Alan and Donna Campbell - (Item determined to be categorically exempt from environmental review) Minor Use Permit to allow a permanent second dwelling unite under the provisions of Butte County Code Section 24-280 on property zoned "U" (Unclassified) and "S -H" (Scenic Highway) located on the northwest corner of Clark Road and Circle J Road, approximately 2.75 miles north of Durham-Pentz Road, identified as AP 041-080-129, Oroville. (SB) (MUP96-14) Stephen Betts said that the existing dwelling is on the upper floor of a barn and will become the second unit. The applicant has a 40 acre parcel and therefore has twice the necessary acreage for the Unclassified zone. Commissioner Lambert asked if the lower portion of the barn could be converted to a home. Mr. -Sanders said that could be done illegally, although the existing -unit is only 864 square feet and could legally go up to 1200 sq. ft. Greta Cline, a neighbor to the north, . said she does not object to the application. The applicants live on the top level of the barn and horses and cows use the lower level of the barn. HEARING CLOSED TO THE PUBLIC It -was agreed that since the structure is a stick built permanent structure, an Aunt Minnie would not be appropriate. Commissioner Nelson said that since the parcel has 40 acres with a 20 acre minimum, he is not opposed to the project. Commissioner Lynch said that the area would probably qualify for the FR -5 or FR -10 zone range. He was not opposed to the project. It should be understood that the second unit in the barn can be no larger than 1200 sq. ft. It was moved by Commissioner Lynch, seconded by Commissioner Cage, and carried unanimously, for approval of the Minor Use Permit according to the findings and conditions of the Agenda Report dated April 17, 1996. The proposed location, size, design, and operating characteristics of the proposed use is in accordance with the purpose of Chapter 24 of the Butte County Code, the purpose of the zone in which the site is located, the Butte County General Plan, and the development policies and standards of the County; and B. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant and only as to those conditions or requirements recommended by their respective departments. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. C. Conditions of Approval: 1. The Second Unit shall not exceed 1200 square feet. 2. Provide two additional off-street spaces. 3. An attached or detached garage or carport with a maximum exterior dimension 20' by 24' is permitted. 4. Adequate sewer and potable water facilities shall be provided under permit as determined by the Butte County Environmental Health Division. 5. Either the existing single family dwelling or the Second Unit shall be owner occupied. Certification of ownership shall be required prior to permit issuance and annually thereafter by submittal of a declaration in a form specified by the Director of Development Services or designee. 6. No permits for any,additional dwelling may be approved unless the Second Unit is first removed. 7. APN 041-080-129: A request for a Minor Use Permit for a Second Dwelling under the provisions of Butte County Code Section 24-280. The property is zoned U (Unclassified) and SH (Scenic Highway), and is located on the northwest corner of Clark Road and Circle J road, approximately 2.75 miles north of Durham-Pentz Road. This project is located in Supervisorial District 4. RELATED ITEMS: None FOR: Planning Commission Hearing for May 9, 1996 SUMMARY: This request is for a Minor Use Permit for a Second Unit. The proposal conforms to the zoning and the General Plan. Staff recommends approval of this application. PROJECT CHARACTERISTICS: This request is for a Minor Use Permit to allow a Second Unit pursuant to Butte County Code Section 24-280 as amended by Ordinance 3176. The property is -a 40 acre parcel and is zoned Unclassified and Scenic Highway. The Land Use Element of the Butte County General Plan designates the property as Agricultural -Residential. A 864 sq. ft. dwelling unit sits on top of a 2,016 sq. ft. barn. Domestic water for the residence is obtained from a well located on the project parcel. An on-site septic tank and leachfield system handles sewage disposal for the residence. Surrounding parcels are zoned Unclassified and Scenic Highway, and have a General Plan designation of Agricultural -Residential. Surrounding parcels range in size from 4.1 to 494 acres, with the predominant size being 5 to 20 acres: Surrounding land use is rural residential and grazing/open land. The applicant intends to build a new 3,500 sq. ft. residence. ANALYSIS: This project will allow a new 3,500 sq. ft. dwelling unit to be constructed on the project site. This will be the primary dwelling unit. The existing 864 sq. ft. dwelling located on top of the barn will become the second dwelling unit. The 40 acre parcel has twice the acreage required for parcels located in an Unclassified zone. Neither dwelling unit will be in the Scenic Highway zone. The proposed location of the second dwelling unit is outside of the required setbacks for the U zone. There is adequate space for two off-street parking spaces for the second dwelling unit. New vehicle traffic generated by the second dwelling unit will not have a significant impact on area streets. The Butte County Environmental Health Division has stated that the existing septic system can be used for both dwelling units. The Butte County Fire Department has requested several conditions for this project in order to lessen the impacts to fire protection services. One condition requires that all new structures placed on the project site shall comply with Public Resources Code'4290, and all other applicable State and County codes, ordinance and regulations in effect at the time of application. The second condition requires that building identification and address be installed and maintained in conformance with Public Resources Code 4290. The third condition requires that the applicant pay $200.00 into the Battalion 3 water tender fund prior to issuance of a building permit for the second dwelling unit. This request is consistent with the intent and requirements of Section 24-280 of the Butte County Code.
