Robert and Josette Knowles - (Item determined to be Categorically Exempt from environmental review) Minor Use Permit to allow a Second Dwelling on property zoned RT -1 (Residential Mobile Home) located on the north side of Rue Rosso Road, 100 feet west of Granada Drive, identified as AP 066-380-019 and 020, Magalia area. (SL) (MUP96-15) f Mr. Lucas said the zoning allows .25 acre lots, and this request is for a second unit on a one acre lot. He said that Condition 4 should be modified to include wording that potable water is to be provided by the Del Oro Water Company. HEARING OPEN TO THE PUBLIC Robert Knowles was present. Commissioner Lambert asked why the applicant combined four underlying lots into one. Mr. Knowles said he wanted to install a triple wide mobile home and needed the space. HEARING CLOSED TO THE PUBLIC Commissioner Cage asked if sprinklers would be required. Mr. Lucas said that there is no authority under CEQA to require sprinklers on this type of request. It was moved by Commissioner Cage, seconded by Commissioner Lambert, and carried unanimously, to approve the request for a Minor Use Permit for Robert and Josette Knowles, with the changed wording to Condition 4. FINDINGS: Section 1: Environmental Findings. A. This application for a Minor Use Permit to allow a Second Dwelling Unit is Categorically Exempt from environmental review; and Section 2: Zoning Ordinance Findings. A. The proposed location, size, design, and operating characteristics of the proposed use is in accordance with the purpose of Chapter 24 of the Butte County Code, the purpose of the zone in which the site is located, the Butte County General Plan, and the development policies and standards of the County; and B. The proposed location, size, design, and operating characteristics of the proposed use will be compatible with and will not adversely affect or be materially detrimental to adjacent uses, residents, buildings, structures or natural resources, with consideration given to: 1. Harmony in scale, bulk, coverage and density; 2. The availability of public facilities, services and utilities; 3. The harmful effect, if any, upon desirable neighborhood character; 4. The suitability of the site for the type and intensity of use or development which is J proposed; 6. Any other relevant impact of the proposed use. C. The proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it will be operated or maintained will not be detrimental to the public health, safety and general welfare, or materially injurious to properties or improvements in the vicinity; and D. The proposed use will comply with each of the applicable provisions of Chapter 24, Section 280, of the Butte County Code. Section 3: Action. A. Subject to the findings indicated in Sections 1 and 2 of this Exhibit A, Minor Use Permit for Robert and Josette Knowles on APN 066-380-019 & 020 to allow a Second Unit is approved subject to the conditions listed herein. B. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant and only as to those conditions or requirements recommended by their respective departments. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. C. Conditions of Approval: The Second Unit shall not exceed 1200 square feet. 2. Provide two additional off-street spaces. 3. An attached or detached garage or carport with a maximum exterior dimension 20' by 24' is permitted. 4. Adequate sewer and potable water facilities shall be provided under permit as determined by the Butte County Environmental Health Division from Del Oro Water Company. 5. Either the existing single family dwelling or the Second Unit shall be owner occupied. Certification of ownership shall be required prior to permit issuance and annually thereafter by submittal of a declaration in a form specified by the Director of Development Services or designee. 6. No permits for any additional dwelling may be approved unless the Second Unit is first removed. 7. Construction, installation or development of structures or facilities on the _ parcels/lots shall comply with the latest California Fire Safe Regulations, (Public Resources Code 4290), and all other applicable State and County codes, ordinances and regulations in effect at the time of application for improvement permits. The proposal conforms to the zoning and the General Plan. Staff recommends approval of this application. PROJECT CHARACTERISTICS: This request is for a Minor Use Permit to allow a Second Unit pursuant to Butte County Code Section 24-280 as amended by Ordinance 3176. The property is presently two parcels with four legal Underlying lots which were recently merged into a single one (1) acre parcel Toned RT -1. The Land Use Element of the Butte County General Plan designates the property as Low Density Residential. The property is presently undeveloped land on which theapplicant proposed to build a 2130 sq. ft. Primary dwelling and a 720 sq. ft. second unit. Domestic water for the dwellings is proposed to.be provided by private wells. An on-site septic tank and leachfield system is proposed for sewage disposal for the dwellings. Surrounding parcels are zoned RT -1 and have a General Plan designation of Low Density Residential. Surrounding land use is residential with parcels predominantly 1/4 acre in size. ANALYSIS: This project will allow a two dwelling units to be constructed on the project site. The one acre parcel has four times the minimum acreage required for parcels located in an RT -1 zone. As indicated in the Zoning Ordinance findings Section 2, B-5, the Commission must determine that new vehicle traffic generated by the second dwelling unit will not have a significant impact on the capacity or physical character of area streets. This project in combination with the recent parcel merger would allow for only two dwellings on the property, a reduction from the possible four units that would have been allowed prior to the lot merger. The Butte County Environmental Health Division (EHD) will require the applicant to obtain a permit and install a septic system. The EHD also recommends that the parcel obtain domestic water from Del Oro Water'Company rather than from private wells. The Butte County Fire Department has requested several conditions for this project in order to lessen the impacts to fire protection services. One condition requires that all new structures placed on the project site shall comply with Public Resources Code 4290, and all other applicable State and County codes, ordinance and regulations in effect at the time of application. The second condition requires that building identification and address be installed and maintained in conformance with Public Resources Code 4290. The third condition requires that the applicant pay $200.00 into the Battalion 3 water tender fund prior to issuance of a building permit for the second dwelling unit. This request is consistent with the intent and requirements of Section 24-280 of the Butte County Code. Upon review of this second unit application, staff has determined that the proposed second unit will not significantly impair the integrity of'the zone in which it lies, nor will it be detrimental to the health, safety, and welfare of the intended occupants or the immediate neighborhood. The proposed location, size, design, and operating characteristics of the proposed use is in accordance with the purpose of Chapter 24 of the Butte County Code, the purpose of the zone in which the site is located, the Butte County General Plan, and the development policies and standards of the County; and B. The second dwelling will be attached by a breezeway to the main unit which is 6,000 square feet. Public utilities are available to the property. The neighborhood character is rural and this dwelling will be consistent with that character and will not generate significant traffic. Commissioner Cage asked about the possibility of flooding. . . Mr. Sanders said that the building site is 43 feet above the area of the property which is in the AE Flood Zone. HEARING OPEN TO THE PUBLIC Robert Hill was present. HEARING CLOSED TO THE PUBLIC It was moved by Commissioner Lynch, seconded by Commissioner Lambert, and carried unanimously for approval of the Use Permit for Robert Hill subject to the findings and conditions of the Agenda Report. FINDINGS: Section 1: Environmental Findings. A. This application for a Minor Use Permit to allow a Second Dwelling Unit is Categorically Exempt from environmental review; and Section 2: Zoning Ordinance Findings. A. The proposed location, size, design, and operating characteristics of the proposed use is in accordance with the purpose of Chapter 24 of the Butte County Code, the purpose of- -the zone in which the site is located, the Butte County General Plan, and the development policies and standards of the County; and B. The proposed location, size, design, and operating characteristics of the proposed use will be compatible with and will not adversely affect or be materially detrimental to adjacent uses, residents, buildings, structures or natural resources, with consideration given to: 1. Harmony in scale, bulk, coverage and density; 2. The availability of public facilities, services and utilities; 3. The harmful effect, if any, upon desirable neighborhood character; 4.. The generation of traffic and the capacity and physical character of surrounding streets; 5. The suitability of the site for the type and intensity of use or development which is proposed; 6. The proposed use will comply with each of the applicable provisions of,Chapter 24, Section 280, of the Butte County Code. Section 3: Action. A. Subject to the findings indicated in Sections 1 and 2 of this Exhibit A, Minor Use Permit for Gary & Judy Sitton on APN 011-410-173 to allow a Second Unit is approved subject to the conditions listed herein. B. Minor changes may be approved administratively by the Directors of Development ` Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant and only as to those conditions or requirements recommended by their respective departments. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. C. Conditions of Approval: The Second Unit shall not exceed 1200 square feet. 2. Provide two additional off-street spaces. An attached or detached garage or carport with a maximum exterior dimension 20' by 24' is permitted. 4. Adequate sewer and potable water facilities shall be provided under permit as determined by the Butte County Environmental Health Division. 5. Either the existing single family dwelling or the Second Unit shall be owner occupied. Certification of ownership shall be required prior to permit issuance and annually thereafter by submittal of a declaration in a form specified by the Director of Development Services or designee. 6. No permits for any additional dwelling may be approved unless the Second Unit is first removed. 7. Construction, installation or development of structures or facilities on the parcels/lots shall comply with the latest California Fire Safe Regulations, (Public Resources Code 4290), and all other applicable State and County codes, ordinances and regulations in effect at the time of application for improvement permits. 8. Building identification and/or addresses shall be installed in conformance with Public Resources Code 4290 and shall be posted at the beginning of building construction and maintained continuously thereafter. The proposed location, size, design, and operating characteristics of the proposed use is in accordance with the purpose of Chapter 24 of the Butte County Code, the purpose of the zone in which the site is located, the Butte County General Plan, and the development policies and standards of the County; and u B. The proposed location, size, design, and operating characteristics of the proposed use will be compatible with and will not adversely affect or be materially detrimental to adjacent uses, residents, buildings, structures or natural resources, With consideration given to: 1. Harmony in scale, bulk, coverage and density; 2. The availability of public facilities, services and utilities; 3. The harmful effect, if any, upon desirable neighborhood character; 4. The generation of traffic and the capacity and physical character of surrounding streets; 5. The suitability of the site for the type and intensity of use or development which is proposed; 6. Any other relevant impact of the proposed use. C. The proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it will be operated or maintained will not be detrimental to the public health, safety and general welfare, or materially injurious to properties or improvements in the vicinity; and D. No permits for any additional dwelling may be approved unless the Second Unit is first removed. 7. Construction, installation or development of structures or facilities on the parcels/lots shall comply with the latest California Fire Safe Regulations, (Public Resources Code 4290), and all other applicable State and County codes, ordinances and regulations in effect at the time of application for improvement permits. 8. This project is located in Supervisorial District 4. RELATED ITEMS: None FOR: Planning Commission Hearing for June 13 1996 SUMMARY: This request is for a Minor Use Permit for a Second Unit. The proposal conforms to the zoning and the General Plan. Staff recommends approval of this application. PROJECT CHARACTERISTICS: This request is for a Minor Use Permit to allow a Second Unit pursuant to Butte County Code Section 24-280 as amended by Ordinance 3176. The property is a 12.01 acre parcel and is zoned FR - 5. The Land Use Element Map of the Butte County General Plan designates the property as Agricultural -Residential. A 5,984 sq. ft. home and attached garage is located on the property. Domestic water for the residence is obtained from a well located on the project parcel. An on-site septic tank and leachfield system handles sewage disposal for the residence. Butte Creek flows through the eastern portion of the project site. Portions of the project site are located within an "AE" flood zone. Surrounding parcels are zoned FR -5, and have a General Plan designation of Agricultural -Residential. Surrounding parcels range in size from 5.02 to 112.12 acres. Surrounding land use is rural residential and grazing/open land. The proposed second unit will be a 1,199 sq. ft. conventionally constructed, wood frame house. ANALYSIS: This project will allow a 1,199 sq. ft. house to be a permanent second dwelling unit. The 12.01 acre parcel has over twice the acreage required for parcels located in an FR -5 zone The proposed location of the second dwelling is outside of the required setbacks for the FR -5 zone. The proposed second dwelling unit will be attached to the primary dwelling unit by a carport/breezeway. A condition of the project will require that the second dwelling unit be architecturally compatible with the main residence. The proposed location of the second dwelling unit is also located outside, but adjacent to, a 100 ft. "No Development Zone" that parallels Butte Creek. The 100' No Development Zone was a mitigation required by the parcel map that created the project parcel. There is adequate space for two off-street parking spaces for the second dwelling unit. New vehicle traffic generated by the second dwelling unit will not have a significant impact on Honey Run Road. The second dwelling unit will obtain its domestic water from the existing on-site well, and sewage disposal will be handled by an individual on-site:septic tank and leachfield system. The Butte County Environmental Health Division has stated that the second dwelling unit must meet the sewage disposal requirements of the Butte County Department of Environmental Health for installation of a sewage disposal system. The Environmental Health Division has also stated that potable drinking water must be supplied to the second dwelling unit and that the second dwelling unit will be allowed to hook up to the existing well. The California Department of Forestry has recommended three conditions for this project: Construction, installation or development of structures or facilities on the parcels/lots shall comply with the latest California Fire Safe Regulations, (Public Resources Code 4290), and all other applicable State and ■ Butte County Department of Development Services■ 0 • County codes, ordinances and regulations in effect at the time of application for improvement permits 2. Portions of the projectsite are located within an "AE" flood zone as shown on the Federal Emergency Management Agency's Flood Insurance Rate Map. The "AE" designates an area of 100 -year flood for which the flood elevation has been determined, which is 257 feet above sea level at the location of the project site. A survey accomplished on the project site showed that the elevation of the proposed second dwelling unit is 300 feet above sea level, well above the flood elevation. Butte County Code Section 24-41 deals with the required finding for approval of a Minor Use Permit. There are six areas that must be considered for approval of a Minor Use Permit. 1. Harmony in scale, bulk, coverage and density - The existing dwelling unit is a 5,984 sq. ft. conventionally built house and attached garage, and the proposed second dwelling unit will be a 1, 1999 sq. ft. conventionally built home. The second dwelling unit will be attached to the existing dwelling unit via a proposed carport/breezeway. The second dwelling unit will be in harmony in scale and bulk with the existing house, and will be architecturally compatible with the existing house. The coverage and density of the project parcel will not be increased significantly due to the large size of the project parcel. The existing structures, proposed additions to the existing structure, and the proposed second dwelling unit will cover less than 3% of the project parcel. The availability of public facilities, services and utilities - Telephone and electrical services already extend to the project parcel. Public water and sewer systems are not located in the project area. The nearest fire station is located approximately four miles away. 3. The harmful effect, if any, upon desirable neighborhood character -. The neighborhood character is rural residential, with parcel sizes ranging from 2.45 to 112 acres. Two of these parcels are owned by the State of California and are maintained as open space. Due to the relativity large size of the parcels, the neighborhood contains large areas of open space. Approval of the second dwelling unit will not have a harmful effect upon the neighborhood character. 4. The generation of traffic and the capacity and physical character of surrounding streets - The proposed second dwelling unit will result in a minor increase in vehicle traffic on Honey run Road and on the intersection of Skyway and Honey run Road. A single family dwelling unit in urban area generates approximately ten vehicle trips per day. However, dwelling units in rural areas generally generate less vehicle traffic than that. The increase in vehicle traffic due to the proposed second dwelling unit will not have a significant impact on vehicle circulation in the project area. 5. The suitability of the site for the type and intensity of use or development which is proposed - There are no physically characteristics of the project site that would preclude a second dwelling unit. While the project site is located in a 100 year flood zone, several surveys conducted on the project site place the location of the proposed second dwelling unit well above the flood elevation. The location of the proposed second dwelling unit is outside of a "No Development Zone" that is adjacent to Butte Creek. 6.
