(File MUP97-08) (LP) Mr. Sanders gave a brief summary of the project stating this is a second dwelling that was established in 1995 as a senior dwelling. He said the applicant is asking that this be changed to a permanent second dwelling. He said.she is not renting to a senior at this time. A video of the property was shown. The hearing was opened to the public. Ms. Carrillo said she agreed with the conditions.. The hearing was closed. It wasmoved by 'Commissioner Mooney, seconded by Commissioner Leland, and unanimously carried to approve the Minor Use Permit as follows: Section 1: Environmental Findings. A. This application for a Minor Use Permit to allow a large family day care facility is Categorically Exempt from environmental review; and B. This application for a Minor Use Permit to allow. a Second Dwelling Unit is Categorically Exempt from environmental review; and Section 2: Zoning Ordinance Findings. A. The proposed location, size, design, and operating characteristics of the proposed use is in accordance with the purpose of Chapter 24 of the Butte County Code, the purpose of the zone in which the site is located, the Butte County General Plan, and the development policies and standards of the County; and B. The proposed location, size, design, and operating characteristics of the proposed use will be compatible with and will not adversely affect, or be materially detrimental to adjacent uses, residents, buildings, structures or natural resources, with consideration given to: �` 0"Butte County Planning Commission Minutes -.June 12, 1997-0.--- _ -- 1. The proposed use will comply with each of the applicable provisions of Chapter 24, Section 265 and Section 280, of the Butte County Code. . Section 3: Action. A. Subject to the findings indicated in Sections 1 and 2 of this Exhibit A, Minor Use Permit for Denice Carrillo on APN 036-650-004 to allow a large family day care facility and a Second Dwelling Unit is approved subject to the. conditions listed herein. B. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant and only as to those conditions or requirements recommended by their respective departments. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. C. - Conditions of Approval: 1. The facility is a single-family residence that is the principal residence of the provider and the use is clearly incidental and secondary to the use of the property for residential purposes. �� ~ J -0 Butte County. One sign, not to exceed 3 square feet, shall be allowed. 4. The Large Family day care home shall be licensed by the California . Department of Social Services, Community Care Licensing. 5. Meet all State Fire Marshall regulations pertaining to Large Family day care facilities. 6. The applicant must meet all other applicable State and local statutes, ordinances, and regulations. 7. Facilities not meeting the above standards shall require a Conditional Use Permit to operate. 8. The Second Dwelling Unit Shall not exceed 1200 square feet. 9. Provide two (2) additional off-street parking spaces. 10. An attached or detached garage or carport with a maximum exterior dimension of 20' by 24' is permitted. 11. Either the existing single family dwelling or the Second .Dwelling Unit shall be owner occupied. Certification of ownership shall be required prior to Use Permit issuance and annually thereafter by submittal of a declaration in the form specified by the Director of Development Services or designee. 12. No permits for any additional dwelling may be approved unless the Second Unit is first removed. 13. Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions set forth below: Denice Carrillo is hereby granted an Administrative Permit in accordance with application filed: November 2, 1994 to allow a detached Senior Citizen dwelling unit on property zoned R-1 (Residential) located on the west side of Lower Wyandotte. Road, approximately 400 feet north of Monte Vista Avenue in the Oroville, CA area. I. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit, constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Section 24- 62. 2. Unless otherwise provided for in a condition to an Administrative Permit, all A conditions must be completed by the permittee within 12 months of the - delivery of the countersigned permit to the permittee. 3. If any use for which an Administrative Permit has been granted is not established within one year of the date of receipt of the countersigned permit by the permittee, the permit shall be come null and void and reapplication shall be required to establish the use. 4. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. SPECIAL CONDITIONS: The "living area" meaning the interior habitable floor space area of a dwelling unit including basements and . attics, but not including a garage or any accessory structure, shall not exceed 1,200 square feet. 2. The senior citizen dwelling unit is intended for the sole occupancy of one (1) adult 62 years of age or over or two (2) adult persons, one of whom is 62 years of age or over. An affidavit of compliance with the age requirements of this section shall be recorded in the office of the Recorder prior to issuance of building permits Said affidavit shall include the legal description of the lot or parcel and shall constitute a covenant running with the land, binding upon the original owners and their heirs, successors and assigns, limiting the occupancy of the senior citizen dwelling unit to the conditions described in this section. The senior citizen dwelling unit shall not be sold as a separate unit unless a parcel • containing the unit is created in compliance with the existing zoning and subdivision ordinances and the resulting density is in conformance with the General Plan. 4. Two off-street parking spaces shall be provided for the senior citizen dwelling unit in addition to the parking spaces required for the primary dwelling unit. 5. Adequate sewer and water facilities shall be provided subject to the approval of Environmental Health Department. 6. All site development standards as required by the zoning district in which the unit is located shall be met. 7. The senior citizen dwelling unit shall be a conventionally constructed building or a mobile home that complies with the National Manufactured Housing Construction and Safety Standards Act of 1974. 8. Maintain at least a 12 ft. wide access to the'rear of the property for fire protection purposes. 9. The approval of this permit constitutes approval only to the extent that the project complies with the Butte County Code and all other applicable regulations. 10. The requirements of all concerned governmental agencies having jurisdiction by law, including but not limited to the issuance of appropriate permits, shall be met. NOTE: Minor changes may be approved administratively by the Director of Development Services upon receipt of a substantiated written request by the applicant. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Prior to issuance of your Use Permit, only people 62 years of age or older could live in the senior citizen dwelling unit. Your Use Permit now allows that dwelling unit to be occupied by a person or persons of any age. On October 15, 1997, you recorded an affidavit at the Butte County Recorder's Office which states that you or any future owners of your parcel will live in one of the two dwelling units on the parcel. That affidavit did not require a statement to show that the senior citizens dwelling unit can now be occupied by a person of any age. The Use Permit issued to you is the authority that gave you permission to rent the second dwelling unit to a person of any age. I hope this letter answers the request that was made of you to modify the affidavit. The proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it will be operated or maintained will not be detrimental to the public health, safety and general welfare, or materially injurious to properties or improvements in the vicinity; and D. Subject to the findings indicated in Sections 1 and 2 of this Exhibit A, Minor Use Permit for Denice Carrillo on APN 036-650-004 to allow a large family day care facility and a Second Dwelling Unit is approved subject to the conditions listed herein. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiat6J written request by the applicant and only as to those conditions or requirements recommended by their respective departments. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. C. Conditions of Approval: 1. The facility is a single-family residence that is the principal residence of the provider and the use is clearly incidental and secondary to the use of the property for residential purposes. 2. Large family day care homes shall meet the following traffic control measures: (a) Provide 2 additional off street parking spaces for a total of 6. (b) The present design of having a circular driveway .or other suitable turn around so vehicles will not have to back out onto Lower Wyandotte Road shall be -maintained. 3. One sign, not to exceed 3 square feet, shall be allowed. 4. The Large Family day care home shall be licensed by the California DepartmEnt of Social Services, Community Care Licensing. 5. Meet all State Fire Marshall regulations pertaining to Large Family day care facilities. 6. The applicant must meet'all other applicable State and local statutes, ordinances, and regulations. 7. Facilities not meeting the above standards shall require a Conditional Use Permit to operate. 8. The Second Dwelling Unit Shall not exceed 1200 square feet. 9. Provide two (2) additional off-street parking spaces. 10. An attached or detached garage or carport with a maximum exterior dimension of 20' by 24' is permitted. 11. Either the existing single family dwelling or the Second Dwelling Unit shall b-3 owner occupied. Certification of ownership shall be required prior to Use Permit issuance and annually thereafter by submittal of a declaration in the form specified by the Director of Development Services or designee. 12. No permits for any additional dwelling may be approved unless the Second Unit is first removed. 13.. Provide an all weather access to all structures, which is designed to carry a 40,000 pound fire apparatus at least 10 feet wide with a 15 foot vertical clearance. This project is located in Supervisorial District 1. RELATED ITEMS:. None FOR: Director's meeting of June 12,1997 ABSTRACT: This request is for a Minor Use Permit for a large family day care facility for no more than 12 children and to change an existing senior citizen dwelling into a permanent seccnd dwelling no larger than 1200 sq. ft. The proposal conforms to the zoning and the General Plan. No significant impacts will occur as a result of this project. Staff recommends approvalof t-iis application. PROJECT CHARACTERISTICS: This project is a request to utilize an existing residence (mobile home) for the large family day care facility subject to a Minor Use Permit as required by Butte County Code 24-120.E.1 regarding uses in an R-1 zone. There is also an existing house on the property, which was established as a senior citizen dwelling and is no longer being used in that capacity. The subject property is approximately 1.25 acres in size. Domestic water for the project site is obtained from O.W.I.D. water system. Sewage disposal for the residences is served by L.O.A.P.U.D. The project site, as well as the surrounding parcels, are zoned R-1 a-ld have a General Plan designation of Low Density Residential. The senior citizen dwelling was approved January 18, 1995 by Administrative Permit No. 95-69' ANALYSIS: The applicant is the owner of the property and resides on the premises and is presently operating a day care facility for up to 6 children. Due to requests from citizens for the service, the applicant is applying to increase the occupancy to 12 children. Pursuant to Butte County Code Section 24-265, large family day care facilities shall meet all of the following minimum standards and conditions, as well as State licensing and Fire Marshall requirements: ■ Butte County Department of Development Services ■ Planning Division ■ The facility is a single family residence that is the principal residence of the provider and the use is clearly incidental and secondary to the use of the property for residential purposes. 2. Properties proposed for Large Family day care shall be located at least 500 feet driving distance from any other Large Family day care property and the granting of the permit shall not result in any residence being bounded on more than one side by a Large. Family day care. 3. Large Family day care homes shall meet the following traffic control measures: (a) In addition to providing the required number of parking spaces for the residential use, one off-street parking space for each employee of the facility and one off-street parking space/loading area shall be provided. The driveway area may be used to meet this requirement. (b) Large Family day care homes located on principal or minor arterial roads as designated by the General Plan Circulation Element shall provide drDp- off and pick-up areas which prevent vehicles from backing onto such roads. (c) Properties proposed for Large Family day care homes shall have frontage on and access off a paved road. Roads that are constructed for he purpose of meeting this requirement shall meet the RS -4C standard as contained in the Butte County Improvement Standards contained in Chapter 20 of the Butte County Code. 4. One sign, not to exceed 3 square feet, shall be allowed. This project does meet the requirements to allow a large family day care facility in a R-1 zone. The number of children, limited to 12, will not significantly impact the neighborhood. The existing mobile home is approximately 1500 sq. ft. and is where the present day care facility is be ng operated. There are no other day care facilities within 500 feet of the project site.. Lower Wyandotte Road is a minor arterial road. It does carry significant amounts of traffic. There will be an increase in the number of vehicle trips on Lower Wyandotte Road in the a.m. and pin. due to this project. This increase in peak hour vehicle trips will not cause any significant imps:;ts to the local streets. Vehicles can exit, drop off and pick up the children by means of a circular driveway. The existing senior citizen dwelling is 850 sq. ft. The county removed the age restriction because there were no means of enforcing who was living in the dwellings. The dwelling is presently being rented to people who are not senior citizens. This request is consistent with the intent and requirements of Section 24-265, (Day Cere Facilities), and Section 24-280, (Second Units), of the Butte County Code. The project site, as well as the surrounding parcels, are zoned R-1 and have a General Plan designation of Low Density Residential. The senior citizen dwelling was approved January 18, 1995 by Administrative Permit No. 95-89. ANALYSIS: The applicant is the owner of the property and resides on the premises and is presently operating a day care facility for up to 6 children. Due to requests from citizens for the service, the applicant is applying to increase the occupancy to 12 children. Pursuant to Butte County Code Section 24-265, large family day care facilities shall meet all of the following minimum standards and conditions, as well as State licensing and Fire Marshall,requiremenis: ■ Butte County Department of Development Services ■ Planning Division ■ • The facility is a single family residence that is the principal residence of the provider and the use is clearly incidental and secondary to the use of the property for residential purposes. I 2. Properties proposed for Large Family day care shall be located at least 500 feet driving distance from any other Large Family day care property and the granting of the permit shall not result in any residence being bounded on more than one side by a Large Family day care. 3. Large Family day care homes shall meet the following traffic control measures: (a) In addition to providing the required number of parking spaces for the residential use, one off-street parking space for each employee of the facility and one off-street parking space/loading area shall be provided. The driveway area may be used to meet this requirement. (b) Large Family day care homes located on principal or minor arterial roads as designated by the General Plan Circulation Element shall provide drop- off and pick-up areas which prevent vehicles from backing onto such roads. (c) Properties proposed for Large Family day care homes shall have frontage on and access off a paved road. Roads that are constructed for the purpose of.meeting this requirement shall meet the RS -4C standard as contained in the Butte County Improvement Standards contained in Chapter 20 of the Butte County Code. 4. One sign, not to exceed 3 square feet, shall be allowed. This project does meet the requirements to allow a large family day care facility in a R-1 zone. The number of children, limited to 12, will not significantly impact the neighborhood. The existing mobile home is approximately 1500 sq. ft. and is where the present day care facility is being operated. There are no other day care- facilities within 500 feet of the project site. Lower Wyandotte Road is a minor arterial road. It does carry significant amounts of traffic. There will be an increase in the number of vehicle trips on Lower Wyandotte Road in the a.m. and p.m. due to this project. This increase in peak hour vehicle trips will not cause any significant impacts to the local streets. Vehicles can exit, drop off and pick up the children by means of a circular driveway. The existing senior citizen dwelling is 850 sq. ft. The county removed the age restriction because there were no means of enforcing who was living in the dwellings. The dwelling is presently being rented to people who are not senior citizens. This request is consistent with the intent and requirements of Section 24-265, (Day Care Facilities), and Section 24-280, (Second Units), of the Butte County Code.
