context of the Nitrate Action Plan, and that department approved the proposal. There was discussion of possible future annexation of the property to the City of Chico or connection to city sewer. Commissioner Lynch said that the previous mobile home was removed, and there is no justification to recreate a situation that is not in conformance with the general neighborhood' of single family homes. Also there might be problems with a well and septic tank on such a small lot, even though the Environmental Health Dept. is not opposed and a 4 bedroom single family dwelling would create more effluent. Commissioner Lynch said he would not be opposed to a mobile home as an Aunt Minnie unit, but a permanent second dwelling would not fit into the neighborhood. HEARING OPEN TO THE PUBLIC BUTTE COUNTY PLANNIING COMMISSION MINUTES - JANUARY 11, 19996 Tony Sims, the applicant and builder, said that a 4 bedroom house could be built and would have more impact on the septic. There will be sufficient parking spaces. The house will be attractive and will add to the neighborhood. It,will be a small unit on a relatively large lot. The property owners want to turn the existing home into a rental unit. Commissioner Nelson objected to having Second Units in an R-1 zone. Mr. Sims said that the Chico General Plan encourages this type of land use at a greater density. Commissioner Nelson said he would feel better if he knew that community sewer and water were available within the next ten years. Commissioner Lambert said that the property is not within the City of Chico and does not have sewer and water services. Mr. Sims said he thought the County was going to let the City act like a City in this type of matter. Commissioner Lambert said that the only reason for this proposal is to create a rental. Mr. Kelly, the property owner, said they are not primarily interested in creating a rental. Mainly they would like to have a new house, but they do not need a rental. Ideally he would prefer to have a family member live in the second home. Commissioner Nelson thought that because the proposed new home would be smaller than the existing home, it appears that the desire is to create a rental. Mr. Kelly said that he and his wife do not need a two bedroom home. They would like to upgrade their living standard and live in a new home. Commissioner Cage asked if the Kellys had thought about adding on to their existing home or remodeling it. Mr. Kelly said they don't want a bigger house; they want a newer house. He pointed out that two homes have already been approved for the property -and used the existing septic t' system which was enlarged at the time the mobile home was installed. Mr. Hogan said that the law states that the application cannot be denied based on doubling of the zone. The comments by Commissioner Lynch about the character of the neighborhood and harmony, size,, bulk, and capacity of the site would be appropriate findings for denial and should be quite clear if the project is denied. Doubling of the zone is not a finding that can be made for denial according to Government Code. BUTTE COUNTY PLANNIING COMMISSION MINUTES - JANUARY,11, 19996 • Mr. Farrel asked if this item could be appealed to the Board of Supervisors? Mr. Hogan said that basically an appeal could be made to the Board of Supervisors. Mr. Farrel agreed that Second Units are allowed in this zone. Any findings for denial should be carefully made. The project must comply with Condition 4 to provide adequate L sewer and water facilities. The only room for discretion is neighborhood compatibility. Commissioner Nelson said that this appears to be a "rubber stamp issue." Chairman Seegert said that the main concern was the adequacy of the well and septic _ on a parcel of this size. Mr. Farrel said that two small homes on almost half an acre is not high density. He did, not feel it is good to make policy in the midst of a current application. Commissioner Nelson said that it would be necessary to change the rules in order to avoid this type of land use. Commissioner Lynch said the only basis for denial would be neighborhood incompatibility. Commissioner Cage asked if a precedent has been set in denials or approvals of this type of request? Mr. Hogan said that two requests were changed to Aunt Minnie's. There have been no denials of Second Units since February 1995. If the request is not approved, staff -would appreciate specific findings so future applicants and staff can be aware ,of the specific issues. �. Commissioner Lambert said that the Commission has indicated its unhappiness with. Second Units; but -has been advised'by,staff that there Was' -very little -to do about it, or could not make specific findings. Although requests have not been denied, it hasn't been _ because the Commission didn't want to makedenials of Second Units. Commissioner Cage asked if the lot could be split after a second home is built. Commissioner Lynch said that the adjacent lot has been split. Mr. Farrel said that the potential for splitting the lot would be controlled by other requirements and would not be affected by any action taken today on the Second Dwelling. T� BUTTE COUNTY PLANKING COMMISSION MINUTES - JANUARY 11, 19996 Mr. Hogan pointed out that if the request is denied, the second residence could be built on the property and attached to the existing house, although without kitchen facilities. Commissioner Lambert said that findings stated by Commissioner Lynch and the single. family character of the neighborhood would be adequate grounds for denial as well as consideration of the Nitrate Action Plan. Commissioners Nelson and; Lynch believed that based on the findings of the Environmental Health Department, the Nitrate Action Plan could not be a basis for denial of the application. Commissioner Lynch said that no one from the neighborhood is present to address the issue and he doubts that a strong legal finding can be made for neighborhood incompatibility. Chairman Seegert said his main concern was conflict with the Nitrate Action Plan, but if the Environmental Health Dept. has no problem then that addresses his concern. Commissioner Lynch asked if the square footage of the existing housing on the property would be unchanged. Mr. Hogan said that a Minor Use Permit cannot restrict future additions to the primary dwelling. With Environmental Health clearance a 4 bedroom unit could possibly be built. Mr. Farrel said the applicant could voluntarily agree to limit the size of the unit. Commissioner Lynch noted he would vote reluctantly in favor of the request. Commissioner Lambert noted that the Environmental Health Dept. and County Counsel should be present for the workshop on Second Units. It was moved by Commissioner Nelson, seconded by Commissioner Cage, and carried for approval of the Minor Use Permit for Agasy subject to the findings and conditions of the Agenda Report of November 28, 1995, by the following vote: AYES: Commissioners Nelson, Cage, Lynch and Chairman Seegert NOES: Commissioner Lambert ABSENT: No one ABSTAIN: No one -- ---- ----- - FINDINGS: - -- Section 1: Environmental Findings. A. This application for a Minor Use Permit to allow a Second Dwelling Unit is Categorically Exempt from environmental review; and BUTTE COUNTY PLANNIING COMMISSION MINUTES - JANUARY 11, 19996 Section 2: Zoning Ordinance Findings. A. - Therproposed location, size, design, and operating characteristics of the proposed use is in accordance with the purpose of Chapter 24 of the Butte County Code, the purpose of the zone in which the site is located, the Butte County General Plan, and the development policies and standards of the County; and B. The proposed location, size, design, and operating characteristics of the proposed use will be compatible with and will not adversely affect or be materially detrimental to adjacent uses, residents, buildings, structures or natural resources, with consideration given to: 1. Harmony in scale, bulk, coverage and density; 2. The availability of public facilities, services and utilities; 3. The harmful effect, if any, upon desirable neighborhood character; 4. The generation of traffic and the capacity and physical character of surrounding streets; 5. The suitability of the site for the type and intensity of use or development which is proposed; 6. Any other relevant impact of the proposed use. C. The proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it will be operated or maintained will not be detrimental to the public health, safety and general welfare, or materially injurious to properties or improvements in the vicinity; and D. The proposed use will comply with each of the applicable provisions of Chapter 24, Section 280, of the Butte County Code. ' Section 3: Action. A. Subject to the findings indicated in Sections 1 and 2 of this Exhibit A, Minor Use, Permit for Larry and Shirley Kelly on APN 005-382-02 to allow a Second Unit is approved subject to the conditions listed herein. B. Minor changes may be approved administratively by the Director of Development Services, or designee, upon receipt of a substantiated written request by the applicant. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid, and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. BUTTS COUNTY' PLANNI ING COMMISSION MINUTES-­yJA5[6ARY-11;-19996 C. Conditions of Approval: 3 1. The Second Unit shall not exceed 1200 square feet. 2. Provide two additional off-street spaces. 3. An attached or detached garage or carport with a maximum exterior dimension 20' by 24' is permitted. 4. Adequate sewer and potable water facilities shall be provided under permit as determined by the Butte County Environmental Health Division. 5. Either the existing single family dwelling or the Second Unit shall be owner occupied. Certification of ownership shall be required prior to permit issuance and annually thereafter by submittal of a declaration in a form specified by the Director of Development Services or designee. 6. No permits for any additional dwelling may be approved unless the Second Unit is first removed. 7. Applicant must also comply with all other applicable State and local statutes, ordinances, and regulations. NOTE: Issuance of this permit does not waive the requirement of obtaining Building Division and Environmental Health Division permits before starting construction, nor does it waive any other requirements of federal, state, and local law. (SB) (File MUP96-07) This item was pulled from the Consent Agenda. There was a discussion of the procedures involved with pulling an item from the Consent Agenda and what is required in order to hold the item as a public hearing. Mr. Farrel said that if- any action is taken which is different from the recommendation of the Planning Manager, the item must be removed from the Consent Agenda, set for public hearing and properly noticed. The noticed hearing was the one conducted by the Planning Manager. The item can be discussed and information obtained at this hearing. The item must be set for public hearing if the intent is to take an action different from the recommended action. Mr. Farrel explained that the process for Minor Use Permits was set up in order to expedite the process by granting broader administrative authority for permit items to staff. This is a hybrid situation, in that staff advertises the item and reviews it, but the Planning Commission wants to review it. If items are pulled from the Consent Agenda, there will be ardelay because there will have to be two public hearings. Mr. Farrel suggested that either staff takes responsibility for ' hearing the items, or the items come directly to the Planning Commission in the first place. Chairman Nelson felt that it should be possible to hold a public hearing on a Consent item Commissioner Lynch said that one situation they had been trying to correct, was that it was easier to get a -permanent second dwelling than a temporary second dwelling. Commissioner Cage said that the items are not really "minor" items. There was a consensus that it might be preferable to have the Planning Commission be the hearing body for second dwellings. Commissioner Lambert said that it might be necessary to challenge the ruling that came from the State. It had been thought that the items must be approved so staff might as well handle them. Mr. Farrel noted that density per se cannot be used as the basis for determining if second units can be allowed. J There was a consensus that the subject of second units should be discussed as a workshop item in the future. BUTTE COUNTY PLANKNG'-COMMISSION MINUTES - December 14, 1995 0 9 Commissioner Lambert said County Counsel should be contacted and present at the workshop. Commissioner Lynch said that a finding should be made if the item is scheduled for a public r hearing. - , . - , Mr. Farrel said that neighborhood compatability might be the type of finding that could be made. Commissioner Lambert agreed with that statement. She said that although the state requires that second units be allowed, the state has also required the Nitrate Action Plan in the Chico area. Commissioner Nelson felt that second units should be allowed, but not everywhere on every parcel. Commissioner Lambert said that Minor Use Permits should have one hearing before the Planning Commission. Chairman Nelson felt the Nitrate Action Plan should be taken into consideration with second units in the Chico area. Commissioner Lynch felt the lot would be too small for an additional well and septic and should be discussed in a public hearing. The well should be abandoned and the dwelling connected to California Water Service. The item should have a public.hearing to consider the issue of a well and septic tank on an 18,000 sq. ft. lot. Steve Betts, Planner, said that the Environmental Health Dept. determines the adequacy of the acreage for sanitation purposes. Commissioner Cage felt that a five person hearing could be more specific than a one person hearing. Mr. Farrel noted that there is standard condition in the Agenda Report which addresses the sewer and water issues. He noted that this discussion can take place, but if the proposal is changed or denied, a public hearing would be required. Mr. Seegert asked if the proposed second unit is to replace a previously existing dwelling? Mr. Betts said that there was formerly an Administrative Permit for an Aunt Minnie type of mobile home, which has been removed. Commissioner Lambert felt that the neighborhood would be very interested in this item and for that reason also, there should be a public hearing. BUTTE -"COUNTY. DATE: January 1, 1996 The Consent Agenda Item for a Minor Use Permit for a second dwelling unit located as 973 Ohio St., Chico (Chapmantown) was pulled by the Planning Commission from the December 11, 1995, consent agenda, and set for a public hearing on January 11, 1996. The Planning Commission has several concerns about the proposed second dwelling, especially the possibility of increased nitrates from the septic system and compatibility with the neighborhood., DISCUSSION: The proposed second unit will be a 911 sq. ft. one -bedroom house. Two dwelling units were at one time located on the project site: the existing dwelling unit and a two- bedroom mobile home. The mobile home was installed in 1976 and was removed in 1987. The proposed second dwelling will occupy the same site as the removed mobile home. The septic system was approved by the Butte County Environmental Health Department for hookup to the existing dwelling unit and the mobile home. The project site is located within the Chico Nitrate Plan area. The Plan does not allow more than one dwelling per parcel on parcels that are less than one acre. The project parcel is .39 acre in size. The mobile home was installed prior to implementation of the Chico Nitrate Plan. The proposed second unit will be a "stick -built" house, which is much more attractive than a standard mobile home and is more harmonious with the other dwelling units in the neighborhood. The Environmental Health Department approved the proposed second unit based on the fact that the proposed unit was replacing the mobile home. The proposed second dwelling unit, with one bedroom, should generate less sewage, hence fewer nitrates, then the two-bedroom mobile home did. It should be noted that there were no letters received for or against this application, nor were there any neighbors present at the Planning Manager's hearing. RECOMMENDATION: Approve the Minor Use Permit with the Conditions contained in the November 28, 1995 Agenda Report. The proposed location of the second dwelling will be outside of the required setbacks for the A -R zone. There is adequate space for two off-street parking spaces for the second dwelling unit. New vehicle traffic generated by the addition of a new dwelling unit will be minimal and will not have a significant impact on area streets. The second dwelling has been approved for hookups to the existing well and existing septic system by the Butte County Environmental Health Department. This request is consistent with the intent and requirements of Section 24-280 of the Butte County Code. The proposed location, size, design, and operating characteristics of the proposed use is in accordance with the purpose of Chapter 24 of the Butte County Code, the purpose of the zone in which the site is located, the Butte County General Plan, and the development policies and standards of the County; and B. The proposed location, size, design, and operating characteristics of the proposed use will be compatible with and will not adversely affect or be materially detrimental to adjacent uses, residents, buildings, structures or natural resources, with consideration given to: 1. Harmony in scale, bulk, coverage and density; 2. The availability of public facilities, services and utilities; 3. The harmful effect, if any, upon desirable neighborhood character; 4. The generation of traffic and the capacity and physical character of surrounding streets; 5. The suitability of the site for the type and intensity of use or development which is proposed, 6. Any other relevant impact of the proposed use. C. The proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it will be operated or maintained will not be detrimental to the public health, safety and general welfare, or materially injurious to properties or improvements in the vicinity; and D. The proposed use will comply with each of the applicable provisions of Chapter 24, Section 280, of the Butte County Code. Section 3: Action. A. Subject to the findings indicated in Sections 1 and 2 of this Exhibit A, Minor Use Permit for Larry and Shirley Kelly on APN 005-382-02 to allow a Second Unit is approved subject to the conditions listed herein. B. Minor changes may be approved administratively by the Director of Development Services, or designee, upon receipt of a substantiated written request by the applicant. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid, and environmental determination as conditionally approved.
