The item was -opened to the public Vice Chair Cage asked the applicant how they got to the rear of the property and where is the day care to be located? Mrs. McMurray said they will be using the house and back yard for the day care. She . noted that there is room in the front to park four cars. The item was closed to the public. It was moved by Commissioner Leland,seconded by Commissioner Mooney, and. unanimously carried to approve the consent agenda as follows: Denise McMurray - Minor Use Permit: Section 1: Environmental Findings. A. This application for a Minor Use Permit to allow a large day care center is Categorically Exempt from environmental review; and Section 2: Zoning Ordinance Findings. A. The proposed location, size, design, and operating characteristics of the proposed use is in accordance with the purpose of Chapter 24 of the Butte County Code, the purpose of the zone in which the site is located, the Butte County General Plan, and the development policies and standards of the County; and The proposed location, size, design, and operating characteristics of the proposed use will be compatible with and will not adversely affect, or be materially detrimental to adjacent uses, residents, buildings, structures or natural resources, with consideration given to: ❑,Butte•County,;Planning Commission •Minutes - June 12, 1997 ❑ 1. Harmony in scale, bulk, coverage and density; 2. The availability of public facilities, services and utilities; 3. The harmful effect, if any, upon desirable neighborhood character; 4.. Any other relevant impact of the proposed use. C. The proposed use will comply with each of the applicable provisions of Chapter 24, Section 265, of the Butte County Code. Section 3: Action. A. Subject to the findings indicated in Sections 1 and 2 of this Exhibit A, Minor Use Permit for Denise McMurray on APN 004-363-027 to allow a large family day care facility is approved subject to the conditions listed herein. B. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant and only as to those conditions or requirements recommended by their respective departments. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. C. Conditions of Approval: 1. r The facility is a single-family residence that is the principal residence of the provider and the use is clearly incidental and secondary to the use of the property for residential purposes. Mr. Sanders recommended to the Planning Commission that the Minor Use Permit for Denise McMurray be approved subject to the findings and conditions listed in Exhibit A of the Agenda Report and the item be scheduled for the June 12, 1997 Planning Commission Consent Agenda. If the Planning Commission concurs with the recommendation, the Minor Use Permit can be issued. II. This project is located in Supervisorial District 2. RELATED ITEMS: None FOR: Directors meeting of June 2, 1997 ABSTRACT: This request is for a Minor Use Permit for a large family day care facility for no more than 12 children. The proposal conforms to the zoning and the General Plan. No significant impacts will oc:ur as a result of this project. Staff recommends approval of this application. PROJECT CHARACTERISTICS: This project is a request to utilize a single family residence as a large family day care.facility subject to a Minor Use Permit as required by Butte County Code 24-95.D.1 regarding uses in an AR zone. The subject property is approximately .14 (6250 sq.ft.) acres in size and is developed with a 1,670 square foot single family residence. Domestic water for the project'site is obtained from the California Water Service. An on-site septic tank and leachfield system handles sewage disposal for the residence. The project site as well as the surrounding parcels -are zoned AR and have a General Plan designation of Medium Density Residential. - Surrounding parcels are all of similar size .as the subject property. There are no other large day care center facilities located within 500 feet driving distance from the project site. ANALYSIS: This project will allow. a large day care center in an AR zone. A small day care center (6; or less children) is currently operated out of the project site. The increase in the number of children will not significantly impact the neighborhood. The house is located in a single family residential neighborhood and 10th Street is a collector street and does not carry significant amounts of traffic. The change from a small day care home to a large day care home will increase the number of vehicle trips generated due to the day care facility from approximately 12 to approximately 24. This increase will not cause any significant impacts to local streets. Vehicles can easily access the facility by utilizing 4 parking spaces provided directly from the street on-site. This request is consistent with the intent and requirements of Section 24-265 of the Butte County Coce. Upon review of this licensed day care application, staff has determined that the proposed day care will not significantly impair the integrity of the zone in which it lies, nor will it be detrimental to the health, safety, and welfare of the intended occupants or the immediate neighborhood. RELATED ITEMS: None FOR: Directors meeting of June 2, 1997 ABSTRACT: This request is for a Minor Use Permit for a large family day care facility for no more than 12 children. The proposal conforms to the zoning and the General Plan. No sign ificantimpacts will occur as a result of this project. Staff recommends approval of this application. PROJECT CHARACTERISTICS: This project is a request to utilize a single family residence as a la-ge family day care facility subject to a Minor Use Permit as required by Butte County Code 24-95.D.1 regarding uses in an AR zone. The subject property is approximately .14 (6250 sq.ft.) acres in size and is developed with a 1,670 square foot single family residence. Domestic water for the project site is obtained from the California Water Service. An on-site septic tank and leachfield system handles sewage disposal for the residence. The project site as well as the surrounding parcels are zoned AR and have a General Plan designation of Medium Density Residential. Surrounding parcels are all of similar size as the subject property. There are no other large day care center facilities located within 500 feet drivng distance from the project site. ANALYSIS: This project will allow a large day care center in an AR zone. A small day care center (E or less children) is currently operated out of the project site. The increase in the number of children will not significantly impact the neighborhood. The house is located in a single family residential neighbonccod and 10th Street is a collector street and does not carry significant amounts of traffic. The change from a small day care home to a large day care home will increase the number of vehicle trips generated due to the day care facility from approximately 12 to approximately 24. This increase will not cause any significant impacts to local streets. Vehicles can easily access the facility by utilizing 4 parking spaces provided directly from the street on-site. This request is consistent with the intent and requirements of Section 24-265 of the Butte County Code. Upon review of this licensed day care application, staff has determined that the proposed day care will not significantly impair the integrity of the zone in which it lies, nor will it be detrimental to the health, safety, and welfare of the intended occupants or the immediate neighborhood. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved.
