Rita Hobbs - (Item determined to -be categorically exempt from environmental
review) -Minor -Use Permit to.allow,a permanent second dwelling. unit, under -the
provisions of Butte County Code Section 24-280 on property zoned AR -MH -5
(Agricultural Residential - Mobile Home - 5 acre parcels) located on the east side
of Lone Tree Road, approximately 2,075 feet north of Kenneth Lane, at 293 Lone
Tree Road, identified as AP 026-260-014, Palermo. (LP) (MUP97-10) (VIDEO)
A video of the site was shown. Mr. Sanders gave a brief summary of the project. He said
it would be difficult to divide this parcel later, but it could be done.
Chairman Lambert asked if the Code allows for older mobile homes?
Mr. Sanders said the older mobile home would not be a new -installation.
Chairman Lambert said she has a problem with a 1960 mobile home of 600 sq. ft. being
used as a permanent second dwelling and a rental. She said she would not have a
problem with the 1960 mobile home being a temporary use.
Commissioner Mooney said a permanent second dwelling unit.is allowed under the zoning
and General Plan designation.
Commissioner Leland said if there is a second unit allowed, the size of the parcel needs
to be double the size of the zone.
The hearing was opened to the public.
Rita Hobbs said she wanted the second unit for her son. She said she has no intention of
splitting the property.
Chairman Lambert said she would be more in favor of a temporary second dwelling.
Mr.. Sanders noted that the zone has provisions for duplex and multi -family dwellings.
Commissioner Nelson said he did not see a problem with this application.
Commissioner Cage noted that once another dwelling is built, the older mobile home will
become the permanent second dwelling.
The hearing was closed.
It was moved by Commissioner Mooney; seconded by Commissioner Cage; and carried
for approval as follows:

Section 1: Environmental Findings.
A. This application for a Minor Use Permit to allow'a permanent second dwelling unit
is Categorically Exempt from environmental review; and
Section 2: Zoning Ordinance Findings.
A. The proposed location, size, design, and operating characteristics of the proposed
use is in accordance with the purpose of Chapter 24 of the Butte County Code, the
purpose of the zone in which -the site is located, the Butte County General Plan, and
the development policies. and standards of the County, and
B. The proposed location, size, design, and operating characteristics of the proposed
use will be compatible with and will not adversely affect or be materially detrimental
to adjacent uses, residents, buildings, structures or natural resources, with
consideration given to:
1. Harmony in scale, bulk, coverage and density;
2. The availability of public facilities, services and utilities;
3. The harmful effect, if any, upon desirable neighborhood character;
4. The generation of traffic and the capacity and physical character of
surrounding streets;
5. The suitability of the site for the type and intensity of use or development
which is 'proposed;
6. Any other relevant impact of the proposed use. r
C. The proposed location, size, design, and operating characteristics of the proposed
use and the conditions under which it will -be operated or maintained will not.be
detrimental to the public health, safety and general.welfare, or materially injurious
to properties or improvements in the vicinity; and
D. The proposed use will comply with each of the applicable provisions of Chapter 24,
Section 280, of the Butte County Code.
Section 3: Action.
A. Subject to the findings indicated in Sections.1,and 2 of this Exhibit-A,_Minor Use
- Permit for Rita Hobbs on APN 026-260-014 to allow a permanent second dwelling
unit is approved subject to the conditions listed herein.

B. Minor changes may be approved administratively by the Directors of Development
Services, Environmental Health, or Public Works upon receipt of a substantiated'
written request by the applicant and only as to those conditions or requirements
recommended by their respective departments. Prior to such approval, verification
shall be made by each Department or Division that the modification is consistent
with the application, fees paid and environmental determination as -conditionally
approved. Changes deemed to be major or significant in nature shall require a
formal application for amendment.
C. Conditions of Approval:
1. The Second Unit shall not exceed 1200.square feet.
2. Provide two additional off-street spaces.
3. An attached or detached garage or carport with a maximum exterior
dimension 20' by 24' is permitted.
4. Adequate sewer facilities shall be provided under permit as determined by
the Butte County Environmental Health Division.,
5. Either the existing single family dwelling or the Second Unit shall be owner
occupied. Certification of ownership shall be required prior to permit
issuance and annually thereafter by submittal of a declaration in a form
specified by the Director of Development Services or designee.
6. No permits for any additional dwelling may be approved unless the
applicant/owner first receive approval from the Butte County Planning
Commission.
7. Construction, installation or development of structures or facilities on the
parcels/lots shall comply ..with the latest California Fire Safe Regulations,
(Public Resources Code 4290), and all other applicable State and County
codes, ordinances and regulations in effect at the time of application for
improvement permits.
8. Building identification and/or addresses shall be installed in conformance
with Public Resources Code 4290 and shall be posted at the beginning of
building construction and maintained continuously thereafter.
9. Provide an all weather access to all structures, which, is designed to carry a
40,000 pound fire apparatus, at least 10 feet wide with a 15 foot vertical
clearance.

Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special
conditions set forth below: Rita Hobbs is hereby granted a Minor Use Permit in
accordance with the application filed May 19, 1997 to allow a permanent second dwelling
unit on property zoned ARMH-5, located at 293 Lone Tree Road, Oroville.
1. Failure to comply with the conditions specified herein as the basis for approval of
application and issuance of Permit, constitutes cause for the revocation of said
permit in accordance with the procedures set forth in the Butte County. Zoning
Ordinance, including Butte County Code Sec. 24-62.
2. Unless otherwise provided for in a condition to this Minor Use Permit, all conditions
must be completed by the Permittee within 12 months of the delivery of the
countersigned permit to the Permittee.
3. If any use for which a Minor Use Permit has been granted is not established within
one year of the date of receipt of the countersigned permit by the permittee, the
permit shall become null and void and reapplication shall be required to establish
the use.
4. The terms and conditions of this permit shall run with the land and shall be binding
upon and be to the benefit of the heirs, legal representatives, successors, and
assigns of the Permittee.
FINDINGS:
Section 1: Environmental Findings.
A. This application for a Minor Use Permit to allow a permanent second
dwelling unit is Categorically Exempt from environmental review; and
Section 2: Zoning Ordinance Findings.
A. The proposed location, size, design, and operating characteristics of the
proposed use is in accordance with the purpose of Chapter 24 of the Butte
County Code, the purpose of the zone in which the site is located, the Butte
County General Plan, and the development policies and standards of the
County; and
B. The proposed location, size, design, and operating characteristics of the
proposed use will be compatible with and will not adversely affect or be
materially detrimental to adjacent uses, residents, buildings, structures or
natural resources, with consideration given to:
1. Harmony in scale, bulk, coverage and density;
2. The availability of public facilities, services and utilities;
3. The harmful effect, if any, upon desirable neighborhood character;
4. The. generation of traffic and the capacity and physical character of
surrounding streets;
5. The suitability of the site for the type and intensity of use or
development which is proposed;
6. Any other relevant impact of the proposed use.
C. The proposed location, size, design, and operating characteristics of the
.proposed use and the conditions under which it will be operated or
maintained will not be detrimental to the public health, safety and general
welfare, or materially injurious to properties or improvements in the vicinity,
and
D. The proposed use will comply with each of the applicable provisions of
Chapter 24, Section 280, of the Butte County Code.
Section 3: Action.
A. Subject to the findings indicated in Sections 1 and 2 of this Exhibit A, Minor
Use Permit for Rita Hobbs on APN 026-260-014 to allow a permanent
second dwelling unit is approved subject to the conditions listed herein.
B. Minor changes may be approved administratively by the Directors of
Development Services", Environmental Health, or Public Works upon receipt
of a substantiated written request by the applicant and only as to those
conditions or requirements recommended by their respective departments.
Prior to such approval, verification shall be made by each Department or
Division that the modification is consistent with the application, fees paid and
environmental determination as conditionally approved. Changes deemed
to be major or significant in nature shall require a formal application for
amendment.
C. Conditions of Approval:
1. The Second Unit shall not exceed 1200 square feet.
2. Provide two additional off-street spaces.
3. An attached or detached garage or carport with a maximum exterior
dimension 20' by 24' is permitted.
4. Adequate sewer facilities shall be provided under permit as determined by
the Butte County Environmental Health Division.
5. Either the existing single family dwelling or the Second Unit shall be owner
occupied. Certification of ownership shall be required prior to permit
issuance and annually thereafter by submittal of a declaration in a form
specified by the Director of Development Services or designee.
6. No permits -for any additional dwelling may be approved unless the
applicant/owner first receive approval from the Butte County Planning
Commission.
7. Construction, installation or development of structures or facilities on the
parcels/lots shall comply with the latest California Fire Safe Regulations,
(Public Resources Code 4290), and all other applicable State and County
codes, ordinances and regulations in effect at the time of application for
improvement permits.
8. Building identification and/or addresses shall be installed in conformance
with Public Resoutces Code 4290 and shall be posted at the beginning of
building construction and maintained continuously thereafter.
9. Provide an all weather access to all structures, which is designed to carry a
40,000 pound fire apparatus, at least 10 feet wide with a 15 foot vertical
clearance.
10. Contact O.W.I.D. for connection of the second dwelling to the existing.water
service.
11. Applicant shall comply with all other applicable federal, state and local
regulations.
NOTE: Issuance of this permit does not waive the requirement of obtaining'Building
Division and Environmental Health Division permits before starting construction, nor does
it waive any other requirements of federal, state, and local law.

At the regular meeting of the Butte County Planning Commission held July 24, 1997, your
request for a Minor Use Permit to allow a permanent second dwelling on property zoned
AR -MH -5 located at 293 Lone Tree Road, Palermo, was approved subject to the conditions
listed on the permit.
Should you desire to appeal any of the conditions imposed by the Planning Commission,
you must do so in writing, to the Clerk of the Board of Supervisors, 25 County Center Drive,
Oroville, California, prior to 5:00 p.m., Monday, August 4, 1997. The appeal deposit of
$250.00 must be paid at that time. If you do not appeal and if there are no other appeal
within the 10 calendar -day appeal period, the action of the Planning Commission is final.
For purposes of the California Environmental Quality Act, a Notice of Exemption must be
filed. The fee for the filing of a Notice of Exemption is the $25.00 documentary handling
fee. A check made payable to the Butte County Treasurer in the amount of $25.00 should
be submitted to the Planning Division in order to complete the process.
You will receive your valid permit, if there are no appeals, after it has been signed by the
Planning Commission Chairman and we have received your recorded Certification of
Ownership.

A request for a Minor Use Permit for a permanent second dwelling unit
under the provisions of Butte County Code Section 24-280. The property
is zoned ARMH-5 (Agricultural Residential Mobile Home, 5 acre minimum
parcel size), and is located on the east side of Lone Tree Road,
approximately 2,075 ft. north of Kenneth Lane, located at 293 Lone Tree
Road, Palermo. This project is located in Supervisorial District 1.

SUMMARY: This request is for a Minor Use Permit for a permanent second dwelling unit no
larger than 1200 sq. ft.. The proposal conforms to the zoning and the General Plan. The
application meets the requirements of Section 24-280 of the Zoning Code.
PROJECT CHARACTERISTICS: This request is for a Minor Use Permit to allow a Second Unit
pursuant to Butte County Code Section 24-280 as amended by Ordinance 3176. The size of
the project parcel is 16.08 acres, the current zoning is ARMH-5. The Land Use Element Map
of the Butte County General Plan designates the property as Agricultural -Residential. A 1960,
600 sq. ft. mobile home and a barn are located on the property. Domestic water for the
residence is obtained from O.W.I.D. An on-site septic tank and leachfield system handles
sewage disposal for the residence.
ANALYSIS:.. This project will allow a 1200 sq. ft. second unit as a permanent second dwelling
unit. The 16.08 acre parcel exceeds the minimum lot size requirements of the ARMH-5 zone.
The applicant proposes to build a 1,008 sq. ft. conventional house on the property as the primary
dwelling. The existing 600 square foot mobile home will, therefore, become the second dwelling.
The Butte. County Environmental Health Division (EHD) will require the applicant to obtain a
permit and install a septic system. O.W.I.D. requests the applicant apply for connection to.the
existing water service. New vehicle traffic generated by the addition of a new dwelling unit will
be minimal and will not have a significant impact on area streets. Access to both homes will be
via the existing driveway.
Butte County Code Section 24-41 addresses the required findings for approval of a Minor Use
Permit. There are six areas that must be considered for approval of a Minor Use Permit:

1. Harmony in scale, bulk, coverage and density - The addition of the second unit will not
change the general density characteristics of the area because the lot is of great enough
size to adequately provide for three dwelling units total, if developed to maximum density
of the ARMH-5 zone.
2. The availability of public facilities, services and utilities - Telephone and electrical services
already extend to the project parcel. Public water is provided to the project site.
3. The harmful effect, if any, upon desirable neighborhood character - The project site has
the same character as the project area. The surrounding lots are all approximately 5+/ -
acres in size. The surrounding lots are also zoned ARMH-5 with a general plan land use
designation of Agricultural Residential. Most of the adjacent lots are developed to rural
density and are suitable for second units.
4. The generation of traffic and the'capacity and physical character of surrounding streets -
The addition of a permanent second dwelling unit may generate more vehicle traffic than
is now being generated, but the increase will be minimal and will not have an impact on
the roads in the project area.
5. The suitability of the site for the type and intensity of use or development which is
proposed - The project site is suitable for the permanent second unit with capacity to
allow another dwelling unit if the parcel were to be developed to maximum density of the
ARMH-5 zone.
6. Any other relevant impact of the proposed use - None.
Upon review of this second unit application, staff has determined that the proposed second unit
will not significantly impair the integrity- of the zone in which it lies, nor will it be detrimental to the
health, safety, and welfare of the intended occupants or the immediate neighborhood. This
conclusion is based upon the site requirements for the ARMH-5 zone, criteria for the Agricultural
Residential land use designation, the analysis and conclusions of those areas that must be met
for approval of a Minor Use Permit, and based upon a site visit.
The Butte County Environmental Health Division has stated that the second dwelling unit can
be effectively served by a septic system on the site.
This request is consistent with the intent and requirements of Section 24-280 of the Butte County
Code.
ENVIRONMENTAL DOCUMENTATION: This application has been determined to be
categorically exempt from the provisions of CEQA under a Class 3 exemption.
PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be held.
Notices of the hearing will be mailed to the nearest 10 property owners..

RECOMMENDATION: Staff recommends that the Planning Commission approve the Minor
Use Permit for Rita Hobbs on APN 026-260-014, File # MUP 97-10. Should the Commission
find that the development of the second unit is appropriate, staff has included the following
findings and conditions listed in Exhibit A.

Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special
conditions set forth below: Rita Hobbs is hereby granted a Minor Use Permit in accordance with
the application; filed May 19, 1997 to allow a permanent second dwelling unit on property zoned
ARMH-5, located at 293 Lone Tree Road, Oroville.
1. " Failure to comply with the conditions, specified herein as the basis for approval of
application and issuance of Permit, constitutes cause for the revocation of said
permit in accordance with the procedures set forth` "'in the Butte County Zoning
Ordinance, including .Butte County Code Sec..:24-62. .
2. Unless otherwise provided for in a condition to this Minor Use Permit, all conditions
must. be completed by the Permittee .within 12 months of the delivery of the
countersigned permit to the Permittee.
3. If any use for which a Minor Use Permit has been granted is not established within
one year of the date of receipt of the countersigned permit by the permittee, the
permit shall become null and void and reapplication shall be required to establish
the use.
4. The terms and conditions of this permit shall run with the land and shall be binding
upon and be to the benefit of the heirs, legal representatives, successors, and
assigns of the Permittee.
FINDINGS:
Section 1: Environmental Findings.

is Categorically Exempt from environmental review; and

Section 2: Zoning Ordinance Findings
A. The proposed location,. size, design, and operating characteristics of the proposed
use is in accordance with the purpose of Chapter 24 of the Butte County Code, the
purpose of the zone in which the site is located, the Butte County General Plan,
and the development policies and standards of the County;* and
B. The proposed location, size, design, and operating characteristics of the proposed
use will be compatible with and will not adversely affect or be materially
detrimental to adjacent uses, residents, buildings, structures or natural resources,
with consideration given to:
1. Harmony in scale, bulk, coverage and density;
2. The availability of public facilities, services and utilities;
3. The harmful effect, if any, upon desirable neighborhood character;
4. The generation of traffic and the capacity and physical character of
surrounding streets;
5. The suitability of the site for the type and intensity of use or development
which is proposed;
6. Any other relevant impact of the proposed use.
C. The proposed location, size, design, and operating characteristics of the proposed
use and the conditions under which it will be operated or maintained will not be
detrimental to the public health, safety and general welfare, or materially injurious
to properties or improvements in the vicinity; and
D. The proposed use will comply with each of the applicable provisions of Chapter 24,
Section 280, of the Butte County Code.
Section 3: Action.
A. Subject to the findings indicated in Sections 1 and 2 of this Exhibit A, Minor Use
Permit for Rita Hobbs on APN 026-260-014 to allow a permanent second dwelling
unit is approved subject to the conditions listed herein.
B. Minor changes may be approved administratively by the Directors of Development
Services, Environmental Health, or Public Works upon receipt of a substantiated
written request by the applicant and only as to those conditions or requirements
recommended by their respective departments. Prior to such approval, verification
shall be made by each Department or Division that the modification is consistent
with the application, fees paid and environmental determination as conditionally
approved. Changes deemed to be major or significant in nature shall require a
formal application for amendment.

1. The Second Unit shall not exceed 1200 square feet.
2. Provide two additional off-street spaces.
3. An attached or detached garage or carport with a maximum exterior -
dimension 20' by 24' is permitted.
4. Adequate sewer facilities shall be provided under permit as determined by
the Butte County Environmental Health Division.
5. Either the existing single family dwelling or.the Second Unit shall be.owner
occupied. Certification of ownership shall be required prior to permit
issuance and annually thereafter by submittal of a declaration I in a form
specified by the Director of Development Services or designee.
6. No permits for any additional dwelling may be approved unless the
applicant/owner first receive approval from the Butte County Planning
Commission.
7. Construction, installation or development of structures or facilities on the
parcels/lots shall comply with the latest California. Fire Safe Regulations,
(Public Resources Code 4290), and all other applicable State and County
codes, ordinances and regulations in effect'at the time of application for,
improvement permits.
8. Building identification and/or addresses -shall be�installed; in',conformance
with Public Resources Code 4290 and shall be posted at the beginning of
building construction and maintained continuously thereafter.
9. Provide an all weather access to all structures, which is designed to carry
a 40,000 pound fire apparatus, at least 10 feet wide with a 15 foot vertical
clearance.
10. Contact O.W.I.D. for connection of the second dwelling to the existing water
service.
11. Applicant shall comply with all other applicable federal, state and local
regulations.
NOTE: Issuance of this permit.does-not waive the requirement of obtaining Building
Division and Environmental Health Division permits before starting construction, nor does it
waive any other requirements of federal, state, and local law.

Department specifications and to the satisfaction of the County Fire Warden.

prior to construction of facilities.
6. In lieu of hydrant installation, payment may be made into the hydrant

E. BUILDING PERMITS
1. Prior to building permit issuance for a new residential dwelling unit(s), the applicant shall
pay all applicable development fees at the rate in effect at the time of acceptance of the
application. Such fees, shall include, but not be limited to: Park Fee, School Fee,
Drainage Fee, Permit and Plan Checking Fees, Water and Sewer Service Fees, and Fire
Protection Fees.
2. Prior to building permit issuance for a new commercial or industrial development, or
addition to an ebsting development, the applicant shall pay all applicable development
fees at the rate in effect at the time of acceptance of the application. Such fees shall
include, but not be limited to: School Fee, Drainage Fee, Permit and Plan Checking Fees,
Water and Sewer Service Fees, and Fire Protection Fees.
F. EXISTING STRUCTURES
1. Comply with the Uniform Building Code for property line clearances considering use, area
and fire -resistiveness of existing buildings.
2. Existing building(s) shall be made to comply with current Building and Zoning regulations
for the intended new use of the building(s) or the existing building(s) shall be demolished.

G. SECOND UNITS
1. The Second Unit may be attached to the primary residence or may be a separate, on-site
detached dwelling.
2. The attached second unit shall be architecturally compatible with the primary residence
and the appearance of the building shall be that of a single family dwelling.
3. The size of the attached second unit shall not exceed 640 square feet or 30% of the size of
the primary dwelling, whichever is greater, in no case shall the second unit exceed 1200
square feet. A detached second unit shall not exceed 1200 square feet.
4. The parcel or lot upon which the Second Unit is to be located must meet the minimum
acreage requirements for which the parcel or lot is zoned.
5. In addition to the off-street parking required for the primary dwelling, one off-street parking
space shall be provided for second units of 640 square feet or less; two additional off-
street parking spaces shall be provided for larger units.
6. An attached or detached garage or carport with a maximum exterior dimension of 12' by
20' is permitted for second units of 640 square feet or less. A garage or carport with a
maximum dimension of 20'x 24' is permitted for larger second units.
7. Adequate sewer and potable water facilities shall be provided as determined by the Butte
County Environmental Health Division.
8. A second unit may not be placed on a parcel or lot where a temporary mobile home, in
accordance with Section 24-295 and 24-295.20, has been approved or on a lot that has
more than one dwelling located upon it.
9. Either the existing single family dwelling or the second unit shall be owner occupied.
Verification of ownership shall be required prior to permit issuance and annually thereafter
by submittal of a declaration in a form specified by the Director of Development Services or
designee.
