Michael & Sheri Royers - (Item determined to be categorically exempt from environmental review) Minor Use Permit for a permanent second dwelling unit on property zoned FR -5 (Foothill Recreational = 5 acre parcels) located on the east side of Honey Run Road, approximately 1.9 miles northeast of Centerville Road, identified as AP 011-280-117, Chico. (SB) (MUP97-04) (VIDEO) - Stephen Betts summarized the staff report. The zone is FR -5 and the parcel size is 5.03 acres. A letter from Bill Carter states that Little Butte Creek originates on the property, the leachfield will impact a downhill well and expresses concern that the second unit will be a rental. A letter of opposition was received from Sheri and Larry Trimboli because of density concerns, impact on the land, and impacts of two leachfields on natural springs and streams. Another letter of opposition was also received from Mark and Kathy Slabodnik. Mike Royers, the applicant, said the second unit is not a 3000 foot house. It is a garage with living quarters above. The other house is less than 2500 square feet. The leachfield is adequate for both dwellings. Mr. Betts said the Health Department has approved the leachfield system which will probably be a combined system for both dwellings. Bill Carter said there is a concern that the second unit might be a rental. There is concern about a leachfield near a spring which is a tributary to Little Butte Creek. There is also concern about density and the size of the building. Mr. Carter shares riparian rights with the Royers parcel and is concerned that the water from the spring is not diverted. He is concerned that his well might be affected. HEARING CLOSED TO THE PUBLIC Chairman Lambert said that unless there is twice the minimum acreage required by the zone, second units double the density of the zone. The requested revised Second Unit Ordinance has not come forward as yet. Commissioner Leland felt the Commission is bound by the existing Second Unit Ordinance and Government Code 65852.2. Mr. Sanders said there might be more leeway in regulating second units than was originally thought. Chairman Lambert said when two units are allowed on a five acre parcel, there is one dwelling unit per 2.5 acres, which doubles what the existing zoning allows." Commissioner Leland thought impact on wells and springs would be appropriate criteria, but not density. BUTTE COUNTY PLANNING COMMISSION MINUTES - March 27, 1997 It was moved by Commissioner Cage, seconded by Commissioner Mooney and carried, for approval of the Minor Use Permit for Michael and Sheri Royers on AP 011-280-117, subject to the findings and conditions of the Agenda Report dated March 17, 1997, by the following vote: AYES: Commissioners Cage, Mooney and Leland NOES: Chairman Lambert ABSENT: Commissioner Nelson ABSTAIN: 0 Section 1: Environmental Findings. A. This application for a Minor Use Permit to allow a Second Dwelling Unit is Categorically Exempt from environmental review; and Section 2: Zoning Ordinance Findings. A. The proposed location, size, design, and operating characteristics of the proposed use is in accordance with the purpose of Chapter 24 of the Butte County Code, the purpose of the zone in which the site is located, the Butte County General Plan, and the development policies and standards of the County; and B. The proposed location; size, design, and operating characteristics of the proposed use will be compatible with and will not adversely affect or be materially detrimental to adjacent uses, residents, buildings, structures or natural resources, with consideration given to: 1. Harmony in scale, bulk, coverage and density; 2. The availability of public facilities, services and utilities; 3. The harmful effect, if any, upon desirable neighborhood character; 4. The generation of traffic and the capacity and physical character of surrounding streets; 5. The suitability of the site for the type and intensity of use or development which is proposed; 6. Any other relevant impact of the proposed use. C. The proposed use will comply with each, ofthe applicable provisions of Chapter 24, Section 280, of the Butte County Code. Section 3: Action. A. Subject to the findings indicated in Sections 1 and 2 of this Exhibit A, Minor Use Permit for Michael and Sheri Royers on APN 011-280-117 to allow a Second Unit is approved subject to the conditions listed herein. B. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant and only as to those conditions or requirements recommended by their respective departments. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. ` C. Conditions of Approval: 1. The Second Unit shall not exceed 1200 square feet. 2. Provide two additional off-street spaces. 3. An attached or detached garage or carport with a maximum exterior dimension 20' by 24' is permitted. 4. Either the existing single family dwelling or.the Second Unit shall be owner occupied. Certification of ownership shall be required prior to Use Permit issuance and annually thereafter by submittal of a declaration in a form specified by the Director of Development Services or designee. 5. No permits for any additional dwelling may be approved unless the Second Unit is first removed. 6. Construction, installation or development of structures or facilities on the parcels/lots shall comply with the latest California Fire Safe Regulations, (Public Resources Code 4290), and -all other applicable - State and County codes, ordinances and regulations in effect at the time of application for improvement permits. This project is located in Supervisorial District 5. RELATED ITEMS: None FOR: Planning Commission Hearing for March 27, 1997 SUMMARY: This request is for a Minor Use Permit for a Second Unit. The proposal conforms to the zoning and the General Plan. Staff recommends approval of this application. PROJECT CHARACTERISTICS: This request is for a Minor Use Permit to allow a 816 sq.ft. second unit pursuant to Butte County'Code Section 24-280 as amended by Ordinance 3176. The property is a 5.03 acre parcel and is zoned FR -5. The Land Use Element Map of the Butte County General Plan designates the property as Agricultural Residential. The project site is located in Butte Creek Canyon, adjacent to Honey Run Road. The project site is vegetated with brush and scattered oak and digger pine trees. A natural spring is located on the project site. The project site is currently undeveloped, but the applicant intends to construct a 2,500 sq. ft. residence for use as the primary dwelling unit. Domestic water will be obtained from an on-site well. Sewage disposal will be handled by a septic tank/leachfield system. Surrounding parcels are zoned FR -5 with a General Plan designation of Agricultural -Residential and Grazing/Open Land and range in size from 5 to 47 acres. ANALYSIS: This project will allow a 816 sq.ft. second unit as a permanent second dwelling unit. The 5.03 acre parcel exceeds the minimum lot size requirements of the FR -5 zone and will not become overcrowded due to the second unit. The proposed location of the second dwelling will be outside of the required setbacks for the FR -5 zone. There is adequate space for two off- street parking spaces for the second dwelling unit. New vehicle traffic generated by the addition of a second dwelling unit will be minimal and will not have a significant impact on Honey Run Road. The applicant intends to live in the second dwelling unit until the primary dwelling unit is constructed. The applicant has stated that the intended resident of the proposed second dwelling unit, after the primary dwelling unit is constructed, will be an elderly relative. However, there is nothing that could prevent the applicants from renting out the second dwelling unit if they so desire. Butte County Code Section 24-41 addresses the required findings for approval of a Minor Use Permit. There are six areas that must be considered for approval of a Minor Use Permit: 1. Harmony in scale, bulk, coverage and density - The second dwelling unit will be a conventionally built structure which will be located on top of a barn. The primary dwelling unit and the proposed second dwelling unit will be similar in scale and bulk. The proposed second dwelling unit will also be architecturally compatible with the primary dwelling unit. No additional land area will be required for the second dwelling unit because it will be located on top of a barn, thus reducing the coverage on the parcel. 2. The availability of public facilities, services and utilities - Telephone and electrical services already extend to the project parcel. Domestic water will be supplied by an on-site well, and sewage disposal will be handled by an on-site septic tank/leachfield system. The project site is located approximately 1.6 miles from the Town of Paradise and approximately 6 miles from the City of Chico. Most services can be obtained in the Town of Paradise. 3. The harmful effect, if any, upon desirable neighborhood character - The character of the project area is rural residential, with single family dwelling units located on five acre parcels. The second dwelling unit, which will be built on top of a barn, and will be located approximately 315 feet from Honey Run Road and approximately 40 ft. from the nearest property line. While the proposed second dwelling unit will increase the density of dwelling units in the project area, it will not have a harmful effect on the neighborhood character. 4. The generation of traffic and the`capacity and physical character of surrounding streets - The second dwelling unit may result in a slight increase in vehicle traffic on Honey Run Road, but the increase will be minimal and will not have an impact on the roads in the project area. A single family dwelling unit in an urban area generates approximately ten vehicle trips per day. Dwelling units in rural areas generally generate less vehicle trips than a dwelling unit in an urban area. The number of vehicle trips that will be generated by the proposed second dwelling unit will not have a significant impact on Honey Run Road. 5. The suitability of the site for the type. and intensity of use or development which is proposed - The project site is suitable for the permanent second unit with regards to the type and intensity of the proposed use. There is sufficient buildable area on the parcel for both the primary and second dwelling units. The Butte County Environmental Health Department has tentatively approved the locations of the primary and replacement leachfields. ❑ Butte County Department of Development Services ❑ Planning Division ❑ 2 6. Any other relevant impact of the proposed use - None. This request is consistent with the intent and requirements of Section 24-280 of the Butte County Code. Upon review of this second unit application, staff has determined that the proposed second unit will not significantly impair the integrity of the zone in which it lies, nor will it be detrimental to .the health, safety, and welfare of the intended occupants or the immediate neighborhood. The Butte County Fire Department is requiring that the construction, installation, or development of structures on the project site comply with the latest California Fire Safe Regulations (Public Resources Code 4290), and all other applicable State and County Codes. They are also requiring that building identification and addresses be installed and maintained in conformance with Public Resources Code 4290 and that in lieu of a pressurized water system for fire. protection the applicant shall pay $200.00 into the Battalion 2 Water Tender Fund prior to issuance of building permit. The Butte County Environmental Health Division is recommending that two conditions be placed on this project. The first condition requires that the project meet Butte County Code requirements for sewage. disposal. The second condition requires that the project meet Butte County requirements for potable water. . The Butte County Department of Public Work is requiring that the applicant obtain an encroachment permit for the driveway and construct it to County standards. . ENVIRONMENTAL DOCUMENTATION: This application has been determined to be categorically exempt from the provisions of CEQA under a Class 3 exemption. PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be held. Notices of the hearing will be mailed to the. nearest 10 property owners. RECOMMENDATION: Staff recommends that the Planning Commission approve the Minor Use Permit on APN 011-280-117, MUP 97-04, for Michael and Sheri Royers for a second dwelling unit, subject to the findings and conditions listed in Exhibit A. The proposal conforms to the zoning and the General Plan. Staff recommends approval of this application. PROJECT CHARACTERISTICS: This request is for a Minor Use Permit to allow a 816 sq.ft. second unit pursuant to Butte County Code Section 24-280 as amended by Ordinance 3176. The property is a 5.03 acre parcel and is zoned FR -5. The Land Use Element Map of the Butte County General Plan designates the property as Agricultural Residential. The project site is located in Butte Creek Canyon, adjacent to Honey Run Road. The project site is vegetated with brush and scattered oak and digger pine trees. A natural spring is located on the project site. The project site is currently undeveloped, but the applicant intends to construct a 2,500 sq. ft. residence for use as the primary dwelling unit. Domestic water will be obtained from an on-site well. Sewage disposal will be handled by a septic tank/leachfield system. Surrounding parcels are zoned FR -5 with a General Plan designation of Agricultural -Residential and Grazing/Open Land and range in size from 5 to 47 acres. ANALYSIS: This project will allow a 816 sq.ft. second unit as a permanent second dwelling unit. The 5.03 acre parcel exceeds the minimum lot size requirements of the FR -5 zone and will not become overcrowded due to the second unit. The proposed location of the second dwelling will be outside of the required setbacks for the FR -5 zone. There is adequate space for two off- street parking spaces for the second dwelling unit. New vehicle traffic generated by the addition of a second dwelling unit will be minimal and will not have a significant impact on Honey Run Road. The applicant intends to live in the second dwelling unit until the primary dwelling unit is constructed. The applicant has stated that the intended resident of the proposed second dwelling unit, after the primary dwelling unit is constructed, will be an elderly relative. However, there is nothing that could prevent the applicants from renting out the second dwelling unit if they so desire. Butte County Code Section 24-41 addresses the required findings for approval of a Minor Use Permit. There are six areas that must be considered for approval of a Minor Use Permit: 1. Harmony in scale, bulk, coverage and density - The second welling unit will be a conventionally built structure which will be located on top of a The primary dwelling unit and the proposed second dwelling unit will be similar in scale and bulk. The proposed second dwelling unit will also be architecturally compatible with the primary dwelling unit. No additional land area will be required for the second dwelling unit because it will be located on top of a barn, thus reducing the coverage on the parcel. 2. The availability of public facilities, services and utilities - Telephone and electrical services already extend to the project parcel. Domestic water will be supplied by an on-site well, and sewage disposal will be handled by an on-site septic tank/leachfield system. The project site is located approximately 1.6 miles from the Town of Paradise and approximately 6 miles from the City of Chico. Most services can be obtained in the Town of Paradise. Pqrk is 3. The harmful effect, if any, upon desirable neighborhood character - The character of the project area is rural residential, with single family dwelling units located on five acre parcels. The second dwelling unit, which will be built on top of aR and will be located approximately 315 feet from Honey Run Road and approximately 40 ft. from the nearest property line. While the proposed second dwelling unit will increase the density of dwelling units in the project area, it will not have a harmful effect on the neighborhood character. 4. The. generation of traffic and the capacity and physical character of surrounding streets - The second dwelling unit may result in a slight increase in vehicle traffic on Honey Run Road, but the increase will be minimal and will not have an impact.on the roads in the project area. A single family dwelling unit in an urban area generates approximately ten vehicle trips per day. Dwelling units in rural areas generally generate less vehicle trips than a dwelling unit in an urban area. The number of vehicle trips that will be generated by the proposed second dwelling unit will not have a significant impact on Honey Run Road. 5. The suitability of the site for the type and intensity of use or development which is proposed - The project site is suitable for the permanent second unit with regards to the type and intensity of the proposed use. There is sufficient buildable area on the parcel for both the primary and second dwelling units. The Butte County Environmental Health Department has tentatively approved the locations of the primary and replacement leachfields. ❑ Butte. This request is consistent with the intent and requirements of Section 24-280 of the Butte County Code. Upon review of this second unit application, staff has determined that the proposed second unit will not significantly impair the integrity of the zone in which it lies, nor will it be detrimental to the health, safety, and Welfare of the intended occupants or the immediate neighborhood. The Butte County Fire Department is requiring that the construction, installation, or development of structures on the project site comply with the latest California Fire Safe Regulations (Public Resources Code 4290), and all other applicable State and County Codes. They are also requiring that building identification and addresses be installed and maintained in conformance with Public Resources Code 4290 and that in lieu of a pressurized water system for fire protection the applicant shall pay $200.00 into the Battalion 2 Water Tender Fund prior to issuance of building permit. The Butte County Environmental Health Division is recommending that two conditions be placed on this project. The first condition requires that the project meet Butte County Code requirements for sewage disposal. The second condition requires that the project meet Butte County requirements for potable water. The Butte County Department of Public Work is requiring that the applicant obtain an encroachment permit for the driveway and construct it to County standards. ENVIRONMENTAL DOCUMENTATION: This application has been determined to be categorically exempt from the provisions of CEQA under a Class 3 exemption. Building identification and/or addresses shall be installed in conformance with Public Resources Code 4290 and shall be posted at the beginning of building construction and maintained continuously thereafter. 8.
