Mr. Betts gave a brief summary of the project. He said the applicant has stated there are
no CC&Rs. He said staff received a copy of Page 1 of the CC&Rs. He said the applicant
does not want a mobile home because he needs wheelchair access. ,
The hearing was opened to the public.
Mr. Schuster said Mr. Casper is ill and wishes to remain with his family. He said the
applicant has agreed to remove the kitchen when Mr. Casper is gone and turn the building
into a pool or guest house and is asking for approval.
The hearing was closed.
It was moved by Commissioner Lambert, seconded by Commissioner Nelson, and
unanimously carried for approval adding a condition to "reconstruct the residence to meet
the requirements of a guest house or other legal accessory building when no longer
occupied by Mr. Casper." subject to the findings and conditions in Exhibit A as follows:
Section 1: Environmental Findings.
A. This application for a Minor Use Permit to allow a Second Dwelling Unit is
Categorically Exempt from environmental review; and
Section 2: Zoning Ordinance Findings.
A. The proposed location, size, design, and operating characteristics of the
proposed use is in accordance with the purpose of Chapter 24 of the Butte
County Code, the purpose of the zone in which the site is located, the Butte
County General Plan, and the development policies and standards of the
County; and
B. The proposed location, size, design, and operating characteristics of the
proposed use will be compatible with and will not adversely affect or be
materially detrimental to adjacent uses, residents, buildings, structures or
natural resources, with consideration given to:

1. Harmony in scale, bulk, coverage and density;
►- 2. The availability of public facilities, services and utilities;
3. The harmful effect, if any, upon desirable neighborhood character;
4. The generation of traffic and the capacity and physical character of
surrounding streets;
5. The suitability of the site for the type and intensity of use or
development which is proposed;.
6. Any other relevant impact of the proposed use.
C. The proposed location, size, design, and operating characteristics of the
proposed use and the conditions under which it will be operated or
maintained will not be detrimental to the public health, safety and general
welfare, or materially injurious to properties or improvements in the vicinity;
and
D. The proposed use will comply with each of the applicable provisions of
Chapter 24, Section 280, of the Butte County Code.
Section 3: Action.
A. Subject to the findings indicated in Sections 1 and 2 of this Exhibit A, Minor
Use Permit for Sharon Casper on APN 039-520-021 to allow a Second Unit
is approved subject to the conditions listed herein.
B. Minor changes may be approved administratively by the Directors of
Development Services, Environmental Health, or Public Works upon receipt
of a substantiated written request by the applicant and only as to those
conditions or requirements recommended by their respective departments.
Prior to such approval, verification shall be made by each Department or
Division that the modification is consistent with the application, fees paid and
environmental determination as conditionally approved. Changes deemed
to be major or significant in nature shall require a formal application for
amendment.
C. Conditions of Approval:
1. The Second Unit shall not exceed 1200 square feet.
2. Provide two additional off-street spaces.
3. An attached or detachbd garage or carport with a maximum exterior
dimension 20' by 24' is permitted.

4. Adequate sewer and potable water facilities shall be provided under
permit as determined by the Butte County Environmental Health
Division. Applicant must apply for a permit to install an on-site sewage —.
disposal system for the second dwelling and hook-up to the Durham
Irrigation District for domestic water.
5. Either the existing single family dwelling or the Second Unit shall be
owner occupied. Certification of ownership shall be required prior to
permit issuance and annually thereafter by submittal, of a declaration
in a form specified by the Director of Development Services or
designee.
6. No permits for any additional dwelling may be approved unless the
Second Unit is first removed.
7. In lieu of a pressurized water system or water storage tank, payment
of $200.00 per new dwelling unit into the Battalion 3 water tender
fund, is required prior to the issuance of a building permit.
8. Provide an all weather access to all structures, which is designed to
carry a 40,000 pound fire apparatus at least 10 feet wide with a 15
foot vertical clearance.
9. The second dwelling unit shall be architecturally compatible with the
main house.
10. Reconstruct dwelling to meet requirements of guest house or other
legal accessory building when no longer occupied by Ronald C.
Casper.
11. Applicant must also comply with all other applicabld'State and local
statutes, ordinances, and regulations.

accessible unit for her ailing father. Mrs. Casper's father has an ever.advancing
case of Parkinson's and will be confined to a wheel chair very soon. The '
Casper's have a full time nurse in their home now to care for Mr. Caspers. It is
our intention, since the existing home's bathrooms and halls were not set up. for
a wheel chair, to build a two bedroom 1 bath (792 sqft) with a kitchenette. This
new building will be fully handicap equipped for all his future needs. Mr.
Caspers and his nurse will be residing in the new unit Your timely processing

Chico Municipal Airport. Disclosure measures shall be in place before any lots are sold and
include: the existence of avigation easements, the existing and projected future overflight and
noise levels, and such related issues as are appropriate to fully inform such prospective
homebuyer or rental tenant. Enhanced disclosure may be modeled on Butte County Code,
Chapter 35 Protection of Agricultural Land. NCSP
11. Street trees and shading requirements apply to all new development. Street trees must be
planted within six months of the completion of streets. Local street species can be selected by
the developer and property owners. Trees should have a spreading structure and be planted
30 to 50 feet apart depending on species. Submit a landscaping plan to the Planning Division

Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special
conditions set forth below: Sharon Caspers is hereby granted a Minor Use Permit in accordance
with the application filed February 15, 1996 to allow. a second unit on property zoned SR -1
located at 9656 Teal Lane, Durham.
Failure to comply with the conditions specified herein as the basis for approval of
application and issuance of Permit, constitutes cause for the revocation of said
permit in accordance with the procedures set forth in the Butte County Zoning
Ordinance, including Butte County Code Sec. 24-45.65.
2. Unless otherwise provided for in a special condition to this Minor Use Permit, all
conditions must be completed by the Permittee within 24 months of the delivery of
the countersigned permit to the Permittee.
3. If any use for which a Minor Use Permit has been granted is not established within
two years of the date of receipt of the countersigned permit by the Permittee, the
permit shall become null and void and reapplication and a new permit shall be
required to establish the use.
4. The terms and conditions of this permit shall run with the land and shall be binding
upon and be to the benefit of the heirs, legal representatives, successors, and
assigns of the Permittee.
FINDINGS:
Section 1: Environmental Findings.
A. This application for a Minor Use Permit to allow a Second Dwelling Unit is
Categorically Exempt from environmental review; and
Section 2: Zoning Ordinance Findings.
A. The proposed location, size, design, and operating characteristics of the proposed
use is in accordance with the purpose of Chapter 24 of the Butte County Code, the
purpose of the zone in which the site is located, the Butte County General Plan,
and the development policies and standards of the County; and
B. The proposed location, size, design, and operating characteristics of the proposed
use will be compatible with and will not adversely affect or be materially
detrimental to adjacent uses, residents, buildings, structures or natural resources,
with consideration given to:
1. Harmony in scale, bulk, coverage and density;
2. The availability of public facilities, services and utilities;
3. The harmful effect, if any, upon desirable neighborhood character;
4. The generation of traffic and the capacity and physical character of
surrounding streets;
5. The suitability of the site for the type and intensity of use or development
which is proposed;
6. Any other relevant impact of the proposed use.
C. The proposed location, size, design, and operating characteristics of the proposed
use and the conditions under which it will be operated or maintained will not be
detrimental to the public health, safety and general welfare, or materially injurious
to properties or improvements in the vicinity; and
D. The proposed use will comply with each of the applicable provisions of Chapter 24,
Section 280, of the Butte County Code.
Section 3: Action.
A. Subject to the findings indicated in Sections 1 and 2 of this Exhibit A, Minor Use
Permit for Sharon Caspers on APN 039-520-021 to allow a Second Unit is
approved subject to the conditions listed herein.
B. Minor changes may be approved administratively by the Directors of Development
Services, Environmental Health, or Public Works upon receipt of a substantiated
written request by the applicant and only as to those conditions or requirements
recommended by their respective departments. Prior to such approval, verification
shall be made by each Department or Division that the modification is consistent
With the, application, fees paid and environmental determination. as conditionally
approved. Changes deemed to be major or significant in nature shall require a
formal application for amendment.
C. Conditions of Approval:
The Second Unit shall not exceed 1200 square feet.
2. Provide two additional off-street spaces.
3. An attached or detached garage or carport with a maximum exterior
dimension 20' by 24' is permitted.
4. Adequate sewer and potable water facilities shall be provided under permit
as determined by the Butte County Environmental Health Division.
Applicant must apply for a permit to install an on-site sewage disposal
system for the second dwelling and hook-up to the Durham Irrigation
District for domestic water.
5. Either the existing single family dwelling or the Second Unit shall be owner
occupied. Certification of ownership shall be required prior to permit
issuance and annually thereafter by submittal of a declaration in a form
specified by the Director of Development Services or designee.
6. No permits for any additional dwelling may be approved unless the Second
Unit is first removed.
7. In lieu of a pressurized water system or water storage tank, payment of
$200.00 per new dwelling unit into the Battalion 3 water tender fund, is
required prior to the issuance of a building permit.
8. Provide an all weather access to all structures, which is designed to carry
a 40,000 pound fire apparatus at least 10 feet wide with a 15 foot vertical
clearance.
9. The second dwelling unit shall be architecturally compatible with the main
house.
10. Reconstruct dwelling to meet. requirements of guest house or other legal
accessory building when no longer occupied by Ronald C. Casper.
11. Applicant must also comply with all other applicable State and local
statutes, ordinances, and regulations.
NOTE: Issuance of this permit does not waive the requirement of obtaining Building Division and
Environmental Health Division permits before starting construction, nor does it waive any other
reauirements of federal. state. and local law.

At the regular meeting of the Butte County Planning Commission held April 11, 1996, your
request for a Minor Use Permit to allow a second dwelling, was approved subject to the
conditions listed on the enclosures. Please sign both copies and return both copies to this
Division" within 40 calendar days.
Should you desire to appeal any of the conditions imposed by the Planning Commission,
you must do so in writing, to the Clerk of the Board of Supervisors, 25 County Center Drive,
Oroville, California, prior to 5:00 p.m., Monday, April 22, 1996. The appeal deposit of
$250.00 must be paid at that time. If you do not appeal and if there are no other appeal
within the 10 calendar -day appeal period, the action of the Planning Commission is final.
For purposes of the California Environmental Quality Act, a Notice of Exemption must be
filed. The fee for the filing of a Notice of Exemption is the $25.00 documentary handling
fee. A check made payable to the Butte County Treasurer in the amount of $25.00 should
be submitted to the Planning Division by April 23, 1996.
Please be aware that failure to return the signed copies within 40 calendar days will
invalidate the Planning Commission's approval. Re-application to this Division would then

Dear Commissioners:
This letter is, written in opposition to the request by Stephen Schuster and
Sharon Casper for a Minor Use Permit to allow a second dwelling on Ms.
Casper's lot on Teal . Lane in the Vintage Estates subdivision in Durham.
We purchased Lot 14 (2591 Widgeon Lane) in Vintage Estates last August
with the understanding this development was zoned SRI and would `consist
only of single family dwellings. In fact, Mr. Schuster himself* presented this
single family aspect in his sales pitch to us on his lots in this development.
Given the low density character of the neighborhood, the high quality
requirements specified in the C.C.&R.s, and the high prices commanded for
the lots, we strongly think multiple dwellings are inappropriate.
We have heard that Ms. Casper plans to use the. second dwelling for an in
law unit, however, this could easily, change into a rental situation that we
do not want in our neighborhood. We are particularly concerned about
this because we've been informed that she currently rents a room out in
her Teal, Lane house. This may be in conflict with., existing zoning or at
least, in our opinion, against the spirit of SRI zoning in our neighborhood.
We plan to raise our children in this neighborhood long term and therefore
would appreciate your serious consideration of our objections. We urge the
Planning Commission to disallow their request for a second dwelling.

ABSTRACT: This request is for a Minor Use Permit for a Second Unit. The proposal conforms to the zoning and
the General Plan. Staff recommends approval of this application.
PROJECT CHARACTERISTICS: This request is for a Minor Use Permit to allow a Second Unit pursuant to Butte
County Code Section 24-280 as amended by Ordinance 3176. The property is a 1.04 acre parcel and is zoned SR -
1. The Land Use Element of the Butte County General Plan designates the property as Agricultural -Residential.
A 2,455 sq. ft. home occupies the site. Domestic water for the project site is obtained from the Durham Irrigation
District. An on-site septic tank and leachfield system handles sewage disposal for the residence. Surrounding
parcels are zoned SR -1 and have a General Plan designation of Agricultural -Residential. Surrounding parcels range
in size from 1.05 to 43.9 acres, with the predominate size in the 1 to 1.4 acre range.
ANALYSIS: This project will allow a 792 sq. ft house as a second unit. The 1.04 acre parcel exceeds the minimum
lot size requirements of the SR -1 zone and will not become overcrowded due to the second unit. The proposed
location of the second dwelling will be outside of the required setbacks for the SR -1 zone. There is adequate space
for two off-street parking spaces for the second dwelling unit. Vehicle traffic generated by the addition of the second
dwelling unit will be minimal and will not have a significant impact on area streets. The second dwelling unit will
obtain its domestic water supply from a community well. Sewage disposal will be handled by an on-site septic tank
and leachfield system. The Butte County Environmental Health Division has stated that the applicant must apply
for a permit to install an on-site sewage disposal system for the second dwelling and hook-up the second dwelling
unit to the Durham Irrigation District for domestic water supply. The Butte County Fire Department has requested
a payment of $200.00 into the Battalion 3 water tender in lieu of a pressurized water system or water storage tank.
The fire department has also requested that there be an all weather access to all structures, which is designed to
carry a 40,000 pound fire apparatus at least 10 feet wide with a 15 foot vertical clearance.
The second dwelling unit will be a 792 sq. ft. stick -built house. The house will be designed for occupancy by a
handicapped person. The person who will reside in the house is the owner's father, who, due to illness, will soon
be confined to a wheelchair. A nurse will also reside in the second dwelling unit. The applicant has stated that the
existing dwelling unit is not set up for occupancy by a handicapped person, and that a temporary mobile home is not
adequate due to the limitations on movements for a person in a wheelchair. The applicant has also stated that there
are no codes, covenants, or restrictions (CC&Rs) for the project site that restricts second dwelling units.
This request is consistent with the intent and requirements of Section 24-280 of the Butte County Code. Upon review

of this second unit application, staff has determined that the proposed second unit will not significantly impair the
integrity of the zone in which it lies, nor will it be detrimental to the health, safety, and welfare of the intended
occupants or the immediate neighborhood.
ENVIRONMENTAL DOCUMENTATION: This application has been determined to be categorically exempt from the
provisions of CEQA under a Class 3 exemption.
PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be held. Notices of the hearing
will be mailed to the nearest 10 property owners.
RECOMMENDATION: Staff recommends that the Planning Commission approve the Minor Use Permit on APN
039-520-021, File # MUP 96-11, for a second dwelling unit for Sharon Caspers, subject to the findings and
conditions listed in Exhibit A.

Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions set forth below:
Sharon Caspers is hereby granted a Minor Use Permit in accordance with the application filed February 15, 1996
to allow a second unit on property zoned SR -1 located at 9656 Teal Lane, Durham.
Failure to comply with the conditions specified herein as the basis for approval of application and
issuance of Permit, constitutes cause for the revocation of said permit in accordance with the
procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-
45.65.
Unless otherwise provided for in a special condition to this Minor Use Permit, all conditions must be
completed by the Permittee within 24 months of the delivery of the countersigned permit to the
Permittee.
3. If any use for which a Minor Use Permit has been granted is not established within two years of the
date of receipt of the countersigned permit by the Permittee, the permit shall become null and void
and reapplication and a new permit shall be required to establish the use.
4. The terms and conditions of this permit shall run with the land and shall be binding upon and be to
the benefit of the heirs, legal representatives, successors, and assigns of the Permittee.
FINDINGS:
Section 1: Environmental Findings
A. This application for a Minor Use Permit to allow a Second Dwelling Unit is Categorically Exempt
from environmental review; and
Section 2: Zoning Ordinance Findings.
A. The proposed location, size, design, and operating characteristics of the proposed use is in
accordance with the purpose of Chapter 24 of the Butte County Code, the purpose of the zone in
which the site is located, the Butte County General Plan, and the development policies and
standards of the County; and
B. The proposed location, size, design, and operating characteristics of the proposed use will be
compatible with and will not adversely affect or be materially detrimental to adjacent uses,

residents, buildings, structures or natural resources, with consideration given to:
1. Harmony in scale, bulk, coverage and density;
2. The availability of public facilities, services and utilities;
3. The harmful effect, if any, upon desirable neighborhood character;
4. The generation of traffic and the capacity and physical character of surrounding streets;
5. The suitability of the site for the type and intensity of use or development which is proposed;
6. Any other relevant impact of the proposed use.
C. The proposed location, size, design, and operating characteristics of the proposed use and the
conditions under which it will be operated or maintained will not be detrimental to the public health,
safety and general welfare, or materially injurious to properties or improvements in the vicinity; and
D. The proposed use will comply with each of the applicable provisions of Chapter 24, Section 280, of
the Butte County Code.
Section 3: Action.
A. Subject to the findings indicated in Sections 1 and 2 of this Exhibit A, Minor Use Permit for Sharon
Caspers on APN 039-520-021 to allow a Second Unit is approved subject to the conditions listed
herein.
B. Minor changes may be approved administratively by the Directors of Development Services,
Environmental Health, or Public Works upon receipt of a substantiated written request by the
applicant and only as to those conditions or requirements recommended by their respective
departments. Prior to such approval, verification shall be made by each Department or Division that
the modification is consistent with the application, fees paid and environmental determination as
conditionally approved. Changes deemed to be major or significant in nature shall require a formal
application for amendment.
C. Conditions of Approval:
The Second Unit shall not exceed 1200 square feet.
2. Provide two additional off-street spaces.
3. An attached or detached garage or carport with a maximum exterior dimension 20' by 24'
is permitted.
4. Adequate sewer and potable water facilities shall be provided under permit as determined
by the Butte County Environmental Health Division. Applicant must apply for a permit to
install an on-site sewage disposal system for the second dwelling and hook-up to the
Durham Irrigation District for domestic water.
5. Either the existing single family dwelling or the Second Unit shall be owner occupied.
Certification of ownership shall be required prior to permit issuance and annually thereafter
by submittal of a declaration in a form specified by the Director of Development Services
or designee.
6. No permits for any additional dwelling may be approved unless the Second Unit is first
removed.
7. In lieu of a pressurized water system or water storage tank, payment of $200.00 per new

H. FIRE PROTECTION
1. Construction, installation or development of structures or facilities on the parcels/lots shall
comply with the latest California Fire Safe Regulations, (Public Resources Code 4290),
and all other applicable State and County codes, ordinances and regulations in effect at
the time of application for improvement permits.
2. Building identification and/or addresses shall be installed in conformance with Public
Resources Code 4290 and shall be posted at the beginning of building construction and
maintained continuously thereafter.
3. Fire hydrant identification, reflector or post reflectors shall be installed acceptable to the
County Fire Warden.
4. In lieu of a pressurized water system or water storage tank, payment of $200.00 per
created parcel into the Battalion 3 water tend fund, is required prior to the issuance of a
building permit.
5. A pressurized community water system for fire protection is required. The specific
locations and fire flow requirements shall be in accordance with the Fire Department
specifications and to the satisfaction. of the County Fire Warden. Average required hydrant
spacing _ feet, hydrant size inches, and residual fire flow gpm. Submit plans
to the Fire Department for review and approval prior to construction of facilities.
_ 6. In lieu of hydrant installation, payment may be made into the hydrant fund at a
cost of $1.72 per lineal foot of street frontage. The estimated fee amount is $

E. BUILDING PERMITS
1. Prior to building permit issuance for a new residential dwelling unit(s), the applicant shall
pay all applicable development fees at the rate in effect at the time of acceptance of the
application. Such fees, shall include, but not be limited to: Park Fee, School Fee,
Drainage Fee, Permit and Plan Checking Fees, Water and Sewer Service Fees, and Fire
Protection Fees.
2. Prior to building permit issuance for a new commercial or industrial development, or
addition to an existing development, the applicant shall pay all applicable development
fees at the rate in effect at the time of acceptance of the application. Such fees shall
include, but not be limited to: School Fee, Drainage Fee, Permit and Plan Checking Fees,
Water and Sewer Service Fees, and Fire Protection Fees.
F. EXISTING STRUCTURES
Comply with the Uniform Building Code for property line clearances considering use, area
and fire -resistiveness of existing buildings.
2. Existing building(s) shall be made to comply with current Building and Zoning regulations
for the intended new use of the building(s) or the existing building(s) shall be demolished.

G. SECOND UNITS
1. The Second Unit may be attached to the primary residence or may be a separate, on-site
detached dwelling.
2. The attached second unit shall be architecturally compatible with the primary residence
and the appearance of the building shall be that of a single family dwelling.
3. The size of the attached second unit shall not exceed 640 square feet or 30% of the size of
the primary dwelling, whichever is greater, in no case shall the second unit exceed 1200
square feet. A detached second unit shall not exceed 1200 square feet.
4. The parcel or lot upon which the Second Unit is to be located must meet the minimum
acreage requirements for which the parcel or lot is zoned.
5. In addition to the off-street parking required for the primary dwelling, one off-street parking
space shall be provided for second units of 640 square feet or less; two additional off-
street parking spaces shall be provided for larger units.
6. An attached or detached garage or carport with a maximum exterior dimension of 12' by
20' is permitted for second units of 640 square feet or less. A garage or carport with a
maximum dimension of 20'x 24' is permitted for larger second units.

7. Adequate sewer and potable water facilities shall be provided as determined by the Butte
County Environmental Health Division.
8. A second unit may not be placed on a parcel or lot where a temporary mobile home, in
accordance with Section 24-295 and 24-295.20, has been approved or on a lot that has
more than one dwelling located upon it.
9. Either the ebsting single family dwelling or the second unit shall be owner occupied.
Verification of ownership shall be required prior to permit issuance and annually thereafter
by submittal of a declaration in a form specified by the Director of Development Services or
designee. ,
