Susan Blickle - (Item determined to be categorically exempt from environmental review) Minor Use Permit to allow a large family day care facility for up to 12 children on property zoned R-1 (Residential) located on the west side of Spruce Street, approximately 180 feet north of Ninth Avenue, identified as AP 003-353-007, Chico. (SH) (MUP97-07) Mr. Sanders called the meeting to order noting that the applicant was present. The hearing was opened. Ms. Blickle agreed to the conditions as listed in the agenda report dated April 14, 1997. The hearing was closed. Mr. Sanders recommended to the Planning Commission that the Minor Use Permit for Susan Blickle be approved subject to the findings and conditions listed in Exhibit A of the Agenda Report and the item be scheduled for the April 24, 1997 Planning Commission Consent Agenda. If the Planning Commission concurs with the recommendation, the Minor Use Permit can be issued. This project is located in.Supervisorial District 3. RELATED ITEMS: None FOR: Director's meeting of April 21,1997 ABSTRACT: This request is for a Minor Use Permit for a large family day care facility for no more than 12 children. The proposal conforms to the zoning and the General Plan. No significant impacts will occur as a result of this project. Staff recommends approval of this application. PROJECT CHARACTERISTICS: This project is a request to utilize a single family residence's accessory structures as a large family day care facility subject to a Minor Use Permit as required by Butte County Code 24-120.E.1 regarding uses in an R-1 zone. The subject property its approximately .24 acres in size and is developed with a total of 5487 square feet of existing structures: single family residence and a 26 -seat hair salon. Domestic water for the project site is obtained from a community water system. An on-site septic tank and leachfield system handles sewage disposal for the residence. The project site as well as the surrounding parcels are zoned R-1 and have a General Plan designation of Medium Density Residential. Surrounding parcels are all of similar size -as the subject property. For the past 20+ years, a small business, a hair salon, has been operated on this site. The are no other large day care center facilities located within 500 feet driving distance from the project site. ANALYSIS: This project will allow a large day care center in a R-1 zone. A hair salon business has previously operated out of the project site: The number of children, limited to 12, will nit significantly impact the neighborhood. The house is located in the middle of Spruce Avenua, between 9th Avenue and 10th Avenue, in a single family residential neighborhood. Spruce Avenue is a residential collector for both the Esplanade and Mangrove Avenue. It does not carry significant amounts of traffic. There will be an increase in the number of vehicle trips on Spruce Avenue in the a.m. and p.m. due to this project. This type of use is required'to have, aside from ■ Butte County Department of Development Services ■ Planning Division ■ the applicant, one employee over the age of 16 years. For quite a number of years, in excess of 20 years, the site generated a daily stream of traffic related to the hair salon business. The change from a hair salon to a large day care home may increase the number of A.M. and PJA peak hour vehicle trips generated by the day care facility to approximately 26, as juxtaposed to a constant stream of traffic that a hair salon would generate during business hours. TI -is increase in peak hour vehicle trips will not cause any significant impacts to the local streets. Vehicles can exit the site by means of an alley, either onto 9th Avenue or 10th avenue. This request is consistent with the intent and requirements of Section 24-265 of the Butte Cour-ty Code. Upon review of this licensed day care application, staff has determined that the proposed day care will not significantly impair the integrity of the zone in which it lies, nor will it be detrimental to the health, safety, and welfare of the intended occupants or the immediate neighborhood. k ENVIRONMENTAL DOCUMENTATION: This application has been determined to be categorically exempt from the provisions of CEQA under a Class 3 exemption. RECOMMENDATION: Staff recommends that the Director of Development Services set this item for approval on the consent agenda of the Planning Commission subject to the findings and conditions listed in Exhibit A. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit, constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-45.65. 2. Unless otherwise provided for in a special condition to this use permit, all conditions must be completed by the Permittee within 12 months of the delivery of the countersigned permit to the Permittee. 3. If any use for which a use, permit has been granted is not established within one year of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. 4. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. FINDINGS: ■ Butte County Department of Development Services ■ Planning Division ■ 3 Section 1: Environmental Findings. A. This application for a Minor Use Permit to allow a large day care center is Categorically Exempt from environmental review; and Section 2: Zoning Ordinance Findings. A. The proposed location, size, design, and operating characteristics of the proposed use is in accordance with the purpose of Chapter 24 of. -the Butte County Code, the purpose of the zone in which the site is located, the Butte County General Plan, and the development policies and standards of the County; and B. - The proposed location, size, design, and operating characteristics of the proposed use will be compatible with and will not adversely affect, or be materia ly detrimental to adjacent uses, residents, buildings, structures or natural resources, with consideration given to: 1. Harmony in scale, bulk, coverage and density; 2. The availability of public facilities, services and utilities; 3. The harmful effect, if any, upon desirable neighborhood character; 4. The generation of traffic and the capacity and physical character :)f surrounding streets; 5. The suitability of the site for the type and intensity of use or developme-It which is proposed; 6. Any other relevant impact of the proposed use. C. The proposed location, size, design, and operating characteristics of the proposed use and the -conditions under which it will be operated or maintained will not be detrimental to the public health, safety and general welfare, or materially injurious to properties or improvements in the vicinity; and D. The proposed use will comply with each of the applicable provisions of Chapter 24, Section 265, of the Butte County Code. Section 3: Action. A. Subject to the findings indicated in Sections 1 and 2 of this Exhibit A, Minor Use Permit for Susan Blickle on APN 003-353-007 to allow a large family day cane facility is approved subject to the conditions listed herein. B. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant and only as to those conditions or requirements recommended by their respective departments. Prior to such approval, verification ■ Butte County Department of Development Services ■ Planning Division ■ 4 shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. C. Conditions of Approval: The facility is a single-family residence that is the principal residence of the provider and the use is clearly incidental and secondary to the use of the property for residential purposes. 2. Properties proposed for Large Family day care shall be located at least 500 feet driving distance from any other Large Family day care property and the granting of the permit shall not result in any residence being bounded on more than one side by a Large Family day care. 3. Large Family day care homes shall meet the following traffic control measures: (a) In addition to providing the required number of parking spaces for the residential use, provide one off-street parking space for each employee of the facility and one off-street parking space\loading area shall be provided. The driveway area may be used to meet this requirement. (b) Large Family day care homes located on principal or minor arterial roads as designated by the General Plan Circulation Element shall provide dro:)- off and pick-up areas which prevent vehicles from backing onto such roads. (c) Properties proposed for Large Family day care homes shall have frontage on and access off a paved road. Roads that are costructed for the purpose of meeting this requirement shall meet the RS -4C standard as contained in the Butte County Improvement Standards contained in Chapter 20 of the Butte County Code. 4. One sign, not to exceed 3 square feet, shall be allowed. 5. The Large Family day care home shall be licensed by the California Departme it of Social Services, Community Care Licensing. 6. Meet all State Fire Marshall regulations pertaining to Large Family day care facilities. 7. Facilities not meeting the above standards shall require a Conditional Use Pernit to operate. Environmental Health Condition: 9. The applicant shall be required to connect to the public sewer system should the on-site sewage system fail. NOTE: Issuance of this permit does not waive the requirement of.obtaining Building Division and Environmental Health Division permits before starting construction, nor does it waive any other requirements of federal, state, and local law. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit, constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County ?oning Ordinance, including Butte County Code Sec. 24-45.65. 2. Unless otherwise provided for in a special condition to this use permit, all conditions must be completed by the Permittee within 12 months of the delivery of the countersigned permit to the Permittee. 3. If any use for which a use permit has been granted is not established within one year of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. 4. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, .and assigns of the Permittee. FINDINGS: Section 1: Environmental Findings. A. This application for a Minor Use Permit to allow a large day care center is Categorically Exempt from environmental review; and Section 2: Zoning Ordinance Findings. A. The proposed location, size, design, and operating characteristics of the proposEd use is in accordance with the purpose of Chapter 24 of the Butte County Code, tl-e purpose of the zone in which the site is located, the Butte County General Plan; and the, development policies and standards of the County; and i B. The proposed location, size, design, and operating characteristics of the proposed use will be compatible with and will not adversely affect, or be materially detrimental to adjacent use residents, buildings, structures or natural resources, with consideration given to: 1. Harmony in scale, bulk, coverage and density; 2. The availability of public facilities, services and utilities; 3. The harmful effect, if any, upon desirable neighborhood character; 4. The generation of traffic and the capacity and physical character of surrounding streets; 5. The suitability of the site for the type and intensity of use or development which is proposed; 6. Any other relevant impact of the proposed use. C. The proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it will be operated or maintained will not :)e detrimental to the public health, safety and general welfare, or materially injurious to properties or improvements in the vicinity; and D. The proposed use will comply with each of the applicable provisions of Chapter 24, Section 265, of the Butte County Code. Section 3: Action. A. Subject to the findings indicated in Sections 1 and 2 of this Exhibit A, Minor Use Permit for Susan Blickle on APN 003-353-007 to allow a large family day care facility is approved subject to the conditions listed herein. B. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant and only as to those conditions or requirements recommended by their respective departments. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. C. Conditions of Approval: The facility is a single-family residence that is the principal residence of the provider and the use is clearly incidental and secondary to the use of the property for residential purposes. 2. Properties proposed for Large Family day care shall be located at least 500 feet driving distance from any other Large Family day care property and the granting R' of the permit shall not result in any residence being bounded on more than one side by a Large Family day care. 3. Large Family day care homes shall meet the following traffic control measures: (a). . In addition to providing the required number of parking spaces for the residential use, provide one off-street parking space for each employee of the facility and one off-street parking space\loading area shall be provided. The driveway area may be used to meet this requirement. (b) Large Family day care homes located on principal or minor arterial roads as designated by the General Plan Circulation Element shall provide drop- off and pick-up areas which prevent vehicles from backing onto such roads. (c) Properties proposed for Large Family day care homes shall have frontage on and access off a paved road. Roads that are costructed for the purpose of meeting this requirement shall meet the RS -4C standard as contaired in the Butte County Improvement Standards contained in Chapter 20 of -he Butte County Code. 4. One sign, not to exceed 3 square feet, shall be allowed. 5. The Large Family day care home shall be licensed by the California Department of Social Services, Community, Care Licensing. 6. Meet all State Fire Marshall regulations pertaining to Large Family day csre facilities. 7. The applicant must meet all other applicable State and local statutes, ordinances, and regulations. 8. Facilities not meeting the above standards shall require a Conditional Use Permit to operate. 9. The applicant shall be required to connect to the public sewer system should the on-site sewage system fail. NOTE: Issuance of this permit does not waive the requirement of. obtaining Building Division and Environmental Health Division permits before starting construction, nor does it waive any other requirements of federal, state, and local law. RELATED ITEMS: None FOR: Director's meeting of April 21,1997 ABSTRACT: This request is for a Minor Use Permit for a large family day care facility for no more than 12 children. The proposal conforms to the zoning and the General Plan. No significant impacts will occur as a result of this project. Staff recommends approval of this application. PROJECT CHARACTERISTICS: This project is a request to utilize a single family residence's accessory structures as a large family day care facility subject to a Minor Use Permit as required by Butte County Code 24-120.E.1 regarding uses in an R-1 zone. The subject property is approximately .24 acres in size and is developed with a total of 5487 square feet of existing structures: single family residence and a 26 -seat hair salon. Domestic water for the project ste is obtained from a community water system. An on-site septic tank and leachfield system handles sewage disposal for the residence. The project site as well as the surrounding parcels are zoned R-1 and have a General Plan designation of Medium Density Residential. Surrounding parcels are all of similar size as the subject property. For the past 20+ years, a small business, a hair salon, has been operated on this site. There are no other large day care center facilities located within 500 feet driving distance from the project site. ANALYSIS: This project will allow a large day care center in a R-1 zone. A hair salon business has previously operated out of the project site. The number of children, limited to 12, will not significantly impact the neighborhood. The house is located in the middle of Spruce Avenwa., between 9th Avenue and 10th Avenue, in a single family residential neighborhood. Spruce Avenue is a residential collector for both the Esplanade and Mangrove Avenue. It does not carry significant amounts of traffic. There will be an increase in the number of vehicle trips on Spruce Avenue in the a.m. and p.m. due to this project. This type of use is required to have, aside frcm ■ Butte County Department of Development Services ■ Planning Division ■ the applicant, one employee over the age of 16 years. For quite a number of years, in excess of 20 years, the site generated a daily stream of traffic related to the hair salon business. The change from a hair salon to a large day care home may increase the number of A.M. and P.M. peak hour vehicle trips generated by the day care facility to approximately 26, as juxtaposed to a constant stream of traffic that a hair salon would generate during business hours. This increase in peak hour vehicle trips will not cause any significant impacts to the local streets. Vehicles can exit the site by means of an alley, either onto 9th Avenue or 10th avenue. This request is consistent with the intent and requirements of Section 24-265 of the Butte County Code. Upon review of this licensed day care application, staff has determined that the proposed day care will not significantly impair the integrity of the zone in which it lies, nor will it be detrimental to the health, safety, and welfare of the intended occupants or the immediate neighborhood. ENVIRONMENTAL DOCUMENTATION: This application has been determined to be categorically exempt from the provisions of CEQA under a Class 3 exemption. RECOMMENDATION: Staff recommends that the Director of Development Services set this item for approval on the consent agenda of the Planning Commission subject to the findings and conditions listed in Exhibit A. Harmony in scale, bulk, coverage and density; 2. The availability of public facilities, services and utilities; 3. The harmful effect, if any, upon desirable neighborhood character; 4. The generation of traffic and the capacity and physical character of surrounding streets; 5. The suitability of the site for the type and intensity of use or development which is proposed; 6. Any other relevant impact of the.proposed use. C. The proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it will be operated or maintained will not to detrimental to the public health, safety and general welfare, or materially injurious to properties or improvements in the vicinity; and D. The proposed use will comply with each of the applicable provisions of Chapter 24, Section 265, of the Butte County Code. Section 3: Action. A. The facility is a single-family residence that is the principal residence of the provider and the use is clearly incidental and secondary to the use of the property for residential purposes. 2. Properties proposed for Large Family day care shall be located at least 500 feet driving distance from any other Large Family day care property and the granting of the permit shall not result in any residence being bounded on more than one side by a Large Family day care. 3. Large Family day care homes shall meet the following traffic control measures: (a) In addition to providing the required number of parking spaces for the residential use, provide one off-street parking space for each employee -of the facility and one off-street parking space\loading area shall be provided. The driveway area may be used to meet this requirement. - (b) Large Family day care homes located on principal or minor arterial roads as designated by the General Plan Circulation Element shall provide drop- off and pick-up areas which prevent vehicles from backing onto such roads. (c) Properties proposed for Large Family day care homes shall have frontage on and access off a paved road. Roads that are costructed for the purpose of meeting this requirement shall meet the RS -4C standard as contained in the Butte County Improvement Standards contained in Chapter 20 of the Butte County Code. 4. One sign, not to exceed 3 square feet, shall be allowed. 5. The Large Family day care home shall be licensed by the California Department of Social Services, Community Care Licensing. 6. - Meet all State Fire Marshall regulations pertaining to Large Family day care facilities. 7. Facilities not meeting the above standards shall require a Conditional Use Permit' to operate. Environmental Health Condition: 9.
