PERMIT NO: 007-120-025 ASSESSOR'S PARCEL NUMBER Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions set forth below: Katie Youra is hereby granted a Minor Use Permit in accordance with the application filed May 13, 1996 to allow a large family day care facility on property zoned R-1 located at 2713 Madera Lane, Chico. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit, constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-45.65. 2. Unless otherwise provided for in a special condition to this use permit, all conditions must be completed by the Permittee within 12 months of the delivery of the countersigned permit to the Permittee. 3. If any use for which a use permit has been granted is not established within one year of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. 4. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. FINDINGS: Section 1: Environmental Findings. A. This application for a Minor Use Permit to allow a large day care center is Categorically Exempt from environmental review; and Section 2: Zoning Ordinance Findings. A. The proposed location, size, design, and operating characteristics of the proposed use is in accordance with the purpose of Chapter 24 of the Butte County Code, the purpose of the zone in which the site is located, the Butte County General Plan, c and the development policies and standards of the County; and B. The proposed location, size, design, and operating characteristics of the proposed use will be compatible with and will not adversely affect, or be materially detrimental to adjacent uses, residents, buildings, structures or natural resources, with consideration given to: 1. Harmony in scale, bulk, coverage and density; 2. The availability of public facilities, services and utilities; 3. The harmful effect, if any, upon desirable neighborhood character; 4. The generation of traffic and the capacity and physical character of surrounding streets; 5. The suitability of the site for the type and intensity of use or development which is proposed; 6. Any other relevant impact of the proposed use. C. The proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it will be operated or maintained will not be detrimental to the public health, safety and general welfare, or materially injurious to properties or improvements in the vicinity; and D. The proposed use will comply with each of the applicable provisions of Chapter 24, Section 265, of the Butte County Code. Section 3: Action. A. Subject to the findings indicated in Sections 1 and 2 of this Exhibit A, Minor Use Permit for Katie Youra on APN 007-120-025 to allow a large family day care facility is approved subject to the conditions listed herein. B. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant and only as to those -conditions or requirements recommended by their respective departments. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require'a formal application for amendment. C. Conditions of Approval: The facility is a single-family residence that is the principal residence of the provider and the use is clearly incidental and secondary to the use of the property for residential purposes. 2. In addition to providing the required number of parking spaces for the residential use, provide one off-street parking space for each employee of the facility and one off-street parking space\loading area shall be provided. The driveway area may be used to meet this requirement. 3. One non -illuminated sign, not to exceed 3 square feet in area and four feet in height, shall be allowed. 4. The Large Family day care home shall be licensed by the California Department of Social Services, Community Care Licensing. 5. Meet all State Fire Marshall regulations pertaining to Large Family day care facilities. 6. Grant an avigation easement to the City of Chico. 7. Applicant must also comply with all other applicable State and local statutes, ordinances, and regulations. NOTE: Issuance of this permit does not waive the requirement of obtainina Buildina Division and Environmental Health Division permits before starting construction, nor does it waive any other requirements of federal, state, and local law. He noted that the day care center is on an individual septic system. Approval of the Consent Agenda was moved by Commissioner Lynch, seconded by Commissioner Lambert, and carried unanimously. (CS) (MUP96-19) Mr. Farrel called the meeting to order noting that the applicant was present. Mr. Farrel informed Ms. Youra that this matter may need to be referred to the Airport Land Use Commission for review. He said he would check with staff. The hearing was opened. Ms. Youra said she did not understand why the project may need to be heard by the Airport Land Use Commission. Mr. Farrel explained, with discretionary permits within 2 miles of an airport, the airport would need to review the project to protect the airport. Mrs. Youra said she has a large lot and there is no problem with parking and she agreed to meet the other conditions. The hearing was closed. There was a brief recess while Mr. Farrel consulted with Mr. Lucas on the airport issue. Mr. Farrel stated that this project is conditioned for an avigation easement, and, therefore, does not need to be reviewed by the Airport Land Use Commission. Mr. Farrel set this item for approval on the consent agenda of the Planning Commission for July 11, 1996, subject to the findings and conditions listed in Exhibit A, attached to the Agenda Report. This project is located in Supervisorial District 3. RELATED ITEMS: None FOR: Directors meeting of July 1, 1996 ABSTRACT: This request is for a Minor Use Permit for a large family day care facility for no more than 12 children. The proposal conforms to the zoning and the General Plan. No significant impacts will occur as a result of this project. Staff recommends approval of this application. PROJECT CHARACTERISTICS: This project is a request to utilize a single family residence as a large family day care facility subject to a Minor Use Permit as required by Butte County Code 24-120.E.1 regarding uses in an R-1 zone. The subject property is approximately .28 acres in size and is developed with a 1,700 square foot single family residence. Domestic water for the project site is obtained from a community water system. An on-site septic tank and leachfield system handles sewage disposal for the residence. The project site as well as the surrounding parcels are zoned R-1 and have a General Plan designation of Low -Density Residential. Surrounding parcels are all of similar size as the subject property. For the past 5 years, a small family day care facility has been operated on this site. There are no other large day care center facilities located within 500 feet driving distance from the project site. ANALYSIS: This project will allow a large day care center in a R-1 zone. A small day care center (6 or less children) is currently operated out of the project site. The increase in the number of children will not significantly impact the neighborhood. The house is located at the corner of Madera Lane and Elverta Circle in a single family residential neighborhood. Madera Lane is not a through street and does not carry significant amounts of traffic. There will be an increase in the number of vehicle trips on both Pillsbury Road and Madera Lane due to this project. One person who does not live at the residence will be employed. The change from a small day care home to a large day care home will increase the number of vehicle trips generated due to the day care facility from approximately 12 to approximately 26. This increase will not cause any significant impacts to either street. Vehicles can easily turn around in the driveway which faces Elverta Circle or use the cul-de-sac at the end of Elverta The site is within 2 miles of the Chico Municipal Airport and is subject to regular over flights from a variety of aircraft. While the current usage of the airport may not pose any conflicts with the proposed use, future flight patterns or different aircraft may result in a change or increase in noise levels for this property as well ■ Butte County Department of Development Services ■ Planning Division ■ as the surrounding area. To protect the airport's operating status, the applicant should grant an avigation easment in favor to the airport. This will hopefully limit any future claims the applicant may have regarding the compatibility of airport operations and the day care operations. This request is consistent with the intent and requirements of Section 24-265 of the Butte County Code. Upon review of this licensed day care application, staff has determined that the proposed day care will not significantly impair the integrity of the zone in which it lies, nor will it be detrimental to the health, safety, and welfare of the intended occupants or the immediate neighborhood. ENVIRONMENTAL DOCUMENTATION: This application has been determined to be categorically exempt from the provisions of CEQA under a Class 3 exemption. PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be held. Notices of the hearing will be mailed to the nearest 10 property owners. RECOMMENDATION: Staff recommends that the Director of Development Services set this item for approval on the consent agenda of the Planning Commission subject to the findings and conditions listed in Exhibit A. The proposal conforms to the zoning and the General Plan. No significant impacts will occur as a result of this project. Staff recommends approval of this application. PROJECT CHARACTERISTICS: This project is a request to utilize a single family residence as a large family day care facility subject to a Minor Use Permit as required by Butte County Code 24-120.E.1 regarding uses in an R-1 zone. The subject property is approximately .28 acres in size and is developed with a 1,700 square foot single family residence. Domestic water for the project site is obtained from a community water system. An on-site septic tank and leachfield system handles sewage disposal for the residence. The project site as well as the surrounding parcels are zoned R-1 and have a General Plan designation of Low -Density Residential. Surrounding parcels are all of similar size as the subject property. For the past 5 years, a small family day care facility has been operated on this site. There are no other large day care center facilities located within 500 feet driving distance from the project site. ANALYSIS: This project will allow a large day care center in a R-1 zone. A small day care center (6 or less children) is currently operated out of the project site. The increase in the number of children will not significantly impact the neighborhood. The house is located at the corner of Madera Lane and Elverta Circle in a single family residential neighborhood. Madera Lane is not a through street and does not carry significant amounts of traffic. There will be an increase in the number of vehicle trips on both Pillsbury Road and Madera Lane due to this project. One person who does not live at the residence will be employed. The change from a small day care home to a large day care home will increase the number of vehicle trips generated due to the day care facility from approximately 12 to approximately 26.'This increase will not cause any significant impacts to either street. Vehicles can easily turn around in the driveway which faces Elverta Circle or use the cul-de-sac at the end of Elverta The site is within 2 miles of the Chico Municipal Airport and is subject to regular over flights from a variety of aircraft. While the current usage of the airport may not pose any conflicts with the proposed use, future flight patterns or different aircraft may result in a change or increase in noise levels for this property as well ■ Butte County Department of Development Services ■ Planning Division ■ as the surrounding area. To protect the airport's operating status, the applicant should grant an avigation easment in favor to the airport. This will hopefully limit any future claims the applicant may have regarding the compatibility of airport operations and the day care operations.
