(File MUP97-06) (SH) Mr. Hackney gave a brief summary of the project. He said the request complies with the zoning and General Plan designation. Commissioner Mooney asked about #2 of the analysis on the Agenda Report where it states public water and sewer service is provided. He said the project has a septic system and well. Mr. Hackney said this is correct and the report is in error. The hearing was opened to the public. Bill Anderson said he was concerned with property values being lowered because of the condition of the proposed mobile home. Sandy Gilb, neighbor, said she was concerned with the increased use to Lost Horizon Road. She said it is a gravel road. She also said there are blind. curves on Lower Wyandotte. She said it is hard to get people to help maintain the gravel road. She said that drainage from the Schoenfeldt property goes into hers. She was concerned with a second septic or second set of leach lines draining onto her property. She was concerned with the second unit becoming a nuisance because Ms. Schoenfeldt is elderly and will not be able to control the renters. Commissioner Mooney'noted that Environmental Health was not opposed to this permit. Ms. Gilb said she was concerned with future leach fields and the drainage. Mr. Hackney said the applicant plans to move into the mobile home and rent out the front" house. 0 Butte County Planning Commission Minutes = June 12, 1997 ❑ - - Teresa Hays said her husband does all the maintenance on the dirt road. She was against the increase in traffic. She was -also concerned that if one person was allowed a second unit, more would go in and ruin the neighborhood atmosphere. She said noise is a factor. She said Ms. Schoenfeldt has been cutting down trees that would have helped stop some of the noise. Mr. Hackney noted that the minor use. permit procedure was set up by the -Planning Commission several years ago. Ms. Hays said it was her understanding when she bought her property that they were only allowed one single-family dwelling per parcel. Commissioner Leland said there is a Second Unit Ordinance that allows anyone in the County to have a second unit if they meet certain criteria. Mr. Sanders said the AR zone allows for duplex or multi -family units. Ms.. Hays said the mobile home is an eyesore. Jackie Wright said she is concerned with the fire hazard. She said rental people will not take care of the home as an owner would. -She said noise is a concern. She said the access road was narrow. It was noted that the applicant was not present. The hearing was closed to the public. Commissioner Leland said the Commission is bound by the provisions of Code Section 24-280. He said there is no requirement as to the aesthetics. He said this type of permit should be handled on the consent agenda or by an Administrative Permit. He said the Commission almost has to vote to approve.. Vice Chairman Cage asked about a condition to replant the trees that were removed. Mr. Sanders said there is no nexus with the relief being applied for.to require the replanting of the trees. Commissioner Leland did not think the Commission should be concerned with aesthetics. Mr. Sanders. said there is no restriction against people removing trees except for - commercial purposes. He said under B findings on Page 5 of the Report, the Commission does have some discretion on whether or not to approve this permit. _ ❑'Butte County Planning Commission Minutes - June 12, 1997 ❑ - - --- It was moved by Commissioner Mooney, seconded by Commissioner Leland, and unanimously carried for approval as follows: Section 1: Environmental Findings. A. This application for a Minor Use Permit to allow a large day care center is Categorically Exempt from environmental review; and Section 2: Zoning Ordinance Findings. A. The proposed location, size, design, and operating characteristics of the proposed use is in accordance with the purpose of Chapter 24 of the Butte County Code, the purpose of the zone in which the site is located, the Butte County General Plan, and the development policies and standards of the County; and B. The proposed location, size, design, and operating characteristics of the proposed use will be compatible with and will not adversely affect, or be materially detrimental to adjacent uses, residents, buildings, structures or natural resources, with consideration given to: 1. Harmony in scale, bulk, coverage and density; 2. The availability of public facilities, services and utilities; 3. The harmful effect, if any, upon desirable neighborhood character; 4. The generation of traffic and the capacity and physical character of surrounding streets; 5. The suitability of the site for the type and intensity of use or development which is proposed; 6. Any other relevant impact of the proposed use. C. The proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it will be operated or maintained will not be detrimental to the public health, safety and.general welfare, or materially injurious to properties or improvements in the vicinity; .. and D. The proposed use will comply with. each of the applicable - provisions of Chapter 24, Section 280, of the Butte County Code. Section 3: Action. A. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant and only as to those conditions or requirements recommended by their respective departments. Prior to such approval, verification shall be made by each Department or -Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. C. Conditions of Approval: 1. - The Second Unit shall not exceed 1200 square feet. 2. Provide two additional off-street parking spaces. 3. An attached or detached garage or carport with a maximum exterior dimension 20' by 24' is permitted. 4. Either the existing single family dwelling or the Second Unit shall be owner occupied. Certification of ownership shall be required prior to Use Permit issuance and annually thereafter by submittal of a declaration in a form specified by the Director of Development Services or designee. 5. No permits for any additional dwelling may be approved unless the Second Unit is first removed. 6. Building identification an/or addresses shall be installed in conformance with Public Resources Code 4290 and shall be posted at the beginning of building construction and maintained continuously thereafter. 7. Provide an all weather access to all structures, which is designed to carry a 40,000 pound fire apparatus at least 10 feet wide with a 15 foot vertical clearance. 8. In lieu of a pressurized water system or water storage tank, payment of. $200.00 into the Battalion 6 Water Tender Fund is required prior to issuance of building permit. 9. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit, constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-45.65. 2. Unless otherwise provided for in a special condition to this use permit, all conditions must be completed by the Permittee within 12 months of the delivery of the countersigned permit to the Permittee. 3. If any use for which a use permit has been granted is not established within one year of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. 4. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the, Permittee. The proposal conforms to the zoning and the General Plan. Staff recommends approval of this application. PROJECT CHARACTERISTICS: This request is for a Minor Use Permit to allow a Second U -lit pursuant to Butte County Code Section 24 -280 -as amended by Ordinance 3176. The property is a 5.41 acre parcel and is zoned AR -5 (Agricultural Residential - 5 acre minimum) which requires a minimum lot size of five (5) acres. The Land Use Element of the Butte County General Plan designates the property as Agricultural Residential. A 1750 sq. ft. home with a 1,400 square foot garage is located on the property. Domestic water for the project site is obtained from an onsite well. An onsite septic tank and leachfield system handles sewage disposal for the residence. Surrounding parcels are zoned AR -5 with a General Plan designation of Agricultural Residential and are predominantly 5 acres in size. ANALYSIS: This project will allow a 1200 square foot second unit as a permanent second dwelling unit. The 5.41 acre parcel exceeds the. minimum lot size requirements of the AR -05 zone and will not become overcrowded due to the second unit. The proposed location of the second dwelling will be outside of the required setbacks for the AR -5 zone. There is adequate space for two off-street parking spaces for the second dwelling unit. New vehicle ,traffic generated by the addition of a new dwelling unit will be minimal and will not have a significant impact on area streets. Access to the second dwelling unit will be via a new driveway off of Lost Horizon Drive. Butte County Code Section 24-41 addresses the required findings for approval of a Minor Use Permit. There are six areas that must be considered for approval of a Minor Use Permit: 1. Harmony in scale, bulk, coverage and density - The addition of the second unit will not change the general density characteristics of the area because the lot is of great enough size to adequately provide for the second unit. 2. The harmful effect, if any, upon desirable neighborhood character - The project site has the same character as the project area. The surrounding lots are all approximately 5+/ - acres in size. The surrounding lots are also zoned AR -5 with a general plan land use designation of Agricultural Residential. Most of the adjacent lots are developed to rural density and are suitable for second units. 4. The generation of traffic and the capacity and physical character of surrounding streets - The addition of a permanent second dwelling unit may generate more vehicle traffic than is now being generated, but the increase will be minimal. and will not have an impact on the roads in the project area. 5. The suitability of the site for the type and intensity of use or development which is proposed - The project site is suitable for the permanent second unit with regards to the type and intensity of the proposed use. 6. Any other relevant impact of the proposed use - None. Upon review of this second unit application, staff has determined that the proposed second unit will not significantly impair the integrity of the zone in which it lies, nor will it be detrimental to the health, safety, and welfare of the intended occupants or the immediate neighborhood. This conclusion is based upon the site requirements for the AR -5 zone, criteria for the Agricultural Residential land use designation, the analysis and conclusions of those areas that must be met for approval of a Minor Use Permit, and based upon a site visit. The Butte County Fire Department requires that building identification and addresses be installed and maintained in conformance with Public Resources Code 4290 and that in lieu of a pressurized water system for fire protection the applicant shall pay $200.00 into the Battalion 6 Water Tender Fund prior to issuance of building permit.
