Ms. Nunez said she would never have applied for and paid for this Minor Use Permit if she had realized she did not qualify for it. The neighbors will come to speak in her support if necessary. Dan Jenks, 13378 Sheep Hollow Creek Road, said that the Nunez are great neighbors , and he and Mr. Courtain are not opposed to the rental. There are certain restrictions on the lots as to minimum house size. The problem which exists was begun by the County allowing the second unit to be built in the first place. Now the other neighbors want to build rentals also. The issue has created dissension in the neighborhood. He suggested that mother-in-law units should be allowed only as mobile homes, so they ' could easily be removed. Mr. Jenks and Mr. Courtain are not opposed to the Nunez i rental. y HEARING CLOSED TO THE PUBLIC i Commissioner Nelson said that although there is a problem with second dwellings, he was not opposed to this request. Commissioner Lynch said that this rental was legally installed and now the applicant is caught between County regulations and age discrimination laws. The house is a permanent structure and the only change would be to allow renters younger than 62 years of age. He was in favor of granting this request, but not allowing the situation to occur in the future. Commissioner Cage asked if the owner is proposing to enlarge the home. Ms. Nunez said they are not going to enlarge the home. Chairman Seegert was not opposed to the request for several reasons including: the neighbors are generally not in opposition, the structure is permanent, proper procedures have been followed, and an age requirement would be inconsistent with the revised zoning ordinance. ' Commissioner Lambert was not opposed to this particular request, but said that the Second Unit Ordinance should be changed as soon as possible. t . Commissioner Lynch said that a problem arose when it became easier to get a permanent second dwelling than an Aunt Minnie. It was moved by Commissioner Nelson, seconded by Commissioner Lambert, and carried unanimously, for approval of the Minor Use Permit for Luis and Rosalva Nunez pursuant to the findings and conditions of the Agenda Report. BUTTE COUNTY PLANNING COMMISSION MINUTES - MARCH 14, 1996 There was a consensus that approval of this MUP was not intended to set a precedent, and the second unit ordinance was in need of immediate revision, with public hearings for Minor Use Permits for second units being necessary until the revisions to the ordinance are accomplished. ; FINDINGS: Section 1: Environmental Findings. A. This application for a. Minor Use Permit to allow a Second Dwelling Unit is Categorically Exempt from environmental review; and Section 2: Zoning Ordinance Findings. A. The proposed location, size, design, and operating characteristics of the proposed use is in accordance with the purpose of Chapter 24 of the Butte County Code, the purpose of the zone in which the site is located, the Butte County General Plan, and the development policies and standards of the County; and B. The proposed location, size, design, and operating characteristics of the proposed use will be compatible with and will not adversely affect or be materially detrimental to adjacent uses, residents, buildings, structures or natural resources, with consideration given to: 1. Harmony in scale, bulk, coverage and density; 2. The availability of public facilities, services and utilities; 3. The harmful effect, if any, upon desirable neighborhood character; 4. The generation of traffic and the capacity and physical character of surrounding streets; 5. The suitability of the site for the type and intensity of use or development which is proposed; 6. Any other relevant impact of the proposed use. C. The proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it will be operated or maintained will not be detrimental to the public health, safety and general welfare, or materially injurious to properties or improvements in the vicinity; and D. The proposed use will comply with each of the applicable provisions of, Chapter 24, Section 280, of the Butte County Code. B. Minor changes may be approved administratively by the Director of Development Services, or designee, upon receipt of a substantiated written request by the applicant. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid, and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. C. Conditions of Approval: " 1. The Second Unit shall not exceed 1200 square feet. 2. Provide two additional off-street spaces. 3. An attached or detached garage or carport with a maximum exterior dimension 20' by 24' is permitted. 4. Adequate sewer and potable water facilities shall be provided under permit as determined by the Butte County Environmental Health Division. 5. Either the existing single family dwelling or the Second Unit shall be owner occupied. Certification of ownership shall be required prior to permit issuance and annually thereafter by submittal of a declaration in a form specified by the Director of Development Services or designee. 6. No permits for any additional dwelling may be approved unless the Second Unit is first removed. 7. Maintain a defensible space around both dwellings per PRC 4291. 8. CONSENT AGENDA — Luis and Rosalva Nunez - (Item determined to be categorically exempt from environmental review) Minor Use Permit to allow a second dwelling on property zoned SR -3 (Suburban Residential- 3 acre parcels) located on the northeast corner of Sheephollow Creek Road and Allison Meadows Road, at 3010 Allison Meadow Road, identified as AP 048-010-045, Chico. (MUP96-08) (SB) There was a consensus that this item should be pulled from the Consent Agenda for further discussion, and possibly be set for a public hearing. It was noted. that some letters of opposition have been received. Luis and Rosalva Nunez - (item determined to be categorically exempt from environmental review) Minor Use Permit to allow a second dwelling on property zoned SR -3 (Suburban Residential - 3 acre parcels) located on the northeast corner of Sheephollow Creek Road and Allison Meadows Road, at 3010 Allison Meadow Road, identified as AP 048-010-045, Chico. (MUP96-08) (SB) It was noted that the request would eliminate the requirement for occupancy of the Second Unit by a person 62 years of age or older. Mr. Farrel noted that the new ordinance allows for more flexibility. Commissioner Nelson said the Second Unit is in conflict under the CC&Rs of the subdivision. Mr. Farrel said that CC&Rs could be considered as an indication of "neighborhood_ character." Commissioner Lynch said that the County cannot enforce CC&Rs but should not "fly in the face of them" without a legitimate reason. The CC&Rs should be examined in terms of "neighborhood character." Commissioner Lambert noted that the Commission has been advised in the past that Second Unit requests cannot really be denied. Since a Second Unit has already been granted, is the Commission required to grant a second request? Mr. Farrel said that if this request is denied, the unit could remain under its current permit. Commissioner Lambert was not iri favor of the proposal, and said that if necessary, a public hearing should be Held to receive public- comments to review letters received in opposition. BUTTE -COUNTY PLANNING COMMISSION MINUTES - February 8, 1996 Chairman Seegert said that the circumstances for an Aunt Minnie can be entirely different from those for a Second Unit, and he would not necessarily be in favor of approving such a change. What may be -allowed as a temporary situation by neighbors, might not be something they would want as a permanent situation. Commissioner Lambert noted that the original permit was for a permanent senior unit, not an Aunt Minnie. Commissioner Lynch noted that it used to be easier and cheaper to obtain a permit for a permanent second dwelling than an Aunt Minnie. He felt that to allow this type of change from senior unit to second unit would set a precedent, and should not be approved. The unit can currently be rented to one or two people 62 years of age or older and should not be changed. The rules for second units might be revised within the next few months. It was agreed that in order to take any action other than that recommended by the Planning Manager, would require a public hearing. ommissioner Cage thought that CC&Rs could be taken into consideration regarding this request. Mr. Betts said that CC&Rs are a private matter between homeowners. Chairman Seegert said that CC&Rs would indicate neighborhood character. Commissioner Lynch said there is a difference between enforcing CC&Rs and being informed about them. It would have been helpful if the opponents of this request had provided a copy of the CC&Rs. Mr. Farrel noted that the applicants have made an honest attempt to come forward to obtain a proper permit. It is likely that there are senior units being used as rentals without the proper permits. He suggested that perhaps, rather than setting a public hearing, maybe the item should be continued to a future date until the issue of second units is settled. Commissioner Lambert felt that the age restrictions would be less objectionable to a neighborhood than a rental with no restrictions. Commissioner Lynch suggested asking the applicant if she would prefer to.wait for a decision until after the second unit ordinance is revised. Commissioner Lambert asked if the ordinance is changed, if the applicant would have to pay new fees? BUTTE COUNTY -PLANNING -COMMISSION MINUTES - February 8, 1996 0 Mr. Farrel said it should not be necessary for the applicant to pay new fees. He noted that the item could be set for public hearing and then continued to a later date. It was moved by Commissioner Lynch, seconded by Commissioner Lambert, and carried unanimously, to remove the Nunez item from the Consent Agenda, and to set a public hearing for March 14, 1996, at 9:00 a.m. Chairman Seegert said that in light of the CC&Rs he would not have voted for the original permit. Commissioner Nelson was not in favor of putting the applicant indefinitely "on hold." Mrs. Nunez, the applicant, said that there is no homeowners association as claimed in the letter by Royal Courtain. Mrs. Nunez presented a letter signed by every neighbor except two. She said the other neighbors are upset that Mr. Courtain sent a letter representing a homeowners association which they are not -a part of and neither are there CC&Rs. The neighbors held a meeting and Mr. Courtain was also at the meeting and said he no longer has a problem with the rental unit. The neighbors do not have a problem with the rental unit. Other neighbors are renting with no permits, whereas Mrs. Nunez is trying to do it legally. The only agreement which Mr. Courtain is involved with is the road maintenance agreement, which he seems to think constitutes a homeowners association. Mrs. Nunez' letter is signed by ten neighbors. Hogan, Planning Manager FROM: Stephen Betts, Assistant Planner DATE: January 3, 1996 REQUEST: File # MUP 96-08 - Rosalva and Luis Nunez (Applicant/Owner), APN 048-010-045: A request for a Minor Use Permit for a Second Dwelling on property zoned SR -3 (Suburban -Residential 3 -acre minimum parcel size), located on the northeast corner of Sheephallow Creek Rd. and Allison Meadows Rd., at 3010 Allison Meadow Rd., Chico. This project is located in Supervisorial District 3. RELATED ITEMS: None FOR: Administrative Hearing for January 22, 1996 SUMMARY: This request is for a Minor Use Permit for a Second Unit. The proposal conforms to the zoning and the General Plan. Staff recommends approval of this application. PROJECT CHARACTERISTICS: This request is for a Minor Use Permit to allow a Second Unit pursuant to Butte County Code Section 24-280 as amended by Ordinance 3176. The second dwelling already exists, for which an Administrative Permit for a senior citizen dwelling was granted in September, 1994. The property is a 3.53 acre parcel and is zoned SR -3 (Suburban -Residential 3 -acre minimum parcel size). The Land Use Element of the Butte County General Plan designates the property as Agricultural -Residential. A 2,600 sq. ft. primary home, and a 850 sq. ft. senior citizen home occupies the site. Domestic water for the two residences is obtained from wells located on the project parcel. Individual on-site septic tanks and leachfield systems handle sewage disposal for the two residences. Surrounding parcels are zoned SR -3 and A-40, and have a General Plan designation of Agricultural -Residential and range in size from 3 to 70 acres. Surrounding land use is suburban residential and grazing/open land. ANALYSIS: This project will allow the already -existing 850 sq. ft. senior citizen house to be converted to a second dwelling unit. The Administrative Permit for the 850 sq. ft. dwelling unit currently allows only people of age 62 or older to live in it. The Minor Use Permit will allow the applicant to rent out the second dwelling to a person of any age. The 3.53 acre parcel exceeds the minimum lot size requirements of the SR -3 zone and is not overcrowded due to the second unit. The location of the second dwelling is outside of the required setbacks for the SR -3 zone. There is adequate space for two off-street parking spaces for the second dwelling unit. New vehicle traffic, if any, generated by the conversion of the senior citizen dwelling to a second dwelling will not have a ■ Butte County Department of Development Services ■ Planning Division ■ 11 AGENDA ITEM significant impact on area streets. The California Department of Forestry has requested that the applicant maintain a "defensible space" around both dwellings per Public Resources Code 4291. This request is consistent with.the intent and requirements of Section 24-280 of the Butte County Code. Upon review of this second unit application, staff has determined that the proposed second unit will not significantly impair the integrity of the zone in which it lies, nor will it be detrimental to the health, safety, and welfare of the intended occupants or the immediate neighborhood. ENVIRONMENTAL DOCUMENTATION: This application has been determined to be categorically exempt from the provisions of CEQA under a Class 3 exemption. PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be held. Notices of the hearing will be mailed to the nearest 10 property owners. RECOMMENDATION: Staff recommends that the Planning Commission approve the Minor Use Permit on APN 048-010-045, File # MUP 96-08, for Rosalva and Luis Nunez, subject to the findings and conditions listed in Exhibit A. Chico. (MUP96-08) (SB) Mr. Sanders -noted two letters were received in opposition to a rezone from Royal Courtain and Dan & Kathy :Jenks. He said that both correspondents live on Sheephallow Creek Road -in the Sheephallow Creek .Subdivision. He said the letters were opposed to a second unit. Mr. Sanders pointed out that this is a request for a second unit and *not a rezone. He said the use is allowed pursuant to State Law and the County Code Section pertaining to second dwelling and he did not feel these laws could be overridden by CC&Rs on the property. He said this project meets the requirements of the Second Unit Ordinance. He said the effect of this change will be to take away the age restriction of the current second unit. Mr. Sanders recommended to the Planning Commission that the Minor Use Permit for Luis and Rosalva Nunez be approved subject to the findings and conditions listed in Exhibit A and the item be scheduled for the February 8, 1996 Planning Commission Consent Agenda. If the Planning Commission concurs with the recommendation, the Permit can be issued. There is no appeal for Minor Use Permit decisions. II. The proposed location, size, design, and operating characteristics of the proposed use will be compatible with and will not adversely affect or be materially detrimental to adjacent uses, residents, buildings, structures or natural resources, with consideration given to: 1. Harmony in scale, bulk, coverage and density; 2. The availability of public facilities, services and utilities; 3. The harmful effect, if any, upon desirable neighborhood character; 4. The generation of traffic and the capacity and physical character of surrounding streets; 5. The suitability of the site for the type and intensity of use or development which is proposed; 6. Any other relevant impact of the proposed use. C. The proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it will be operated or maintained will not be detrimental to the public health, safety and general welfare, or materially injurious to properties or improvements in the vicinity; and D.
